Treating Tribes and Counties as Good Neighbors Act This bill revises the Good Neighbor Authority program to modify the treatment of revenue from timber sale contracts under good neighbor agreements with the Department of Agriculture (USDA) and the Department of the Interior. (The Good Neighbor Authority permits USDA and Interior to enter into cooperative agreements or contracts with states, counties, and Indian tribes to perform forest, rangeland, and watershed restoration services on federal land managed by the Forest Service or the Bureau of Land Management.) Specifically, the bill (1) requires Indian tribes and counties to retain revenue generated from timber sales under a good neighbor agreement; and (2) allows states, counties, and Indian tribes to use such revenue for authorized restoration projects on nonfederal lands under a good neighbor agreement. (Under current law, only a state is permitted to retain the revenues, and the revenues must be used for restoration projects on federal land.)

Conservation Reserve Program Flexibility Act of 2021 or CRP Flexibility Act of 2021 This bill modifies the Conservation Reserve Program (CRP) to permit emergency haying during the primary nesting season to respond to drought or other emergencies. (Under current law, emergency haying is only permitted outside of the primary nesting season.) Under CRP, the Department of Agriculture provides annual payments to agricultural producers to take highly erodible and environmentally sensitive land out of production and install resource-conserving practices.

Food Chemical Reassessment Act of 2021 This bill establishes the Office of Food Safety Reassessment within the Center for Food Safety and Applied Nutrition and addresses related issues. The office must conduct reassessments of additives, food contact substances, and other related substances to ensure that such substances are safe. Specifically, every three years, the office must reassess the safety of at least 10 substances or classes of substances, including those that are generally recognized as safe for use in food. The office must issue final regulations relating to the safety of each reassessed substance. The bill also specifies 10 substances that the office must assess in its first review. The Food and Drug Administration (FDA) must reestablish the Food Advisory Committee to advise the FDA on issues related to the substance assessments required by this bill.

Not later than 90 days after entering into an agreement, the USDA or Interior, as appropriate, and such state shall jointly conduct a stewardship and fireshed assessment. The USDA and Interior shall carry out fireshed management projects in accordance with the timeline and project size limitations included in the stewardship and fireshed assessment. Fireshed management projects shall be categorically excluded from the preparation of an environmental assessment or an environmental impact statement and exempt from the special administrative review process.

Commonsense Coordination Act This bill allows a federal agency to categorically exclude certain actions from the preparation of an environmental assessment or an environmental impact statement if another agency has categorically excluded such actions. Such a categorical exclusion shall not be subject to judicial review. The bill also categorically excludes certain forest management activities from requirements for environmental assessments or environmental impact statements. The forest management activities designated for such a categorical exclusion are those carried out by the Department of Agriculture (USDA) or the Department of the Interior jointly with another federal agency on certain National Forest System lands or certain public lands, respectively; and for which a categorical exclusion applies with respect to such other agency. USDA or Interior, as appropriate, may use the categorical exclusion after first obtaining written confirmation from the other federal agency that the categorical exclusion applies to the proposed forest management activity.

Resilient Federal Forests Act This bill modifies and sets forth provisions regarding forest management activities on National Forest System, public, and tribal lands. The bill provides for, among other things the Departments of Agriculture (USDA) and Interior to conduct fireshed management projects in fireshed management areas, certain categorical exclusions for various purposes, the balancing of the short- and long-term effects of forest management activities while considering injunctive relief, USDA and Interior to establish their own discretionary arbitration pilot programs as an alternative dispute resolution process for forest management activities, increasing the maximum term for a stewardship end result contract to 20 years, demonstration projects to support the development and commercialization of biochar on Indian forest lands or rangelands and in nearby communities by providing reliable supplies of feedstock from federal lands, the decommissioning of certain Forest Service Roads within designated high fire-prone areas, repealing of the Eastside Screens requirements on National Forest System lands, making the Northwest Forest Plan Survey and Manage Mitigation Measure Standards and Guidelines inapplicable to any National Forest System lands or public lands, development of a protection plan for giant sequoia trees on National Forest System lands and public lands, and permanent rights of access to the Oregon and California Railroad grant lands and the Coos Bay Wagon Road grant lands for private landowners issued reciprocal road rights-of-way.

Agriculture Environmental Stewardship Act of 2021 This bill allows energy tax credits through 2023 for investments in (1) qualified biogas property, or (2) qualified manure resource recovery property. Qualified biogas property comprises a system that (1) uses anaerobic digesters or other specified processes to convert biomass into a gas which is at least 52% methane, and (2) captures the gas for use as a fuel. The term includes property that cleans and conditions the gas for use as a fuel. Qualified manure resource recovery property comprises a system that uses specified processes to recover the nutrients nitrogen and phosphorus from a non-treated digestate or animal manure by reducing or separating at least 50% of the nutrients, excluding any reductions during the incineration, storage, composting, or field application of the non-treated digestate or animal manure. The term also includes certain processing equipment. The Department of the Treasury must enter into an agreement with the National Renewable Energy Laboratory for a study of biogas and report to Congress on the study.

Restore Environmental Vitality and Improve Volatile Economy by the Civilian Conservation Corps Act or the REVIVE the CCC Act This bill permits AmeriCorps to establish the Civilian Conservation Corps (CCC) to address unemployment and environmental conservation and requires the Department of Agriculture to establish an agricultural workforce development program to incentivize apprenticeships in agriculture. The CCC must make grants to local host entities to allow those entities to select applicants to participate in conservation-related service projects. Local entities eligible for grants include, among others, state and local offices, nonprofit organizations, sponsors of apprenticeship programs, and individual farmers. A prospective CCC member must apply for placement with an approved local host for a service position hosted by that local entity. Applicants selected are considered CCC members but are not considered employees of the local host. The local host must provide CCC members with an allowance of $15 per hour of service and must provide a basic healthcare plan to full-time members. A CCC member who completes a term of service with a local host may be eligible to receive an award of up to $5,000 from AmeriCorps towards the costs of an apprenticeship program. These awards and allowances are not considered income for purposes of federal income taxation. The bill also requires the Department of Agriculture to establish an agricultural workforce development program to encourage agricultural businesses to employ apprentices by reimbursing up to 50% of apprenticeship costs.

Western Wildfire Support Act of 2021 This bill establishes activities to address wildfires. The bill requires the Department of Agriculture (USDA) and the Department of the Interior to establish spatial fire management plans before the end of FY2024. The bill establishes accounts in the Treasury for addressing wildfires, a program to train and certify citizens who wish to be able to volunteer to assist USDA or Interior during a wildland fire incident, a program to award grants to eligible states or units of local government to acquire slip-on tank and pump units for a surge capacity of resources for fire suppression, the Theodore Roosevelt Genius Prize for the management of wildfire-related invasive species, and the Management of Wildfire-Related Invasive Species Technology Advisory Board. The bill also requires the Department of Defense (DOD) to reimburse a state or federal agency for the costs of wildfire suppression as a result of a fire caused by DOD activity, requires the Joint Fire Science Program to work with unmanned aircraft test ranges to carry out research and development of unmanned aircraft system fire applications, requires federal and state disaster preparedness programs to include postdisaster assistance, and authorizes the Federal Emergency Management Agency to provide funding to a state agency to establish and operate a website to provide information relating to postfire recovery funding and resources to a community or an individual impacted by a wildland fire.

Veterans' Agricultural Apprenticeship Act of 2021 This bill requires the Department of Agriculture to establish a program to make direct loans to farmers and ranchers who will provide mentorship and apprenticeship opportunities for veterans who have not previously operated a farm or ranch. The Government Accountability Office must report on the effectiveness of the program in assisting veterans in becoming farmers and ranchers.

American Seasonal and Perishable Crop Support Act This bill establishes a program within the Department of Agriculture to make payments to certain producers of seasonal and perishable crops that experienced a decline in market price because of imports of such crops. The bill also sets out a method for calculating these payments. To be eligible for the payments, producers must earn less than a specified limit and derive at least 75% of their adjusted gross income from farming, ranching, or forestry.

Action Versus No Action Act This bill limits the scope of certain environmental assessments or impact statements related to forest management activities on National Forest System lands or public lands suitable for timber production to a consideration only of the effects of the forest management activity and the alternative of no action. Specifically, the bill applies to assessments or impact statements prepared by the Department of Agriculture (USDA), with respect to National Forest System lands, or the Department of the Interior, with respect to public lands, for forest management activities that meet at least one of the criteria specified. In the case of the alternative of no action, USDA or Interior shall consider whether to evaluate the effect of no action on, among other things, forest health, wildfire potential, insect and disease potential, and timber production; and the implications of a resulting decline in forest health, loss of habitat diversity, wildfire, or insect or disease infestation on potential losses of life and property, domestic water supply in the project area, and wildlife habitat loss.

Stop Causing Alarming Tree, Air, and Soil Trauma Resulting from Obstructive Progressives' and Hypocritical Environmentalists' Schemes Act or the Stop CATASTROPHES Act This bill categorically excludes certain forest management activities from the requirement to prepare an environmental assessment or an environmental impact statement. The activities are those that are carried out by the Department of Agriculture on National Forest System Lands or the Department of the Interior on public lands where the primary purpose is to improve or restore such lands or reduce the risk of wildfire on such lands. To be excluded, the area of the forest management activity may not exceed 10,000 acres.

Forest Litigation Reform Act of 2021 This bill sets forth provisions regarding legal challenges to federal forest management activities on land suitable for timber production. The bill revises the standard of review for a court considering a request for injunctive relief applicable to an agency's qualified forest management activity. Specifically, a court must balance the impact to the ecosystem of undertaking the agency action against not undertaking the agency action. The bill also limits the length of preliminary injunctive relief and stays pending appeal in such cases to 60 days. Additionally, the bill directs the Department of Agriculture, with respect to National Forest System lands, and the Department of the Interior, with respect to public lands, to each establish a discretionary arbitration pilot program as an alternative dispute resolution process for challenges to qualified forest management activities. The bill prohibits amounts from being obligated or expended from the Claims and Judgment Fund and awards to pay any fees or other expenses to any plaintiff related to an action challenging a qualified forest management activity.

Salvaging American Lumber Via Action with Greater Efficiency Act or the SALVAGE Act This bill provides for certain activities related to salvage operations and certain reforestation activities conducted on National Forest System lands or public lands. The bill categorically excludes salvage operations carried out by the Department of Agriculture (USDA) and the Department of the Interior, on certain National Forest System lands or certain public lands, respectively, from the requirement to prepare an environmental assessment or an environmental impact statement. Each salvage operation covered by the categorical exclusion may not contain treatment units that exceed a total of 10,000 acres. An environmental assessment for a salvage operation or reforestation activity proposed to be conducted on National Forest System lands or public lands that are adversely impacted by a large-scale catastrophic event shall be completed within 60 days after the conclusion of the event. In the case of such reforestation activities USDA and Interior shall, to the maximum extent practicable, achieve reforestation of at least 75% of the impacted lands during the five-year period following the conclusion of the catastrophic event. No later than 60 days after a wildfire is contained on National Forest System lands, USDA shall convert any timber sales on lands impacted by such wildfire to salvage sales. No restraining order, preliminary injunction, or injunction pending appeal shall be issued by any U.S. court respecting any decision to prepare or conduct a salvage operation or reforestation activity in response to a large-scale catastrophic event.

Water and Agriculture Tax Reform Act of 2021 This bill permits tax-exempt mutual ditch or irrigation companies to earn income from dispositions of certain property and stock interests without affecting their tax-exempt status, but requires that such income be used to pay the costs of operations, maintenance, and capital improvements of such a company. The bill also establishes a rule regarding the organizational governance of mutual ditch or irrigation companies. Where state law provides that such a company may be organized in a manner that permits voting on a basis that is pro rata to share ownership on corporate governance matters, the tax-exempt status of the mutual ditch or irrigation company must be determined without taking into account whether its member shareholders have one vote on corporate governance matters per share held in the corporation.

Bioeconomy Research and Development Act of 2021 This bill directs the Office of Science and Technology Policy (OSTP) to implement a National Engineering Biology Research and Development Initiative to advance societal well-being, national security, sustainability, and economic productivity and competitiveness. Among other activities, the initiative must include sustained support for research centers, individual investigators, technologies, and training. The initiative shall include outreach to primarily undergraduate and minority-serving institutions about initiative opportunities, and shall encourage the development of research collaborations between research-intensive universities and such institutions. The OSTP shall designate an interagency committee to coordinate initiative activities as appropriate. The interagency committee shall submit triennial reports to Congress through FY2028 in support of the initiative. The National Science Foundation (NSF) shall seek to enter into an agreement with the National Academies of Sciences, Engineering, and Medicine to conduct a review of, and make recommendations with respect to, the ethical, legal, environmental, safety, security, and other appropriate societal issues related to engineering biology research and development. The NSF, National Institute of Standards and Technology, National Oceanic and Atmospheric Administration, Department of Energy, National Aeronautics and Space Administration (NASA), Department of Agriculture, Environmental Protection Agency, and Department of Health and Human Services shall carry out related activities as part of the initiative.

Local Law Enforcement Protection Act of 2021 This bill requires state and local governments to certify that they provide a certain level of qualified immunity to law enforcement officers in order to be eligible for (1) funds under the Community Development Block Grant program, and (2) loans under the Department of Agriculture's Community Facilities Direct Loan and Grant Program. Qualified immunity is a judicially created legal doctrine that shields government officials from civil liability in cases involving the deprivation of statutory or constitutional rights.

Tribal Biochar Promotion Act of 2021 This bill establishes biochar demonstration projects. Biochar refers to carbonized biomass produced by converting feedstock through reductive thermal processing for nonfuel uses. Specifically, the bill directs the Department of the Interior (for land under Bureau of Land Management jurisdiction) and the Department of Agriculture (for land under Forest Service jurisdiction) to enter into agreements with tribes or tribal organizations to carry out biochar demonstration projects. Helping America's Farmers Act This bill provides financial assistance to certain agricultural entities. Specifically, the bill directs the Farm Service Agency (FSA) of the Department of Agriculture (USDA) to carry out a program to provide economic disaster loans to certain agricultural entities with an adjusted gross income of less than or equal to $500,000. Under the program, such entities are eligible for zero-interest loans of up to $2 million and may seek loan forgiveness based on demonstrated economic hardship. In making loans, priority must be given to (1) entities located in states most impacted by an economic disaster; and (2) minority, veteran, and women farmers and ranchers. The FSA may also guarantee a loan to certain agricultural entities with an adjusted gross income of greater than $500,000 if such loan meets certain requirements. Entities that apply for a loan or loan guarantee may request that the FSA provide an emergency grant of at least $20,000 upon application. The bill also provides funding for USDA to carry out a program to provide FSA staff with appropriate training relating to economic injury loan processing and servicing.

This bill makes changes to enrollment processes and other aspects of the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC). Under current law, an individual who participates in Medicaid and other specified means-tested programs automatically meets applicable income eligibility for WIC. The bill extends this automatic income eligibility to participants in Head Start programs, certain nutrition programs (e.g., the Food Distribution Program on Indian Reservations), and the Children's Health Insurance Program. It also extends income eligibility to individuals who reside in a household in which a member receives assistance from such a program. Other changes in the bill include (1) allowing states to certify a child's eligibility for WIC for up to two years, and (2) requiring states to address benefits for infants and children under the care of kinship families in WIC plans.

Tribal Access to Clean Water Act of 2021 This bill provides funding for and expands access to water resources for Native communities (i.e., Indian tribes and Native Hawaiian communities). First, the bill provides funding for the Indian Health Service to (1) plan, design, construct, modernize, improve, and renovate water, sewer, and solid waste sanitation facilities; (2) provide technical assistance; and (3) operate and maintain water facilities that serve Native communities. Next, the bill provides funding for the Department of Agriculture to provide water and wastewater facility grants to eligible entities (e.g., Native communities) that have residents facing significant health risks due to inadequate water supply systems. An eligible entity shall not be required to provide a matching contribution in order to receive a grant. In addition, the bill reauthorizes through FY2031 the Bureau of Reclamation's Rural Water Supply Program. Further, the bill provides funding for and establishes a grant program for tribal clean water access projects. It also provides funding for the Native American Affairs Technical Assistance Program. The bill also provides funding for the Environmental Protection Agency to provide grants to Indian tribes and Alaska Native villages for drinking water and clean water.

Chester County Reversionary Interest Release Act This bill directs the Department of Agriculture (USDA) to release the reversionary interest of the United States in a 0.62-acre parcel of land in Chickasaw State Forest in Tennessee (the state forest land), if, as consideration for the release, Tennessee agrees to transfer to the United States a vested future interest in the 0.90-acre parcel known as the Webb property that is similar to the reversionary interest in order to facilitate a land exchange between Bethel Baptist Church in Henderson, Tennessee, and the state. As soon as the state has complied with specified requirements concerning the deed for the state forest land, USDA shall convey to the state the undivided mineral interest of the United States in such land. Additionally, USDA must determine the mineral character of the state forest land and the fair market value of the U.S. mineral interests no more than 90 days after enactment of this bill. Tennessee must pay the United States the fair market value of the mineral interests.

Broadband Internet Connections for Rural America Act This bill reauthorizes and makes other changes to various programs of the Department of Agriculture (USDA) that support broadband internet expansion in rural areas. Specifically, the bill reauthorizes through FY2030 and modifies a program that provides grants, loans, and loan guarantees for broadband expansion. Modifications include revising the criteria used to prioritize applications and projects and changing the name of the program to the ReConnect Rural Broadband Program. Further, the bill terminates on June 30, 2022, a separate USDA pilot program that supports broadband expansion in rural areas; any program funds that remain available after that date shall be used for the ReConnect Rural Broadband Program. The bill also reauthorizes through FY2030 programs that support (1) rural broadband access, including for economically challenged communities; and (2) innovative technologies to decrease broadband deployment costs and increase broadband speeds. It also increases the authorization of appropriations for grants, loans, and other assistance to expand middle mile broadband infrastructure (i.e., connections between national and regional internet backbones and schools, businesses, residences, and other local connection sites). Additionally, USDA must establish a system to disseminate information and technical assistance concerning its broadband expansion programs and may award grants to units of governments and other eligible entities to collect data about broadband availability (e.g., location of infrastructure, costs, and speeds).

School Food Modernization Act This bill provides for loan guarantees and grants to support healthy meals under the National School Lunch Program and School Breakfast Program. The bill directs the Department of Agriculture (USDA) to issue loan guarantees to local educational agencies (LEAs), school food authorities, tribal organizations, and other eligible entities to finance infrastructure improvements or equipment purchases to facilitate their provision of healthy meals through the school meal programs. USDA must also award competitive matching grants to assist LEAs, school food authorities, and tribal organizations in purchasing the durable equipment and infrastructure they need to serve healthier meals and improve food safety. USDA must give preference under both programs to applicants that demonstrate a substantial or disproportionate need for food service infrastructure or durable equipment, and shall establish fees for the loan guarantee program. In addition, USDA must award competitive matching grants to experienced third-party training institutions to provide school food service personnel with the training and technical assistance they need to (1) meet or exceed nutrition standards under the school meal programs, and (2) improve the efficacy and efficiency of the school meal programs.

Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2022 This bill provides FY2022 appropriations for the Department of Agriculture (USDA), the Food and Drug Administration, and related agencies. The bill provides appropriations to USDA for agricultural programs, including the Office of the Secretary, Executive Operations, the Office of Civil Rights, the Economic Research Service, the National Agricultural Statistics Service, the Agricultural Research Service, the National Institute of Food and Agriculture, the Animal and Plant Health Inspection Service, the Agricultural Marketing Service, and the Food Safety and Inspection Service. The bill also provides appropriations to USDA for farm production and conservation programs, including the Farm Production and Conservation Business Center, the Farm Service Agency, the Risk Management Agency, and the Natural Resources Conservation Service. The bill provides appropriations to the Federal Crop Insurance Corporation Fund and the Commodity Credit Corporation Fund. For USDA rural development programs, the bill includes appropriations for Rural Development Salaries and Expenses, the Rural Housing Service, the Rural Business-Cooperative Service, and the Rural Utilities Service. The bill provides appropriations to the Food and Nutrition Service for Child Nutrition Programs; the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC); the Supplemental Nutrition Assistance Program (SNAP, formerly known as the food stamp program); the Commodity Assistance Program; and Nutrition Programs Administration. The bill provides appropriations to the Foreign Agricultural Service for (1) Food for Peace Title II Grants, and (2) McGovern-Dole International Food for Education and Child Nutrition Program Grants. The bill also provides appropriations for the Food and Drug Administration, the Commodity Futures Trading Commission, and the Farm Credit Administration. Additionally, the bill sets forth requirements and restrictions for using funds provided by this and other appropriations acts.

Broadband Internet for Small Ports Act This bill requires the Department of Agriculture, when distributing funds for broadband deployment, to give priority to projects for ports in rural areas. In addition, a recipient of such rural broadband buildout funding must provide certain geolocation information as a condition of receiving the funds.

Salad Bars in Schools Expansion Act This bill requires the Department of Agriculture (USDA) to establish and implement a plan, including through a five-year program of competitive grants, to promote the use of salad bars in schools participating in the school lunch program. Priority in the award of grants may be given to entities that (1) serve schools in which at least 50% of the students are eligible for free or reduced-price lunches or that are located in food deserts, or (2) provide nutrition education. F ood desert is defined as a census tract with a substantial share of residents who live in low-income areas that have low levels of access to a grocery store or a healthy, affordable food retail outlet. USDA shall revise the March 27, 2013, policy memorandum SP 31-2013, Salad Bars in the National School Lunch Program , in light of recommendations submitted to Congress under this bill.

This bill rescinds specified funds that were provided to the Department of Agriculture for assistance and support for socially disadvantaged farmers, ranchers, and forest land owners and operators. The bill makes the rescinded funds available for scholarships at 1890 Institutions (i.e., historically Black colleges and universities that belong to the U.S. land-grant university system).

Wildland Firefighter Fair Pay Act This bill exempts federal wildland firefighters in the Department of the Interior, the Department of Agriculture (USDA), and the Department of Commerce from certain premium pay limitations for work relating to wildfire emergencies. The bill applies retroactively to January 1, 2020. Interior and USDA must each separately submit a report to specified congressional committees on the resources, policies, personnel or structural changes, and other investments necessary to support an expanded full-time, year-round firefighting workforce.

Dairy Pricing and Policy Commission Act of 2021 This bill directs the Department of Agriculture (USDA) to temporarily establish the Dairy Pricing and Policy Commission. The commission shall develop legislative, regulatory, and market-based recommendations to improve milk prices and dairy farm profitability, including for responding to periods of heightened dairy production during low prices; enhance competitiveness of American dairy in world markets; and evaluate new markets for dairy exports. The commission shall terminate on the earlier of (1) the date it submits to USDA and Congress a report of its legislative and regulatory recommendations; or (2) the date that is two years after the commission's establishment.

Opportunities for Fairness in Farming Act of 202 1 This bill establishes restrictions and requirements for checkoff programs, which are programs overseen by the Department of Agriculture (USDA) to promote and provide research and information for a particular agricultural commodity without reference to specific producers or brands. The bill prohibits boards established to carry out a checkoff program or a USDA order issued under a checkoff program from entering into a contract or agreement to carry out program activities with a party that engages in activities to influence any government policy or action that relates to agriculture. A board or its employees or agents acting in their official capacity may not engage in any act that may involve a conflict of interest; anticompetitive activity; unfair or deceptive act or practice; or act that may be disparaging to, or in any way negatively portray, another agricultural commodity or product. Upon approval of USDA, a board may enter directly into contracts and agreements to carry out generic promotion, research, or other activities authorized by law if the agreement or contract requires records accounting for the funds received to be submitted to the board. The board must meet specified requirements regarding the publication of budgets and disbursements of funds. The USDA Inspector General and the Government Accountability Office must conduct specified audits regarding checkoff programs.

Food and Nutrition Education in Schools Act of 202 1 This bill directs the Department of Agriculture (USDA) to establish a Food and Nutrition Education in Schools Pilot Program to award grants to local educational agencies for (1) projects that hire qualified, full-time food and nutrition educators to carry out programs in schools that have the goal of improving student health and nutrition; and (2) projects that fund school gardens or other evidence-based interventions relating to student health and nutrition, aligned with the latest school nutrition standards, to create hands-on learning opportunities for students. In awarding grants under the program, USDA must prioritize projects that serve schools or districts (1) in which not less than 40% of students qualify for free or reduced-price meals, or (2) that include neighborhoods with high rates of childhood obesity or other diet-related diseases. Additionally, it must give priority to projects that provide programming in summer months and those that are joint partnership projects.
