Financial Artificial Intelligence Risk Reduction Act or the FAIRR Act This bill addresses the impact of artificial intelligence on financial markets. The bill requires the Financial Stability Oversight Council to coordinate with agencies regarding threats to the financial system posed by artificial intelligence, including the use of false representations of the likeness, speech, or actions of persons to manipulate or to cause disruptions to financial markets. The council must report on its findings and make policy recommendations to Congress. After congressional review, the council must implement these recommendations. The Securities and Exchange Commission is allowed to seek treble civil penalties for violations of federal securities exchange law that involve machine-manipulated media. The bill establishes liability for a person who, directly or indirectly, deploys or causes to be deployed an artificial intelligence model involved in a securities law violation. The bill also provides for the regulation and supervision of certain financial organizations and service providers. For example, if a credit union that is subject to examination by the Board of Directors of the National Credit Union Administration delegates the performance of certain activities and services, this delegation must be disclosed and is subject to regulation and examination by the board.

Federal Artificial Intelligence Risk Management Act of 2023 This bill directs federal agencies to use the Artificial Intelligence Risk Management Framework developed by the National Institute of Standards and Technology (NIST) regarding the use of artificial intelligence (AI). Specifically, the bill requires NIST to issue guidelines for agencies to incorporate the framework into their AI risk management efforts, which shall, among other things provide standards, practices, and tools consistent with the framework and how they can leverage the framework to reduce risks to people and the planet for agency implementation in the development, procurement, and use of AI; specify appropriate cybersecurity strategies and the installation of effective cybersecurity tools to improve security of AI systems; and set minimum requirements for developing profiles for agency use of AI. The Office of Management and Budget (OMB) must issue guidance requiring federal agencies to incorporate the framework and the guidelines into their AI risk management efforts. The Government Accountability Office shall study the impact of the application of the framework on agency use of AI. The OMB must (1) periodically report to Congress on agency implementation and conformity to the framework, and (2) establish an initiative to provide expertise on AI pursuant to requests by agencies. NIST shall (1) complete a study to review the existing and forthcoming voluntary consensus standards for the testing, evaluation, verification, and validation of AI acquisitions; and (2) convene relevant stakeholders to develop such standards and take other specified steps.

Not later than one year after the enactment of this bill, CDAO must brief Congress on the development of bug bounty programs and long-term plans with respect to such programs. The bill also requires CDAO to study the vulnerabilities to the privacy, security, accuracy of, and capacity to assess, artificial intelligence-enabled military applications. Finally, DOD must report on ways to improve data sharing, interoperability, and quality across DOD.
