Home Health Care Planning Improvement Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act to revise conditions of and limitations on payment for home health care services. Allows payment for home health services to Medicare beneficiaries by: (1) a nurse practitioner; (2) a clinical nurse specialist working in collaboration with a physician in accordance with state law; (3) a certified nurse-midwife; or (4) a physician assistant under a physician's supervision.

Rosa's Law - Amends the Higher Education Act of 1965, the Elementary and Secondary Education Act of 1965, the Rehabilitation Act of 1973, the Public Health Service Act, the Health Professions Education Partnership Act of 1968, the National Sickle Cell Anemia Act, Cooley's Anemia, Tay-Sachs, and Genetic Diseases Act, the Genetic Information Nondiscrimination Act, the Developmental Disabilities Assistance and Bill of Rights Act of 2000, and other federal enactments and regulations to change references to mental retardation to references to an intellectual disability.

TARP Sunset Act of 2009 - Amends the Emergency Economic Stabilization Act of 2008 (EESA) to terminate, on December 31, 2009 (as under current law), the authority of the Secretary of the Treasury to implement the Troubled Asset Relief Program (TARP). Repeals the Secretary's authority to extend the TARP program through October 3, 2010, upon submission of a written certification to Congress.

Expresses the sense of the Senate that the U.S. delegation to the 21st Regular Meeting of the International Commission for the Conservation of Atlantic Tunas should: (1) seek the adoption of all revisions to the multi-annual recovery plan for bluefin tuna in the eastern Atlantic and Mediterranean that will conform the plan to the scientific advice provided by the Standing Committee on Research and Statistics; (2) seek to expand time and area closures of spawning areas in the Mediterranean in conformity with the scientific advice provided by the Standing Committee; (3) pursue the continued review and assessment of compliance; (4) seek to address noncompliance; (5) pursue the commitment by the Commission and its parties to fund additional research on the western Atlantic and eastern Atlantic and Mediterranean bluefin tuna stocks including, but not limited to, the extent to which they mix; and (6) defend U.S. interests with regard to Atlantic bluefin tuna, Atlantic swordfish, and other species managed by the Commission, including the protection of U.S. quota shares.

Access to Nutritious Meals for Young Children Act of 2009 - Amends the the Richard B. Russell National School Lunch Act to increase reimbursement rates for free, reduced price, and paid meals and snacks served under the Child and Adult Care Food Program (CACFP) at nonresidential child care centers and family or group day care homes. Allows such providers to be reimbursed for the service of three meals and a snack. (Currently, reimbursement is provided for two meals and a snack.) Lowers the percentage of children or school children in an area that must be eligible for free or reduced price meals under the school lunch or breakfast programs to make family or group day care homes in the area eligible for higher CACFP reimbursement rates as tier I homes. Increases the maximum monthly administrative payment per home provided to sponsors of family or group day care homes. Directs the Secretary of Agriculture to improve the ability of the CACFP to reach low-income families by streamlining program and paperwork requirements.

Cold War Service Medal Act of 2009 - Authorizes the Secretary of the military department concerned to issue the Cold War Service Medal to members of the Armed Forces who were discharged or released under honorable conditions after having: (1) served on active duty for at least 24 consecutive months during the Cold War (September 2, 1945, through December 26, 1991); (2) deployed outside the continental United States for at least 30 days during such period; or (3) performed other Cold War service as the Secretary of Defense may prescribe. Expresses the sense of Congress that the Secretary should expedite the design of the Medal as well its issuance to eligible members.

National Women's History Museum Act of 2009 - Directs the Administrator of General Services (GSA) to convey, by quitclaim deed, to the National Women's History Museum, Inc. specified property in the District of Columbia, on terms which the Administrator deems appropriate. Requires the property to be dedicated for use as a site for a national women's history museum for a 99-year period.

Child Support Protection Act of 2009 - Amends part D (Child Support and Establishment of Paternity) of title IV of the Social Security Act to repeal the exclusion from federal matching payments of any amounts expended by a state from child support incentive payments it has received from the Secretary of Health and Human Services. (Thus reinstates federal matching of state spending of child support incentive payments.)

Amends the Internal Revenue Code relating to the building rehabilitation tax credit to: (1) allow an increased 30% credit for projects involving $7.5 million or less in rehabilitation expenditures; (2) allow rehabilitated buildings used for lodging to qualify for such credit; (3) establish a 50-year placed-in-service requirement for non-historic rehabilitated buildings; (4) allow such credit for certain tax-exempt use property; (5) provide for the transferability of such credit; (6) increase the energy efficiency tax credit allowed to rehabilitated buildings; and (7) exempt from taxation refunds attributable to state historic tax credits.

World War II War Crimes Accountability Act of 2009 - Expresses the sense of the Senate that: (1) the United States should encourage extradition and prosecution of the remaining Nazi war criminals; (2) the Simon Wiesenthal Center should be commended for its historic work in bringing to light the atrocities of the Holocaust and in advancing justice for Nazi war criminals through Operation: Last Chance; and (3) the Office of Special Investigation of the Department of Justice (DOJ) is advancing U.S. foreign policy by bringing wanted World War II criminals to justice and should be commended for its actions. Directs the Attorney General, in evaluating the effect on U.S. law enforcement and security interests for purposes of a country's eligibility for visa waiver program designation, to consider the extent to which such country is: (1) cooperating in extraditing or prosecuting Nazi war criminals; and (2) admitting into its territory aliens ordered removed from the United States because of participation in Nazi persecution, genocide, torture, or extrajudicial killing. Authorizes the President, after congressional notification, to not terminate a country's designation based upon such evaluation if in the national interest.

Abrupt Climate Change Research Act of 2009 - Directs the Secretary of Commerce to establish within the Office of Oceanic and Atmospheric Research of the National Oceanic and Atmospheric Administration (NOAA) and carry out a program of extramural awards to conduct scientific research on abrupt climate change (defined as change in climate that occurs so rapidly or unexpectedly that human or natural systems have difficulty adapting).

IDEA Full Funding Act - Amends the Individuals with Disabilities Education Act (IDEA) to reauthorize and make appropriations for the grant program to assist states and outlying areas in providing special education and related services to children with disabilities. Decreases the amount authorized and makes appropriations for FY2010-FY2011, authorizes and makes specified appropriations for FY2012-FY2015, and authorizes and makes appropriations pursuant to a formula for FY2016 and thereafter.

Cleaner, Secure, and Affordable Thermal Energy Act - Amends the Internal Revenue Code to: (1) allow a tax credit for residential energy property expenditures to convert a home heating system using oil fuel to a system using natural gas boilers and furnaces and biomass heating appliances; (2) allow bonus depreciation of property used to convert a home heating system; (3) allow the use of tax-exempt energy conservation bonds to finance conversions of fuel oil heating systems; and (4) extend through 2012 accelerated depreciation for natural gas distribution facilities.

Expanding Building Efficiency Incentives Act of 2009 - Amends the Internal Revenue Code to: (1) increase and extend for three years the new energy efficient home tax credit; (2) increase the rate of the tax deduction for energy efficient commercial buildings; (3) allow a $200 tax credit through 2011 for the cost of a home energy rating; and (4) allow a $500 tax credit for the cost of training and certifying home performance auditors to conduct home energy ratings.

Next Step for Main Street Credit Availability Act of 2009 - Amends the Small Business Act to increase maximum amounts of loans under the section 7(a) guaranteed loan program and the Microloan Program. Amends the Small Business Investment Act of 1958 to increase maximum amounts of loans to state and local development companies for plant acquisition, construction, conversion, and expansion. Expresses the sense of Congress that the Administrator of the Small Business Administration (SBA) should establish a website that: (1) lists SBA lenders; and (2) allows prospective borrowers to compare loan rates and apply online.

Public Safety Employer-Employee Cooperation Act of 2009 - Declares that it is the purpose of this Act to provide collective bargaining rights for public safety officers employed by states or local governments. Directs the Federal Labor Relations Authority (FLRA) to determine whether a state substantially provides for specified rights and responsibilities for public safety officers, including: (1) granting public safety employees the right to form and join a labor organization which excludes management, supervisory, and confidential employees, and which is, or seeks to be, recognized as the exclusive bargaining agent for such employees; and (2) requiring public safety employers to recognize and agree to bargain with the employees' labor organization. Requires the FLRA to issue, in accordance with the public safety employee rights and responsibilities, regulations establishing collective bargaining procedures for public safety employers and employees in states that do not substantially provide for such rights and responsibilities. Directs the FLRA, in such cases, to: (1) determine the appropriateness of units for labor organization representation; (2) supervise or conduct elections to determine whether a labor organization has been selected as an exclusive representative by a voting majority of the employees in an appropriate unit; (3) resolve issues relating to the duty to bargain in good faith; (4) conduct hearings and resolve complaints of unfair labor practices; and (5) resolve exceptions to arbitrators' awards. Grants a public safety employer, employee, or labor organization the right to seek enforcement of FLRA regulations and orders through appropriate state courts. Prohibits public safety employers, employees, and labor organizations from engaging in lockouts, sickouts, work slowdowns, or strikes. Waives federal preemption of state law governing strikes by public safety officers. Provides that existing collective bargaining units and agreements shall not be invalidated by this Act.

Expanding Industrial Energy Efficiency Incentives Act of 2009 - Amends the Internal Revenue Code to: (1) increase megawatt and horsepower capacity limitations for the combined heat and power system property energy tax credit; and (2) allow new tax credits to improve advanced motor system energy efficiency, to replace chlorofluorocarbon (CFC) refrigerant chillers, and for investment in any qualifying efficient industrial process water use project.

Efficient Vehicle Leadership Act of 2009 - Amends the Internal Revenue Code to: (1) allow a new income tax credit for certain fuel-efficient motor vehicles with a purchase price not exceeding $50,000, beginning with model year 2011; (2) allow such credit as an offset against the alternative minimum tax (AMT); and (3) revise the gas guzzler excise tax to impose an increased tax on fuel guzzler motor vehicles, beginning with model year 2013, based on specified fuel efficiency ratings.

Employee Stock Ownership Plan Promotion and Improvement Act of 2009 - Amends the Internal Revenue Code to: (1) exempt certain distributions, including dividends, by S corporations to an employee stock ownership plan (ESOP) from the penalty tax for premature employee benefit plan withdrawals; (2) exempt deductions for ESOP dividends from corporate alternative minimum tax adjustments based on adjusted earnings and profits; (3) allow deferral of the recognition of gain for certain sales to ESOPs sponsored by any domestic corporation, including S corporations; (4) allow reinvestment of ESOP stock proceeds eligible for nonrecognition of gain in certain mutual funds; and (5) modify certain ESOP stock ownership rules. Amends the Small Business Act to allow a majority-owned ESOP business concern to continue to qualify for loans, preferences, and other programs under such Act.

Federal Board of Certification Act of 2009 - Establishes a Federal Board of Certification to certify that the mortgages within a security instrument meet the underlying standards they claim to meet with regards to such mortgage characteristics as: (1) documentation; (2) loan to value ratios; (3) debt service to income ratios; and (4) borrower credit standards and geographic concentration. States that the purpose of this certification process is to increase the transparency, predictability, and reliability of securitized mortgage products. Authorizes market participants, including firms that package mortgage loans into mortgage securities, to elect to have their mortgage securities evaluated by the Board. Authorizes the Board to: (1) promulgate regulations establishing enumerated security standards to use in certifying mortgage securities; (2) establish uniform principles and standards and report forms for the regular examination of such securities; and (3) develop uniform reporting systems for ascertaining mortgage security risk. Grants the Board access to all books, accounts, records, reports, files, memorandums, papers, things, and property belonging to or in use by federal financial institutions regulatory agencies. Requires any publication, transmission, or webpage containing an advertisement for or invitation to buy a mortgage security to carry a disclaimer that certification by the Federal Board of Certification can in no way be considered a guarantee of the mortgage security, but is merely a judgment of the degree of risk offered by the security in question.

Employment Non-Discrimination Act of 2009 - Prohibits employment discrimination on the basis of actual or perceived sexual orientation or gender identity by covered entities (employers, employment agencies, labor organizations, or joint labor-management committees). Prohibits preferential treatment or quotas. Allows only disparate treatment claims. Prohibits related retaliation. Makes this Act inapplicable to: (1) religious organizations; and (2) the relationship between the United States and members of the Armed Forces. Declares that this Act does not repeal or modify any federal, state, territorial, or local law creating a special right or preference concerning employment for a veteran. Provides for the construction of this Act regarding: (1) enforcement by employers of rules and policies; (2) sexual harassment; (3) certain shared facilities such as showers or dressing facilities; (4) construction of new or additional facilities; (5) dress and grooming standards; and (6) provision of employee benefits to married vs. unmarried couples. Declares that, in this Act, "married" refers to a legal union between one man and one woman. Prohibits the Equal Employment Opportunity Commission (EEOC) from collecting statistics from covered entities on actual or perceived sexual orientation or gender identity or compelling the collection by covered entities of such statistics. Provides for enforcement, including giving the EEOC, the Librarian of Congress, the Attorney General, and U.S. courts the same enforcement powers as they have under specified provisions of the Civil Rights Act of 1964, the Government Employee Rights Act of 1991, and other specified laws. Allows actions and proceedings, subject to exception, against the United States and the states.

New Markets Tax Credit Extension Act of 2009 - Amends the Internal Revenue Code to: (1) extend the new markets tax credit through 2014; (2) provide for an inflation adjustment to the limitation amount for such credit after 2009; and (3) allow an offset against the alternative minimum tax (AMT) for such credit.

Forest Carbon Incentives Program Act of 2009 - Requires the Secretary of Agriculture to establish a carbon incentives program to achieve supplemental greenhouse gas emission reductions on private forest land of the United States. Directs the Secretary (subject to specified requirements) to provide to owners of eligible land financial incentive payments for: (1) eligible practices that measurably increase carbon sequestration and storage over a designated period, as specified through a climate mitigation contract; and (2) permanent avoided deforestation agreements (i.e., permanent conservation easements that cover eligible land that will not be converted for development). Directs the Secretary to: (1) specify requirements to address intentional or unintentional reversal of carbon sequestration during the contract period; (2) issue regulations that specify eligible practices and related compensation rates, standards, and guidelines; (3) establish and implement protocols that provide monitoring and verification of compliance with such contracts; (4) report on progress toward reaching specified levels of carbon sequestration and storage through such contracts; and (5) adjust (at least every two years) eligible practices and compensation rates for future contracts based on the results.

Multinational Species Conservation Funds Semipostal Stamp Act of 2009 - Requires the United States Postal Service to issue and sell, at a premium, a Multinational Species Conservation Funds Semipostal Stamp. Requires proceeds from the sale of such stamp to be: (1) transferred to the United States Fish and Wildlife Service (USFWS) to help fund the operations supported by the Multinational Species Conservation Funds; and (2) divided equally among the African Elephant Conservation Fund, the Asian Elephant Conservation Fund, the Great Ape Conservation Fund, the Marine Turtle Conservation Fund, and the Rhinoceros and Tiger Conservation Fund. Prohibits such proceeds from being taken into account in any decision relating to the level of appropriations or other federal funding to be furnished to the USFWS or such Funds. Requires the stamp to: (1) be made available to the public for at least five years; and (2) depict images of flagship multinational species.

Milk Import Tariff Equity Act - Amends the Harmonized Tariff Schedule of the United States to impose tariff-rate quotas (quantitative import limits) and provide various duty rates on certain casein, caseinates, milk protein concentrate, and other casein derivatives and glues imported into the United States (except imports from Mexico). Authorizes the President to: (1) enter into a trade agreement with a foreign country to grant new concessions as compensation in order to maintain the general level of reciprocal and mutually advantageous concessions; and (2) proclaim any necessary modification or continuance of any existing duty, or continuance of existing duty-free or excise treatment, or any quantitative limitation. Sets forth certain limits on the reduction of duties on such products.
