Health Care Fraud Enforcement Act of 2009

Health Care Fraud Enforcement Act of 2009 - Directs the United States Sentencing Commission to review and amend guidelines and policy statements relating to health care fraud to increase the sentences for such crimes based upon the dollar amount of fraud involved. Expands the definition of "health care fraud" to include anti-fraud provisions of the Social Security Act relating to kickbacks, bribes, or rebates, the Food, Drug and Cosmetic Act, and the Employee Retirement Income Security Act of 1974 (ERISA). Makes a health care fraud violation under such statutes a false or fraudulent claim for purposes of the False Claims Act. Amends the federal criminal code to allow a conviction for health care fraud without actual knowledge of a fraud prohibition or a specific intent to commit a health care fraud violation. Amends the Civil Rights of Institutionalized Persons Act to expand the power of the Attorney General to issue subpoenas for records under such Act. Authorizes additional appropriations to the Department of Justice (DOJ) for FY2011-FY2016 for investigations and prosecutions relating to fraud and abuse in connection with any health care benefit program.

Trade Enforcement Priorities Act - Amends the Trade Act of 1974 to revise requirements for identification of trade enforcement priorities by the United States Trade Representative (USTR). Requires the USTR, in identifying priority foreign country trade practices, to concentrate on U.S. trading partners: (1) that represent the largest trade deficit in dollar value with the United States, excluding petroleum and petroleum products; (2) whose practices have the most negative impact on maintaining and creating U.S. jobs, wages, and productive capacity; and (3) whose practices limit market access for U.S. goods and service. Requires the USTR to consult with specified congressional committees on the priorities, actions, assessments, and practices required to be identified in the report. Requires the USTR, with respect to a priority trade practice of a World Trade Organization (WTO) foreign country, or a foreign country with which the United States has a bilateral or regional trade agreement in effect, to initiate: (1) dispute settlement consultations in the WTO; (2) dispute settlement consultations under the bilateral or regional trade agreement; (3) negotiations that seek an agreement for the elimination of the priority foreign country trade practice or, if elimination is not feasible, an agreement that provides for compensatory trade benefits; or (4) any other action to eliminate the priority foreign country trade practice. Prescribes certain actions with respect to the priority foreign country trade practices of other countries.

Fair Sentencing Act of 2010

Fair Sentencing Act of 2009 - Amends the Controlled Substances Act and the Controlled Substances Import and Export Act to: (1) increase the amount of a controlled substance or mixture containing a cocaine base (i.e., crack cocaine) required for the imposition of mandatory minimum prison terms for crack cocaine trafficking to eliminate the sentencing disparity between crack and powder cocaine; (2) increase monetary penalties for drug trafficking and for the importation and exportation of controlled substances. Eliminates the five-year mandatory minimum prison term for first-time possession of crack cocaine. Directs the U.S. Sentencing Commission to review and amend, if appropriate, its sentencing guidelines for trafficking in a controlled substance to reflect the use of a dangerous weapon or violence in such crime and the culpability and the role of the defendant in such crime, taking into account certain aggravating and mitigating factors. Directs the Comptroller General to report on the effectiveness of drug court programs funded by the Department of Justice (DOJ) Office of Justice Programs.
