Breast and Cervical Cancer Mortality Prevention Act of 1990 - Amends the Public Health Service Act to direct the Secretary of Health and Human Services, through the Director of the Centers for Disease Control, to make grants to States, with regard to breast and cervical cancer, for screening, referrals and follow-up services, public information and education programs, education and training for health professionals, quality monitoring of screening, and evaluations of such activities. Sets forth preferences in making the grants and requires equitable geographical distribution. Requires matching non-Federal funds in a specified ratio. Requires that States agree to: (1) provide all of certain services by a specified date; (2) switch to any improved screening procedures which become available; and (3) assure the quality of any screening procedures used. Directs the Secretary to establish guidelines for assuring the quality of mammography and cytological screening conducted under these provisions. Requires that low-income women be given priority in the provision of services. Requires that a charge for services, if any: (1) be made according to a public schedule; (2) be adjusted for income of the woman involved; and (3) not be imposed on women with incomes below the poverty line. Requires services to be provided throughout a State, including to members of any Indian tribe or tribal organization. Authorizes the Secretary to provide training and technical assistance. Directs the Secretary to provide for annual evaluations of programs carried out under this Act. Authorizes appropriations. Limits the number of grants made to seven in FY 1991.

Human Services Reauthorization Act of 1990 - Extends authorized appropriations from FY 1991 through 1994 to carry out programs under the following Acts: (1) the Head Start Act; (2) the Follow Through Act; (3) the State Dependent Care Development Grants Act; (4) the Community Services Block Grant Act; (5) the Child Development Associate Scholarship Assistance Act; and (6) the Low-Income Home Energy Assistance Act of 1981. Amends the Human Services Reauthorization Act of 1986 to extend authorized appropriations from FY 1991 through 1994 to carry out the grant program relating to demonstration partnership agreements addressing the needs of the poor.

Rural Nursing Incentive Act of 1990 - Amends title XVIII (Medicare) of the Social Security Act to provide direct coverage under part B (Supplementary Medical Insurance) of the Medicare program of nurse practitioner or clinical nurse specialist services furnished in rural areas. Sets the Medicare payment for such services at 80 percent of the lesser of the actual charge or the prevailing charge that would have been recognized had the services been performed by a physician. Requires that such payments be made on an assignment-related basis.

Civil Rights Act of 1990 - Amends the Civil Rights Act of 1964 to provide that: (1) once a complainant has demonstrated that an employment practice results in a disparate impact on the basis of race, color, religion, sex, or national origin, the respondent has the burden of proving that the practice is justified by business necessity; (2) a complainant need not demonstrate which of a group of practices results in the demonstrated disparate impact; and (3) a respondent need not show business necessity for a specific practice within a group of practices if the respondent shows that that practice does not contribute to the disparate impact. Declares that an unlawful employment practice is established on a demonstration that race, color, religion, sex, or national origin was a motivating factor for any employment practice, even though such practice was also motivated by other factors, but bars certain types of relief if the respondent establishes that it would have taken the same action in the absence of any discrimination. Prohibits a challenge to an employment practice that implements a litigated or consent judgment or order resolving a claim of employment discrimination: (1) by a person who had certain types of notice and opportunity; (2) by a person whose interests were adequately represented by another person who challenged the judgment or order; or (3) if reasonable efforts were made to provide notice to interested persons. Increases to two years the time limit within which a charge of an unlawful employment practice must be filed. Removes provisions setting a separate time limit for charges initially filed with a State or local agency. Declares that a seniority system or practice which is part of a collective bargaining agreement is an unlawful employment practice if it was included in the agreement with the intent to discriminate. Allows, except for disparate impact cases, for compensatory damages (but not back pay) and, where there is malice or reckless or callous indifference, for punitive damages. Allows any party, where compensatory or punitive damages are sought, to demand a jury trial. Includes expert fees and other litigation expenses in any attorney's fees awarded. Prohibits a consent order or judgment settling a claim unless the parties and their counsel attest that a waiver of attorneys' fees was not compelled as a condition of the settlement. Allows to the prevailing party in the original action an award of attorney's fees and costs in defending a challenged judgment or order. Increases to 90 days after final action by a Federal agency the time limit for a Federal employee to bring a civil action. Allows to Federal employees the same interest to compensate for delay in payment as in cases involving non-public parties. Requires Federal civil rights laws to be broadly construed to effect their purpose to eliminate discrimination and provide effective remedies. Prohibits, except as expressly provided, any Federal civil rights law from being construed to restrict or limit the rights, procedures, or remedies available under any other Federal civil rights law. Declares that, for purposes of provisions relating to equal rights under the law, the right to make and enforce contracts includes the making, performance, modification, and termination of contracts, and the enjoyment of all benefits, privileges, terms, and conditions of the contractual relationship.

Medicaid Frail Elderly Community Care Amendments of 1990 - Amends title XIX (Medicaid) of the Social Security Act to permit States to provide Medicaid coverage of community care for functionally disabled elderly individuals. Considers individuals who are unable to perform at least two daily living activities or who have Alzheimer's disease and require substantial assistance or supervision as functionally disabled individuals. Defines a covered community care setting as a nonresidential setting or a residential setting in which more than two unrelated adults reside and personal services are provided. Requires that community care be provided to each client in accordance with an individual community care plan (ICCP) prepared and periodically reviewed and revised by a community care case manager on the basis of the manager's consultation with the client and a comprehensive functional assessment of a client's needs conducted by an interdisciplinary team before his or her receipt of care and at least annually thereafter. Sets a ceiling on Medicaid payments to States for community care. Reduces Federal Medicaid payments to States that reduce their Medicaid community care expenditures below their FY 1990 expenditures for such care. Requires that community care and community care settings meet requirements, to be developed by the Secretary of Health and Human Services, concerning client rights, the quality of such care, and safety and sanitation. Imposes specified minimum requirements on such care and settings, including certain Medicaid requirements currently applicable to nursing facilities. Requires that community care settings: (1) disclose persons having an ownership or control interest in the setting; and (2) exclude a person from such interest if he or she has been excluded from the Medicaid program or had an interest in a community care setting repeatedly found to have provided substandard care. Makes: (1) the Secretary responsible for certifying that State community care providers and settings comply with Medicaid requirements; and (2) States responsible for certifying that other community care providers and settings comply with Medicaid requirements. Requires that providers and settings be certified annually. Bases community care setting certification on an annual, unannounced survey. Directs the Secretary to: (1) develop a protocol for conducting surveys; and (2) conduct sample surveys of community care settings, within two months of State surveys, to test the adequacy of State surveys. Authorizes the Secretary to conduct a special survey of a setting or a review of a provider when there is reason to question its compliance with this Act. Prohibits the use of surveyors who have an interest in the provider or setting being surveyed. Requires States and the Secretary to investigate complaints against providers or settings concerning violations of this Act's requirements. Requires each State to provide, through the State agency responsible for the certification of such providers and settings, for the receipt, review, and investigation of allegations of client neglect and abuse, and of misappropriation of client property by providers. Requires that: (1) certain information regarding providers and settings and their compliance with this Act's requirements be made available to the public; and (2) State Medicaid fraud and abuse control units be given access to provider or setting survey and certification information. Requires that when the Secretary or State determines that a provider's or setting's deficiencies immediately jeopardize the client's health and safety, immediate action be taken to remove the jeopardy and correct the deficiencies or the provider's or setting's participation in Medicaid be terminated. Authorizes the Secretary or States to terminate a community care provider's participation in the Medicaid program and to impose a civil monetary penalty for failure to meet this Act's requirements. Sets forth the Secretary's responsibilities relating to community care requirements. Requires that State Medicaid payment rates for community care be reasonable and adequate to meet the costs of providing such care efficiently, economically, and in accordance with applicable laws, regulations, and standards. Prohibits the coverage of substandard community care, penalties imposed for such care, and community care furnished by family members.

Rape and Incest Victims' Choice Resolution - Expresses the sense of the House of Representatives that Federal Medicaid (title XIX of the Social Security Act) funding should be available for the abortion of pregnancies resulting from rape or incest if such acts, considering the physical and mental state of the women involved, are reported promptly.

Department of Environmental Protection Act - Title I: Establishment of Department of Environmental Protection - Redesignates the Environmental Protection Agency as the Department of Environmental Protection, an executive department to be administered by a Secretary of Environmental Protection. Establishes within the Department: (1) an Office of International Environmental Affairs; (2) an Office of Enforcement; and (3) a Center for Environmental Statistics (Center). Encourages the Secretary to assist the Secretary of State in negotiating and administering international environmental protection agreements and participating in the work of international environmental protection organizations. Encourages the Secretary to continue the Department's role in conducting international environmental research and providing technical assistance to other nations to improve environmental quality. Requires the Secretary to establish an Advisory Committee on Environmental Statistics to advise the Center and the Congress on the collection and dissemination of statistical data. Directs the Secretary to maintain a comprehensive guide to the Department's environmental and public health information services. Requires the Secretary to establish an Advisory Committee on Public Access to provide recommendations on improving public access to departmental information. Directs the Secretary to: (1) study the use of computer telecommunications and other means to provide for access to such information; and (2) permit the reduction or waiver of user fees for such access. Title II: Commission on Environmental Administration - Establishes the Commission on Environmental Administration to analyze and make recommendations on specified reorganization and management issues in the Department. Authorizes appropriations.

Amends the Energy Policy and Conservation Act to require the Secretary of Energy to establish a Regional Petroleum Products Reserve for Federal Energy Administration Region 1. Directs the Secretary to accumulate residential heating petroleum products at Reserve facilities in case of severe price increases or disruptions of petroleum imports. Requires the Secretary to develop and promulgate a separate distribution plan for this Regional Petroleum Products Reserve. Requires (current law permits) the Secretary to: (1) establish an Industrial Petroleum Reserve as part of the Strategic Petroleum Reserve; and (2) require petroleum product importers and refiners to maintain readily available inventories in amounts determined by the Secretary.

Expedited Consideration of Proposed Rescissions Act of 1990 - Amends the Congressional Budget and Impoundment Control Act of 1974 to require a special message, in the case of budget authority proposed to be rescinded or reserved, to include language amending the law authorizing such programs to allow them to continue to function at the proposed new level of budget authority. Allows the President to transmit to both Houses of the Congress, for expedited consideration, one or more special messages proposing to rescind all or part of any item of budget authority provided in an appropriation bill. Requires that such special message be transmitted not later than three days after the President approves the appropriation bill and be accompanied by a draft bill or joint resolution that would, if enacted, rescind the budget authority proposed to be rescinded. Sets forth House and Senate procedures for the expedited consideration of such a proposal.

Freedom of Choice Act of 1989 - Provides that a State may not restrict the right of a woman to choose to terminate a pregnancy: (1) before fetal viability; or (2) at any time, if such termination is necessary to protect the life or health of the woman. Allows a State to impose requirements medically necessary to protect the life or health of such women.

Area Health Education Centers Enhancement Act of 1989 - Directs the Secretary of Health and Human Services to conduct a study concerning the area health education center program, including the clinical clerkship program, continuing education in rural areas, and recruitment and retention efforts relating to medically underserved areas. Authorizes appropriations. Amends the Public Health Service Act to authorize the Secretary to extend the contract of a health education and training center for not more than a six-year period if it is designated by the Secretary as disadvantaged due to factors beyond the control of the center. Increases the authorization of appropriations for area health education centers for FY 1991.

Rural Physician Shortage Act of 1989 - Directs the Secretary of Health and Human Services to conduct a study of health manpower, including the distribution of physicians through the United States. Amends the Public Health Service Act to direct the Secretary to establish a pilot program to conduct National Health Service Corps recruitment seminars. Prohibits the Secretary from requiring that areas designated as health manpower shortage areas before enactment of this Act demonstrate a need for at least one additional full-time equivalent practitioner in order to continue to be so designated. Directs the Secretary to: (1) project Corps field strength necessary to ensure adequate physician manpower in shortage areas until the year 2019; and (2) establish a plan for maintaining such strength. Adds physicians' assistants programs to the list of degree programs eligible for Corps scholarships and loan repayments.

International Narcotics Control Act of 1989 - Expresses the sense of the Congress that: (1) it is crucial to international antidrug efforts that funds be made available to provide alternative sources of income for individuals in major coca producing countries who are dependent on illicit drug production, as well as for eradication, enforcement, rehabilitation, treatment, and education programs in such countries; and (2) the United States and other major donor countries should provide increased economic assistance to major coca producing countries which have taken steps to attack illicit coca production by methods which reduce the flow of cocaine to the world market. Urges the Director of National Drug Policy to develop and submit to the Congress a plan which addresses such needs. Authorizes the President to make funds for foreign military financing under the Arms Export Control Act and international military education and training under the Foreign Assistance Act of 1961 available to provide defense articles and services and international military education and training to Bolivia, Colombia, and Peru. Earmarks specified amounts of such assistance for narcotics law enforcement training and interdiction activities and procurement of defense articles by enforcement agencies in such countries. Makes such countries eligible only if they maintain democratic governments and their law enforcement agencies do not engage in human rights violations. Requires the President to report to specified congressional committees prior to obligating such funds. Provides for human rights reporting on such countries. Authorizes appropriations. Amends the International Narcotics Control Act of 1988 to earmark specified amounts of international military education and training assistance and anti-narcotics military assistance for FY 1990 for eligible countries in Latin America and the Caribbean. Waives provisions of the Arms Export Control Act concerning foreign military financing with respect to financing for narcotics control activities. Prohibits the provision of such assistance to Bolivia, Colombia, and Peru. Amends the Arms Export Control Act to require the Special Defense Acquisition Fund to be used to acquire defense articles for narcotics control purposes. Amends the Foreign Assistance Act of 1961 to authorize the President to transfer excess defense articles to any country: (1) which is a major illicit drug producing country in Latin America and the Caribbean with a democratic government; and (2) whose armed forces do not engage in human rights violations. Requires such countries to ensure that such articles will be used only in support of anti-narcotics activities. Limits the aggregate value of articles to be transferred to a country in any fiscal year. Permits such transfers only if: (1) the articles are drawn from existing Department of Defense (DOD) stocks; (2) funds available to DOD for the procurement of defense equipment are not expended in connection with such transfers; and (3) the President determines that such transfers will not have an adverse impact on the military readiness of the United States. Permits such transfers without cost to the recipient country. Requires the President to notify specified congressional committees prior to transferring such articles. Waives certain prohibitions on the provision of assistance to countries in default on loan payments to the United States with respect to narcotics-related assistance for FY 1990 for major illicit drug producing countries. Earmarks specified amounts of grant military assistance and foreign military financing for FY 1990 for arming aircraft used in narcotics control eradication or interdiction efforts. Prohibits such funds from being used to purchase new aircraft. Requires the notification of the House Foreign Affairs Committee and the Senate Foreign Relations Committee prior to the use of such funds. Earmarks a specified amount of international narcotics control assistance for FY 1990 for the testing and use of herbicides for the aerial eradication of coca. Limits the amount of FY 1990 international narcotics control assistance to be made available for Mexico. Permits excess assistance to Mexico only if specified congressional committees are notified. Waives a prohibition on assistance to drug traffickers with respect to FY 1990 assistance to major drug transit countries if the President certifies that: (1) certain provisions of the Foreign Assistance Act of 1961 with regard to money laundering do not apply to such a country; (2) such country was previously a major illicit drug producing country but has effectively eliminated drug production during the preceding two years; and (3) such country is cooperating fully with the United States or has taken certain steps with respect to narcotics control. Expresses the sense of the Congress that U.S. trade policy should be coordinated with U.S. narcotics control objectives, particularly with respect to the International Coffee Agreement. Commends the President for reviewing, and urges him to continue to review whether: (1) the International Coffee Agreement negotiations should be resumed; and (2) the trade benefits provided in the Caribbean Basin Economic Recovery Act should be extended to the major coca producing countries of Latin America. Requires the President to report to the Congress on such review. Urges the President to: (1) place debt relief and drug control efforts in Latin American countries among the highest of foreign policy priorities; and (2) ensure that the Director of National Drug Control Policy, the Secretary of State, and the Secretary of the Treasury have leading roles in addressing these problems. Urges the President to consult with Latin American countries to arrange a hemispheric summit to discuss specific illicit drug and debt issues. Expresses the sense of the Congress that: (1) the proposal for the promotion of a multilateral anti-narcotics force for the Western Hemisphere should be endorsed; and (2) the United States should work through multilateral organizations to determine the feasibility, and assist in the establishment, of such force. Urges the President to: (1) seek agreement by relevant foreign countries, especially NATO countries and members of the Warsaw Pact, to join with the United States in halting weapons transfers to narcotics traffickers in Latin America; and (2) improve the coordination of U.S. efforts to track the flow of such weapons to international narcotics traffickers and to prevent illegal shipments from the United States. Calls upon the President to direct the U.S. representative to INTERPOL to urge such organization to study the feasibility of establishing an international database on the flow of the types of weapons acquired illegally by international narcotics traffickers. Requires the President to report to the Congress on such actions. Amends the State Department Basic Authorities Act of 1956 to raise the limit on the amount of rewards for information concerning international terrorism. Makes technical amendments to provisions of the Foreign Assistance Act of 1961 concerning international narcotics control. Incorporates related provisions of the Anti-Drug Abuse Act of 1988 and the International Narcotics Control Act of 1986 into such Act. Authorizes appropriations for FY 1990 for international narcotics control assistance. Requires countries receiving such assistance to bear an appropriate share of the costs for any activity for which assistance is provided. Exempts assistance for narcotics control crop substitution activities from a prohibition on the use of funds to support the production of any agricultural commodity in a foreign country which would compete with a similar U.S. commodity. Authorizes the President to release Bolivia, Colombia, or Peru from obligations to make payments to the United States if such country is participating in a program for the use of herbicides for the aerial eradication of coca. Directs the President to report annually to the Speaker of the House and the Senate Foreign Relations Committee on international narcotics control activities. Makes technical amendments to, and repeals specified provisions of, the International Narcotics Control Act of 1988, the International Narcotics Control Act of 1986, and the Narcotics Control Trade Act.

Older Americans Long-Term Care Insurance Act of 1989 - Title I: Tax Provisions Related to Long-Term Care Insurance - Amends the Internal Revenue Code to require that, for the purpose of determining the income tax liability of issuers of qualified long-term insurance, the contracts be treated as accident or health insurance. Applies this provision to policies covering at least 12 consecutive months of necessary diagnostic, preventive, therapeutic, rehabilitative, or personal care services that are provided in a setting other than an acute care unit of a hospital. Requires policies issued after 1989 to be reinsured by the Federal National Long-Term Care Reinsurance Corporation, if the Corporation is incorporated when the policy is issued. Directs the Secretary of Health and Human Services to: (1) submit to the Congress before 1991 a study on long-term insurance policies; and (2) report annually to the Congress regarding the certification of qualified long-term care insurance. Treats qualified long-term care insurance as accident or health insurance and its benefits as benefits for personal injuries or sickness for purposes of determining appropriate tax exclusions for employer contributions or employee benefits. Excludes from gross income: (1) distributions or payments from individual retirement plans that are used during the year to pay the premiums for qualified long-term care coverage of individuals aged 59 1/2 or older; and (2) amounts received upon surrender, cancellation, or exchange of a life insurance contract and used during the year to pay the premiums for qualified long-term care insurance. Title II: Federal National Long-Term Care Reinsurance Corporation - Federal National Long-Term Care Reinsurance Corporation Act - Authorizes the Secretary to provide for the incorporation of the Federal National Long-Term Care Reinsurance Corporation (not an agency or establishment of the U.S. Government). Requires the Corporation to confine its activities to reinsuring insurance companies for extraordinary loss in the issuance or payment of qualified long-term care insurance benefits. Directs the Corporation to report annually to the President and to the Congress regarding its activities.

Rural Assistance and Revitalization Act of 1989 - Title I: Rural Business and Job Creation - Subtitle A: Rural Partnerships Investment Board - Establishes a Rural Partnerships Investment Board to provide lines of credit to enable eligible entities to develop rural business development revolving funds. Establishes in the Treasury a Rural Business Investment Fund. Subtitle B: Rural Capital Access Program - Directs the Secretary of Agriculture to establish a rural capital access program to encourage lending institutions to provide rural business loans. Subtitle C: Rural Economic Development Administered by the Secretary and the Rural Electrification Administration - Amends the Rural Electrification Act of 1936 to establish a position of Assistant Administrator for Economic Development in the Rural Electrification Administration (REA). Establishes within REA a technical assistance unit to advise borrowers with regard to economic and community development activities. Provides for deferred payment on economic development loans. Amends the Consolidated Farm and Rural Development Act to authorize water and waste facility loans for certain REA borrowers. Amends the Rural Electrification Act of 1936 to establish in the Treasury a Rural Business Incubator Fund to fund REA borrowers in order to create or operate rural business incubators. Title II: Administration - Renames the Department of Agriculture and the Secretary of Agriculture the Department of Agriculture and Rural Development (Department) and the Secretary of Agriculture and Rural Development, respectively. Establishes in the Department the Rural Electrification and Development Administration (Administration) to be headed by an Assistant Secretary for Electrification and Rural Development. Transfers to the Administration: (1) the REA; (2) the community facilities, water and waste disposal, and business and industry loan programs administered by the Farmers Home Administration; and (3) other development programs as the Secretary may assign to the Administration. Establishes in the Rural Development Administration (sic) an Office of Rural Policy. Title III: Information - Directs the Census Bureau to expand its data collection efforts with regard to changing rural economic conditions. Amends the Rural Development Act of 1972 to establish a rural development research grant program. Directs the Secretary to establish: (1) a National Center for Cooperative Research, Education, Training, and Development; and (2) similar regional centers. Title IV: Human Capacity - Amends the Rural Development Act of 1972 to direct the Secretary to establish an Extension Service rural economic and business development program. Amends the Farm Credit Act of 1971 to authorize Farm Credit System (System) institutions to provide technical assistance to rural communities. Amends the Consolidated Farm and Rural Development Act to increase the authorization of appropriations for technical assistance. Title V: Rural Infrastructure - Amends the Consolidated Farm and Rural Development Act to: (1) establish local income-based loan rates for health care and related facilities; (2) increase the ceiling for water and waste facility grants; and (3) establish an emergency community water assistance grant program. Title VI: Provisions Relating to Institutions of the Farm Credit System - Amends the Farm Credit Act of 1971 to authorize System institutions to participate in specified agricultural real estate and operating loan guarantee programs. Increases the scope of System institution credit. Title VII: Regulations - Requires final implementing regulations to be issued within six months of enactment of this Act.

Small Business Access Improvement Act of 1989 - Amends the Internal Revenue Code to allow a tax credit for small businesses for the expense of providing public accommodations access to the disabled. Reduces the tax deduction for expenditures to remove architectural and transportation barriers to the handicapped and elderly.

Declares it is in the interests of the United States to support efforts to protect South Pacific marine resources (including albacore tuna, porpoises, whales, seals and other marine mammals, birds, sea turtles, and fish) from the slaughter of driftnet fishing. Supports the Tarawa Declaration and the South Pacific Commission resolution calling for an immediate ban on driftnet fishing in the South Pacific. Urges the Secretary of State to work toward an international convention banning driftnet fishing in the South Pacific. Urges Japan and Taiwan to immediately cease the use of driftnets in international South Pacific waters.

Forest Stewardship Assistance Act of 1989 - Amends the Cooperative Forestry Assistance Act of 1978 to authorize the Secretary of Agriculture to establish a Forest Stewardship Assistance Program to encourage the long-term stewardship of nonindustrial private forest lands by assisting owners to manage their forest and related resources. Authorizes FY 1990 through 1994 appropriations.

Billboard Control Act of 1989 - Revises Federal provisions with respect to restrictions on outdoor advertising adjacent to interstate and Federal-aid primary highways. Specifies that a State shall be treated as failing to provide effective control of the erection and maintenance of outdoor advertising signs, displays, and devices (signs): (1) unless the State submits to the Secretary of Transportation by December 1st of each year an inventory of conforming and non-conforming signs in such State; and (2) if the State allows vegetation located on any land on which the State owns a right-of-way for a highway to be cut to improve the visibility of such signs. Requires the Secretary to submit to the Congress a detailed annual report on the extent to which each State has complied with the requirements of this Act, including a compilation of inventories and a description of the Secretary's efforts to assure that necessary directional information about facilities providing goods and services of interest to the traveling public is available to motorists. Makes exceptions to restrictions under this Act for signs which are lawfully in existence on September 1, 1989, and those located in industrial or commercial areas.
