Autism Treatment Acceleration Act of 2009 - Amends the Public Health Service Act to require the Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration, to implement an Autism Care Center Program to provide grants and other assistance to improve the effectiveness and efficiency in providing comprehensive care to individuals diagnosed with autism spectrum disorders and their families. Directs the Secretary to: (1) provide grants for services to enable adults with autism spectrum disorders to be as independent as possible; (2) establish the National Registry for Autism Spectrum Disorders; and (3) award grants for multimedia campaigns to increase public education and awareness and reduce stigma concerning such disorders. Establishes the Interdepartmental Autism Coordinating Committee to coordinate all federal efforts concerning autism spectrum disorders. Repeals provisions establishing the Interagency Autism Coordinating Committee to coordinate all efforts within the Department of Health and Human Services (HHS) concerning autism spectrum disorders. Requires the Secretary to establish: (1) the National Network for Autism Spectrum Disorders Research and Services to provide resources for, and facilitate communication between, autism spectrum disorder researchers and service providers; and (2) a National Data Repository for Autism Spectrum Disorders Research and Services to facilitate the development and rapid dissemination of research into best practices that improve care. Requires the Secretary to award national training initiative supplemental grants to address the unmet needs of individuals with autism spectrum disorders and their families. Amends the Employee Retirement Income Security Act of 1974 (ERISA) and the Public Health Service Act to require group health plans to provide coverage for the diagnosis and treatment of autism spectrum disorders. Applies such requirement to coverage offered in the individual market.

America's Red Rock Wilderness Act of 2009 - Designates specified lands in the following areas of Utah as components of the National Wilderness Preservation System: (1) Great Basin; (2) Zion and Mojave Desert; (3) Grand Staircase-Escalante; (4) Moab-La Sal Canyons; (5) Henry Mountains; (6) Glen Canyon; (7) San Juan-Anasazi; (8) Canyonlands Basin; (9) San Rafael Swell; and (10) Book Cliffs and Uinta Basin. Sets forth administrative provisions regarding: (1) filing by the Secretary of the Interior of a map and a legal description of each designated wilderness area with appropriate congressional committees; (2) the exchange of state-owned lands within such areas; (3) federal reservation of water rights; (4) measurement of setbacks for roads with wilderness; (5) authorized livestock grazing; and (6) withdrawal of such lands from disposition under certain public land laws.

Clean Ocean and Safe Tourism Anti-Drilling Act or COAST Anti-Drilling Act - Amends the Outer Continental Shelf Lands Act (OCSLA) to prohibit the Secretary of the Interior from issuing a lease for the exploration, development, or production of oil, natural gas, or any other mineral in either the Mid-Atlantic or the North Atlantic planning areas.

Homeless Emergency Assistance and Rapid Transition to Housing Act of 2009 - Amends the McKinney-Vento Homeless Assistance Act to consolidate housing assistance programs for homeless persons. Declares that the mission of the U.S. Interagency Council on Homelessness is to coordinate the federal response to homelessness and to create a national partnership at every level of government and with the private sector to reduce and end homelessness in the nation while maximizing the effectiveness of federal contributions to end homelessness. Prescribes requirements for the selection of community homeless assistance planning boards, particularly for collaborative applicants. Requires the relevant parties in a geographic area to establish a collaborative applicant to apply for a homeless assistance grant. Requires a collaborative applicant to: (1) design a collaborative process to develop such grant applications and evaluate project outcomes; (2) establish priorities for funding projects; (3) participate in the Consolidated Plan for the geographic area served by the applicant; (4) ensure operations of, and consistent participation by, project sponsors in a community-wide homeless management information system (HMIS); and (5) act as a unified funding agency to distribute HUD funds to other project sponsors in the applicable geographic area funds for their projects. Prescribes requirements for: (1) an emergency solutions grants program; (2) a continuum of care grants program; (3) designation of high-performing communities; and (4) a rural housing stability assistance program. Increases from 5% to 7.5% the amount of any emergency solutions grant a recipient may use for administrative purposes. Requires the Comptroller General to study and report to Congress on: (1) appropriate administrative costs for implementing the emergency solutions grants program; and (2) homelessness and homeless assistance in rural areas.

Safe Highways and Infrastructure Preservation Act - Prohibits a state from prescribing or enforcing any regulation that allows a restricted property-carrying unit (any trailer, semi-trailer, container, or other property-carrying unit longer than 53 feet, except for a fire-fighting unit) to operate on the National Highway System (NHS) (including the Interstate System), unless the operation of such unit is authorized by the state on June 1, 2008, and in actual and lawful operation on a regular or periodic basis (including seasonal operations) on or before that date. Prohibits a state from allowing the operation of a commercial motor vehicle combination on the NHS (except a vehicle or load that cannot be dismantled or divided easily, and that has been issued a special permit under state law) with more than one property-carrying unit (excluding the truck tractor) whose property-carrying units are more than: (1) the maximum combination trailer, semi-trailer, or other type of length limitation allowed by state law on June 1, 2008; or (2) the length of the property-carrying units of those commercial motor vehicle combinations, by specific configuration, in actual and lawful operation on a regular or periodic basis (including continual seasonal operation) in such state on or before June 1, 2008. Prohibits a state from allowing the operation of a vehicle or combination (other than a longer combination vehicle) exceeding Interstate weight limits on the Interstate System unless its operation was lawful: (1) on July 1, 1956; (2) in the case of the overall gross weight of any group of two or more consecutive axles, on January 4, 1975; or (3) under a special permit pursuant to state (grandfather) law. Declares that Interstate weight limitations on vehicles and combinations (other than longer combination vehicles) that operate on the Interstate System shall also apply to such vehicles and combinations that operate on non-Interstate segments of the NHS, unless: (1) such segments are subject to lower state weight limits; or (2) a state allows the operation of any vehicle or combination on an existing non-Interstate segment of the NHS that could be so operated lawfully on June 1, 2008.

Medicare Fracture Prevention and Osteoporosis Testing Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act, as amended by the Medicare Improvements for Patients and Providers Act of 2008, to direct the Secretary of Health and Human Services to establish a national minimum payment amount for CPT code 77080 (relating to dual energy x-ray absorptiometry, or DXA, the most widely accepted method of measuring bone mass to predict fracture risk) and CPT code 77082 (relating to vertebral fracture assessment, or VFA), and any successor to such codes as identified by the Secretary (bone mass scans). Directs the Secretary to arrange with the Institute of Medicine of the National Academies to study and report to the Secretary and Congress on: (1) the ramifications of Medicare reimbursement reductions for DXA and VFA on beneficiary access to bone mass measurement benefits; and (2) the methods to increase use of bone mass measurement by Medicare beneficiaries.

Teaching Geography is Fundamental Act - Amends the Higher Education Act of 1965 to establish a geography education grant program under title II (Teacher Quality Enhancement). Authorizes the Secretary of Education to award a grant to a national nonprofit educational organization or consortium, with 75% to be used for matching subgrants to institutions of higher education associated with state geographic alliances, nonprofit educational organizations, or state or local educational agencies. Requires program participants to use their grants and subgrants to enhance the geographic literacy of students in kindergarten through grade 12 by supporting specified activities, including: (1) educational research; (2) teacher training; (3) the development of effective teaching tools and learning materials; (4) the application of rigorous academic standards and assessment techniques; (5) comparative studies of world cultures, economies, and environments; and (6) the exchange of information regarding the state of geographic literacy and strategies for its improvement.

National Criminal Justice Commission Act of 2009 - Establishes the National Criminal Justice Commission to undertake a comprehensive review of the criminal justice system. Directs the Commission to: (1) review all areas of federal and state criminal justice costs, practices, and policies; (2) make specified findings relating to incarceration, prison administration, the impact of gang activity, drug policy, mental illness among prisoners and the role of the military in crime prevention; (3) make recommendations for changes in policies and laws to address findings; (4) consult with government and nongovernmental leaders, including state and local law enforcement officials; and (5) submit a final report to Congress and the President and make such report public.

Civil Access to Justice Act of 2009 - Amends the Legal Services Corporation Act to reauthorize the Legal Services Corporation (LSC) at increased levels for FY2010-FY2015. Requires the LSC Board of Directors to include at least one individual with financial or audit experience. Eliminates state advisory councils. Requires the LSC to establish: (1) a protocol for the receipt of donations; (2) an audit committee, a finance committee, and a governance and performance review committee; (3) a continuity of operations plan; and (4) an adequate internal control structure and procedures for financial reporting. Requires the LSC to promote recruitment and retention of highly qualified staff members for all grantees, contractees, or recipients of financial assistance through the Pilot Loan Repayment Assistance Program or other appropriate programs. Limits the coverage of prohibited purpose provisions of federal law only to recipient use of funds from the LSC itself. (Thus lifts such restrictions, except those related to abortion litigation, on the use of state and local funds and private donations.) Permits only class action suits arising under established state or federal statutory or established judicial case law. Revises eligibility requirements for LSC grantees and funds recipients, extending specific eligibility to those seeking assistance with matters relating to home foreclosure or mortgage default or delinquency. Requires distribution of LSC funds on the basis of a system of competitive bidding, as well as specific allocations for all geographic areas, Native American communities, and migrant and seasonal farm workers. Prohibits the use of LSC funds to provide legal assistance with respect to: (1) litigation relating to prison conditions; (2) the defense of an individual in a proceeding to evict him or her from a public housing project in connection with a drug offense; or (3) all but certain aliens. Authorizes the LSC to allow use of a portion of the funds provided under the grant or contract to acquire and develop information technology to promote full access to high-quality, efficient legal representation and materials for self-representation. Allows the use of LSC funds to provide legal assistance with respect to any fee-generating case (which is currently prohibited), but only if the recipient's attorney reports on the representation and the amount of fees awarded. Directs the LSC to require an audit of each recipient in accordance with generally accepted auditing standards. Amends the Higher Education Act of 1965 to authorize the Secretary of Education to enter into grants or contracts with accredited law schools in the states for the purpose of paying up to 90% of the costs of expanding or establishing clinical experience programs in such schools.

Development, Relief, and Education for Alien Minors Act of 2009 or DREAM Act of 2009 - Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to repeal the provision making unlawful aliens ineligible for higher education benefits based on state residence unless a U.S. citizen or national is eligible for such benefits without regard to state residence. Authorizes the Secretary of Homeland Security to cancel the removal of, and adjust to conditional permanent resident status, an alien who: (1) entered the United States before his or her 16th birthday and has been present in the United States for at least five years immediately preceding enactment of this Act; (2) is a person of good moral character; (3) is not inadmissible or deportable under specified grounds of the Immigration and Nationality Act; (4) at the time of application, has been admitted to an institution of higher education or has earned a high school or equivalent diploma; (5) from the age of 16 and older, has never been under a final order of exclusion, deportation, or removal; and (6) was under age 35 on the date of this Act's enactment. Sets forth the conditions for conditional permanent resident status, including: (1) termination of status for violation of this Act; and (2) removal of conditional status to permanent status. Authorizes an alien who has satisfied the appropriate requirements prior to enactment of this Act to petition the Secretary for conditional permanent resident status. Provides for: (1) exclusive jurisdiction; (2) penalties for false application statements; (3) confidentiality; (4) fee prohibitions; (5) higher education assistance; and (6) a Government Accountability Office (GAO) report respecting the number of aliens adjusted under this Act.

21st Century Cancer ALERT (Access to Life-Saving Early detection, Research and Treatment) Act - Amends the Public Health Service Act to revise provisions related to the National Cancer Program, including to require the establishment of an entity within the National Cancer Institute (NCI) to augment ongoing efforts to advance new technologies in cancer research, support the national collection of tissues for cancer research purposes, and ensure the quality of tissue collection. Sets forth provisions governing clinical trials, including ethical and privacy standards. Requires the Secretary of Health and Human Services to award grants for research on cancers with a low five-year survival rate and rare cancers. Expands coverage of colorectal screenings, including through providing grants and allowing states to provide coverage for such screenings under Medicaid. Provides for biomarkers research. Amends the Employee Retirement Income Security Act of 1974 (ERISA) to prohibit a group health plan from discriminating against participants and beneficiaries participating in cancer clinical trials. Sets forth provisions regarding retirement pay for nurses retiring from the Armed Forces. Requires the Secretary to study the current and future cancer care workforce needs. Prohibits the Secretary from awarding patient navigator grants unless entities provide assurances that patient navigators meet minimum core proficiencies. Provides for coverage under Medicare for payment of routine costs of care furnished to individuals participating in cancer clinical trials. Requires the Secretary to conduct a demonstration project under which payment for comprehensive cancer care planning services will be made under Medicare. Provides for coverage of tobacco cessation products. Provides for research on cancer survivorship related to childhood cancer and health disparities in outcomes. Requires the Secretary to convene a Workforce Development Collaborative on Psychosocial Care During Chronic Medical Illness.

Best Buddies Empowerment for People with Intellectual Disabilities Act of 2009 - Authorizes the Secretary of Education to award grants to, or enter into agreements with, Best Buddies (a nonprofit organization dedicated to helping people with intellectual disabilities mesh with mainstream society) to promote the expansion of its programs.

Helping Housing, Awareness, and Navigation Demonstration Services for Individuals With Autism Spectrum Disorders Act of 2009 or the Helping HANDS for Autism Act of 2009 - Amends the Public Health Service Act to direct the Secretary of Health and Human Services to establish a demonstration program to award grants to eligible entities to develop an autism navigator program to create a more efficient, effective, coordinated use of the health, housing, education, and social service systems for individuals with an autism spectrum disorder. Directs the Secretary to determine the functions of autism navigators, which may include: (1) case management and psychosocial assessment and care; (2) notifying individuals of autism clinical trials; (3) helping individuals overcome barriers in accessing and securing appropriate services in a timely manner; and (4) coordinating with relevant departments providing services to individuals with an autism spectrum disorder and their families. Requires a navigator program to provide centralized access for individuals with an autism spectrum disorder to multiple federal and state activities and programs related to autism spectrum disorders. Requires grantees to collect autism data and ensure confidentiality. Directs the Secretary to: (1) disseminate a standard curriculum for training first responders in assisting individuals with autism and other cognitive behavioral disabilities and their families during emergencies; and (2) award grants to states and local governments for such training. Requires the Secretary of Housing and Urban Development to provide for a program for adults with autism spectrum disorder with the goal of providing individualized housing and services.

Appalachia Restoration Act - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to define "fill material" to mean pollutants that: (1) replace a portion of the water of the United States with dry land; or (2) modify the bottom elevation of a body of water for any purpose. Excludes from such definition: (1) the disposal of excess spoil material resulting from coal surface mining and reclamation activities in waters of the United States; or (2) trash or garbage.

Ending the Medicare Disability Waiting Period Act of 2009 - Amends title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act (SSA) to: (1) phase out the waiting period for disabled individuals to become eligible for benefits under SSA title XVIII (Medicare); and (2) eliminate the waiting period for individuals with life-threatening conditions to become eligible for such benefits. Directs the Secretary of Health and Human Services to request the Institute of Medicine of the National Academy of Sciences to study the range of disability conditions that can be delayed or prevented if individuals receive access to health care services and coverage before a condition reaches disability levels.

Oil Spill Prevention Act of 2009 - Requires double hull protection of oil fuel tanks on certain vessels with a tank capacity of at least 600 cubic meters. Provides steps to be taken by the Secretary of the department in which the Coast Guard is operating regarding maritime emergency prevention, including: (1) authorizing ordering the vessel to operate or anchor in a specified manner (including the power to order a change of direction or speed); (2) requiring port and waterway safety assessments; and (3) requiring a review and validation of the recruiting, retention, training, and expansion of vessel traffic service personnel. Establishes the Merchant Mariner Medical Advisory Committee. Requires establishment of medical standards and periodic physical examinations for merchant mariners. Requires that at least one trained and experienced pollution investigator be on duty or on call at all times for each Coast Guard Sector Command. Modifies requirements regarding the duration of merchant mariner's documents and certificates of registry. Authorizes the extending of licenses, certificates of registry, and merchant mariner's documents in specified circumstances. Terminates that authorization on December 31, 2011. Establishes the Support of Seafarers Fund to: (1) pay support for a seafarer in the United States who is involved in any matter related to the Coast Guard's administration or enforcement of any treaty, law, or regulation; or (2) pay support for any seafarer abandoned in the United States. Requires a shipowner to reimburse the Fund, plus a surcharge, in certain circumstances. Authorizes the requiring of a related bond or surety.

Community Choice Act of 2009 - Amends title XIX (Medicaid) of the Social Security Act (SSA) to require state Medicaid plan coverage of community-based attendant services and supports for certain Medicaid-eligible individuals. Outlines requirements for: (1) an enhanced federal medical assistance percentage (FMAP) for ongoing activities of early coverage states that enhance and promote the use of community-based attendant services and supports; and (2) increased federal financial participation for certain expenditures incurred by the state for the provision of such services and supports. Directs the Secretary of Health and Human Services to: (1) award grants to eligible states which have established a Consumer Task Force to assist the state in its development of real choice systems change initiatives; and (2) conduct a demonstration project for the purpose of evaluating service coordination and cost-sharing approaches with respect to the provision of community-based services and supports to dually eligible individuals.

Breast Cancer Patient Protect Act of 2009 - Amends the Employee Retirement Income Security Act of 1974 (ERISA), the Public Health Service Act, and the Internal Revenue Code to require a group health plan that provides medical and surgical benefits to ensure that inpatient (and in the case of a lumpectomy, outpatient) coverage and radiation therapy are provided for breast cancer treatment. Prohibits such a plan from: (1) restricting benefits for any hospital length of stay to less than 48 hours in connection with a mastectomy or breast conserving surgery or 24 hours in connection with a lymph node dissection, insofar as the attending physician, in consultation with the patient, determines such stay to be medically necessary; or (2) requiring that a provider obtain authorization from the plan or issuer for prescribing any such length of stay. Requires such a plan or issuer to: (1) provide notice to each participant and beneficiary regarding the coverage required under this Act; and (2) ensure that coverage is provided for secondary consultations. Prohibits a group health plan from taking specified actions to avoid the requirements of this Act. Applies such requirements to health insurance issuers offering coverage in the individual market. Allows a health insurance issuer that provides individual health insurance coverage to nonrenew or discontinue an individual's coverage based on the intentional concealment of material facts regarding a health condition related to the condition for which coverage is being claimed.

Dorothy I. Height and Whitney M. Young, Jr. Social Work Reinvestment Act - Directs the Secretary of Health and Human Services (HHS) to establish the Social Work Reinvestment Commission to provide independent counsel to Congress on policy issues associated with the recruitment for, and retention, research, and reinvestment in, the profession of social work. Directs the Commission to study and report to Congress on issues facing the social work profession, including: (1) fair market compensation, high social work educational debt, social work workforce trends, translating social work research to practice, and social work safety; and (2) state-level social work licensure policies and reciprocity agreements for providing services across state lines. Requires such study to assess the professional capacity of the social work workforce to serve and respond successfully to the increasing biopsychosocial needs of individuals, groups, and communities in certain areas, including aging and child welfare. Authorizes the Secretary to award: (1) workplace improvement grants to eligible entities and individuals to address workplace concerns for the social work profession, including caseloads, compensation, social work safety, supervision, and working conditions; and (2) research grants, education and training grants, and community-based programs of excellence grants. Directs the Secretary to: (1) contract with a national social work research entity to serve as a coordinating center and clearinghouse for information on activities funded under the grants; and (2) develop a multi-media outreach campaign and issue public service announcements that advertise and promote the social work profession.

Mental Health on Campus Improvement Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services, acting through the Administrator of the Substance Abuse and Mental Health Services Administration, to award grants to eligible institutions of higher education to improve mental and behavioral health services and outreach on college and university campuses. Directs the Secretary to give special consideration to programs that: (1) demonstrate the greatest need; (2) propose effective approaches for initiating or expanding campus services; (3) target underserved and at-risk populations; (4) coordinate with a community mental health center or other community mental health resources; (5) identify how the college or university will address psychiatric emergencies; and (6) demonstrate the greatest potential for replication and dissemination. Allows the Secretary to provide technical assistance to grantees. Requires the Secretary, acting through the Administrator, to convene an interagency, public-private sector working group to plan, establish, and begin coordinating and evaluating a targeted public education campaign that is designed to focus on mental and behavioral health on college campuses. Requires the Secretary to establish the College Campus Task Force to discuss mental and behavioral health concerns on college and university campuses.

Smoke Free Mothers and Babies Act of 2009 - Amends title XIX (Medicaid) of the Social Security Act to require coverage, without cost-sharing, of counseling and pharmacotherapy for cessation of tobacco use by pregnant women. Provides for an increased federal medical assistance percentage (FMAP) for tobacco cessation counseling services and medications.

Belated Thank You to the Merchant Mariners of World War II Act of 2009 - Establishes in the Treasury the Merchant Mariner Equity Compensation Fund for payments by the Secretary of Veterans Affairs of a monthly benefit of $1,000 to each individual who, between December 7, 1941, and December 31, 1946, was a documented member of the U.S. merchant marine (including the Army Transport Service and the Naval Transport Service) serving as a crewmember of a vessel that was operated in U.S. waters by the War Shipping Administration or the Office of Defense Transportation and under contract to, or the property of, the United States. Requires such individuals to: (1) apply for such benefit before October 1, 2009; and (2) not have received benefits under the Servicemen's Readjustment Act of 1944.

Star-Spangled Banner Bicentennial Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue $5 gold coins and $1 silver coins in commemoration of the bicentennial of the writing of the Star-Spangled Banner . Requires a coin design emblematic of the War of 1812, and in particular of, the Battle for Baltimore that formed the basis for the Star-Spangled Banner. Limits the period for coin issuance to calendar year 2012. Imposes a surcharge of $35 per coin for the $5 coins and $10 per coin for the $1 coins, which shall be distributed to the Maryland War of 1812 Bicentennial Commission for the purpose of supporting bicentennial activities, educational outreach activities, and preservation and improvement activities pertaining to the sites and structures relating to the War of 1812.

Children's Health Protection Act of 2009 - Amends the Employee Retirement Income Security Act of 1974 (ERISA), the Public Health Service Act, and the Internal Revenue Code to prohibit a group health plan from imposing any preexisting condition exclusion for individuals who have not attained 25 years of age. Applies such requirement to coverage offered in the individual market.

Condemns all forms of anti-Semitism and rejects attempts to rationalize anti-Jewish hatred or attacks as a justifiable expression of disaffection over political events in the Middle East or elsewhere. Decries the comparison of Jews to Nazis perpetrating a Holocaust or genocide as a pernicious form of anti-Semitism. Calls on leaders to speak out against manifestations of anti-Semitism that have entered the Middle East debate. Fitness Integrated with Teaching Kids Act or the FIT Kids Act - Amends the Elementary and Secondary Education Act of 1965 (ESEA) to require annual state and local educational agency report cards to include specified information on school health and physical education programs. Includes the promotion of healthy, active lifestyles by students within ESEA grant programs that support school counseling, smaller learning communities, community learning centers, and parental involvement in their childrens' education. Revises the professional development program for teachers and principals to include training for physical and health education teachers, and training on improving students' health habits and participation in physical activities. Directs the Secretary of Education to contract with the National Academy of Sciences (NAS) for a study that: (1) assesses the effect health and physical education have on students' ability to learn; and (2) makes recommendations for improving, and measuring improvements to, their health and physical education in schools.

Senator Paul Simon Water for the World Act of 2009 - Amends the Foreign Assistance Act of 1961 to direct the Administrator of the United States Agency for International Development (USAID) to establish the Office of Water within the Bureau for Economic Growth, Agriculture, and Trade to: (1) give assistance to provide safe water and sanitation for people worldwide; and (2) be headed by a Director for Safe Water and Sanitation. Outlines the Director's duties. Requires the Secretary of State, in order to increase the capacity of the Department of State to address international issues regarding safe water, sanitation, integrated river basin management, and other international water programs, to establish a Special Coordinator for International Water. Outlines the Special Coordinator's duties. Amends the Senator Paul Simon Water for the Poor Act of 2005 to: (1) revise requirements concerning the safe water and sanitation strategy; (2) provide for the establishment of a program to build the capacity of host country institutions and officials responsible for water and sanitation in countries that receive assistance to provide safe water and sanitation under the Foreign Assistance Act of 1961; (3) expand the list of activities that may be supported by assistance furnished by the President for programs in developing countries to provide affordable and equitable access to safe water and sanitation; and (4) require the report regarding water for peace and security to include an assessment of political tensions over water sources and a multidisciplinary assessment of the expected impacts of global climate change on water supplies in 10, 25, and 50 years.

Directs the President pro tempore of the Senate and the Speaker of the House of Representatives to make appropriate arrangements for the award of a single gold medal in honor of the Women Airforce Service Pilots (WASP) collectively, in honor of their pioneering military service and exemplary record, which forged revolutionary reform in the U.S. Armed Forces. Expresses the sense of Congress that the Smithsonian Institution shall make the medal available for display elsewhere, particularly at other locations associated with the WASP.

Congenital Heart Futures Act - Amends the Public Health Service Act to authorize the Secretary of Health and Human Services (HHS), acting through the Director of the Centers for Disease Control and Prevention (CDC) in collaboration with appropriate congenital heart disease patient organizations and professional organizations, to conduct, support, and promote a comprehensive public education campaign to increase awareness regarding congenital heart disease, including the need for lifelong treatment. Authorizes the Secretary to: (1) award a grant to one entity to enhance and expand infrastructure to track the epidemiology of congenital heart disease and to organize such information into a comprehensive National Congenital Heart Disease Registry with the purpose of facilitating research into the types of health services patients use and identifying possible areas for educational outreach and prevention; and (2) establish an Advisory Committee on Congenital Heart Disease. Authorizes the Director of the National Heart, Lung, and Blood Institute to expand, intensify, and coordinate research and related activities of the Institute regarding congenital heart disease.

Preservation of Antibiotics for Medical Treatment Act of 2009 - Amends the Federal Food, Drug, and Cosmetic Act to require the Secretary of Health and Human Services to deny an application for a new animal drug that is a critical antimicrobial animal drug unless the applicant demonstrates that there is a reasonably certainty of no harm to human health due to the development of antimicrobial resistance attributable to the nontherapeutic use of the drug. Defines "critical antimicrobial animal drug" as a drug intended for use in food-producing animals that contains specified antibiotics or other drugs used in humans to treat or prevent disease or infection caused by microorganisms. Requires the Secretary to withdraw approval of a nontherapeutic use of such drugs in food-producing animals two years after the date of enactment of this Act unless certain safety requirements are met.

Responsible Education About Life Act - Authorizes the Secretary of Health and Human Services to make grants to states for sex education programs, including education on abstinence and contraception, to prevent teenage pregnancy and sexually transmitted diseases. Expresses the sense of Congress that states are encouraged, although not required, to provide matching funds to receive such grants. Requires the Secretary to provide for a national evaluation of a representative sample of such programs for effectiveness in delaying the initiation of sexual intercourse and other high-risk behaviors, preventing pregnancy and sexually transmitted disease, and increasing contraceptive knowledge and behavior. Requires states receiving such grants to provide for an individual evaluation of the state's program by an external, independent entity. Prohibits such programs from discriminating on the basis of sex, race, ethnicity, national origin, disability, religion, sexual orientation, or gender identity.

Pre-existing Condition Patient Protection Act of 2009 - Amends the Employee Retirement Income Security Act of 1974 (ERISA), the Public Health Service Act, and the Internal Revenue Code to prohibit a group health plan from: (1) imposing any preexisting condition exclusion; or (2) providing for an affiliation period for coverage offered by a health maintenance organization (HMO). Defines an "affiliation period" as a period of time before health insurance coverage becomes effective. Requires each health insurance issuer offering coverage in the group market in a state to accept every employer in the state that applies for such coverage. Revises provisions governing individual health insurance coverage to apply certain prohibitions related to denying coverage and preexisting condition exclusions to coverage offered in an area (currently, a state). Requires the Secretary of Health and Human Services to report to Congress concerning the occurrence of adverse selection as a result of this Act. Requires health insurance issuers to which this Act applies to submit to the Secretary specified information on enrollees and claims. Directs the Secretary to require that group health plans and health insurance issuers provide data to the Secretary for compliance purposes. Sets forth civil penalties for violations. Directs the Government Accountability Office (GAO) to report to the Secretary on: (1) the impact of this Act and other relevant federal laws; and (2) this Act's effect on the affordability of health insurance coverage and on the expansion of coverage and reductions in the number of uninsured and underinsured.

Women Veterans Health Care Improvement Act of 2009 - Directs the Secretary of Veterans Affairs to: (1) report on barriers to the receipt of comprehensive health care through the Department of Veterans Affairs (VA) encountered by women veterans, especially those of Operations Iraqi Freedom and Enduring Freedom; (2) provide for an independent study on health consequences for women veterans serving on active duty in deployments in such Operations; and (3) report on the employment of full-time managers for women veterans programs at VA medical centers. Requires the Secretary to: (1) develop a plan to improve the provision of VA health care services to women veterans; (2) carry out a program of education, training, certification, and continuing medical education for mental health professionals providing care for veterans suffering from sexual trauma; (3) carry out a pilot program of providing reintegration and readjustment services in group retreat settings to women veterans recently separated from service after a prolonged deployment; and (4) carry out a pilot program on subsidies for child care for certain women veterans receiving health care from VA facilities. Requires women veterans recently separated from service to be included on the Advisory Committee on Women Veterans and the Advisory Committee on Minority Veterans. Authorizes the Secretary to furnish care to a newborn child of a woman veteran receiving VA maternity care for up to seven days after the birth of the child.

Military Family Nutrition Protection Act of 2009 - Amends the Richard B. Russell National School Lunch Act to exclude combat pay from household income in calculating a child's eligibility for free or reduced price meals under the school lunch program. Amends the Child Nutrition Act of 1966 to require states to exclude combat pay from family income in making eligibility determinations under the special supplemental nutrition program for women, infants, and children.

Cruise Vessel Security and Safety Act of 2009 - Sets forth cruise vessel security and safety requirements concerning: (1) vessel design and construction; (2) crew access to passenger staterooms; (3) log book entry and reporting of deaths, missing individuals, and alleged crimes; (4) a database of crewmembers terminated due to commission of a crime; (5) maintenance of rape kits on board; (6) crime scene investigation training and certification for vessel crewmembers; (7) video surveillance to monitor crime; and (8) posting of certain safety information. Sets forth penalties for violations of this Act. Amends the Ports and Waterways Safety Act to revise the authority of the Secretary of the department in which the Coast Guard is operating (Secretary) to dispatch Coast Guard personnel on vessels to deter or respond to terrorism or transportation security incidents. Authorizes use of such personnel to act as: (1) environmental observers to monitor compliance with federal laws regarding the discharge of waste into U.S. waters; and (2) public safety officers to assist vessel passengers and crew with reporting and investigation of crimes, securing of suspects, and collection of crime evidence. Directs the Secretary to study and report to Congress on the security needs of a passenger vessel depending on the number of passengers on the vessel, with recommendations for security improvements. Amends the Death on the High Seas Act to extend from 3 to 12 miles from the U.S. shore the high seas jurisdiction wherein a death by a wrongful act, neglect, or default of a person or vessel will allow the personal representative of the decedent to bring a civil action in admiralty.

Clean, Low-Emission, Affordable, New Transportation Efficiency Act - Establishes the Low Greenhouse Gas Transportation Fund. Requires the Administrator of the Environmental Protection Agency (EPA), for each of calendar 2012-2050, to auction 10% of emission allowances established under any EPA program providing for the reduction of greenhouse gas emissions and the auctioning of emission allowances. Requires deposit of auction proceeds into the Fund to implement state and metropolitan planning organization (MPO) greenhouse gas emission reduction plans, and provide funding to transit projects that help reduce such emissions. Requires states and MPOs representing populations of more than 200,000 people to: (1) establish goals for reducing greenhouse gas emissions from the transportation sector for the next 10 years; and (2) develop transportation greenhouse gas emission reduction plans, including supporting lists of prioritized transit projects, that are integrated into state and MPO long-range transportation and transportation improvement plans. Directs the Secretary of Transportation and the EPA Administrator to contract with the Transportation Research Board of the National Academy of Sciences to study and report recommendations for improving research tools and federal data sources necessary to assess the effect of state and local transportation, land use, and environmental plans on motor vehicle use rates and transportation sector greenhouse gas emissions.

Psoriasis and Psoriatic Arthritis Research, Cure, and Care Act of 2009 - Requires the Secretary of Health and Human Services, acting through the Director of the National Institutes of Health (NIH), to continue to expand and intensify research and related NIH activities with respect to psoriasis and psoriatic arthritis. Requires the Directors of the National Institute of Arthritis and Musculoskeletal and Skin Diseases and the National Institute of Allergy and Infectious Diseases to continue to conduct and support research to expand understanding of the causes of, and to find a cure for, psoriasis and psoriatic arthritis. Requires the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to undertake psoriasis and psoriatic arthritis data collection and develop a psoriasis and psoriatic arthritis patient registry. Encourages the Secretary to convene a summit on federal efforts regarding psoriasis and psoriatic arthritis research, treatment, education, quality-of-life, and data collection. Directs the Secretary to enter into an agreement with the Institutes of Medicine to study insurance coverage of psoriasis and psoriatic arthritis.

Directs the Secretary of the military department concerned to provide uncharged leave or a monetary benefit to any member or former member of the Armed Forces who, on any day beginning on January 19, 2007, and ending on the date of implementation of the Post-Deployment/Mobilization Respite Absence program, would have qualified for a day of administrative absence under such program had it been in effect. Makes such benefit: (1) an amount not to exceed $200 for each day, in the case of a former member; and (2) either one day of administrative absence or an amount not to exceed $200, in the case of a current member. Excludes from such benefit any members discharged or released under other than honorable conditions. Sets at 40 the maximum number of days for which such benefit may be provided.

Employee Free Choice Act of 2009 - Amends the National Labor Relations Act to require the National Labor Relations Board (NLRB) to certify a bargaining representative without directing an election if a majority of the bargaining unit employees have authorized designation of the representative (card-check) and there is no other individual or labor organization currently certified or recognized as the exclusive representative of any of the employees in the unit. Sets forth special procedural requirements for reaching an initial collective bargaining agreement following certification or recognition. Revises enforcement requirements with respect to unfair labor practices during union organizing drives, particularly a preliminary investigation of an alleged unfair labor practice (ULP) which may lead to proceedings for injunctive relief. Requires that priority be given to a preliminary investigation of any charge that, while employees were seeking representation by a labor organization, or during the period after a labor organization was recognized as a representative until the first collective bargaining contract is entered into, an employer: (1) discharged or otherwise discriminated against an employee to encourage or discourage membership in the labor organization; (2) threatened to discharge or to otherwise discriminate against an employee in order to interfere with, restrain, or coerce employees in the exercise of guaranteed self-organization or collective bardaining rights; or (3) engaged in any other related ULP that significantly interferes with, restrains, or coerces employees in the exercise of such guaranteed rights. Adds to remedies for such violations: (1) back pay plus liquidated damages; and (2) additional civil penalties.

Amends the Internal Revenue Code to exempt from the harbor maintenance tax commercial cargo (other than bulk cargo) loaded at: (1) a port in the U.S. mainland and unloaded at another such port after transport solely by coastal route or river or unloaded at a port in Canada located in the Great Lakes Saint Lawrence Seaway System; or (2) such a port in Canada and unloaded at a port in the U.S. mainland. Defines the "Great Lakes Saint Lawrence Seaway System" as the waterway between Duluth, Minnesota, and Sept Iles, Quebec, encompassing the five Great Lakes, their connecting channels, and the Saint Lawrence River.

Retired Pay Restoration Act of 2009 - Allows the receipt of both military retired pay and veterans' disability compensation with respect to any service-connected disability (under current law, only a disability rated at 50% or more). Makes eligible for the full concurrent receipt of both veterans' disability compensation and either military retired pay or combat-related special pay those individuals who were retired or separated from military service due to a service-connected disability.

Authorizes Senators or Senate officers or employees to: (1) solicit other Senators or Senate officers or employees within Senate buildings for nonmonetary book donations from March 9-March 27, 2009, to assist elementary school students in the Washington, D.C. metropolitan area; and (2) work with nonprofit organizations to deliver such donations.

Repeals certain provisions which require the offset of amounts paid in dependency and indemnity compensation from Survivor Benefit Plan (SBP) annuities for the surviving spouses of former military personnel who are entitled to military retired pay or would be entitled to such pay except for being under 60 years of age. Prohibits recoupment by the Secretary of Defense of certain amounts previously paid to SBP recipients in the form of a retired pay refund. Repeals the optional authority of (and instead requires) the Secretary of the military department concerned to pay an annuity to a member's dependent children when there is no eligible surviving spouse. Directs the Secretary concerned to restore annuity eligibility to a surviving spouse who earlier agreed to transfer such eligibility to a surviving child or children of a member.

Caging Prohibition Act of 2009 - Prohibits state or local election officials from preventing an individual from registering or voting (including by provisional ballot) in any election for federal office, or permitting a formal challenge under state law to an individual's registration status or eligibility to vote in a federal election, if the sole basis for such decision or challenge is evidence consisting of: (1) a voter caging document or voter caging list; (2) an unverified match list; (3) the foreclosure status of the individual's residence; or (4) certain information indicating a change of residence. Defines "voter caging document" as: (1) any nonforwardable document that is sent to an individual at the address at which such individual is registered (or seeking to become registered) as a voter in a federal election, and that is returned to the sender or to a third party as undelivered or undeliverable; and (2) any document (other than a notice warning of possible removal from the voting rolls) sent to an individual at the address at which such individual is registered containing instructions to return the document to the sender or a third party, but is not so returned. Defines "unverified match list" as one produced by: (1) matching the identity of registered voters or voter registration applicants with the identity of individuals who are ineligible to vote in the registrar's jurisdiction, by virtue of death, conviction, change of address, mental impairment, or otherwise, unless the process for matching the identities establishes beyond a reasonable doubt that the identities belong to the same individual; or (2) failing to match the identity of registered voters or voter registration applicants with the identity of individuals listed in the database of the state motor vehicle authority or in information provided by the Commissioner of Social Security under a verification agreement. Outlines requirements for challenges to an individual's registration or voting eligibility by persons other than election officials.

Access to Durable Medical Equipment Act - Amends part B (Supplementary Medical Insurance) of title XVIII (Medicare) of the Social Security Act, as amended by the Medicare Improvements for Patients and Providers Act of 2008, with respect to Medicare quality standards for suppliers of items and services which shall be applied by recognized independent accreditation organizations. Applies to pharmacies and pharmacists the eligible professional exemption from such accreditation requirements, unless such standards are designed specifically for application to pharmacies and pharmacists. Authorizes the Secretary of Health and Human Services to exempt pharmacies and pharmacists from such standards if licensing, accreditation, or other mandatory quality requirements apply to them with respect to the furnishing of items and services.

Expresses support for the goals and ideals of Multiple Sclerosis Awareness Week. Reaffirms the U.S. people's commitment to combating multiple sclerosis by promoting awareness about its causes and risks, promoting new education programs, supporting research, and expanding access to medical treatment. Recognizes people living with multiple sclerosis and salutes the health care professionals and medical researchers who assist those living with multiple sclerosis and continue to work to find cures and improve treatments.

Federal and Military Retiree Health Care Equity Act - Amends the Internal Revenue Code to permit: (1) federal civilian and military retirees to pay Federal Employees Health Benefits Program (FEHBP) and TRICARE supplemental premiums on a pretax basis (i.e., exclude premiums from gross income); and (2) a tax deduction (available to itemizers and nonitemizers) for TRICARE supplemental premiums or enrollment fees. Directs the Director of the Office of Personnel Management (OPM) and the Secretary of Defense to ensure that the option of paying FEHBP and TRICARE supplemental premiums on a pretax basis is available to federal civilian and military retirees for the first open enrollment period beginning not less than 90 days after the enactment of this Act.
