Healthy Families Act

Healthy Families Act - Requires certain employers, who employ 15 or more employees for each working day during 20 or more workweeks a year, to provide a minimum paid sick leave and employment benefits of: (1) seven days annually for those who work at least 30 hours per week; and (2) a prorated annual amount for those who work less than 30 but at least 20 hours a week, or less than 1,500 but at least 1,000 hours per year. Allows employees to use such leave to meet their own medical needs or to care for the medical needs of certain family members. Directs the Secretary of Labor to exercise certain investigative and enforcement authority with respect to this Act's provisions for employees covered by title I of the Family and Medical Leave Act of 1993 or the Government Employee Rights Act of 1991. Provides that, for employees under their jurisdiction, such authority shall be exercised by the Librarian of Congress, the Comptroller General, the Board of Directors of the congressional Office of Compliance, or the Merit Systems Protection Board. Declares that the requirements under this Act are minimum requirements, and are not to be construed to discourage employers from adopting or retaining more generous leave policies.

No Oil Producing and Exporting Cartels Act of 2007 or NOPEC - Amends the Sherman Act to declare it to be illegal and a violation of the Act for any foreign state or instrumentality thereof to act collectively or in combination with any other foreign state or any other person, whether by cartel or any other association or form of cooperation or joint action, to limit the production or distribution of oil, natural gas, or any other petroleum product (petroleum), to set or maintain the price of petroleum, or to otherwise take any action in restraint of trade for petroleum, when such action has a direct, substantial, and reasonably foreseeable effect on the market, supply, price, or distribution of petroleum in the United States. Denies a foreign state engaged in such conduct sovereign immunity from the jurisdiction or judgements of U.S. courts in any action brought to enforce this Act. States that no U.S. court shall decline, based on the act of state doctrine, to make a determination on the merits in an action brought under this Act. Authorizes the Attorney General to bring an action in U.S. district court to enforce this Act. Amends the Federal judicial code to make an exception to the jurisdictional immunity of a foreign state in an action brought under this Act.

Directs the Secretary of Veterans Affairs to carry out a five-year pilot program to assess the feasibility and advisability of awarding grants to eligible entities to assist members of the Armed Forces, particularly those with serious wounds, injuries, or mental disorders, women members, and members of the National Guard and reserves, in applying for and receiving health care benefits and services from the Department of Veterans Affairs (VA) and otherwise after completion of military service, in order to ensure that such members receive a continuity of care and assistance in and after the transition from military service to civilian life. Requires at least one location of the pilot program to be in the vicinity of: (1) a military medical facility that treats members who are seriously wounded or injured in Afghanistan or Iraq; (2) a VA medical center located in a rural area; and (3) a VA medical center located in an urban area.

Authorizes any state to adopt measures to prohibit any investment of state assets in the Government of Sudan, or in any company with a qualifying business relationship with Sudan, during any period in which the Government of Sudan, or the officials of such government are subject to sanctions authorized under the Sudan Peace Act, the Comprehensive Peace in Sudan Act of 2004, the USA PATRIOT Improvement and Reauthorization Act of 2005, the Darfur Peace and Accountability Act of 2006, or any other federal law or executive order. Defines state assets as any public pension, retirement, annuity, or endowment fund, or similar instrument managed by a state. Applies this Act to measures adopted by a state before, on, or after the enactment of this Act.

Microbicide Development Act - Amends the Public Health Service Act to require the Director of the Office of AIDS Research to: (1) expedite the implementation of the federal strategic plan for the conduct and support of microbicide research and development; and (2) expand, intensify, and coordinate all activities with respect to research and development of microbicides to prevent the transmission of HIV and other sexually transmitted diseases. Requires the Director of the National Institute of Allergy and Infectious Diseases to: (1) establish within the Division of AIDS an organizational branch to carry out microbicide research and development; and (2) assign priority to ensuring adequate funding and support for the Microbicide Trials Network and other programs for supporting microbicides clinical trials. Requires the Director of the Centers for Disease Control and Prevention (CDC) to fully implement the CDC's microbicide agenda to support microbicide research and development. Directs the head of the Office of HIV/AIDS of the U.S. Agency for International Development (USAID) to develop and implement a program to support the development of microbicides products for the prevention of the transmission of HIV/AIDS and other diseases, and facilitate wide-scale availability of such products. Requires the Secretary of State to report to Congress on advance market commitments of microbicides to prevent HIV infection as a means of creating private sector investment incentives.

Revises grant selection criteria. Authorizes the Secretary of Housing and Urban Development (HUD) to conduct funding-related site visits for HOPE VI applicants. Requires: (1) public housing agencies to establish performance benchmarks for each of their HOPE VI projects; and (2) the Secretary to establish specified sanctions for failure to meet such benchmarks. United States Policy in Iraq Resolution of 2007 - Directs the President to begin the phased redeployment of U.S. forces from Iraq within 120 days of enactment of this joint resolution with the goal of redeploying by March 31, 2008, all U.S. combat forces from Iraq, except for a limited number essential for protecting U.S. and coalition personnel and infrastructure, training and equipping Iraqi forces, and conducting targeted counter-terrorism operations. Requires the President to transition the U.S. forces' mission in Iraq promptly to such purposes. States that such redeployment shall be implemented as part of a diplomatic, political, and economic strategy that includes sustained engagement with Iraq's neighbors and the international community in order to bring stability to Iraq. Directs the President, not later than 60 days after enactment of this Act and every 90 days thereafter, to report to Congress on the progress made in such mission transition and force redeployment.

Traumatic Brain Injury Act of 2008

Reauthorization of the Traumatic Brain Injury Act - Amends the Public Health Service Act to revise the national program for traumatic brain injury registries to include grants for state traumatic brain injury surveillance systems. Requires the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC) , to conduct a study to: (1) determine the incidence of traumatic brain injury and prevalence of traumatic brain injury related disability; (2) report national trends in traumatic brain injury; (3) identify common therapeutic interventions which are used for the rehabilitation of individuals with such injuries; (4) identify interventions and therapies that can prevent or remediate the development of secondary neurologic conditions related to traumatic brain injury; and (5) develop practice guidelines for such rehabilitation. Authorizes appropriations for FY2008-FY2011 for the National Institutes of Health's (NIH) trauma research program. Allows the Secretary, acting through the Administrator of the Health Resources Services Administration (HRSA), to make grants to states and American Indian consortia (currently, only states) to improve access to rehabilitation (currently, health) and other services regarding traumatic brain injury. Requires the Administrator and the Commissioner of the Administration on Developmental Disabilities to coordinate the collection of data regarding protection and advocacy services. Directs the Administrator to make a grant for training and technical assistance to protection and advocacy systems, if funds permit.

Paycheck Fairness Act - Amends the portion of the Fair Labor Standards Act of 1938 (FLSA) known as the Equal Pay Act to revise remedies for and enforcement of prohibitions against sex discrimination in the payment of wages to: (1) add nonretaliation requirements; (2) increase penalties; and (3) authorize the Secretary of Labor (the Secretary) to seek additional compensatory or punitive damages. Requires the Equal Employment Opportunity Commission (EEOC) and the Office of Federal Contract Compliance Programs to train EEOC employees and affected individuals and entities on matters involving wage discrimination. Authorizes the Secretary to make grants to eligible entities for negotiation skills training programs for girls and women. Directs the Secretaries of Labor and Education to issue regulations or policy guidance to integrate such training into certain programs under their Departments. Directs the Secretary to provide for certain studies, information, national summit, and guidelines, awards, and assistance for employer evaluations of job categories based on objective criteria. Establishes the Secretary of Labor's National Award for Pay Equity in the Workplace. Amends the Civil Rights Act of 1964 to require the EEOC to collect certain pay information. Directs: (1) the Commissioner of Labor Statistics to collect data on woman workers in the Current Employment Statistics survey; (2) the Office of Federal Contract Compliance Programs to use specified types of methods in investigating compensation discrimination and in enforcing pay equity; and (3) the Secretary to make accurate information on compensation discrimination readily available to the public.

Directs the Director of the Office of Personnel Management (OPM) and the Secretary of Defense to ensure that the option of paying FEHBP and TRICARE supplemental premiums on a pretax basis is available to federal civilian and military retirees for the first open enrollment period beginning not less than 90 days after the enactment of this Act.

Child Nutrition Promotion and School Lunch Protection Act of 2007 - Amends the Child Nutrition Act of 1966 to require the Secretary of Agriculture to revise the definition of "food of minimal nutritional value," the sale of which in areas where school meals are sold or eaten is prohibited as a condition for federal funding of school lunch and breakfast programs. Applies such definition (and prohibition) to all food sold outside such programs anywhere on school campuses at any time of the day, with the possible limited exemption of food sold at school fundraisers. Requires the Secretary, when revising such definition, to consider the recommendations of authoritative scientific organizations and evidence concerning the relationship between diet and health.

America COMPETES Act or America Creating Opportunities to Meaningfully Promote Excellence in Technology, Education, and Science Act - American Innovation and Competitiveness Act - Directs the President to: (1) convene a National Science and Technology Summit; (2) establish a President's Council on Innovation and Competitiveness; and (3) establish the Innovation Acceleration Research Program. Directs the Administrator of the National Aeronautics and Space Administration (NASA) to: (1) establish an Aeronautics Institute for Research; (2) coordinate basic and fundamental research activities related to physical sciences, technology, engineering, and mathematics; and (3) establish a Basic Research Executive Council. Authorizes appropriations for the National Institute of Standards and Technology (NIST) for the Hollings Manufacturing Extension Partnership Program. Requires the NIST Director to: (1) establish the Standards and Technology Acceleration Research Program; and (2) reestablish the Experimental Program to Stimulate Competitive Technology. Requires the Administrator of the National Oceanic and Atmospheric Administration (NOAA) to: (1) establish a program of ocean and atmospheric research and development; and (2) develop an ocean, coastal, and atmospheric science education plan. Protecting America's Competitive Edge Through Energy Act or PACE-Energy Act - Directs the Secretary of Energy to: (1) appoint a Department of Energy (DOE) Director of Mathematics, Science, and Engineering Education, and establish a Mathematics, Science, and Engineering Education Fund; (2) award grants for establishing specialty schools for mathematics and science; (3) establish a national laboratories summer internship program for middle and secondary school students; (4) establish Centers of Excellence in Mathematics and Science at schools in regions of national laboratories; (5) establish or expand programs to strengthen mathematics and science teaching skills of public school teachers; (6) establish a program to expand and enhance higher education nuclear science educational capabilities; (7) award grants to outstanding DOE early-career researchers; and (8) establish a program to support the appointment of distinguished scientists by institutions of higher education and national laboratories. Establishes the Advanced Research Projects Authority-Energy. Authorizes the Secretary of Education to award grants to: (1) develop and implement programs to provide courses of study in mathematics, science, engineering, or critical foreign languages with concurrent teacher certification or to enhance teacher knowledge and teaching skills; (2) increase the number of teachers and students teaching or enrolled in advanced placement or international baccalaureate courses in mathematics, science, or critical foreign languages; (3) help low-income students performing below grade level in mathematics; (4) establish programs of study in critical foreign languages; (5) promote content knowledge requirements for secondary school graduation and establish or improve a statewide P-16 education data system. Requires the Director of the National Science Foundation (NSF) to: (1) expand the Graduate Research Fellowship Program and the Integrative Graduate Education and Research Traineeship Program; (2) establish a clearinghouse and pilot programs relating to the creation or improvement of professional science master's degree programs; (4) establish a program to provide mentors for women interested in careers in science, technology, engineering, and mathematics; and (5) establish a program of basic research in advanced information and communications technologies.

Applies such prohibition only if the individual asserting the rights knew or had reason to know at the time of acquiring the rights asserted that the mark or name was the same or substantially similar to the mark or name used in connection with the business or assets that were confiscated.

Children's Dental Health Improvement Act of 2007 - Amends title V (Maternal and Child Health Services) of the Social Security Act to direct the Secretary of Health and Human Services to award grants to states to improve dental services to children enrolled in Medicaid or the State Children's Health Insurance Program (SCHIP). Amends the Public Health Service Act to require the Secretary, acting through the Health Resources and Services Administration (HRSA), to establish a grant program to expand the availability of primary dental care services in dental health professional shortage areas or medically underserved areas. Authorizes retention bonuses for eligible dental officers of the Indian Health Service. Requires the Secretary, acting through the Administrator of HRSA and the Director of the Indian Health Service, to establish demonstration projects to increase access to dental services for children in underserved areas. Directs the Secretary to establish: (1) an oral health initiative to reduce disparities in oral health; and (2) Chief Dental Officers for Medicaid and SCHIP, HRSA, and the Centers for Disease Control and Prevention (CDC). Requires the Director of the CDC to collect data on dental, craniofacial, and oral health. Requires the Secretary to identify populations at high risk for early childhood caries (tooth decay) and to develop prevention programs. Revises the eligibility requirements for the school-based dental sealant program to include Indian tribes. Directs the Secretary, acting through the Director of the CDC, to award grants to states and Indian tribes to improve their basic capacity to improve the oral health of children and their families.

Ban Asbestos in America Act of 2007 - Amends the Toxic Substances Control Act to require the National Institute for Occupational Safety and Health to conduct a study that: (1) describes the science concerning the disease mechanisms and health effects of exposure to asbestos and other biopersistent durable fibers and methods for measuring and analyzing asbestos; (2) describes labeling practices relating to asbestos-containing material; and (3) recommends future asbestos-related disease research and exposure assessment practice needs. Requires the Administrator of the Environmental Protection Agency (EPA) to promulgate regulations that prohibit the importing, manufacturing, processing, or distributing of asbestos-containing products, subject to limited exemption upon petition and specified exemptions sought by the Department of Defense (DOD) and the National Aeronautics and Space Administration (NASA). Requires the disposal of asbestos-containing products within two years. Exempts products that are no longer in the stream of commerce or that are in the possession of an end user. Requires the Administrator to establish a plan to: (1) increase awareness of the dangers posed by asbestos-containing products and contaminants in homes and workplaces and by asbestos-related diseases; (2) provide information to, and encourage participation in research and treatment endeavors by, asbestos-related disease patients and their families and front-line health care providers; and (3) encourage health care providers and researchers to provide to patients and their families information relating to research, diagnostic, and clinical treatments relating to asbestos. Amends the Public Health Service Act to: (1) direct the Secretary of Health and Human Services to expand and coordinate research programs on diseases caused by asbestos exposure, particularly mesothelioma, asbestosis, and pleural injuries; (2) provide for establishment of a national clearinghouse for data and specimens relating to asbestos-related diseases; (3) require the Director of the National Institutes of Health (NIH) to establish an asbestos-related disease research and treatment network; and (4) direct the Secretary to support research on mesothelioma and other asbestos-related diseases that is directly relevant to the health of the Armed Forces.

Directs the Secretary to: (1) establish blood flow monitoring demonstration projects; and (2) arrange with the Institute of Medicine of the National Academy of Sciences to evaluate the barriers to increasing the number of individuals with ESRD who elect to receive home dialysis services or other treatment modalities under Medicare. Sets forth required training for patient care dialysis technicians. Directs the Secretary to establish an independent, multidisciplinary, nonpartisan End-Stage Renal Disease Advisory Committee. Establishes the annual update framework for the Medicare ESRD composite rate. Directs the Secretary to establish a three-year continuous quality improvement initiative under which quality payments are provided to renal dialysis facilities, providers of services, and physicians that: (1) provide items and services to individuals with ESRD enrolled under Medicare part B (Supplementary Medical Insurance); and (2) meet quality benchmarks and demonstrate quality improvements. Requires the Secretary to make quality incentive payments to facilities and providers whose services to individuals with ESRD have substantially improved or exceeded a certain threshold. Extends Medicare as secondary payer with respect to individuals with ESRD.

Amends part E (Federal Payments for Foster Care and Adoption Assistance) of title IV of the Social Security Act to authorize all states to opt to enter agreements to provide kinship guardianship assistance payments on behalf of children to grandparents and other relatives who have assumed legal guardianship of children for whom they have cared as foster parents and have committed to care for on a permanent basis. Allows states to use part E funds to make such payments under specified conditions. Provides that adoptive parents of children with special needs remain eligible for adoption assistance, even if they receive kinship guardianship assistance. Authorizes the use of foster care independence program funds to provide independent living services and education and training vouchers for children who exit foster care to kinship guardianship or adoption after age 16. Authorizes kinship guardianship demonstration projects. Requires states to: (1) notify all adult grandparents and other adult relatives (with exceptions due to family or domestic violence) when a child is removed from custody of a parent or parents; and (2) explain the options the relative has to participate in the child's care and placement. Allows state agencies to establish separate standards for foster family homes in which a foster parent is a relative of the foster child.

Urges the President to instruct the U.S. Representative to the United Nations and all U.S. representatives in bilateral and multilateral fora that they should ensure that: (1) relevant text refers to multiple refugee populations that have been caused by the Arab-Israeli conflict; and (2) any explicit reference to the resolution of the Palestinian refugee issue is matched by a similar reference to the resolution of the issue of Jewish, Christian, and other refugees from Arab and Muslim countries from the Middle East, North Africa, and the Persian Gulf. Clarifies that the United States supports the position that as an integral part of any comprehensive peace the issue of refugees and the mass violations of human rights of minorities in Arab and Muslim countries throughout the Middle East, North Africa, and the Persian Gulf must be resolved in a manner that includes: (1) consideration of the legitimate rights of all refugees displaced from Arab and Muslim countries from the Middle East, North Africa, and the Persian Gulf; and (2) recognition of the losses incurred by Jews, Christians, and other minority groups as a result of the Arab-Israeli conflict.

Requires the Secretary to establish an Arthritis and Rheumatic Diseases Interagency Coordinating Committee to: (1) improve coordination of federal research activities related to arthritis and rheumatic diseases; and (2) convene a summit to provide a detailed overview of such current federal research. Requires the Director of the National Institutes of Health (NIH) to expand and intensify juvenile arthritis research. Allows the Secretary, acting through the Director of the CDC, to award grants to support juvenile arthritis data collection. Requires the Federal Procurement Data System to be modified to include publication of information on specified federal contractor penalties and violations. Amends the Federal Property and Administrative Services Act of 1949 to prohibit awarding of certain monopoly federal contracts. Requires revision of the FAR to require competition for certain multiple award contracts. Denies protest rights for certain awards. Prohibits an agency from contracting for the performance of: (1) any inherently governmental function; or (2) acquisition functions closely associated with inherently governmental functions. Prescribes minimum requirements for political appointees holding public contracting and safety positions. Includes as a protected disclosure by a federal employee: (1) any lawful disclosure an employee or applicant reasonably believes is credible evidence of waste, abuse, or gross mismanagement, without restriction as to time, place, form, motive, context, or prior disclosure; and (2) the disclosure of information required to be kept secret in the interest of national defense or the conduct of foreign affairs that the employee or applicant reasonably believes is direct evidence of waste, abuse, or gross mismanagement if such disclosure is made to a Member or employee of Congress who is authorized to receive information of the type disclosed. Sets forth provisions concerning review and appeal of actions concerning such disclosures. Amends the Homeland Security Act of 2002 to provide that, for purposes of provisions regarding the protection of voluntarily shared critical infrastructure information, a permissible use of independently obtained critical infrastructure information includes any lawful disclosure an employee or applicant reasonably believes is credible evidence of waste, fraud, abuse, or gross mismanagement, without restriction as to time, place, form, motive, context, or prior disclosure. Requires agencies to inform employees on how to make a lawful disclosure of information.

Directs the Secretary to promulgate national voluntary consensus standards for first responder equipment and training. Lists authorized and prohibited uses of grants. Requires each grant recipient to submit quarterly and annual reports on homeland security spending. Establishes penalties for states that fail to pass through to local governments, first responders, and other local groups funds or resources within 45 days of receipt. Expresses the sense of Congress regarding interoperable communications and Citizen Corps councils. Requires the Secretary to ensure coordination of federal efforts to prevent, prepare for, and respond to emergencies. Directs the Secretary to conduct studies regarding: (1) implementation of a nationwide emergency telephonic alert notification system; (2) modifying the definition of "National Capital Region" to expand the area under the jurisdiction of the Office of National Capital Region Coordination; (3) risk-based funds allocation for port security grants; and (4) funds allocation under the Assistance to Firefighter Grants Program.

Family Smoking Prevention and Tobacco Control Act - Amends the Federal Food, Drug, and Cosmetic Act to provide for the regulation of tobacco products by the Secretary of Health and Human Services through the Food and Drug Administration, including through disclosure, annual registration, inspection, recordkeeping, and user fee requirements. Sets forth criteria by which tobacco products are deemed adulterated or misbranded. Allows the Secretary to require prior approval of all label statements. Allows the Secretary to restrict the sale or distribution of tobacco products, including advertising and promotion, if the Secretary determines that such regulation would be appropriate for the protection of the public health. Prohibits such regulations from: (1) limiting product sales or distribution to authorization of a practitioner licensed to prescribe medical products; (2) prohibiting product sales in face-to-face transactions by a specific category of retail outlets; or (3) establishing a minimum age greater than 18 years of age for product purchases. Prohibits cigarettes from containing any artificial or natural flavor (other than tobacco or menthol) or an herb or spice, including strawberry, cinnamon, or coffee. Requires the Secretary to establish tobacco product standards to protect the public health, but reserves to Congress the power to ban any tobacco products or reduce the nicotine level to zero. Allows the Secretary to take specified actions, including public notification and recall, against unreasonably harmful products. Requires premarket approval of all new tobacco products. Sets forth standards for the sale of modified risk tobacco products. Sets forth provisions regarding: (1) judicial review; (2) coordination with the Federal Trade Commission (FTC); (3) congressional review of regulations; and (4) state and local authority. Requires the Secretary to establish a Tobacco Products Scientific Advisory Committee. Amends the Federal Cigarette Labeling and Advertising Act to change cigarette warning label and advertising requirements. Amends the Comprehensive Smokeless Tobacco Health Education Act of 1986 to change smokeless tobacco warning label and advertising requirements.

Directs the Secretary to establish a demonstration project which allows the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to waive, for two-year periods, requirements for awarding breast and cervical cancer grants that specify the percentage of grant funds to be spent on screening and referrals for medical treatments if certain requirements are met, including: (1) the state involved will use the waiver to leverage private funds to supplement screening and referral services or the application of such requirements would result in a barrier to the enrollment of women; and (2) the Secretary finds that granting such a waiver to a state will not adversely affect the quality of such services. Allows the Secretary to extend a waiver if the waiver requirements are and have been met. Requires the Secretary to include information on waivers as part of the evaluations of the activities carried out pursuant to breast and cervical cancer grants.

Military Health Care Protection Act - Expresses the sense of Congress that: (1) the Department of Defense (DOD) and the nation have a committed obligation to provide health benefits to retired military personnel that exceeds the obligation of corporate employers to their employees; (2) DOD has many additional options to constrain the growth of health care spending in ways that do not disadvantage retirees, and should pursue such options rather than seeking large fee increases for retirees and their dependents; and (3) any percentage increase in health care fees, deductibles, or copayments for retirees and their families, and for members of the Selected Reserve currently serving on active duty and their families, should not exceed the percentage increase in military retired pay or basic pay, respectively. Limits to the previous percentage increase in retired or basic pay the authorized annual fee increase under: (1) the DOD pharmacy benefits program; and (2) certain premiums and other charges under the TRICARE program (a DOD managed health care program). Prohibits: (1) charges for DOD inpatient care from exceeding $535 per day after March 31, 2006 (currently, during the period beginning on April 1, 2006, and ending on September 30, 2007); (2) charging an enrollment fee under the Civilian Health and Medical Program of the Uniformed Services (CHAMPUS); and (3) a person from being denied a claim due to failure to enroll.

Makes the provisions of this Act inapplicable to an alien who is: (1) inadmissible or deportable under criminal or security grounds, including September 11, 2001, terrorist activity; or (2) a family member of such an alien.

Requires the Secretary to establish a Breast Cancer and Environmental Research Panel to: (1) develop a comprehensive research strategy for centers; (2) make recommendations with respect to the mechanisms, peer review criteria, and allocations under this Act; (3) assist in the overall program evaluations; and (4) make recommendations for the dissemination of information on program process.
