Trade Promotion Authority Act of 2001

Trade Promotion Authority Act of 2001 - Sets forth the overall trade negotiating objectives of the United States for trade agreements (generally similar to the objectives of the Omnibus Trade and Competitiveness Act of 1988 (OTCA)), including to: (1) further strengthen the system of international trading disciplines and procedures, including dispute settlement; and (2) foster economic growth, raise living standards, and promote full employment in the United States and to enhance the global economy. Sets forth the principal U.S. negotiating objectives (generally similar to the principal OTCA negotiating objectives) regarding trade barriers and other trade distortions, trade in services, foreign investment, intellectual property, transparency, improvement of the World Trade Organization (WTO) and other multilateral and bilateral trade agreements, foreign regulatory practices, electronic commerce, reciprocal trade in agriculture, and WTO extended negotiations. Requires the United States Trade Representative (USTR) to consult closely with Congress during trade negotiations. Sets forth the authority of the President (generally similar to the authority under OTCA) to enter into trade agreements with foreign countries regarding tariff and non-tariff barriers. States that a trade agreement may be entered into (before June 1, 2005; or June 1, 2007, if trade authorities procedures (or fast-track procedures) are extended under this Act) only if it makes progress in meeting the overall and principal trade negotiating objectives, and the President satisfies certain notification and consultation requirements set forth in this Act, including submission of the agreement for assessment by the International Trade Commission. Applies trade authorities procedures to bills implementing trade agreements if they consist of: (1) a provision approving a trade agreement entered into under this Act, and approving any statement of administrative action; and (2) if changes in existing laws or new statutory authority are required to implement such agreements, provisions necessary to implement them, either repealing or amending existing laws or providing new statutory law. Authorizes both Houses of Congress to adopt, within 60 days of each other, a procedural disapproval resolution denying trade authorities procedures to any trade agreement if the President has failed or refused to notify or consult with Congress about it. Exempts from the notice and consultation requirements of this Act any tariff or nontariff agreement which results from negotiations commenced before enactment of this Act, and which: (1) is entered into under the auspices of the WTO regarding the rules of origin work program; (2) is entered into with Chile or Singapore; or (3) establishes a Free Trade Area for the Americas. Requires the appointment of a Congressional Oversight Group to serve as advisor to the U.S. delegation after the President notifies Congress of his intention to enter into the negotiation of any tariff or nontariff trade agreement. Requires the President to submit an implementation and enforcement plan at the same time a final text of any tariff or nontariff trade agreement is submitted to Congress.

Outfitter Policy Act of 2001 - Prohibits unauthorized outfitters from conducting commercial outfitted activities on Federal land. Requires the Secretaries of Agriculture and the Interior to establish criteria for granting outfitter permits. Sets forth procedures for granting permits and describes permit requirements Requires fees for outfitter authorizations. Requires authorized outfitters to defend and indemnify the United States for costs or expenses associated with injury, death, or damage to any person or property caused by negligence or wanton disregard for persons or property arising out of an outfitter's activities. Requires outfitter permits to include a principal allocation of outfitter use and authorizes temporary permits to include such allocation. Authorizes the Secretary to adjust an allocation of use. Permits temporary allocations of use for up to two years and the renewal, transfer, or extension of such allocations. Requires the Secretary to: (1) develop a process for annual evaluation of the performance of authorized outfitters; and (2) renew an authorization at the outfitter's request, under appropriate conditions. Makes outfitter permits transferable to qualified transferees under specified conditions. Sets forth recordkeeping requirements for authorized outfitters. Requires the Secretary to: (1) grant authorized outfitters full access to administrative remedies; and (2) establish an expedited procedure for consideration of appeals. Entitles outfitters that hold existing permits, contracts, or other authorizations to issuance of permits under this Act if their recent performance was determined good, satisfactory, or acceptable, or the equivalent.

Medicare Extension of Drugs to Seniors (MEDS) Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to add a new part D (Prescription Medicine Benefit for the Aged and Disabled) establishing a voluntary insurance program to provide prescription medicine benefits, including pharmacy services, for eligible individuals (including low-income individuals) who are aged or disabled or have end-stage renal disease, and who elect to enroll during a prescribed period, to be financed from monthly premium payments by enrollees together with Federal appropriations. Creates the Prescription Medicine Insurance Account within the Federal Supplemental Medical Insurance Trust Fund. Directs the Secretary of Health and Human Services to develop and implement an Employer Incentive Program that encourages employers to provide adequate prescription medicine benefits to retired individuals and maintain such existing benefit programs. Outlines provisions for substantial reductions in the price of prescription drugs for Medicare beneficiaries. Amends the Federal Food, Drug, and Cosmetic Act, as amended by the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2001, with respect to the importation of certain prescription drugs, to revise testing requirements (granting the Secretary certain waiver discretion) and add approved labeling requirements. Requires the recipient of a patent to make a reasonable pricing agreement with the Secretary (or the Secretary to waive such an agreement in the public interest) if any Federal agency or any non-profit entity: (1) undertakes federally funded health care research and development; and (2) is to convey or provide a patent or other exclusive right to use such research and development for a drug or other health care technology.

Amends the Food Security Act of 1985 to revise the environmental quality incentives program respecting: (1) land management practices; (2) minimum contract term; (3) fund carryover; and (4) confined animal feeding operations and conservation priority areas. Amends the Federal Agriculture Improvement and Reform Act of 1996 to direct the Secretary of Agriculture to use specified funds for pilot programs to prevent listing of threatened or endangered species through the development of critical habitats for such species. Amends the Food Security Act of 1985 respecting the conservation reserve program to: (1) direct the Secretary to carry out at least ten pilot programs that address local and regional cropland and conservation issues; (2) expand haying and grazing authority; and (3) revise base history provisions. Increases maximum wetlands reserve program acreage. Expresses the sense of Congress concerning minimum funding for, and the importance of, conservation technical assistance.

Revises such credit respecting: (1) carryback and carryforward; (2) passive activity; (3) minimum tax; and (4) income inclusion addback. Establishes a limited value-added agricultural property investment credit, which shall be available to: (1) a person who materially participates in an eligible farming business; or (2) an eligible farmer-owned entity. States that such credit shall not apply to property placed in service after December 31, 2007.

Corporate Welfare Elimination Act of 2001 - Title I: Tax Reform - Termination of Energy and Natural Resource Tax Subsidies Act of 2001 - Amends the Internal Revenue Code to repeal or terminate the following: (1) the expensing of intangible drilling and development costs and of mining exploration and development costs; (2) the credit for producing fuel from a nonconventional source; (3) the percentage depletion deduction for mines, oil and gas wells, other natural deposits, and timber; (4) tax benefits for alcohol fuels; (5) the enhanced oil recovery credit; (6) the credit and deduction for electric vehicles, clean-fuel vehicles, and certain refueling property; (7) the deduction for tertiary injectants; (8) the rehabilitation credit for non-historic structures (reduces such credit for certified historic structures); (9) the provisions concerning the treatment of Blue Cross and Blue Shield Organizations; (10) the small life insurance company deduction; (11) the alternative tax on small property and casualty insurance companies; (12) provisions permitting farming businesses to use the cash method of accounting; (13) the deduction for soil and water conservation expenditures; (14) the deduction for expenditures by farmers for fertilizer, etc.; (15) certain exceptions permitting farm businesses to use the cash method of accounting; (16) the exclusion for the cancellation of qualified farm indebtedness; (17) the exclusion for certain cost-sharing payments; (18) the reforestation credit; (19) the rapid amortization of reforestation expenditures; (20) the exclusion of certain income of citizens or residents living abroad; (21) the exclusion for income of foreign sales corporations; (22) the deferral of income of controlled foreign corporations; (23) the deferral of tax under the Merchant Marine Capital Construction Fund; (24) the special treatment for magazine circulation expenditures; and (25) the special treatment for returns of magazines, paperbacks, and records. Title II: Natural Resources - Public Resources Deficit Reduction Act of 2001 - Subtitle A: General Provisions -Prohibits any timber, minerals, forage, or other natural resources owned by the United States and any federally owned water, or hydroelectric energy of a Federal facility from being sold, leased, or otherwise disposed of by any Federal entity for less than fair market value. (Sec. 212) Authorizes the Secretaries of the Interior and Agriculture to establish and collect user fees as necessary to reimburse the United States for expenses incurred in administering programs. (Sec. 213) Requires the revenues from the sale, lease, and transfer of Federal assets to be included in the President's budget submission to Congress. Subtitle B: Revenue from Mining Claims - Requires the holders of mining claims to pay an annual claim maintenance fee of $100 per claim per calendar year. Allows the waiver of such fee for holders of more than ten claims. (Sec. 223) Requires claimholders to pay a royalty of eight percent of gross income for production of locatable minerals on Federal lands. (Sec. 224) Amends the Internal Revenue Code to impose an excise tax on gross income resulting from the severance of any locatable mineral, or mineral concentrates or products, from a mine or other natural deposit. Makes such tax inapplicable to gross income to which a royalty is imposed. (Sec. 225) Establishes the Abandoned Locatable Minerals Mine Reclamation Fund for the reclamation and restoration of land and water resources adversely affected by past mineral activities on Federal lands. Credits the royalties and excise tax under this title to such Fund. (Sec. 226) Prohibits the issuance of a patent for any mining claim unless the Secretary of the Interior determines that, for the claim concerned: (1) a patent application was filed before January 27, 1995; and (2) all requirements are met under the Revised Statutes for vein or lode claims and for placer claims. (Sec. 227) Requires the Secretary to adjust all dollar amounts under this title for changes in purchasing power every ten years, employing the Consumer Price Index as the basis for adjustment. Subtitle C: Use or Disposal of Federal Natural Resources - Amends the Federal Land Policy Management Act of 1976 to direct the Secretary of Agriculture, with respect to National Forest lands in the 16 contiguous Western States, and the Secretary of the Interior, with respect to public domain lands, where domestic livestock grazing is permitted under applicable law, to establish an annual domestic livestock grazing fee equal to fair market value, based on a specified formula. Sets forth provisions regarding: (1) abolition of grazing advisory boards; and (2) the U.S. share of receipts. (Sec. 232) Amends the National Forest Management Act of 1976 to prohibit below-cost timber sales from National Forest System Lands. (Sec. 233) Amends the Forest and Rangeland Renewable Resources Planning Act of 1974 to require the Secretary of Agriculture in revising land management plans to take into account the economic suitability of lands for timber production. (Sec. 234) Amends the Food Security Act of 1995 and the Federal Crop Insurance Act to provide for the reduction of payment limitations for persons who receive Federal irrigation water for agricultural purposes. (Sec. 237) Amends the Emergency Livestock Feed Assistance Act of 1988 to repeal the livestock feed assistance program. (Sec. 238) Amends the Mineral Leasing Act to require that oil and gas rental prices for leases on public lands be established at fair market value. (Sec. 239) Requires that permits for the use of communications sites on public lands be established at fair market prices.

Limits to one $5 voucher the maximum amount any one woman may receive, regardless of the number of her infants or children. Makes specified amounts from the Department of Education available for such book voucher program. Consumer Food Safety Act of 2001 - Declares that persons who produce or process food for human consumption are responsible for preventing or minimizing food safety hazards. Mandates a national program to protect human health by ensuring that the food industry has effective safety programs for food consumed in the United States. Requires that any food processing facility and importer register. Mandates regulations: (1) setting standards for sanitation and tolerances for biological, chemical, and physical hazards; (2) requiring process controls, recordkeeping, and sampling; (3) providing for agency records access; (4) unannounced inspections at least quarterly of processing and importing facilities; and (5) tolerances (including indicators) for contaminants. Authorizes assistance to a State in planning and implementing a food safety program. Mandates a comprehensive and efficient system to ensure imported food safety. Authorizes the Secretary of Health and Human Services to enter into an agreement with any nation desiring to export food to the United States. Sets forth requirements for the agreement, including reciprocity. Mandates: (1) inclusion of food in an active surveillance system and more accurate assessment of the frequency and sources of U.S. human illness associated with food; (2) establishment of guidelines for a sampling system; and (3) ranking of food categories based on their hazard to human health and approaches to minimize hazards. Requires: (1) a national food safety public education program; (2) regional and national food safety advisories; (3) standardized written and broadcast advisory formats; and (4) incorporation of State and local advisories into the national program. Provides, if there is a reasonable probability that the food would present a public health threat, for voluntary and mandatory recalls. Authorizes the Secretary to impose traceability requirements on a type or class of food when necessary to assure the protection of public health. Authorizes civil actions and monetary penalties for violations of this Act.

Upper Mississippi River Basin Conservation Act of 2001 - Directs the Secretary of the Interior (Secretary), through the United States Geological Service, to establish a nutrient and sediment monitoring network for the Basin to: (1) monitor sediment and nutrient loss; (2) record changes to sediment and nutrient loss; (3) provide coordinated data to be used in computer modeling of the Basin; and (4) identify major sources for targeting resources to reduce sediment and nutrient loss. Directs the Secretary to: (1) establish guidelines for related data collection and storage activities; (2) inventory the sediment and monitoring efforts of governmental and nongovernmental entities for the purpose of creating a baseline understanding of overlap, data gaps, and redundancies; and (3) collaborate with other public and private monitoring efforts in establishing the monitoring program. Directs the National Research Council of the National Academy of Sciences to conduct an assessment of water resource and water quality management within the Basin. Requires the Director of the United States Geological Survey, in collaboration with the Chief of the Natural Resources Conservation Service, to establish a computer modeling program of nutrient and sediment sources in the Basin. Directs the Secretary of Agriculture to: (1) work with public and private entities to evaluate best management practices to reduce nutrient and sediment loss; (2) assess such practices' economic risks; and (3) administer a grant program to demonstrate such practices. Requires the Director to establish an Internet-based system to distribute information about nutrient and sediment loss reduction projects and nutrient and sediment levels in the Upper Mississippi River and its tributaries. Amends the Food Security Act of 1985 to provide for privacy of personal data received with respect to natural resources conservation programs. Directs the Secretary of Agriculture to establish the Advisory Council on the Upper Mississippi River Stewardship Initiative. Directs the Secretary of Agriculture and the Secretary of the Interior to establish an Interagency Working Group to coordinate Federal nutrient and sediment reduction efforts in the Basin.

Children's Environmental Protection Act - Amends the Toxic Substances Control Act (TSCA) to require the Administrator of the Environmental Protection Agency (EPA) to ensure that each environmental pollutant standard protects children and other vulnerable subpopulations with an adequate margin of safety, evaluate child susceptibility data concerning any pollutant for which a standard is established, and adopt an additional margin of safety in the absence of reliable data. Requires the Administrator to annually repromulgate at least three of the standards identified by the Children's Environmental Health Protection Advisory Committee (established by this Act) as posing a special risk to children or publish a finding explaining the decision not to do so. Requires each federally funded school and day care center to reduce child pesticide exposure and provide parents with advance notification of any pesticide application. Directs the Administrator to distribute certain EPA guidance for a least toxic pest control strategy and an annual list of pesticides that contain an identified carcinogen, developmental or reproductive toxin, category I or II acute nerve toxin, or endocrine disrupter. Bars federally funded facilities from applying any such pesticide. Requires parental notice and the posting of warning signs before pesticide applications. Directs the Administrator to identify pollutants commonly used or found in areas accessible to children and publish lists of safer substances, exposure reduction guidelines, and right-to-know information. Amends the Emergency Planning and Community Right-to-Know Act of 1986 to require the Administrator to identify, and establish thresholds for, toxic chemicals that may present a significant risk to children's health or the environment. Requires reporting by other substantially contributing facilities. Amends TSCA to direct the Administrator and the Secretaries of Agriculture and Health and Human Services to coordinate and support research to examine the health effects and toxicity of environmental pollutants on children and vulnerable subpopulations.

Prescribes guidelines for: (1) the monitoring of forest carbon; and (2) forest carbon cooperative agreements and loan program on specified lands. Instructs the Secretary to establish an assistance program provided through State revolving loan funds to Indian tribes and owners of nonindustrial private forest land to undertake forestry carbon activities. Permits the States of Washington, Oregon, Idaho, and Montana to apply for funding from the Bonneville Power Administration for purposes of funding loans that meet both the objectives of this Act and certain fish and wildlife objectives of the Bonneville Power Administration.

Transfers to the Administration all functions of the following Federal agencies that relate to administration or enforcement of the food safety laws, as determined by the President: (1) the Food Safety and Inspection Service of the Department of Agriculture; (2) the Center for Food Safety and Applied Nutrition of the Food and Drug Administration (FDA); (3) the Center for Veterinary Medicine of FDA; (4) the National Marine Fisheries Service of the National Oceanic and Atmospheric Administration of the Department of Commerce as it relates to the Seafood Inspection Program; and (5) such others as the President may designate by executive order.
