United States · United States Congress · 25 April 2023

Veteran Improvement Commercial Driver License Act of 2023 This bill authorizes approval of certain commercial driver education programs for purposes of Department of Veterans Affairs (VA) educational assistance if the programs meet specified requirements. The 340B program allows certain providers to receive covered outpatient drugs at reduced prices from manufacturers. Specifically, PBMs and insurance plans may not reimburse 340B participants at a lower rate than other entities not participating in the program; impose differing terms (such as fees, charge-backs, or audits) on 340B participants; interfere with an individual's choice to receive drugs from a 340B participant; require 340B participants to identify which drugs fall within the program; or refuse to contract with a 340B participant on the basis that they utilize the program. Further, insurance plans may not deny coverage of drug because it is a 340B drug. Violations of this bill are subject to a civil penalty of not more than $5,000 per violation per day. These prohibitions also apply to prescription drug (Part D) sponsors under Medicare. The bill also provides for a process to prevent duplicate 340B drug discounts to states under Medicaid.

Strengthening Medicare for Patients and Providers Act

United States · United States Congress · 3 April 2023

Strengthening Medicare for Patients and Providers Act This bill modifies certain adjustments to payment amounts under the Medicare physician fee schedule. Payment amounts under the Medicare physician fee schedule are based on a service's relative value, a conversion factor, and a geographic adjustment factor. Current law provides for separate conversion factors for physicians that are qualifying participants in advanced alternative payment models (also known as qualifying APM participants) and for other physicians beginning in 2026, with an annual update of 0.75% and 0.25%, respectively. The bill replaces the separate conversion factors for qualifying APM participants and other physicians with a single conversion factor and provides for an update that is equal to the annual percentage increase in the Medicare Economic Index, beginning in 2024. (The Medicare Economic Index is a specialized index that is generally used to determine allowed charges for physician services based on annual price changes.)

Specifically, it increases the amount of time, from 3 business days to a minimum of 10 business days, that a federal firearms licensee must wait to receive a completed background check prior to transferring a firearm to an unlicensed person. If a submitted background check remains incomplete after 10 business days, then the prospective purchaser may submit a petition for a final firearms eligibility determination. Specifically, the bill allows an individual seeking a WIC certification, recertification, or a nutritional risk evaluation to do so by phone or through video teleconference, in addition to the in-person option. The bill also reauthorizes Food and Nutrition Service (FNS) WIC funding for infrastructure, management information systems, and special nutrition education through FY2029. Specified funds must be used to establish, develop, improve, replace, or administer technology platforms that allow for secure communication between health care providers and program clinics under the program. Further, the Department of Agriculture must report to Congress about the use of remote technologies and other digital tools in the WIC program. Under current law, individuals are generally required to be physically present to certify their WIC eligibility and receive benefits, with exceptions. The FNS has temporarily waived these requirements and allowed remote certification and benefits using authorities that were originally provided by laws that were enacted to address the COVID-19 pandemic.

Women’s Health Protection Act of 2023

United States · United States Congress · 30 March 2023

Women's Health Protection Act of 2023 This bill prohibits governmental restrictions on the provision of, and access to, abortion services. Before fetal viability, governments may not restrict providers from using particular abortion procedures or drugs, offering abortion services via telemedicine, or immediately providing abortion services if delaying risks the patient's health. Furthermore, governments may not require providers to perform unnecessary medical procedures, provide medically inaccurate information, or comply with credentialing or other conditions that do not apply to providers who offer medically comparable services to abortions. Additionally, governments may not require patients to make medically unnecessary in-person visits before receiving abortion services or disclose their reasons for obtaining services. After fetal viability, governments may not restrict providers from performing abortions when necessary to protect a patient's life and health. The same provisions that apply to abortions before viability also apply to necessary abortions after viability. Additionally, states may authorize post-viability abortions in circumstances beyond those that the bill considers necessary. Further, the bill recognizes an individual's right to interstate travel, including for abortion services. The bill also prohibits governments from implementing measures that are similar to those restricted by the bill or that otherwise single out and impede access to abortion services, unless the measure significantly advances the safety of abortion services or health of patients and cannot be achieved through less restrictive means. The Department of Justice, individuals, or providers may sue states or government officials to enforce this bill, regardless of certain immunity that would otherwise apply.

Goldie’s Act

United States · United States Congress · 24 March 2023

Goldie's Act This bill expands enforcement provisions under the Animal Welfare Act (AWA). Specifically, the bill directs the Department of Agriculture (USDA) to document and record detailed descriptions of violations of the act observed during inspections and investigations. USDA must provide a copy of all records documenting violations to state, local, and municipal animal control or law enforcement officials within 24 hours of such inspections or investigations. Inspections must be held at least once a year of each research facility, the premises of each animal dealer, and each exhibitor of animals. If violations are found during inspections, then USDA must conduct any necessary follow-up inspections until all the violations are corrected. Inspectors must confiscate or destroy in a humane manner animals found to be suffering physical or psychological harm as a result of failure to comply with the AWA. Violators are subject to civil penalties as outlined in the bill.
