Fair and Open Skies Act

United States · United States Congress · 9 July 2019

Fair and Open Skies Act This bill prohibits the Department of Transportation (DOT) from issuing a foreign air carrier permit or an exemption from certain air carrier certificate requirements under the United States-European Union Air Transport Agreement of April 2007, unless DOT finds that issuing the permit or exemption would be consistent with Article 17 bis of the agreement, which provides that opportunities created by the agreement do not undermine labor standards or the labor-related rights and principles contained in the laws of the respective parties to the agreement; and imposes conditions on the permit or exemption necessary to ensure compliance with Article 17 bis . The bill modifies policy considerations relating to air carrier certificates to require DOT to consider preventing entry into U.S. markets by flag of convenience carriers (i.e., foreign air carriers established in a country other the home country of their majority owner in order to avoid regulations of the home country) and preventing the undermining of labor standards. In carrying out such air carrier certificate requirements, DOT must consider preventing entry of flag of convenience carriers into U.S. markets as being in the public interest and consistent with public convenience and necessity for safety in air transportation and air commerce. In formulating U.S. international air transportation policy relating to the elimination of discrimination and unfair competition, the Department of State and DOT must include in their considerations the undermining of labor standards.

In addition, it requires the Office of Federal Student Aid to have a unit that enforces compliance with laws governing student financial assistance programs. PRO Students Act

United States · United States Congress · 25 June 2019

Protections and Regulation for Our Students Act or the PRO Students Act This bill increases oversight of postsecondary educational institutions and provides consumer protections for students. Proprietary (i.e., for-profit) institutions of higher education (IHEs) must derive at least 15% of their revenue from non-federal sources or risk becoming ineligible for federal educational assistance funds. Postsecondary educational institutions must meet certain requirements regarding entrance counseling for first-time borrowers, disclosure of clinical training agreement terms, disclosure of a mandatory program review, and preparation of students upon successful program completion. The bill prohibits such institutions from using revenues derived from federal educational assistance funds for recruiting or marketing activities. The bill revises requirements governing IHEs that receive federal educational assistance funds, including to broaden the ban on institutions compensating employees based on their successes in securing either enrollments or student aid awards, prohibit predispute arbitration agreements in student loan contracts that waive the rights available to borrowers, and increase protections for whistleblowers who disclose institutional violations. The Department of Education (ED) must (1) establish a complaint tracking system, (2) conduct mandatory program reviews of institutions that pose a significant risk of failing to comply with certain requirements, and (3) recalculate the cohort default rate for institutions that engage in default manipulation and redetermine their eligibility for federal educational assistance funds. The bill expands the defenses that a borrower may assert for not repaying a student loan. ED may impose civil penalties on IHEs that engage in substantial misrepresentation or other serious violations.

United States · United States Congress · 19 June 2019

War Powers Amendments of 2019 This joint resolution revises the War Powers Resolution, a law designed to limit the President's power to introduce Armed Forces into hostilities. Changes include shortening the time that Armed Forces may be involved in hostilities without congressional action and providing for judicial enforcement. The President shall remove any Armed Forces introduced into hostilities without congressional approval within 30 days unless Congress (1) declares war, (2) enacts a joint resolution specifically authorizing such use of the Armed Forces, (3) extends this deadline by 30 days, or (4) is unable to meet because of an attack on the United States. Current law allows such use of the Armed Forces for 60 days from when the President first reports to Congress about the engagement and allows for a 60-day extension. If Congress takes no such actions, funds may not be used to continue Armed Forces involvement in the hostilities, except to withdraw. The bill removes a provision requiring the removal of such engaged Armed Forces if Congress passes a concurrent resolution requiring such removal. A member of Congress may sue in district court for an order directing the President to comply with this bill. A judgment in such an action shall be directly appealable to the Supreme Court. The bill amends various provisions relating to (1) the President reporting to and consulting with Congress regarding the use of the Armed Forces without congressional authorization, and (2) procedures for the expedited handling of joint resolutions related to such use of force.

United States · United States Congress · 18 June 2019

Small Business Reorganization Act of 2019 This bill creates new bankruptcy procedures for small businesses filing under Chapter 11 and otherwise revises provisions related to venue and trustee responsibilities in Chapter 11 bankruptcies. For small businesses filing under these new procedures, the bill provides for the appointment of a trustee, sets forth requirements regarding the filing, contents, and confirmation of a plan of reorganization, and establishes the conditions of a discharge. Among other things, the bill provides authority to the bankruptcy court to approve a reorganization plan for these small businesses over the objections of the creditors. Currently, creditors must generally vote to approve such a plan. Additionally, only a debtor is allowed to file a plan. Under current law, creditors may also submit plans for court approval. The bill also generally reduces the required disclosures for these small businesses. The bill also provides additional standards a trustee must meet in order to void a preferential transfer for all Chapter 11 filers. (Preferential transfers generally occur when a debtor transfers property before filing bankruptcy that is beneficial to one creditor to the detriment of others.) Specifically, a trustee may only void such a transfer based on reasonable due diligence and must take into account a party's known or reasonably knowable affirmative defenses.
