State Veterans Home Adult Day Health Care Improvement Act of 2017 This bill directs the Department of Veterans Affairs (VA) to enter into an agreement or a contract with each state home to pay for medical supervision model adult day health care for a veteran for whom the home is not receiving VA nursing home care payments. The veteran must need such care either specifically for a service-connected disability, or, if not specifically for one, the veteran must have a service-connected disability rated 70% or more. Payment under each agreement or contract between the VA and a state home must equal 65% of the payment that the VA would otherwise pay to the state home if the veteran were receiving nursing home care. "Medical supervision model adult day health care" means adult day health care that includes the coordination of physician services, dental services, the administration of drugs, and such other requirements as the VA may determine.

Military Widow's Tax Elimination Act of 2017

Military Widow's Tax Elimination Act of 2017 This bill repeals certain provisions which require the offset of amounts paid in dependency and indemnity compensation from Survivor Benefit Plan (SBP) annuities for the surviving spouses of former military personnel who are entitled to military retired pay or who would be entitled to such pay, except for being under 60 years of age. The Department of Defense is prohibited from recouping certain amounts previously paid to SBP recipients in the form of a retired pay refund. The bill requires (current law authorizes) the Secretary of the military department concerned to pay an annuity to a member's dependent children when there is no eligible surviving spouse. The Secretary concerned shall restore annuity eligibility to a surviving spouse who earlier agreed to transfer such eligibility to the surviving child or children of a member.

The Army shall remove the Vietnam Helicopter Pilots Association Memorial Tree and place the monument where the tree stood.

Biennial Budgeting and Appropriations Act This bill amends the Congressional Budget Act of 1974 to require biennial budget resolutions, appropriations bills, and government strategic and performance plans, instead of the annual budget process required under current law. The bill specifies that budget biennium is the two consecutive fiscal years beginning on October 1 of any odd-numbered year. The Office of Management and Budget must report to Congress on the impact and feasibility of changing the definition of a fiscal year and the budget process based on that definition to a two-year fiscal period.

Childhood Cancer STAR Act

Childhood Cancer Survivorship, Treatment, Access, and Research Act of 2017 or the Childhood Cancer STAR Act This bill amends the Public Health Service Act to authorize the National Institutes of Health (NIH) to provide support to collect the medical specimens and information of children, adolescents, and young adults with selected cancers that have the least effective treatments in order to achieve a better understanding of these cancers and the effects of treatment. The national childhood cancer registry is reauthorized through FY2022 and revised to authorize the Centers for Disease Control and Prevention to award grants to state cancer registries to improve tracking of childhood cancers. The Department of Health and Human Services (HHS) may: (1) support pilot programs to develop or study models for monitoring and caring for childhood cancer survivors throughout their lives, (2) establish a task force to develop and test standards for high-quality childhood cancer survivorship care, and (3) carry out a demonstration project to improve care coordination as childhood cancer survivors transition to adult care. HHS must convene a Workforce Development Collaborative on Medical and Psychosocial Care for Pediatric Cancer Survivors. The NIH may support research on: (1) outcomes for, and barriers faced by, pediatric cancer survivors within minority or medically underserved populations; and (2) follow-up care for pediatric cancer survivors, including research on the late effects of cancer treatment and long-term complications. The Government Accountability Office must make recommendations to address barriers to childhood cancer survivors obtaining and paying for adequate medical care.

Ozone Standards Implementation Act of 2017

Ozone Standards Implementation Act of 2017 This bill amends the Clean Air Act by revising the National Ambient Air Quality Standards (NAAQS) program. The bill delays the implementation of the ozone NAAQS that were published in 2015. The bill extends until: (1) October 26, 2024, the deadline for states to submit designations to implement the 2015 ozone NAAQS; and (2) October 26, 2025, the deadline for the Environmental Protection Agency (EPA) to designate state areas as attainment, nonattainment, or unclassifiable areas with respect to the 2015 ozone NAAQS. States must submit a state implementation plan (SIP) by October 26, 2026, to implement, maintain, and enforce the 2015 ozone NAAQS. The bill also changes the review cycle for criteria pollutant NAAQS from a 5-year review cycle to a 10-year review cycle. The EPA may not complete its next review of ozone NAAQS before October 26, 2025. Prior to establishing or revising NAAQS, the EPA must obtain advice from its scientific advisory committee regarding potential adverse public health, welfare, social, economic, or energy effects which may result from attaining and maintaining NAAQS. The EPA must publish regulations and guidance for implementing NAAQS concurrently with the issuance of a new or revised standard. New or revised NAAQS must not apply to preconstruction permits for constructing or modifying a major emitting facility or major stationary source of air pollutants until those regulations and guidance have been published. The bill revises requirements concerning SIPs for extreme ozone nonattainment areas and particulate matter nonattainment areas.

Trickett Wendler Right to Try Act of 2017 This bill requires the federal government to allow unrestricted manufacturing, distribution, prescribing, and dispensing of experimental drugs, biological products, and medical devices that are: (1) intended to treat a patient who has been diagnosed with a terminal illness, and (2) authorized by state law. The federal government must allow unrestricted possession and use of such treatments by patients certified by a physician as having exhausted all other treatment options. A manufacturer, distributor, prescriber, dispenser, possessor, or user of such a treatment has no liability regarding the treatment. The outcome of manufacture, distribution, prescribing, dispensing, possession, or use of such a treatment may not be used by a federal agency to adversely impact review or approval of the treatment. The treatment must: (1) have successfully completed a phase 1 (initial, small scale) clinical trial; (2) remain under investigation in a clinical trial approved by the Food and Drug Administration; and (3) not be approved, licensed, or cleared for sale under the Federal Food, Drug, or Cosmetic Act or the Public Health Service Act.

Small Business Broadband Deployment Act 2017 This bill exempts for five years any small business broadband Internet access service provider with no more than 250,000 subscribers from the enhancements to the transparency rule of the Federal Communications Commission (FCC) under which any person engaged in the provision of broadband Internet access service must disclose publicly accurate information regarding the network management practices, performance, and commercial terms of its broadband Internet access services sufficient for: consumers to make informed choices regarding their use; and content, application, service, and device providers to develop, market, and maintain Internet offerings. The FCC shall report to specified congressional committees, within 180 days after enactment of this bill, its recommendations (together with supporting data) on whether: this exception should be made permanent, and the definition of "small business" for these purposes should be modified.

Miners Protection Act of 2017 This bill amends the Surface Mining Control and Reclamation Act of 1977 (SMCRA) to transfer certain funds to the Multiemployer Health Benefit Plan and the 1974 United Mine Workers of America (UMWA) Pension Plan to provide health and pension benefits to retired coal miners and their families. The bill expands the group whose retiree health benefits are taken into account in determining the amount that the Department of the Treasury must transfer from the Abandoned Mine Reclamation Fund and the General Fund of the Treasury to the Multiemployer Health Benefit Plan. Treasury must also transfer additional funds to the 1974 UMWA Pension Plan to pay pension benefits required under that plan if the amounts available for transfer under SMCRA's $490 million annual limit exceed the amounts required to be transferred for other purposes (including to the UMWA Health Plans). The bill also: (1) prohibits the pension plan from making certain changes to benefits during any year in which a transfer is received, and (2) establishes additional reporting requirements for the plan. The bill repeals requirements for current and former signatories to labor agreements with the UMWA to pay unassigned beneficiaries premiums or backstop premiums if transfers under SMCRA are less than the amount required to be transferred. As an offset, the bill amends the Consolidated Omnibus Budget Reconciliation Act of 1985 to extend the authority of Treasury to collect certain customs user fees.

Combating BDS Act of 2017 This bill allows a state or local government to adopt and enforce measures to divest its assets from, prohibit investment of its assets in, or restrict contracting with: (1) an entity that engages in a commerce- or investment-related boycott, divestment, or sanctions activity targeting Israel; or (2) an entity that owns or controls, is owned or controlled by, or is under common ownership or control with such an entity. Such measures are not preempted by federal law. A state or local government that seeks to adopt or enforce such measures shall comply with specified requirements related to notice, timing, and opportunity for comment. In addition, the bill amends the Investment Company Act of 1940 to prohibit a person from bringing any civil, criminal, or administrative action against a registered investment company based solely upon that company's divestment from securities issued by a person that engages in a commerce- or investment-related boycott, divestment, or sanctions activity targeting Israel.

Demands that the United States ensure that no action is taken at the Paris Conference on the Israeli-Palestinian conflict scheduled for January 15, 2017, that imposes an agreement or parameters on the parties. Notes that granting membership and statehood standing to the Palestinians at the U.N., its specialized agencies, and other international institutions outside of the context of a bilateral peace agreement with Israel would cause severe harm to the peace process and would likely trigger penalties under provisions of the Department of State, Foreign Operations, and Related Agencies Appropriations Act, 2016 regarding limitations on assistance to the Palestinians. Rejects any efforts by international organizations to use such resolution to further isolate Israel and urges the U.S. government to act where needed to counter any such efforts. Urges: (1) U.S. presidential Administrations to uphold the practice of vetoing all Security Council resolutions that seek to insert the council into the peace process, recognize unilateral Palestinian actions, or dictate terms and a time line for a solution of the Israeli-Palestinian conflict; and (2) the incoming presidential Administration to work with Congress to create conditions that facilitate the resumption of negotiations without preconditions between Israelis and Palestinians to achieve a sustainable agreement acceptable to both sides. Reaffirms that it is U.S. policy to seek a sustainable, just, and secure two-state solution to the Israeli-Palestinian conflict.

Revitalizing the Economy of Coal Communities by Leveraging Local Activities and Investing More Act of 2016 or the RECLAIM Act of 2016 This bill amends the Surface Mining Control and Reclamation Act of 1977 to make specified funds available to the Department of the Interior for each of FY2017-FY2021 for distribution to states and Indian tribes to promote economic revitalization, diversification, and development in economically distressed communities through the reclamation and restoration of land and water resources adversely affected by coal mining carried out before August 3, 1977. The bill prescribes general requirements for projects to reclaim abandoned mine lands and waters that are likely to create favorable conditions for the economic development of the project site or promote the general welfare through economic and community development of the area in which the project is conducted. Any such project shall be located in a community affected by a recent decline in mining. A state or Indian tribe that receives funds under this bill may retain a portion of them as necessary to supplement its acid mine drainage abatement and treatment fund for future operation and maintenance costs for the treatment of acid mine drainage associated with individual projects.

National Guard Bonus Repayment and Financial Relief Act This bill requires the Army to review all bonuses, incentive pays, or similar benefits received by members of the Army National Guard between January 1, 2004, and December 31, 2010, to determine if such benefits were issued erroneously and to either: (1) waive repayment of such an erroneous payment if the member concerned fully satisfies any period of service otherwise agreed to or imposed upon the member in connection with receipt of the payment; or (2) repay any such erroneous payment and any interest that was repaid by a member before this bill's enactment if the member fully satisfies any such period of service. The Army may require an Army National Guard member to repay any such erroneous payment upon determining that: (1) the member knowingly received the benefit through fraud or misrepresentation in which the member participated, or (2) repayment is otherwise consistent with provisions governing repayment of unearned pay. For any such member granted relief under this bill, the Army shall: (1) notify all consumer credit reporting agencies that any debt subject to the relief was never valid, and (2) provide assistance to the member facing financial hardship as a result of recoupment actions taken in connection with receipt of the payment. A consumer reporting agency notified of the invalidity of such a debt may not, after the date of notice, make any consumer report containing information relating to the debt.

Bringing Business Back Act of 2016 This bill amends the Internal Revenue Code to allow income or gain attributable to certain real property to be excluded from gross income for a one-year period in which the income attributable to the real property exceeds the pre-depreciation expenses attributable to the property. The exclusion applies to real property that has been certified by the state or local zoning authority and any economic development board as: (1) zoned for commercial use, (2) undeveloped and vacant during the two-year period ending on the date of certification, and (3) located within a qualified census tract. A "qualified census tract" is any census tract that: (1) has an average poverty rate exceeding the national average poverty rate or an unemployment rate above the national unemployment rate; and (2) exhibits another condition of distress, such as deteriorating infrastructure or population decline. A census tract is also qualified if it is located in a rural community that: (1) has an unemployment rate of at least 6%, and (2) in which at least 50% of the houses were constructed before 1980.

Department of Veterans Affairs Appeals Modernization Act of 2016 This bill amends the Department of Veterans Affairs (VA) benefits appeals process to permit a claimant to request: a review of the agency of original jurisdiction's decision by a higher-level adjudicator within the agency based on the original evidence; or a Board of Veterans Appeals (BVA) review under which no BVA hearing is requested and no additional evidence may be submitted or under which a BVA hearing is requested and the appellant requests an opportunity to submit additional evidence at, and within 90 days of, the hearing (for which the BVA shall maintain two separate dockets). (The term "agency of original jurisdiction" means the activity which entered the original determination with regard to a claim for veterans benefits.) The bill prescribes additional information that must be included in the notice of a denied benefit. A finding favorable to a claimant is binding on all subsequent VA adjudicators unless clear and convincing evidence is shown to the contrary. If a claim is denied the claimant may, within one year after the agency of original jurisdiction issues a decision with respect to such claim: (1) file a request for higher-level review, (2) file a supplemental claim, or (3) file a notice of disagreement. The BVA may remand a claim to the agency to obtain a corrective advisory medical opinion. The VA shall provide for expedited treatment by the agency of original jurisdiction of any claim that is remanded by the BVA. The bill revises effective dates of awards provisions. The bill repeals a provision authorizing the BVA to secure an independent medical expert's opinion when warranted by the medical complexity or controversy involved in an appeal case. The VA's duty to assist a claimant shall not apply: (1) once the claimant is provided notice of the agency's initial decision, and (2) to higher-level agency or BVA review. The VA is not required to send notice for a supplemental claim or to readjudicate a claim that has been disallowed except when new and relevant evidence is presented or secured (currently such provision applies to reopening such claim). A claimants's notice of disagreement must set out specific allegations of error of fact or law. The BVA is authorized to dismiss an appeal that fails to do so.

Countering Iranian Threats Act of 2016 This bill directs the Departments of State, Defense, Treasury, and the Director of National Intelligence to submit a 10-year strategy to counter Iranian activities and threats. The President shall impose against Iran's Islamic Revolutionary Guard Corps (IRGC) sanctions with respect to: (1) blocking property of, and prohibiting transactions with, foreign persons who commit or support terrorism; and (2) an entity designated as a foreign terrorist organization. The President shall impose asset blocking and U.S. exclusion sanctions against any person that: (1) materially contributes to the sale or transfer to Iran of specified military equipment or that provides related technical or financial assistance, or (2) materially contributes to Iran's ballistic missile or weapons of mass destruction programs. The President shall impose specified sanctions against a person identified by the Department of State in an annual report as having acted to undermine, or as posing a risk of undermining: (1) the peace or stability in Bahrain, Iraq, Syria, Jordan, Kuwait, Lebanon, Saudi Arabia, Qatar, the United Arab Emirates, or Yemen; or (2) the peace process in Syria. Specified sanctions against Iran are continued until the President certifies that the following Iranian activities have ceased: (1) support for terrorism, (2) development of ballistic missile programs or delivery systems for weapons of mass destruction, (3) human rights abuses, and (4) undermining of cyber security. The President shall impose property blocking sanctions against any person that has engaged in significant activities undermining cyber security by or on behalf of Iran. The President may not issue any license under the International Emergency Economic Powers Act to an offshore dollar clearing entity to conduct a transaction with an Iranian financial institution in U.S. dollars. The National Defense Authorization Act for Fiscal Year 2012 is amended to subject to sanctions: (1) u-turn transactions (fund transfers from a foreign bank that pass through a U.S. financial institution and are then transferred to a second foreign bank), and (2) book transfers (fund transfers for the benefit of an Iranian financial institution made between accounts of the same financial institution). The President is authorized and encouraged to impose asset blocking and U.S. exclusion sanctions against any Iranian official who is responsible for, or complicit in, directing acts of significant corruption in Iran. The Iran Sanctions Act of 1996 is extended through December 31, 2026. The bill sets forth reporting requirements with respect to: (1) Iran's use of sanction relief funds, (2) offshore U.S. dollar clearing for Iranian transactions, (3) U.S.-European Union sanctions coordination, (4) Iranian nuclear weapons research and development, (5) Iran-North Korea nuclear cooperation, (6) Iranian use of commercial aircraft and related services for illicit military or other activities, and (7) U.S. citizens detained by Iran. Treasury shall publish in the Federal Register an IRGC Watch List. It is the sense of Congress that the President should engage with international partners to ensure that the International Atomic Energy Agency is fully funded in order to undertake its verification responsibilities. The bill exempts certain humanitarian and national security activities from sanctions. Upon receipt of credible information that a person is engaged in sanctionable activity, the President shall initiate an investigation to determine whether such person is subject to sanctions.

The veteran must need such care either specifically for a service-connected disability, or, if not specifically for one, the veteran must have a service-connected disability rated 70% or more. Payment under each agreement or contract between the VA and a state home must equal 65% of the payment that the VA would otherwise pay to the state home if the veteran were receiving nursing home care. "Medical supervision model adult day health care" means adult day health care that includes the coordination of physician services, dental services, the administration of drugs, and such other requirements as the VA may determine.

Fiscal Responsibility Act of 2016 or the FIRE Act This bill requires the President and the congressional leadership to appoint members of a National Commission on Fiscal Responsibility and Reform within 180 days of the inauguration of a President. The commission must identify policies to improve the fiscal situation in the medium-term and to achieve fiscal sustainability over the long-term. In carrying out these duties, the commission must propose recommendations to: (1) balance the budget, excluding interest payments on the debt, within 10 years, in order to stabilize the debt-to-GDP (gross domestic product) ratio at an acceptable level; and (2) meaningfully improve the long-term fiscal outlook, including changes to address the growth of entitlement spending and the gap between projected revenues and expenditures. Within one year of the appointment of its members, the commission must vote on a report including the required recommendations. The commission may only issue a final report to be submitted to Congress if at least 12 of its 18 members approve the report. Each commission terminates 30 days after submitting a report to Congress. After consulting with Congress and specified agencies, the President must submit to Congress a joint resolution containing the legislative text necessary to implement the recommendations contained in a report submitted to Congress. The resolution must be accompanied by a special message that includes specified details regarding recommendations of the commission that are excluded from or included in the resolution. Congress must consider the joint resolution using expedited legislative procedures specified in the bill.

Budgeting for Opioid Addiction Treatment Act This bill amends the Internal Revenue Code to impose a one cent per milligram excise tax on the sale of active opioids by the manufacturer, producer, or importer. The tax excludes prescription drugs used exclusively for the treatment of opioid addiction as part of a medically assisted treatment effort. The Department of Health and Human Services (HHS) must establish a program to provide rebates or discounts to cancer and hospice patients to ensure that they do not pay the tax. The bill amends the Public Health Service Act to require any increase in federal revenues from the tax after rebates and discounts are subtracted to be distributed to states under the Substance Abuse Prevention and Treatment Block Grant program to be used exclusively for substance abuse (including opioid abuse) efforts in the states, including specified treatment programs. HHS must report to Congress on the impact of this bill on the retail cost of opioids and patient access to opioid medication, the effectiveness of the discount or rebate for cancer and hospice patients, how the funds are being used to improve substance abuse treatment efforts, and suggestions for improving access to opioids for cancer and hospice patients and substance abuse treatment efforts.

All of the surcharges received from the sale of such coins shall be paid as follows: one-half to the Smithsonian Institution's National Air and Space Museum's "Destination Moon" exhibit; one-quarter to the Astronauts Memorial Foundation; and one-quarter to the Astronaut Scholarship Foundation, to aid its missions by providing college scholarships for the very best and brightest students pursuing degrees in science, technology, engineering, or mathematics.
