Demands that Hamas: (1) immediately and unconditionally release Israeli soldier Gilad Shalit; (2) allow prompt access to Gilad Shalit by competent medical personnel and representatives of the International Committee of the Red Cross; (3) facilitate regular communication by Gilad Shalit with his family and allow his family to know where he is being held; and (4) cease compelling Gilad Shalit to appear in video and voice recordings intended to coerce the government of Israel. Expresses: (1) commitment to the survival of Israel as a Jewish and democratic state within recognized and secure borders; (2) support in resolving the Israeli-Palestinian conflict through the creation of a democratic, viable, and independent Palestinian state living in peace alongside Israel; (3) sympathy for Gilad Shalit's family and the families of other missing Israeli soldiers; and (4) commitment to seek the release of Gilad Shalit and other missing Israeli soldiers. Recalls: (1) the attack on and kidnapping of the bodies of Ehud Goldwasser and Eldad Regev by the Iran-supported terrorist group Hezbollah; and (2) the missing Israeli soldiers Zecharya Baumel, Zvi Feldman, Yehuda Katz, Ron Arad, Guy Hever, and Majdy Halabi. Condemns: (1) Hamas for the illegal and immoral cross border attack and kidnapping of Gilad Shalit; and (2) Iran and Syria, the primary state sponsors and patrons of Hamas, for their ongoing support for international terrorism.

Medicare Lung Cancer Early Detection Promotion Act of 2010 - Amends title XVIII (Medicare) of the Social Security Act, as amended by the Patient Protection and Affordable Care Act (PPACA), to direct the Secretary of Health and Human Services (HHS) to establish payment for x-ray chest radiography services that use Computer-Aided Detection Technology for the early detection of lung cancer.

Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to provide that reasonable service charges applicable to federal entities for water pollution include the same reasonable fees or assessments for stormwater management applicable to any nongovernmental entity. Provides that such a fee or assessment shall not be considered to be a tax or other levy subject to an assertion of sovereign immunity and may be paid using appropriated funds.

United States Nuclear Fuel Management Corporation Establishment Act of 2010 - Amends the Atomic Energy Act of 1954 to establish the United States Nuclear Fuel Management Corporation. Authorizes the Corporation to: (1) implement integrated spent nuclear fuel management consistent with federal policy on a self-sustaining basis through the use of a spent nuclear fuel management enterprise that will eliminate the need for federal funding; and (2) assume responsibility for the activities, obligations, and use of resources of the federal government with respect to spent nuclear fuel management. Establishes in the Treasury the United States Nuclear Fuel Management Corporation Fund. Directs the President to appoint a Transition Manager to transfer spent nuclear fuel management obligations, functions, personnel, and funds from the Secretary of Energy to the Corporation. Designates the Corporation the exclusive marketing agent on behalf of the United States for entering into contracts to provide spent nuclear fuel management and related products and services.

Harbor Maintenance Act of 2010 - Requires the total budget resources for expenditures from the Harbor Maintenance Trust Fund for harbor maintenance programs to equal the level of receipts plus interest credited to such Fund for that fiscal year. Limits the use of such resources to such programs only. Declares that it shall be out of order in the House of Representatives or the Senate to consider any bill, joint resolution, amendment, motion, or conference report that would cause total budget resources for the Fund in a fiscal year for harbor maintenance programs to be less than the level of receipts plus interest credited to the Fund for that fiscal year.

Recognizes the ultimate sacrifice made by the 29 coal miners lost at the Upper Big Branch Mine-South in Raleigh County, West Virginia. Extends the deepest condolences of the Senate to the families of the fallen coal miners. Honors the survivors of the tragedy. Recognizes all coal miners for enduring the immeasurable loss of co-workers and maintaining courage in the aftermath of the explosion at the Upper Big Branch Mine-South. Commends the valiant efforts of the emergency response workers searching for the missing coal miners. Honors the many volunteers who provided support and comfort for the missing coal miners' families during the rescue and recovery operations.

Pre-Election Presidential Transition Act of 2010 - Amends the Presidential Transition Act of 1963 to direct the Administrator of the General Services Administration (GSA) to provide certain presidential transition services and facilities, including office space, equipment, and payment of certain related expenses, to eligible presidential and vice-presidential candidates before a presidential general election. Directs the President, or the President's delegate, to take necessary and appropriate actions to plan and coordinate activities by the executive branch of the federal government to facilitate an efficient transfer of power to a successor President.

Open EAJA Act of 2010 - Directs the Attorney General to issue an annual online report to Congress and the public on the amount of attorney fees and other expenses awarded during the preceding fiscal year pursuant to the law commonly known as the Equal Access to Justice Act (EAJA). Directs the Comptroller General to commence an audit of the Equal Access to Justice Act for 1995 through the end of the calendar year in which this Act is enacted, and report to Congress on the audit results.

Great Lakes Ecosystem Protection Act of 2010 - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to expand the duties of the Great Lakes Program Office by requiring the Office to: (1) provide support for Great Lakes governance and management; and (2) coordinate with the Great Lakes Interagency Task Force. Establishes: (1) the Great Lakes Leadership Council to establish policy, goals, and priorities with respect to Great Lakes protection and restoration, determine a process for participating in international forums, and provide annual input regarding federal budget priorities and levels for Great Lakes protection and restoration; (2) the Great Lakes Management Committee within the Council to report to and provide direction for the Council, monitor and assist implementation activities relating to Great Lakes management, and engage in problem solving regarding Great Lakes management; and (3) the Great Lakes Interagency Task Force. Requires the Administrator of the Environmental Protection Agency (EPA) to report annually to Congress on budgets and restoration activities relating to EPA's organizational elements involved in Great Lakes activities and EPA's reasons for approving or disapproving the Council's recommendations. Authorizes appropriations for: (1) remediation of sediment contamination in areas of concern in the Great Lakes; and (2) the Great Lakes Program. Requires EPA, in coordination with federal partners, to implement a Great Lakes Restoration Initiative which will: (1) identify and support programs to target the most significant environmental problems in the Great Lakes ecosystem; (2) be based on the work of the Task Force and the Council's stakeholders and nongovernmental partners; and (3) represent the government's commitment to significantly advance Great Lakes protection and restoration. Prohibits funding made available to implement the Initiative from being used for water infrastructure activity that is implemented using funds made available under the clean water or drinking water state revolving fund program. Requires federal agencies to: (1) maintain the base level of funding for their Great Lakes activities; and (2) identify new activities to support the environmental goals of the Initiative.

Tax Code Termination Act - Terminates the Internal Revenue Code of 1986 for taxable years beginning after 2013, except provisions of such Code relating to social security taxation (i.e., taxes on wage, self-employment, and railroad retirement income). Establishes within the legislative branch a National Commission on Tax Reform and Simplification. Directs the Commission to: (1) review the Internal Revenue Code of 1986 and its impact on the economy, families, and the workforce: (2) determine whether the current income tax system should be replaced with a flat tax, a national sales tax, or another system, or can be simplified; and (3) submit a report to Congress on the results of its review, with recommendations for fundamental reform and simplification of the Code. Requires congressional approval of a new federal tax system no later than July 4, 2013, or a vote of Congress to reauthorize the Internal Revenue Code of 1986.

Iran Democratic Transition Act of 2010 - Authorizes the President to support a transition to a freely elected democratic government in Iran by providing eligible Iranian democratic opposition organizations with assistance for the communication and dissemination of accurate and independent information to the Iranian people through various media. Urges the President to fully utilize specified existing authorities and funding to: (1) support democracy in Iran through assistance for pro-democracy broadcasting into Iran and the dissemination of accurate and independent information to the Iranian people through various media; and (2) provide humanitarian assistance to individuals or groups determined by the President to be victims of repression by the government of the Islamic Republic of Iran. Prohibits assistance to any organization or individual that has: (1) engaged in military cooperation with the government of the Islamic Republic of Iran; or (2) engaged in or supported terrorism. Authorizes the President to appoint a Special Envoy for Democracy and Human Rights in Iran whose primary responsibility shall be to manage U.S. policy on the promotion of democracy and human rights in Iran. Expresses the sense of Congress that: (1) the U.S. government should explore the possibility of a regional human rights dialogue on Iran that is modeled on the Helsinki process; and (2) if the Iranian people restore democratic rule to Iran the United States should provide humanitarian and democratic transition assistance to the Iranian people and to democratic parties and movements.

Continuing Chemical Facilities Antiterrorism Security Act of 2010 - Amends the Department of Homeland Security Appropriations Act, 2007 to extend until October 4, 2015, the authority of the Secretary of Homeland Security (DHS) to issue interim final regulations establishing risk-based performance standards for security of chemical facilities and requiring vulnerability assessments and the development and implementation of site security plans for such facilities. Requires the Secretary, acting through the Administrator of the Federal Emergency Management Agency (FEMA) and in coordination with the Under Secretary for National Protection and Programs, to: (1) establish a voluntary chemical security training program to enhance the capabilities of high-risk chemical facilities to prevent, prepare for, respond to, mitigate against, and recover from acts of terrorism, natural disasters, and other man-made disasters; and (2) develop a voluntary chemical security exercise program to offer voluntary testing and evaluation of the capabilities of the federal government, state governments, commercial personnel and management, emergency response providers, and the private sector to prevent, prepare for, mitigate against, respond to, and recover from acts of terrorism, natural disasters, and other emergencies at chemical facilities.

Colonel Charles Young Home Study Act - Directs the Secretary of the Interior to conduct a special resource study of the Colonel Charles Young Home, a National Historic Landmark in Xenia, Ohio, to determine the suitability and feasibility of designating the Home as a unit of the National Park System. (Colonel Charles Young was a distinguished African-American officer in the U.S. Army, a pioneer of techniques in military intelligence, as well as a commander of troops in combat in the Spanish-American War and the Mexican expedition against Pancho Villa.)

Federal Acquisition Institute Improvement Act of 2009 - Requires: (1) the Director of the Office of Management and Budget (OMB) and the Administrator of General Services (GSA) to provide the Federal Acquisition Institute (FAI) sufficient budget resources and authority to support government-wide training standards and certification requirements necessary to enhance the mobility and career opportunities of the federal acquisition workforce; and (2) all federal civilian agency acquisition internship or acquisition training programs to follow guidelines provided by the Office of Federal Procurement Policy to ensure consistent training standards necessary to develop uniform core competencies throughout the federal government. Requires FAI to: (1) report through its Board of Directors to the Administrator for Federal Procurement Policy; and (2) provide and update government-wide training standards and certification requirements. Requires the Director of FAI to be appointed by the Administrator and to report directly to the Associate Administrator for Acquisition Workforce. Directs the Administrator to submit to specified congressional committees an annual report on the projected budget needs and expense plans of FAI to fulfill its mandate.

Special Agent Samuel Hicks Families of Fallen Heroes Act - Authorizes the head of the concerned agency to pay the moving, transportation, and relocation expenses attributable to a change of residence within the United States of the immediate family of covered employees, including any federal law enforcement officer, Federal Bureau of Investigation (FBI) employee, or customs and border protection officer, who dies in the performance of official duties, as well as expenses of preparing and transporting the remains of the deceased to the place where the family will reside following the employee's death (or another appropriate place for interment).

Authorizes appropriations for the National Historical Publications and Records Commission for FY2010-FY2014. Amends the Independent Agencies Appropriations Act, 2000 with respect to the Federal National and Regional Records Center Revolving Fund. Authorizes the Archivist of the United States to determine and (as under current law) retain an amount of the Fund's total income as an operating reserve or for the replacement or acquisition of capital equipment and other support systems of the National Archives and Records Administration. (Currently the amount retained for these purposes may not exceed 4%.) Repeals the 4% limitation on the excess of amounts remaining in the Fund at the close of each fiscal year that must be returned to the Treasury as miscellaneous receipts. Requires return to the Treasury as miscellaneous receipts, instead, any unobligated and unexpended balances in the Fund that the Archivist determines to be in excess of those needed for capital equipment or a reasonable operating reserve. Amends the Presidential Historical Records Preservation Act of 2008 to shift from the Commission to the Archivist the authority to make grants for establishment of state and local databases for records of servitude, emancipation, and post-civil war reconstruction. Requires the Archivist to consider Commission advice and recommendations before making such a grant.

Bipartisan Task Force for Responsible Fiscal Action Act of 2009 - Amends the Congressional Budget Act of 1974 to establish in the legislative branch the Bipartisan Task Force for Responsible Fiscal Action to address, and report to the President, the Vice President, the Speaker of the House of Representatives, and the Majority and Minority Leaders of both chambers on, the nation's long-term fiscal imbalances, including federal expenditures and revenues and the current and long-term actuarial financial condition of the federal government. Provides for expedited legislative consideration of Task Force recommendations.

Security Clearance Modernization and Reporting Act of 2009 - Amends the Intelligence Reform and Terrorism Prevention Act of 2004 to extend national security clearance report requirements to the earlier of two years after the Comptroller General has removed all security clearance-related items from the list known as the High-Risk List, or 2017. (Under current law, such report requirement runs through 2011.) Adds to required report information a description of the full range of time required to complete initial clearance applications. Establishes the Security Clearance and Suitability Performance Accountability Council to perform specified duties, and oversee the development of techniques, relating to the enhancement of applicant suitability determinations and security clearances, including holding each U.S. agency accountable for its security procedures. Directs the Council to develop and submit to Congress a strategic plan that identifies the causes of problems with the issuance of security clearances and a description of corrective actions to address such problems. Requires the Director of the Office of Management and Budget (OMB) to submit to Congress an information technology strategy for expediting the security clearance process and for providing security clearance and suitability determination reform consistent with the Report of the Joint Security and Suitability Reform Team, dated December 20, 2008.

Strengthening and Updating Resources and Equipment Act or the SURE Act - Amends the Homeland Security Act to permit grants awarded under the State Homeland Security Grant Program or the Urban Area Security Initiative to be used for maintenance agreements, user fees, or sustainment costs for purchased equipment related to preventing, preparing for, protecting against, and responding to acts of terrorism. Prohibits the Administrator of the Federal Emergency Management Agency (FEMA) from imposing: (1) a limit on the amount of any such award that may be used to pay for equipment purchase and maintenance costs; and (2) any additional limitation, including any fiscal year limitation, on the amount of any such award that may be used for a specific type, purpose, or category of equipment purchase or maintenance cost.

Amends the Internal Revenue Code to: (1) establish a permanent estate tax exclusion of $3.5 million ($7 million for married couples filing joint tax returns) and a maximum 45% tax rate for decedents dying, generation-skipping transfers, and gifts made, after December 31, 2009; (2) allow an annual inflation adjustment to the exclusion amount after 2010; and (3) allow a surviving spouse an increase in the estate tax exclusion by the unused exclusion amount of a deceased spouse. Expresses the sense of the Senate that any reduction in federal revenues resulting from this Act should be fully offset.

Roosevelt Scholars Act of 2009 - Establishes the Theodore Roosevelt Scholarship Foundation as an independent establishment in the executive branch. Directs the Foundation to award scholarships in an annual nationwide competition to individuals (to be known as "Roosevelt Scholars") who are: (1) enrolled in or seeking admission to accredited full-time undergraduate or graduate studies that prepare them for occupations critical to the missions of federal agencies; and (2) nominated by persons that have direct knowledge of their academic or work experience. Sets the maximum scholarship amount at $60,000 for each of up to five academic years, covering tuition, room and board, books, materials, and fees. Requires Roosevelt Scholars to: (1) agree to serve in the federal government for a period of years equal to the number of academic years during which they received their scholarship; (2) complete a federal internship related to their studies while earning their degree; (3) participate in certain extracurricular activities designed to assist their pursuit of federal careers and development of leadership qualities; and (4) serve as sources of information regarding federal scholarship and employment opportunities. Establishes the Theodore Roosevelt Memorial Scholarship Trust Fund consisting of appropriations and gifts for such scholarships. Sets forth additional duties of the Foundation, including the creation of an online directory of all federal scholarship opportunities available to individuals pursuing federal employment and an online directory of current occupations critical to the missions of federal agencies. Amends the Internal Revenue Code to exclude Roosevelt Scholarships from gross income.

Economic Development Revitalization Act of 2009 - Amends the Public Works and Economic Development Act of 1965 to authorize appropriations for economic development assistance programs under such Act for FY2009-FY2013. Includes within the definition of "Regional Commissions" the Southeast Crescent Regional Commission, the Northern Border Regional Commission, and the Southwest Border Regional Commission. Modifies provisions regarding grants for planning and administrative expenses for public works and economic development to authorize funding for fostering regional collaboration among local jurisdictions and organizations. Requires each state receiving assistance to provide a copy of each annual report to each economic development district within the state. Limits the federal share to 50% for public works and economic development grants, with a specified increased federal share: (1) based on the relative needs of an area (e.g., the unemployment rate and the impact of severe outmigration, sudden and severe economic dislocations, and other related economic circumstances); and (2) in the case of a federally declared major disaster. Allows: (1) training, research, and technical grant assistance to be used for a peer exchange program to promote industry-leading practices and innovations relating to the organizational development, program delivery, and regional initiatives of economic development districts; and (2) economic adjustment grant assistance to be used for activities identified by communities whose economies are injured by the loss of natural resource-based, agricultural, or service sector (currently, manufacturing) jobs. Authorizes the Secretary to solicit comments periodically regarding the guidelines and performance requirements for the revolving loan fund program and recommendations for improving performance. Authorizes a recipient of an economic adjustment grant who determines that a revolving loan fund established using such assistance is no longer needed, or that the recipient could make better use of the assistance to carry out another project that meets the requirements of the Act, to request the Secretary to approve conversion of the assistance by: (1) selling fund assets to a third party; or (2) retaining repayments of principal and interest on loans provided through the fund. Requires such a recipient to use the net proceeds from a sale of assets to pay any portion of the costs of projects that meet Act requirements. Authorizes the Secretary to allocate not more than 2% of the amounts made available for economic adjustment grants for development and maintenance of an automated tracking and monitoring system to ensure the proper operation and financial integrity of the revolving loan program. Extends appropriations for the Brightfields demonstration program through FY2013. Directs each economic development district to engage in the full range of economic development activities included in the list contained in the comprehensive economic development strategy of the district that has been approved by the Economic Development Administration. Authorizes the Secretary to consult with any persons who can assist in addressing the problems of area and regional outmigration. Declares that the state of Montana shall be served by the Seattle office of the Economic Development Administration. Directs the Secretary, before providing investment assistance for a construction project, to establish the expected period during which: (1) the recipient shall make best efforts to achieve economic development objectives; (2) any property that is acquired or improved shall be held in trust for the project's benefit; and (3) the Secretary shall retain an undivided equitable reversionary interest in the property. Authorizes the Secretary to terminate the reversionary interest when the recipient has fulfilled its obligations, taking into consideration the economic conditions. Provides for an alternative method of termination. Increases the minimum level of funding for planning and grants for administrative expenses, subject to total appropriations.

Amends the Harmonized Tariff Schedule of the United States to suspend temporarily the duty on 1,3-Propanediaminium, N-[3-[[[dimethyl[3-[(2-methyl-1-oxo-2-pro-penyl)amino]propyl]ammonio]acetyl]amino]propyl]-2-hydroxy-N,N,N',N',N'-pentamethyl-, trichloride, polymer with 2-propenamide.
