Earth Act of 2022

Earth Act of 2022 This bill addresses climate change by establishing requirements concerning renewable energy, zero emission vehicles, regenerative agriculture, and tax incentives related to climate transition costs. Specifically, the bill requires that by 2030, 100% of electricity sold by certain retail electric suppliers must be from renewable energy resources (e.g., wind energy); new motor vehicles (e.g., certain cars and trucks) sold by manufacturers must be zero emission vehicles; land and livestock managed by certain publicly-traded corporations must be managed with regenerative agricultural practices. The Department of Energy (DOE), the Department of Transportation, and the Department of Agriculture (USDA) must create grants to pay up to 50% of the costs of meeting those requirements. DOE must also issue regulations regarding the sourcing, recycling, and disposal of materials used to manufacture renewable energy sources (e.g., equipment that stores renewable energy). The goals of the regulations must be to (1) eliminate the use of rare earth metals in the manufacture of those sources, and (2) ensure the recycling of all such materials. USDA must issue regulations that (1) require the reduction of greenhouse gas emissions resulting from certain land or livestock corporations, and (2) ensure the well-being of animals raised for human consumption or the production of dairy products. The bill also provides tax incentives for electric suppliers, vehicle manufacturers, and such corporations to meet the requirements established by this bill by allowing them to double certain tax deductions for qualified capital climate transitions costs.

Farmers Feeding Families Act of 2022

Farmers Feeding Families Act of 2022 This bill amends The Emergency Food Assistance Program (TEFAP) to authorize the Food and Nutrition Service (FNS) to provide funds for states to purchase priority agricultural products (e.g., fruits, vegetables, meats, and grains) from eligible small businesses and distribute them to needy persons through emergency feeding organizations. New farmers and small or mid-sized family farms qualify as eligible small businesses under this FNS program, as well as packers, distributors, cooperatives, and others that source agricultural products from them. The bill also requires a state's TEFAP plan eligibility standards to include, at a minimum, all individuals or households with an income less than 250% of the poverty line.

SARE Modernization Act

Sustainable Agriculture Research and Education Modernization Act or the SARE Modernization Act This bill reauthorizes the Sustainable Agriculture Research and Education (SARE) program and expands the program to include research on agricultural production systems that increase resilience and climate mitigation in the context of a changing climate. The bill also expands SARE's regional councils to include representatives from 1890 land grant institutions, 1994 land grant institutions, Hispanic-serving institutions, Alaska Native serving institutions, or Native Hawaiian serving institutions.

A bill to amend the Bill Emerson Good Samaritan Food Donation Act to improve the program, and for other purposes.

This bill expands liability protections for the donation of food and grocery products. Specifically, the bill expands the liability protections to include donations of an apparently fit grocery product or apparently wholesome food for which the recipient is charged a good Samaritan reduced price that is no greater than the cost of handling, administering, harvesting, processing, packaging, transporting, and distributing the food or product; or that is donated directly to a needy individual at zero cost by a retail grocer, wholesaler, agricultural producer, agricultural processor, agricultural distributor, restaurant, caterer, school food authority, or institution of higher education.

Student Loan Forgiveness for Farmers and Ranchers Act This bill establishes a student loan forgiveness program for certain farmers or ranchers. Specifically, to receive loan forgiveness under this bill, a borrower must (1) make 120 monthly loan payments under a specified repayment plan while employed full-time at a qualified farm or ranch; and (2) fall within certain categories of individuals such as a beginner farmer or rancher, an individual underrepresented in the agricultural profession, or a veteran farmer or rancher.

Access to Donor Milk Act of 2022

Federal Land Freedom Act

Federal Land Freedom Act This bill sets forth a process that allows a state (including the District of Columbia) to seek to transfer the responsibility of energy development on federal land within its boundaries from the federal government to the state. Federal land does not include land that, as of May 31, 2013, is (1) held for the benefit of an Indian tribe, (2) in the National Park System, (3) in the National Wildlife Refuge System, or (4) in a congressionally designated wilderness area. To qualify for such a transfer of responsibility, a state must have a program that regulates the exploration and development of oil, natural gas, and other forms of energy on its land. The federal responsibility transfers to the state once the state submits to the Department of the Interior, the U.S. Department of Agriculture, and the Department of Energy a declaration that it has such a program and that it seeks to transfer the responsibility. Any action taken by a state to lease, permit, or regulate the exploration and development of energy on federal land in lieu of the federal government is not subject to the Administrative Procedure Act, the National Historic Preservation Act, the Endangered Species Act of 1973, or the National Environmental Policy Act of 1969.

Family Farmer and Rancher Tax Fairness Act of 2022

Farmland Security Act of 2022

Farmland Security Act of 2022 This bill requires the Department of Agriculture (USDA) to submit to Congress an annual report on foreign investments in agricultural land in the United States, including a description of the impact that foreign ownership of agricultural land has on family farms, rural communities, and the domestic food supply. USDA must also establish a public database that contains data from each report submitted.

Industrial Agriculture Accountability Act of 2022

Industrial Agriculture Accountability Act of 2022 This bill establishes additional requirements for larger animal feeding operations (AFOs) owned or controlled by industrial operators and increases handling requirements for livestock and poultry. Specifically, the bill establishes the Office of High-Risk AFO Disaster Mitigation and Enforcement within the Department of Agriculture (USDA) and requires such industrial operators to register with the office and submit annual disaster mitigation plans (e.g., for public health emergencies and major disasters). In addition, industrial operators must pay annual disaster mitigation maintenance fees to the office and are liable for costs associated with disaster events or depopulation (the rapid destruction of animals in response to urgent circumstances). Industrial operators are restricted from using specified methods of depopulation; any person may sue an industrial operator or USDA over a violation. Further, USDA must establish depopulation standards that rapidly induce unconsciousness and death with minimal pain and distress. The Department of Labor must enforce minimum labor standards for industrial operators regarding covered workers or affected contract growers in disaster mitigation events, including whistleblower protections and health insurance requirements. Further, industrial operators may not use incarcerated workers in these events. The bill also includes provisions on the handling of livestock and poultry, such as requiring USDA to set additional standards for animal transport; including poultry in the Humane Methods of Slaughter Act of 1958 and creating a USDA grant program to transition processing facilities to a different slaughter method; requiring USDA to promulgate certain regulations regarding the humane treatment, euthanasia, and disposition of nonambulatory livestock; and terminating programs that allow for slaughter speeds that exceed existing limits or reduce the use of federal inspectors.

Rural Internet Improvement Act of 2022

Rural Internet Improvement Act of 2022 This bill merges the pilot ReConnect Loan and Grant Program with existing loans and grants provided by the Department of Agriculture (USDA) to facilitate broadband access to rural areas that lack sufficient access to broadband. Unobligated amounts available for the pilot program must be transferred and made available, without further appropriations, to this merged program. The bill specifies eligibility criteria and other requirements that apply to the merged program. For example, the bill limits funds from the merged program to projects in areas where at least 90% of the households lack sufficient access to broadband services, which is currently required under the pilot program. Other changes in the bill address procedures for contesting the accuracy of broadband maps that are used to identify eligible areas. It also requires efforts to increase coordination concerning broadband initiatives between USDA, the Federal Communications Commission, and the National Telecommunications Information Administration.

Ensuring America's Critical Infrastructure Act This bill expands the definition of critical infrastructure under the Critical Infrastructures Protection Act of 2001 in the USA PATRIOT Act. The term currently means systems and assets, whether physical or virtual, so vital to the United States that the incapacity or destruction of such systems and assets would have a debilitating impact on security, national economic security, or national public health or safety. The bill includes certain sectors as part of the existing definition, including communications, dams, emergency services, energy, financial services, food and agriculture, healthcare, information technology, transportation systems, and water and wastewater systems.

Fertilizer SUSTAIN Act

Food Deserts Act

Food Deserts Act This bill establishes a Department of Agriculture program to provide grants to states for revolving funds to support the establishment and operation of grocery stores in underserved communities. An underserved community is a community that has (1) limited access to affordable, healthy foods, including fresh fruits and vegetables, in grocery retail stores or farmer-to-consumer direct markets; and (2) a high rate of hunger, a high rate of food insecurity, or a high poverty rate. States must use the funds to make loans to support grocery stores in underserved communities, including for opening a store (excluding new construction), or supporting or purchasing an existing store. States may only make loans for grocery stores that meet requirements related to emphasizing unprocessed, healthful foods; providing staple foods and a variety of raw fruits and vegetables; having a plan to keep the foods in stock; charging affordable prices at or below market values; meeting specified matching requirements using nonfederal funds; and being qualified to operate a store or having partnerships with organizations that provide technical assistance. States must prioritize loan applications from entities that meet criteria related to hiring workers from the underserved community, providing classes or educational information about a healthful diet, sourcing food from local urban farms and gardens, and demonstrating existing supply chain relationships in the grocery industry.

ABC Act of 2022

Access Business Credit Act of 2022 or the ABC Act of 2022 This bill excludes from the gross income of certain banks, for income tax purposes, interest received on small business loans of up to $5 million. The exclusion does not apply to interest received after 2027. The bill applies to loans that are (1) secured by land situated in the United States that is used or held by the small business in connection with the active conduct of a farming business, or (2) incurred in the ordinary course of the trade or business of the small business. To be eligible for the exclusion, a bank must have less than $50 billion in assets at the close of the preceding taxable year.

The bill makes exceptions for specified existing regulations and where the applicable department determines that a decline in wildlife population at the specific unit of federal land or water is primarily caused by the use of lead in ammunition or tackle, based on the field data from such unit, and the state approves the regulations.

Ouachita National Forest Overnight Camping Act

Ouachita National Forest Overnight Camping Act This bill requires the identification and development of campsites and related facilities in the Ouachita National Forest in Arkansas. The Department of Agriculture (USDA) shall (1) identify areas within Albert Pike Recreation Area that may be suitable for overnight camping; (2) review each area identified; and (3) from the areas identified, select and establish campsites and related facilities within the recreation area for public use. USDA must ensure (1) that at least 54 campsites are available, of which not less than 8 shall have electric and water hookups; and (2) that each campsite and related facility identified or established is located outside of the 1% annual exceedance probability flood elevation. Not later than 30 days after the enactment of this bill, USDA shall open each campsite within the recreation area that (1) exists on the enactment of this bill, and (2) is located outside of the 1% annual exceedance probability flood elevation.

The bill also expands eligibility for payments under the programs to include emergency measures to address damages caused by (1) a wildfire that is not caused naturally if the damage is caused by the spread of the wildfire due to natural causes, and (2) a wildfire that is caused by the federal government.

Agriculture Disaster Assistance Improvement Act of 2022

Agriculture Disaster Assistance Improvement Act of 2022 This bill modifies access to Department of Agriculture disaster assistance programs and requires increased interagency cooperation in drought-related activities. The bill specifies that state and federal grazing permit holders are eligible for the Emergency Conservation Program and the Emergency Forest Restoration Program. Further, emergency measures eligible for payments include new permanent measures, such as permanent water wells and pipelines. The bill also waives the 30-day comment period required for applications under the National Environmental Policy Act of 1969 for emergency measures carried out during a drought emergency. Modifications to the Livestock Forage Disaster Program allow for one monthly payment when a county has four consecutive weeks of a D2 rating (severe drought) and two payments for eight consecutive weeks of D2. Currently, one payment is available for eight consecutive weeks of D2. The bill expands coverage for honey bee producers under the Emergency Assistance for Livestock, Honey Bees, and Farm-Raised Fish Program (ELAP) for losses caused by adverse weather or drought, such as transportation costs and reduced honey crops. Further, the bill requires the ELAP payment rate for honey bee producers to incorporate additional factors, such as per-hive and per-colony rates of loss. The USDA must establish an interagency working group to improve the consistency and accuracy of U.S. Drought Monitor data. Finally, the Farm Service Agency and the Forest Service must enter into a memorandum of understanding to better align their drought response activities.

This resolution supports the designation of October 2-October 8, 2022, as National 4-H Week. It also (1) recognizes the important role of 4-H in youth development and education, and (2) encourages all citizens to recognize 4-H for the significant impact the organization and members have made and continue to make by empowering young people with the skills needed to lead for a lifetime.

To establish deadlines for the Secretary of the Interior and the Secretary of Agriculture to complete certain environmental reviews, to establish notification rules for receipt of onshore right-of-way applications, and for other purposes.

This bill establishes deadlines by which the Department of Agriculture and the Department of the Interior must complete certain environmental reviews and environmental impact statements required under the National Environmental Policy Act of 1969. It also modifies maximum terms for and other aspects related to certain rights-of-way on federal lands.
