FCC Reauthorization Act of 2016 This bill reauthorizes the Federal Communications Commission (FCC) for FY2017-FY2018. It designates amounts for the FCC to move to a new facility or reconfigure its existing facility. A cap is placed on the amount of proceeds from the FCC's spectrum license competitive bidding system that the FCC may retain for the development and implementation of such system instead of being deposited in the Treasury. The bill allows a person chosen to fill a commissioner's vacancy on the FCC to continue to serve after the expiration of the fixed term of the commissioner that the person succeeds until a successor has taken office. But the person filling the vacancy may not continue to serve after the session of Congress that begins after the expiration of the fixed term of the commissioner that the person succeeds. The FCC must submit concurrently to Congress a copy of any budget estimates, requests, or legislative recommendations that it submits to the President or the Office of Management and Budget. No U.S. officer or agency may require the FCC to obtain that officer's or agency's approval before the FCC submits legislative recommendations to Congress. The Government Accountability Office must recommend adjustments to the FCC's regulatory fee structure. The Universal Service Antideficiency Temporary Suspension Act is amended to extend through FY2018 provisions rendering the Antideficiency Act inapplicable to: (1) amounts collected or received as universal service contributions, or (2) expenditures or obligations of such contributions. Any deposits that the FCC may require for the qualification of bidders in a system of competitive bidding for spectrum licenses must be deposited directly in the Treasury instead of in an interest bearing account at a financial institution. The bill removes a provision that requires the interest accrued to such a financial institution account to be dedicated for the sole purpose of deficit reduction. The deposits of successful bidders must be credited to the deposit fund of the Treasury, unless existing exceptions apply. The FCC is prohibited from changing its regulations for universal service support payments to implement the February 27, 2004, recommendations of the Federal-State Joint Board on Universal Service regarding single connection or primary line restrictions on universal service support payments.

Making Opportunities for Broadband Investment and Limiting Excessive and Needless Obstacles to Wireless Act or the MOBILE NOW Act This bill requires the National Telecommunications and Information Administration (NTIA) and the Federal Communications Commission (FCC), by December 31, 2020, to make available at least 255 megahertz of federal and nonfederal spectrum below the frequency of 6000 megahertz for mobile and fixed wireless broadband use. The spectrum must be made available on a licensed or unlicensed basis for shared use by nonfederal and federal users to enable the deployment of wireless broadband services. The NTIA must assess the feasibility of authorizing mobile or fixed terrestrial wireless operations, including for advanced mobile service operations, on federal entities and operations in specified bands between 24250 and 86000 megahertz. The FCC must then publish a notice of proposed rulemaking within two years after enactment of this Act to consider service rules authorizing such operations. The Department of Commerce and the FCC must submit reports evaluating the feasibility of allowing commercial wireless services to share use of specified frequencies between 3100 and 4200 megahertz. The FCC must include in its proposals for the assignment of new licenses for nonfederal use under Spectrum Pipeline Act of 2015 any spectrum within those frequencies identified as most suitable for sharing with commercial wireless services if the frequencies are suitable for allocation by competitive bidding. Before 2017, the FCC must take action in its Program Alternatives for Small Wireless Communications Facility Deployments proceeding. The Middle Class Tax Relief and Job Creation Act of 2012 is amended to require executive agencies, within a reasonable period of time, to grant or deny applications for easements or rights-of-way to, in, over, or on federal property to install, construct, modify, or maintain a communications facility installation. Executive agencies must: (1) notify applicants of the reasons for denials, (2) explain delays if a decision is not made within 150 days after receiving an application, and (3) designate an agency point of contact for applicants. The bill expands the categories of infrastructure, antennas, wiring, and wireless transmission equipment for which applicants may seek such easements or rights-of-way. The bill expresses the sense of Congress that federal agencies should: (1) include conduit installation in federally funded highway construction projects, and (2) ensure that communications providers may access such conduit on a nondiscriminatory basis. The Office of Science and Technology Policy (OSTP) must establish a single database of real property owned, leased, or managed by executive agencies that is capable of supporting a communications facility installation. The OSTP must make the database available to: (1) entities that construct or operate communications facility installations or provide communications service, and (2) state and local governments so that they may provide information regarding state and local properties to include in the database. Commerce must submit recommendations to incentivize federal entities to relinquish, or share with federal or nonfederal users, federal spectrum for commercial wireless broadband services. The Office of Management and Budget may provide pre-auction funding to federal agencies for auctions intended to occur within eight years (currently, five years) after the transfer of funds. Federal entities may request an immediate transfer of funds to pay for relocation or sharing costs after the frequencies are reallocated by competitive bidding.

(DME includes certain medically necessary equipment such as walkers, wheelchairs, and hospital beds.) With respect to DME furnished in areas that are not competitive acquisition areas, current regulations require the Centers for Medicare & Medicaid (CMS) to phase in, over a two-year period, Medicare payment adjustments using information from competitive acquisition programs. (Through such programs, payment amounts for each area are determined based on competitive bids submitted by suppliers, rather than according to an established fee schedule.) The bill codifies this requirement and specifies that CMS shall adjust fee schedule amounts to the lesser of: (1) a specified percentage of the regional amount; and (2) the amount that would otherwise be determined according to the fee schedule, with specified adjustments. In determining Medicare payment adjustments for areas that are not competitive acquisition areas, CMS shall solicit stakeholder input and take into account several specified factors. CMS may not establish a ceiling on competitive bids submitted for DME that is less than the amount that would otherwise be paid under Medicare. Small Public Housing Agency Opportunity Act of 2015 This bill amends the United States Housing Act of 1937 to subject a small public housing agency (PHA) to the same requirements as a PHA. A small PHA is a PHA for which the sum of the number of public housing dwelling units and the number of vouchers under Section 8 (tenant-based assistance) it administers is 550 or fewer. The Department of Housing and Urban Development (HUD) shall: carry out physical inspections of a small PHA public housing project at least once every three years, unless it is a troubled small PHA; determine the financial condition of a small PHA public housing program solely on the basis of the ratio of current assets to current liabilities; and determine management condition of a small PHA public housing program solely on the basis of the ratio of vacant unit months to eligible unit months. A small PHA administering Section 8 tenant-based assistance under the housing voucher program must make physical inspections of assisted units at least once every three years. HUD shall evaluate the management of a small PHA's voucher program solely on the basis of its lease-up rate or the budget utilization rate, which must be at least 90% to be acceptable. HUD shall designate a small PHA as a high-performing agency if it exceeds acceptability criteria. HUD may designate a small PHA as a troubled small PHA with respect to its public housing program or housing voucher program only if it meets certain negative criteria. HUD shall establish an appeals process for a small PHA to dispute a determination of deficiency. HUD and a troubled small PHA shall enter into a one-year corrective action agreement (renewable at HUD option) under which the small PHA must undertake actions to correct deficiencies. The bill prescribes and/or revises requirements to reduce the administrative burden on small PHAs with respect to: certain reports; community service; economic opportunities for low- and very low-income persons; exemption of a small PHA administering not more than 400 public housing dwelling units, upon request, from any asset management requirement; exemption from environmental review for a development or modernization project with a total cost of not more than $100,000; and streamlined HUD procedures for such reviews. HUD shall carry out a demonstration project to examine how various methods of determining rent in public housing affect the administrative burden on small PHAs and public housing residents. The bill establishes rent-setting mechanisms for demonstration project participants based on: (1) a tiered system for initial rents for extremely low-income families, very low-income families, and low-income families; (2) a certain range of gross income percentages; or (3) the existing method for establishing rents. A small PHA may elect to be paid for its utility and waste management costs under a HUD assistance formula for a period, at its discretion, of up to 20 years based on its average annual consumption during the three-year period preceding the year in which the election is made. HUD shall develop and deploy all electronic information systems necessary to accommodate full consolidated reporting by PHAs electing to operate in consortia.
