Animal Welfare Enforcement Improvement Act

United States · United States Congress · 17 May 2021

Animal Welfare Enforcement Improvement Act This bill revises the licensing process of the Department of Agriculture (USDA) for animal dealers and exhibitors to expand USDA's oversight and enforcement of animal welfare requirements. The bill also authorizes citizen suits to enforce the Animal Welfare Act. Dealers and exhibitors must apply to USDA for licenses or renewal licenses each year. In order to obtain the licenses or renewals, dealers and exhibitors must meet certain standards for the humane treatment of animals and pass inspections as specified by this bill. USDA may not issue or renew such licenses if the dealers or exhibitors have violated laws relating to animals or if the issuance of the licenses would facilitate the circumvention of state or local laws that prohibit the private ownership of certain animals. Further, USDA must suspend the licenses of dealers or exhibitors whose violations present a risk to animal welfare. USDA must revoke the licenses if the violations persist or if the licensees commit multiple violations. Dealers and exhibitors with suspended or revoked licenses may not be (1) granted another license, (2) granted another license through another person or entity, or (3) employed by another licensee to work with animals during the period of the suspension or revocation.

United States · United States Congress · 14 May 2021

Timely Access to Cancer Treatment Act of 2021 or the TACT Act of 2021 This bill requires insurance plans to authorize, and pharmacies contracted with the plans to dispense, anti-cancer oral medications within certain time frames. Specifically, within 24 hours after receiving a prescription, a pharmacy must inform the health care provider and plan enrollee whether it will dispense the medication. A plan that requires prior authorization for anti-cancer oral medication must make that determination within 72 hours after receiving the request for authorization. Further, if a pharmacy provides notification that it is unable to dispense the medication, the health insurance plan must allow the enrollee to select a different pharmacy to dispense the medication, even if that pharmacy does not have a contract with the plan. Fair and Open Skies Act This bill prohibits the Department of Transportation (DOT) from issuing a foreign air carrier permit or an exemption from certain air carrier certificate requirements under the United States-European Union Air Transport Agreement of April 2007, unless DOT finds that issuing the permit or exemption would be consistent with Article 17 bis of the agreement, which provides that opportunities created by the agreement do not undermine labor standards or the labor-related rights and principles contained in the laws of the respective parties to the agreement; and imposes conditions on the permit or exemption necessary to ensure compliance with Article 17 bis . The bill modifies policy considerations relating to air carrier certificates to require DOT to consider preventing entry into U.S. markets by flag of convenience carriers (i.e., foreign air carriers established in a country other the home country of their majority owner in order to avoid regulations of the home country) and preventing the undermining of labor standards. In carrying out such air carrier certificate requirements, DOT must consider preventing entry of flag of convenience carriers into U.S. markets as being in the public interest and consistent with public convenience and necessity for safety in air transportation and air commerce. In formulating U.S. international air transportation policy relating to the elimination of discrimination and unfair competition, the Department of State and DOT must include in their considerations the undermining of labor standards.

Fire Fighters and EMS Employer-Employee Cooperation Act

United States · United States Congress · 15 April 2021

Fire Fighters and EMS Employer-Employee Cooperation Act This bill requires the Federal Labor Relations Authority to determine whether a state substantially provides fire and emergency medical services (EMS) personnel the right to form and join a labor organization; recognition by fire and EMS employers of the employees' labor organization, agreement to bargain with the organization, and reduction of any agreements to writing in a contract or memorandum of understanding; the right to bargain over hours, wages, and terms and conditions of employment; and arbitration or other mechanisms to resolve an impasse in collective bargaining negotiations. The bill makes the authority responsible for (1) determining the appropriateness of units for labor representation; (2) supervising elections; (3) conducting hearings and resolving complaints of unfair labor practices; and (4) protecting the right of employees to form, join, or assist any labor organization, or to refrain from doing so. An employer, fire and EMS personnel, or labor organization may not engage in a lockout, sickout, work slowdown, strike, or any other organized job action that will measurably disrupt the delivery of emergency services and is designed to compel an employer, fire and EMS personnel, or labor organization to agree to the terms of a proposed contract.
