Safe School Lunch Act of 2008 - Amends the Federal Meat Inspection Act and the Poultry Products Inspection Act to direct the Secretary of Agriculture to order an immediate halt to the distribution of meat, meat food products, poultry, or poultry products upon finding that they may cause a serious, adverse health consequence or be adulterated. Gives persons subject to such an order the opportunity for an informal hearing, within 10 days after the order's issuance, on the actions required by the order and on whether it should be amended to require a recall of the targeted items. Requires the Secretary to order the recall of such items upon affirming that the order should include a recall. Directs the Secretary to: (1) establish a program providing schools that participate in the school lunch or breakfast programs with training regarding the recall of meat, meat food products, poultry, and poultry products; (2) ensure that information on the Department of Agriculture's website concerning the inspection and recall of such items is current, clear, and accessible by school employees and parents; (3) promulgate regulations ensuring that all of such items inspected by the Secretary can be traced from slaughter to final distribution to schools participating in the school lunch or breakfast programs; and (4) review and evaluate the Department's inspection and recall procedures for such items.

International Fisheries Stewardship and Enforcement Act - Directs the Secretary of Commerce and the Secretary of the department in which the Coast Guard is operating to enforce specified laws concerning fisheries and fish products, including the High Seas Driftnet Fishing Moratorium Protection Act, the Marine Mammal Protection Act of 1972, the Dolphin Protection Consumer Information Act, the Atlantic Tunas Convention Act of 1975, the Northern Pacific Halibut Act of 1982, and any other similar law designated by the Secretary. Sets civil and criminal penalties for violations. Revises specified Acts regarding one or more of the following: (1) enforcement of those Acts under this Act; (2) false labeling or identification of fish or fish products; (3) refusing, resisting, or interfering with various enforcement activities; (4) civil or criminal penalties or forfeiture; (5) unlawful activities; and (6) a rule to implement conservation measures. Amends the High Seas Driftnet Fishing Moratorium Protection Act to take a variety of steps regarding illegal, unreported, or unregulated fishing (IUUF) or bycatch of a protected living marine resource. Requires, subject to appropriations, establishment of an International Fisheries Enforcement Program in the Office of Law Enforcement of the National Marine Fisheries Service to detect and investigate IUUF and to enforce this Act. Requires, on request, that the intelligence community collect information on IUUF outside the United States about individuals who are not United States persons. Authorizes establishment of an international cooperation and assistance program, including grants, to support international capacity building. Amends the High Seas Driftnet Fishing Moratorium Protection Act to authorize information disclosure to the Food and Agriculture Organization of the United Nations, international fishery management organizations, or arrangements made under an international fishery agreement. Amends the High Seas Fishing Compliance Act to remove a provision making a high seas fishing permit valid for five years and to modify conditions that void a permit.

Imported Seafood Safety Enhancement Act of 2008 - Requires the Secretary of Health and Human Services to: (1) issue an order refusing admission into the United States of all imports of seafood or seafood products originating from a country or exporter which the Secretary determines do not meet food safety requirements under the Federal Food, Drug, and Cosmetic Act or which are not likely to meet food safety requirements of any other federal law; and (2) notify all U.S. ports of entry of such refusal within five days. Requires shipments denied admission to be clearly marked "Refused Entry by the United States Government." Requires the importer of such a rejected shipment headed for its country of origin to notify the appropriate authority of such country of the reasons admission was refused before the shipment may be released to the importer. Requires the importer of such a rejected shipment bound for a third party country to notify such country's appropriate authority about such refusal, and requires such authority to notify the Food and Drug Administration (FDA) that it accepts such shipment, before the shipment may be released to the importer. Requires the shipment to be destroyed if such authority's notification of acceptance is not made within 45 days after it is notified of the rejection.

Safe Food Enforcement, Assessment, Standards and Targeting Act of 2008 or Safe FEAST Act of 2008 - Amends the Federal Food, Drug, and Cosmetic Act to grant the Secretary of Health and Human Services access to certain records relating to an article of food during a food-related emergency. Requires: (1) owners and operators of facilities engaged in manufacturing, processing, packing, or holding food for consumption in the United States (with specified exceptions) to take specified steps regarding hazard evaluation, implementation of risk-based preventive controls, monitoring and verification of control performance, corrective actions, recordkeeping, and facility inspection; and (2) the Secretary to establish minimum standards for implementation of those requirements. Prohibits operation of a facility that processes or packs food for sale in the United States if the operator has not conducted the required hazard analysis or implemented reasonably appropriate science-based preventive controls or has failed to conduct a required reanalysis or to have a plan documenting compliance with such requirements. Requires each U.S. importer to adopt and document a foreign supplier safety assurance program to assure that imported food is in compliance, is not adulterated, and does not pose a threat of serious adverse health consequences or death. Sets forth provisions regarding: (1) certification of imports by a competent authority of an exporting country; (2) establishment of a voluntary qualified importer program; (3) recognition of qualified laboratories for analyses of imported foods; (4) establishment of regulations for the safe production, harvesting, and packaging of fruits and vegetables; and (5) recognition of third party certification programs. Grants the Secretary mandatory recall authority of food that will cause serious adverse health consequences. Directs the Secretary to develop a comprehensive plan to expand the technical, scientific, and regulatory capacity of foreign governments and food industries from which foods are exported to the United States.

Keeping America's Food Safe Act of 2008 - Amends the Federal Food, Drug, and Cosmetic Act to require: (1) certification of any food safety laboratory or a sampling service that is analyzing, testing, or collecting samples of imported food; and (2) such laboratories or services to submit to the Secretary of Health and Human Services the results of all tests conducted on behalf of an importer. Sets forth civil penalties for: (1) an importer that knowingly engages in the falsification of test results submitted to the Secretary; and (2) a laboratory or service that knowingly submits false test results to the Secretary. Requires the Secretary to establish a certification program to ensure that imported food meets the food safety standards applied to food produced in the United States. Prohibits food from being permitted entry into the United States from a foreign facility in a foreign country unless there are certifications from the facility and country. Sets forth certification requirements for foreign countries. Requires the Secretary to develop and maintain a website that: (1) provides information on federal food standards and best practice requirements for food preparation; (2) assists health professionals to improve their ability to diagnose and treat food-related illness and advise individuals whose health conditions place them at particular risk; and (3) promotes public awareness of food safety issues. Directs the Secretary to develop and maintain a website to provide the public with appropriate information on developing school curricula regarding food safety issues. Establishes whistle-blower's protections.

Makes similar amendments to the the Poultry Products Inspection Act and the Egg Products Inspection Act. Amends the Federal Meat Inspection Act to prohibit the use of nonambulatory livestock for human food.

Government Real Estate Accountability and Transparency Act of 2008 - Requires the submission of annual reports detailing the amount of land that is owned by the federal government and the costs of maintaining that land. No Trespassing Act of 2008 - Bars the Secretary of the Interior from approving a management plan for a National Heritage Area unless the local coordinating entity of the proposed Area notifies the individuals who reside or own property in that Area. Prohibits any National Park Service (NPS) employee or member of the local coordinating entity of a National Heritage Area from entering private property without the owner's consent. Taxpayer Property Protection Act of 2008 - Bars the Department of the Interior, the Department of Energy, and the Forest Service from assuming control of any land in a state unless the citizens of the political subdivisions in which the land is located approve the assumption of control by a referendum. Do No Harm Act of 2008 - Prohibits a National Heritage Area designation from taking effect until the President certifies that it will not cause an adverse impact on specified agriculture, livestock, energy, critical infrastructure, and housing concerns.

Rural America Communication Expansion for the Future Act of 2008 - Amends the Internal Revenue Code to permit taxpayers in rural or underserved areas to elect to expense broadband expenditures, including installation and connection costs. Permits mutual or cooperative telephone companies to reduce their unrelated business taxable income in any year by the amount of their broadband expenditures. Directs the Secretary of the Treasury to designate census tracts identifying rural and underserved areas. Prohibits federal or state agencies from adopting regulations and ratemaking procedures that would eliminate or reduce the broadband expense deduction provided by this Act. Allows a business-related tax credit for providing broadband services to rural or underserved subscribers through the radio transmission of energy. Amends the National Telecommunications and Information Administration Organization Act to establish a grant to a local government with at least one rural or underserved area to establish publicly available broadband networks. Extends funding for: (1) public safety communications interoperability; (2) 911 access; and (3) telehealth programs. Revises provisions relating to rural area loans and loan guarantees regarding access to broadband telecommunications services, including revising the definition of "eligible rural community." Requires designation of a National Center for Rural Telecommunications Assessment. Establishes the Community Connect Grant Program to provide broadband service that fosters economic growth and delivers enhanced educational, health care, and public safety services. Amends the Food, Agriculture, Conservation and Trade Act of 1990 to authorize grants to noncommercial education television broadcast stations that serve rural areas to enhance digital services. Extends the termination date of the authority to guarantee bonds or notes for electrification or telephone purposes.

Authorizes appropriations to the Administrator of the General Services Administration (GSA) for each of FY2009-FY2013 to make improvements to existing U.S. ports of entry to improve border security and for other purposes. Directs the Administrator to give priority to ports determined to be in most need of repair in accordance with required infrastructure assessment studies.

Emergency Wildland Fire Response Act of 2008

Emergency Wildland Fire Response Act of 2008 - Establishes a Federal Wildland Fire Emergency Suppression Fund to cover the costs of federal wildland fire suppression activities associated with a declared emergency wildland fire incident. Sets forth the criteria for which declarations of emergency wildland fire incidents may be made under this Act. Requires a declaration of such an incident to only be made by the Secretary of Agriculture, the Secretary of the Interior, or a designee of the Secretary concerned at the subcabinet level. Allows the Secretary concerned to only access the Fund if the President's annual budget requested funds for wildland fire operations amounting to at least the ten-fiscal year average of expenditures for wildland fire operations. Requires the Secretaries to jointly report every six months on expenditures from and deposits to the Fund. Permits any excess funds for wildland fire operations to be transferred to support reforestation and rehabilitation of forests following wildland fires. Limits the areas in which such funds may be expended. Requires review of wildfire incidents resulting in expenses greater than $10 million. Directs the Secretary of Agriculture to develop a national map of landscape areas most at risk of wildfire and in need of hazardous fuel treatment and maintenance. Authorizes such Secretary to: (1) provide cost-share grants to fire-ready communities to increase their capacity to defend against wildland fire; and (2) enter into contracts or cooperative agreements with a State Forester or equivalent official to implement good neighbor projects on such lands.

Metzenbaum Menu Education and Labeling Act or the MEAL Act - Amends the Federal Food, Drug and Cosmetic Act to require restaurants that are a part of a chain with 20 or more locations doing business under the same trade name to disclose: (1) in a statement adjacent to each menu item, the number of calories, grams of saturated fat plus trans fat, and milligrams of sodium in a standard food serving; (2) other information designed to enable the public to understand the significance of the nutrition information provided in the context of a total daily diet; (3) that such information shall be provided in writing upon request; and (4) in a statement adjacent to the name of the food on a menu board, the number of calories in a serving of the food. Exempts condiments, items placed on a table or counter for general use, daily specials, temporary menu items, and irregular menu items from these requirements. Requires restaurants that sell self-serve food, such as through salad bars or buffet lines, to place a sign that lists the number of calories per standard serving adjacent to each food offered. Permits retail food establishments to voluntarily provide, and states to require, additional nutritional information. Requires vending machine operators to provide a conspicuous sign disclosing the number of calories in each item of food offered.

Downed Animal Enforcement Act of 2008 - Amends the Federal Meat Inspection Act to make it a violation of such Act to: (1) slaughter any nonambulatory livestock, or prepare any carcass or carcass part or meat or meat food product from such animal, for human food use; or (2) fail to comply with the Humane Methods of Slaughter Act of 1958. Establishes the following penalties for violations of such prohibitions: (1) gross income-based civil penalty for a first violation; (2) one-year inspection service suspension for a second violation; and (3) permanent withdrawal of inspection service a third violation. Directs the Secretary of Agriculture to promulgate final regulations that provide for public disclosure of a comprehensive list of establishments at which recalled meat or poultry is known to be available for public consumption or sale.

Fresh Produce Safety Act - Amends the Federal Food, Drug, and Cosmetic Act (FFDCA) to require the Secretary of Health and Human Services (the Secretary) to establish standards for good manufacturing practices for the minimal processing of produce, including standards related to sanitation and water. Requires the Secretary to provide for unannounced inspections of processing facilities to determine if produce processed in the facilities is in compliance with the requirements of this Act. Directs the Secretary to establish general standards for good agricultural practices for the production of raw agricultural commodities, including requirements related to manure, animals, water, and environmental conditions. Gives officers and employees duly designated by the Secretary the authority to inspect appropriate facilities to determine compliance with the standards for good agricultural practices. Directs the Commissioner of Food and Drugs to establish and maintain an active surveillance system to assess the frequency and sources of human illness in the United States associated with the consumption of fresh produce. Directs the Commissioner and the Secretary of Agriculture to design and implement a national public education program on food safety relating to produce. Directs the Secretary of Agriculture to conduct research to assist in the implementation of this Act and the requirements of the FFDCA that relate to produce. Requires the Secretary to establish procedures for equivalency with foreign countries that intend to export raw agricultural commodities and minimally processed produce to the United States.

National Diabetes Coordinator Act of 2008 - Amends the Public Health Service Act to establish within the Office of the Secretary of the Department of Health and Human Services (HHS) the position of National Diabetes Coordinator, whose duties shall be to: (1) serve as the Secretary's principal advisor on reducing the rates of diabetes and its complications; (2) develop a measurement for the incidence of diabetes; (3) develop and coordinate implementation of a national strategy to reduce the incidence, progression, and impact of diabetes and its complications; (4) provide leadership and coordination to ensure that diabetes-related programs and policies of HHS are coordinated internally and with those of relevant federal, state, and local agencies with a goal of avoiding duplication of effort, maximizing impact, and marshaling all government resources; and (5) coordinate public and private resources to develop and lead a public awareness campaign regarding the prevention and control of diabetes and its complications. Requires reports to the President: (1) from the HHS Secretary on a national strategy to reduce the incidence, progression, and impact of diabetes and its complications; (2) from the Director of the Office of Personnel Management (OPM) on negotiations with health plans to include appropriate standards and activities to reduce risk factors for diabetes and encourage prevention and early treatment; and (3) from the Secretary of Agriculture on ways in which food programs and nutritional support can be better targeted at concerns specific to those at risk for diabetes or those already diagnosed whose complications could be reduced by more effective diet.

Federal Land Assistance, Management and Enhancement Act or FLAME Act - Establishes in the Treasury the Federal Land Assistance, Management, and Enhancement Fund (the Flame Fund). Requires amounts in the Flame Fund to be made available to the Secretary of the Interior and the Secretary of Agriculture (the Secretaries) to pay the costs of catastrophic emergency wildland fire suppression activities that are separate from amounts annually appropriated for the predicted annual workload for such activities. Provides for amounts in the Flame Fund to be made available to the Secretaries only after such Secretaries issue a declaration that a wildland fire suppression activity is eligible for funding through the Fund. Directs such Secretaries to establish an accounting and reporting system for the Flame Fund. Requires such Secretaries to: (1) annually report on the use of the funds from the Flame Fund, together with recommendations that the Secretaries may have to improve administrative control and oversight of the Fund; and (2) submit a report that contains a cohesive wildland fire management strategy, consistent with the recommendations of the Comptroller General reports regarding such issue.

Commercial Seafood Consumer Protection Act - Directs the Secretary of Commerce (Secretary) to establish a program to strengthen federal activities for ensuring that commercially distributed seafood meets federal food quality and safety requirements. Directs the Secretary and the Secretary of Health and Human Services to enter into an agreement to strengthen cooperation on seafood safety, including regarding examining and testing seafood imports, inspections of foreign facilities, technical assistance and training of foreign facilities for marine aquaculture, establishing a distribution chain tracking system, and labeling. Directs the Secretary to increase the number of laboratories certified to Food and Drug Administration (FDA) standards. Authorizes the Secretary to increase the number and capacity of laboratories operated by the National Oceanic and Atmospheric Administration (NOAA) involved in testing and other activities under this Act. Directs the Secretary of Health and Human Services to refuse admission of all imports of seafood or seafood products originating from a country or exporter if the shipments are not likely to meet federal requirements. Allows admittance of individual shipments from that country or exporter on evidence from an inspection or a certified laboratory. Authorizes the Secretary to send inspectors to an originating country or exporter.

Allows: (1) a 50% exclusion for the sale of qualified farm property to any other person who certifies that such property will be used for farming purposes for 10 years; and (2) a 25% exclusion for the sale of qualified farm property to any other person for any other use. Defines "qualified farm property" as real property located in the United States which is used for farming purposes for a specified three-year period and in which there was material participation by the taxpayer or the taxpayer's spouse or family member. Requires the recapture of tax benefits if qualified farm property is sold or ceases operation as a farm before the required 10-year period. Increases dollar limitations on bonds issued to finance assistance programs for first-time farmers.

American-Made Energy Act of 2008 - Amends the Internal Revenue Code to modify and set forth provisions concerning tax credits for alternative and renewable energy, nuclear power facility construction, and an advanced coal project and deductions for energy efficient commercial buildings, qualified refinery property, and oil and gas well depletion. Establishes the American-Made Energy Trust Fund. Amends the Energy Independence and Security Act of 2007 to repeal a provision that prohibits federal agencies from procuring alternative or synthetic fuel for any mobility-related use unless its life cycle greenhouse gas emissions are less than those for fuel from conventional petroleum sources. Directs the Federal Trade Commission (FTC) to study the effects of state guaranteed profit laws and credit card processing fees on gasoline prices. Requires the Secretary of the Interior to establish a competitive oil and gas leasing program that will result in an environmentally sound program for the exploration, development, and production of the Coastal Plain's oil and gas resources. Amends the Alaska National Interest Lands Conservation Act of 1980 to repeal a provision concerning the prohibition on leasing or other development leading to the production of oil and gas from the Arctic National Wildlife Refuge. Authorizes the Secretary to designate certain Coastal Plain lands as Special Areas requiring special management and regulatory protection, including the Sadlerochit Spring area. Amends the Energy Policy and Conservation Act to set forth provisions concerning: (1) studying the maintenance of coal-to-liquid products in the Strategic Petroleum Reserve; (2) constructing specified storage facilities for the Reserve; (3) acquiring, storing, transporting, or exchanging coal-to-liquid fuel; (4) procuring biobased fuel or coal-to-liquid fuel; and (5) auctioning to the public coal-to-liquid fuel put option contracts. Amends the Clean Air Act to authorize funding for grants for cellulosic ethanol production for FY2009-FY2010. Amends the Farm Security and Rural Investment Act of 2002 to require the Secretary of Agriculture to: (1) make loan guarantees to entities to assist in paying the cost of development and construction of biorefineries and biofuel production plants to carry out projects to demonstrate the commercial viability of processes for converting biomass to fuels or chemicals; and (2) conduct a competitive research and development program to encourage new forest-to-energy technologies. Amends the Agricultural Risk Protection Act of 2000 to repeal provisions concerning biomass research and development. Authorizes persons who generate credits for renewable fuel that exceed their annual obligation for such fuel to retain such credits for the purpose of complying with obligations under the Clean Air Act with respect to advanced biofuel. Amends the Energy Policy Act of 1992 to terminate prohibitions on expenditures to conduct oil or natural gas leasing and preleasing activities for Outer Continental Shelf (OCS) areas and to revoke withdrawals of federal submerged lands from the OCS. Amends the Outer Continental Shelf Lands Act to prohibit the Secretary of the Interior from granting certain oil or natural gas leases for OCS areas that are located within a specified number of miles of the coastline of a state. Establishes the state seaward boundaries under the Outer Continental Shelf Lands Act. Authorizes the President to take steps to increase the share of electricity generated from nuclear power to 40% of the total domestic generation by 2050.
