Freedom from Government Competition Act of 2009 - Requires each executive or military department or independent establishment to obtain all goods and services necessary for or beneficial to the accomplishment of its authorized functions by procurement from private sources, except if: (1) such goods or services are required by law to be produced or performed by such agency; or (2) the head of the agency determines and certifies that federal production or performance is necessary for the national defense or homeland security, that a good or service is so inherently governmental in nature that it is in the public interest to require production or performance by government employees, or that there is no private source capable of providing the good or service. Requires such private sector provision of goods and services to be performed through: (1) the divestiture of federal involvement; (2) the award of a contract using competitive procedures; (3) converting an activity to performance by a qualified firm under at least 51% ownership by an Indian tribe or a Native Hawaiian Organization; or (4) conducting a public-private competitive sourcing analysis in accordance with Office of Management and Budget (OMB) procedures and determining that using the private sector is in the best interest of the United States and provides the best value to the taxpayer. Authorizes an agency head to utilize federal employees to provide goods or services previously provided by a private sector entity upon completion of a public-private competitive sourcing analysis and after determining that provision by federal employees provides the best value. Requires the Director to carry out a study, in conjunction with the Comptroller General, to evaluate the activities carried out in each agency.

National Defense Authorization Act for Fiscal Year 2010 - Authorizes appropriations for the Department of Defense (DOD) for FY2010. Authorizes appropriations to DOD for: (1) procurement, including for aircraft, missiles, weapons and tracked combat vehicles, ammunition, and shipbuilding and conversion; (2) the Rapid Acquisition Fund; (3) the Joint Improvised Explosive Device Defeat Fund; (4) Defense Production Act purchases; (5) the Mine Resistant Ambush Protected Vehicle Fund; (6) research development, test, and evaluation; (7) operation and maintenance; (8) Working Capital Funds; (9) the National Defense Sealift Fund; (10) the Defense Health Program; (11) chemical agents and munitions destruction; (12) drug interdiction and counter-drug activities; (13) the Defense Inspector General; (14) the Armed Forces Retirement Home; and (15) active and reserve military personnel, including end strengths. Sets forth provisions or requirements concerning: (1) military personnel policy; (2) military pay and allowances; (3) acquisition policy and management; (4) DOD organization and management; (5) financial matters; (6) matters relating to foreign nations; and (7) matters relating to military construction, family housing, and real property. Extends through FY2010 DOD authority to provide income equalization payments to reserve personnel experiencing extended and frequent active-duty mobilizations. Provides a special monthly allowance to servicemembers recovering from combat or combat-related catastrophic injuries. Authorizes certain private sector employees to receive instruction at the Defense Cyber Investigations Training Academy operating under the Defense Cyber Crime Center. Provides enhanced DOD authority to acquire products and services produced in Central Asia, Pakistan, and the South Caucasus.

Homes for Heroes Act of 2009 - Amends the Department of Housing and Urban Development Act to establish in the Department of Housing and Urban Development (HUD) a Special Assistant for Veterans Affairs to: (1) ensure veteran access to HUD housing and homeless assistance programs; (2) coordinate all HUD programs and activities relating to veterans; and (3) serve as a HUD liaison with the Department of Veterans Affairs (VA). Directs the HUD Secretary to provide assistance to private nonprofit organizations and consumer cooperatives to expand the supply of supportive housing for very low-income veteran families (that is, families with incomes not exceeding 50% of the area median income). Amends the United States Housing Act of 1937 to: (1) make housing rental vouchers available to all homeless veterans, regardless of medical condition; and (2) include veterans in public housing planning. Excludes veterans' benefits from income for purposes of HUD assisted housing rental determinations. Requires the Secretary to: (1) make grants to nonprofit entities for technical assistance in sponsoring HUD housing projects for veterans; and (2) report annually to specified congressional committees and the VA Secretary on HUD activities relating to veterans.

Increases the monthly rates of veterans' dependency and indemnity compensation (DIC) payable to surviving spouses through the Department of Veterans Affairs (VA). Provides a phase-in of DIC payments in the case of veterans who die of a non-service-connected disability after being eligible for at least five years for VA compensation for a service-connected disability rated as total. Reduces from 57 to 55 the age after which the remarriage of a surviving spouse shall not terminate DIC payments.

Homeowners' Defense Act of 2009 - Establishes the National Catastrophe Risk Consortium as a nonprofit, nonfederal entity to: (1) maintain an inventory of catastrophe risk obligations held by state reinsurance funds, state residual insurance market entities, and state-sponsored providers of natural catastrophe insurance; (2) issue, on a conduit basis, securities and other financial instruments linked to catastrophe risks insured or reinsured through Consortium members; (3) coordinate reinsurance contracts; (4) act as a centralized repository of state risk information accessible by certain private-market participants; and (5) establish a database to perform research and analysis that encourages standardization of the risk-linked securities market. Authorizes the Secretary of the Treasury to guarantee holders of debt against loss of principal or interest, or both, on any such debt issued by eligible state programs for purposes of promoting the availability of private capital to provide liquidity and capacity to state catastrophe insurance programs and expediting the payment of claims under such programs and better assist the financial recovery from significant natural catastrophes. Provides separate limits on the total principal amount of such obligations for programs that cover earthquake peril and those that cover all other perils. Directs the Secretary to make contracts for reinsurance coverage available for purchase by eligible state programs. Provides pricing guidelines and a limit on aggregate potential federal liability. Establishes a Federal Natural Catastrophe Reinsurance Fund in the Treasury to be funded by amounts received from the sale of reinsurance coverage contracts, amounts appropriated for liability for claims payment, and earnings on investments. Directs the Secretary of Housing and Urban Development (HUD) to establish and carry out a program of grants to eligible entities to develop, enhance, or maintain programs to prevent and mitigate losses from natural catastrophes. Requires a study of the need for and impact of expanding the programs established by this Act to apply to insured losses of eligible state programs for losses arising from commercial insurance policies that provide coverage for properties composed predominantly of residential rental units.

Military Children’s School Investment Act - Amends the Impact Aid program (which compensates local educational agencies [LEAs] for the financial burden of federal activities affecting their areas) of the Elementary and Secondary Education Act of 1965 to authorize the Secretary of Education to award grants to LEAs that: (1) were eligible for Impact Aid in the prior fiscal year due to federally-connected children; and (2) are experiencing an enrollment increase of at least 250 or 10% consisting of certain federally-connected children whose arrival is due to military base closures and realignments or global rebasing, force structure changes or reductions, or actions initiated by the Secretary of Defense. Requires such grants to be used: (1) to construct new schools or expand existing schools to accommodate the influx of students; (2) repair or upgrade academic facilities; or (3) lease, with the Secretary's approval, buildings or portions of buildings from a private entity for additional school space.

Help Student Soldiers Act - Amends title IV (Student Assistance) of the Higher Education Act of 1965 to waive the application of the requirement that students return title IV funds which were unearned due to their withdrawal from school to students whose withdrawal is necessitated by service in the Armed Forces. Provides loan forgiveness under the Federal Family Education Loan, Direct Loan, and Perkins Loan programs to students for that portion of loan assistance which is unearned due to their withdrawal from school for service in the Armed Forces and which is not returned to such programs by their schools.

PROTECT Act or Protecting the Retirement of Our Troops by Ensuring Compensation is Timely Act - Prohibits the Secretary of the military department concerned from presuming deceased a military retiree missing in Iraq or Afghanistan on or after October 7, 2001, until the earlier of seven years after the person was declared missing or the date the death is confirmed and a death certificate is delivered to the next of kin. Requires monthly retired pay to be resumed and any retired pay that may have been due following the declaration of the presumption of death to be retroactively paid to the family of the retiree.

Women Veterans Access to Care Act - Directs the Secretary of Veterans Affairs (VA), in providing health care services to women veterans, to emphasize: (1) with respect to physical health, conditions including reproductive health, preventive medicine and early detection, sexual trauma, special needs of women with prosthetics, and rehabilitation; (2) with respect to mental health, issues including stress reduction, services for depression, anxiety, post-traumatic-stress-disorder (PTSD), and substance abuse, and conflict resolution; (3) improving health-related telecommunications technologies; (4) providing care to women veterans who served in Operations Enduring Freedom or Iraqi Freedom, live in a rural area, or are homebound or elderly; and (5) with respect to health professionals employed by the VA, hiring health professionals who are specialist in fields related to women's health, and offering additional training on special issues regarding women veterans. Requires the Secretary to: (1) conduct a study on health care for women veterans; and (2) carry out an information outreach program for women veterans and their families.

Atomic Veterans Relief Act - Includes within the definition of a "radiation-risk activity" for purposes of eligibility for veterans' disability compensation the exposure at any time to ionizing radiation from undetonated weapons or residual contamination resulting from a nuclear detonation. Directs the Secretary of Veterans Affairs to include in regulations pertaining to the service-connection of veterans' disabilities additional provisions to ensure, in the case of a claim by a radiation-exposed veteran for service-connection of a nonpresumptive disability, that the procedures for establishment of whether the disability is service-connected and which require the mathematical calculation of the level of exposure of the veteran to the ionizing radiation (commonly referred to as dose reconstruction) also require the Secretary to, among other things: (1) determine the facts and circumstances of the exposure while presuming the veteran's recitation of the event as correct, unless clear and convincing evidence establishes otherwise; and (2) obtain a reconstructed dose based on specific facts and circumstances established by the evidence.

Veterans 2nd Amendment Protection Act - Prohibits, in any case arising out of the administration of laws and benefits by the Secretary of Veterans Affairs, considering any person who is mentally incapacitated, deemed mentally incompetent, or experiencing an extended loss of consciousness from being considered adjudicated as a mental defective for purposes of the right to receive or transport firearms without the order or finding of a judge, magistrate, or other judicial authority of competent jurisdiction that such person is a danger to himself or herself or others.

Latin America Military Training Review Act - Directs the Secretary of the Army to suspend operation of the Western Hemisphere Institute for Security Cooperation (Institute). Suspends the authority of the Secretary of Defense to operate such an education and training facility until submission of a report containing the results of an investigation in response to violations of human rights to which training at such Institute contributed. Establishes: (1) a joint congressional task force to assess appropriate education and training for DOD to provide to military personnel of Latin American nations; and (2) a commission to investigate activities of the United States Army School of the Americas and its successor institution, the Institute.

Classified Information Accountability Act of 2009 or CIA Act - Provides a civil penalty of up to $10,000 against a member of the intelligence community who, as part of a communication to a U.S. Senator or Representative that involves classified material: (1) falsifies, conceals, or covers up a material fact; (2) makes any materially false, fictitious, or fraudulent statement or misrepresentation; or (3) makes or uses any false writing or document known to contain any materially false, fictitious, or fraudulent statement or entry. Prohibits any federal department or agency from indemnifying a person from such liability. Authorizes the Senator or Representative concerned to bring a civil action for such a violation. Requires the court involved to review the classified information in camera.

Blue Star/Gold Star Flag Act of 2009 - States that a condominium association, cooperative association, or residential real estate management association may not adopt or enforce any policy, or enter into any agreement, that would restrict or prevent an association member from displaying a Service Flag on residential property within the association with respect to which such member has a separate ownership interest or a right to exclusive possession or use. (A Service Flag, also known as a "blue star banner," is an official banner authorized by the Department of Defense [DOD] for display by families who have members serving in the Armed Forces during any period of war or hostilities the United States may be engaged in for the duration of such hostilities.) States that nothing in this Act shall be considered to permit any display or use inconsistent with: (1) any DOD regulations regarding rules or customs pertaining to the proper display or use of the Service Flag; or (2) any reasonable restriction pertaining to the time, place, or manner of displaying the flag necessary to protect a substantial interest of the condominium, cooperative, or residential real estate management association.

Prohibits the Secretary of Veterans Affairs (VA) from authorizing an honor guard to participate in the funeral of any veteran interred in a national cemetery under the control of the National Cemetery Administration unless the honor guard offers to the family of each veteran in whose funeral the honor guard chooses to participate the option of having it perform one of the 13-fold flag recitations. Expresses the sense of Congress that 13-fold flag recitations are a historical tradition and that it should be the policy of the VA to authorize honor guards to participate in the funerals of veterans and proactively offer such a recitation to each veteran's family.
