Civilian Aviation Certification Equity Act of 2021 This bill requires the Federal Aviation Administration to allow civilian pilots at the Department of Defense to earn certificates and ratings in the same manner as military pilots. Currently, pilots who are members of the U.S. armed forces may use military training and flight hours to qualify for pilot certificates and instrument and type ratings.

Ensuring Veterans' Smooth Transition Act or the EVEST Act This bill requires the Department of Veterans Affairs (VA) to automatically enroll veterans who are eligible for VA health care into the VA health care system upon the receipt of information from the Defense Manpower Data Center of the Department of Defense that proves eligibility of such veterans for enrollment. Any veteran who is eligible for automatic enrollment must be able to access an electronic version of the certificate of eligibility and an electronic mechanism to opt out of such enrollment.

VA Assessment by Independent Measures Act or the VA AIM Act This bill requires the Department of Veterans Affairs (VA) to, at least once every 10 years, enter into a contract with a private sector entity or entities to conduct an independent assessment of the hospital care, medical services, and other health care furnished by the VA. The contracted entities must have experience and proven outcomes in health care management and in optimizing the performance of the health care delivery systems of the Veterans Health Administration and the private sector. The entities must also specialize in implementing large-scale organizational and cultural transformations.

Veterans' Culturally Competent Care Act This bill requires the Department of Veterans Affairs (VA) to establish standards and requirements for the provision of mental health care by non-VA providers in the Veterans Community Care Program (VCCP). The established standards must be the same as the standards applicable to VA employees who provide mental health care. The VA must require non-VA mental health care providers to complete training courses on military culture, core competencies for health care professionals, suicide evaluation and management, post-traumatic stress disorder, traumatic brain injury, and military sexual trauma after the provider becomes approved under the VCCP. The VA must also (1) identify additional training areas for which to develop courses, and (2) require the non-VA providers to complete such courses.

Guaranteeing Healthcare Access to Personnel Who Served Act This bill addresses the administration and provision of health care to veterans through the Department of Veterans Affairs (VA) and non-VA providers. First, the bill provides statutory authority for the eligibility thresholds for when a veteran must receive non-VA care under the Veterans Community Care Program (VCCP) for primary care, mental health care, noninstitutional extended care services, specialty care, or specialty services. Additionally, the bill establishes access to care standards for non-VA care under the VCCP, meaning a veteran's appointment must be within specified distances and time frames. Among other requirements, the VA must also implement an 18-month pilot program to allow certain veterans to use a website or mobile application to request, schedule, and confirm medical appointments with VCCP providers; ensure that VCCP third party administrators and credentials verification organizations comply with specified requirements to help ensure that certain health care providers are excluded from providing non-VA health care services; develop a strategic plan to ensure the effectiveness of the telehealth technologies and modalities delivered by the VA; and establish an online health care education portal for veterans. The bill requires the Government Accountability Office to report on (1) the VA program under which third parties provide transportation for veterans who are seeking VA services or benefits, (2) VA telehealth services, and (3) the VA's Foreign Medical Program. Finally, the Paperwork Reduction Act does not apply to the voluntary collection of information during research conducted by the Veterans Health Administration.

This bill requires federal agencies to submit zero-based budgets to the Office of Management and Budget and the congressional budget committees . A zero-based budget is a systematic budget analysis in which managers (1) examine current objectives, operations, and costs; (2) consider alternative ways of carrying out programs or activities; and (3) rank different programs or activities by order of importance. The bill also requires federal agencies to submit recommendations for spending reductions of at least 2% from the previous year's levels. The Department of Defense and the National Nuclear Security Administration are exempt from this requirement.

American Grown Act This bill prohibits the official display of a cut flower or green in any public area of a building of the Executive Office of the President, the Department of State, or the Department of Defense unless it is produced in the United States. Flood Insurance Rate Map Interagency Technology Act of 2021 or the FIRM IT Act of 2021 This bill modifies technical requirements for National Flood Insurance Program (NFIP) rate maps (community maps delineating flood hazard areas, flood elevations, and flood risk zones that are applicable to flood insurance rate determination). Specifically, the Federal Emergency Management Agency (FEMA) must consult with the Department of Defense, the U.S. Geological Survey, and the National Oceanic and Atmospheric Administration to obtain information relevant to NFIP rate maps. FEMA may include this data, as well as specified property survey information, in NFIP rate maps. The format of NFIP rate maps must conform to specified data and protocols.

Cyber Incident Notification Act of 2021 This bill requires federal agencies and certain entities to report cybersecurity intrusion incidents to the Cybersecurity and Infrastructure Security Agency (CISA) and addresses related issues. Within 24 hours of a confirmed intrusion (or potential intrusion), the targeted agency or entity must report the intrusion to CISA. CISA must promulgate rules relating to the bill, including the information that must be included in each incident report and the entities that must comply with the reporting requirements. At minimum, the covered entities must include federal contractors and owners or operators of critical infrastructure. Similarly, such rules must at minimum require federal agencies and covered entities to report all intrusions involving a nation-state, advanced persistent threat cyber actor, or transnational organized crime group. If a covered entity fails to meet the bill's requirements, CISA may assess a civil penalty of up to 0.5% of the entity's gross revenue for each day the violation lasts. If the violating entity has federal contracts, the General Services Administration may impose additional penalties, including removal from the Federal Contracting Schedule. A violation by a federal agency must be referred to that agency's office of the inspector general, which must treat the case as a matter of urgent concern. CISA, the Department of Justice, and the Office of the Director of National Intelligence must provide periodic reports to Congress concerning the current cyber threat picture facing federal agencies and covered entities.

Western Wildfire Support Act of 2021 This bill establishes activities to address wildfires. The bill requires the Department of Agriculture (USDA) and the Department of the Interior to establish spatial fire management plans before the end of FY2024. The bill establishes accounts in the Treasury for addressing wildfires, a program to train and certify citizens who wish to be able to volunteer to assist USDA or Interior during a wildland fire incident, a program to award grants to eligible states or units of local government to acquire slip-on tank and pump units for a surge capacity of resources for fire suppression, the Theodore Roosevelt Genius Prize for the management of wildfire-related invasive species, and the Management of Wildfire-Related Invasive Species Technology Advisory Board. The bill also requires the Department of Defense (DOD) to reimburse a state or federal agency for the costs of wildfire suppression as a result of a fire caused by DOD activity, requires the Joint Fire Science Program to work with unmanned aircraft test ranges to carry out research and development of unmanned aircraft system fire applications, requires federal and state disaster preparedness programs to include postdisaster assistance, and authorizes the Federal Emergency Management Agency to provide funding to a state agency to establish and operate a website to provide information relating to postfire recovery funding and resources to a community or an individual impacted by a wildland fire.

Supporting Expanded Review for Veterans In Combat Environments Act of 2021 or the SERVICE Act of 2021 This bill expands eligibility for Veterans Health Administration mammography screenings to veterans who served in certain locations during specified periods, including those who were exposed to toxic substances at such locations. The specified locations and corresponding time periods include Iraq between August 2, 1990, and February 28, 1991, and from March 19, 2003, until burn pits (areas used for burning solid waste in open air without equipment) are no longer used in Iraq; the Southwest Asia theater of operations, including Kuwait, Saudi Arabia, Oman, and Qatar, from August 2, 1990, until burn pits are no longer used in such locations; and Afghanistan, Djibouti, Syria, Jordan, Egypt, Lebanon, and Yemen from September 11, 2001, until burn pits are no longer used in such locations; and other locations and time periods as determined by the Airborne Hazards and Open Burn Pit Registry. The bill specifies that the listed locations do not include bodies of water around or airspace above such locations.

Department of Defense Climate Resiliency and Readiness Act This bill requires the Department of Defense (DOD) to address climate resiliency and energy and resource efficiency. Each DOD contract for the procurement of property or services entered into on or after October 1, 2021, must include specified information related to energy consumption and energy sources. When deciding whether to enter into a contract, DOD must consider whether the contractor verifiably produces as much renewable energy as the total energy it consumes and whether there is any order against the contractor for a violation of an environmental law or regulation. Among other elements, the bill requires DOD to achieve aggregate net zero energy in use of energy by non-operational sources by December 31, 2031; DOD to give preference to contractors and small businesses that use green manufacturing technology; DOD to administer the Energy and Climate Resiliency Fund established by the bill; DOD and the military departments to consider climate change risks when making strategic decisions related to any military installation; DOD and other relevant federal agencies to incorporate climate change into the National Defense Strategy, the National Military Strategy, and DOD's operational plans; and DOD to conduct a program of research, development, and demonstration of hybrid microgrid systems and electric grid energy storage. The Government Accountability Office must report on the individual and aggregate uses of DOD's authority to give preference to contractors that use green manufacturing technology and small businesses that verifiably use green manufacturing technology or operate with net zero energy.

National Security Powers Act of 2021 This bill limits presidential authorities related to, and increases congressional oversight of, introducing U.S. armed forces into hostilities, arms transactions, and national emergencies. The bill limits presidential authority to introduce U.S. forces into hostilities absent a declaration of war, specific statutory authorization, or when necessary to repel a sudden attack (or imminent threat of an attack). It also establishes procedures for the President to notify Congress of and obtain authorization for the introduction of U.S. forces into hostilities (or the risk of them). Additionally, the bill repeals laws authorizing the use of force abroad and the War Powers Resolution, which provides procedures for Congress and the President to participate in decisions to send U.S. forces into hostilities. For a treaty or other international obligation to authorize the introduction or retention of U.S. forces, Congress must specifically enact implementing legislation to that effect. The President must seek congressional approval before entering, renewing, or extending an arms sale or related transaction if the transaction exceeds specified dollar thresholds. This does not apply to transactions with NATO and its member countries, Australia, Japan, South Korea, Israel, New Zealand, or Taiwan. The bill restricts presidential authorities related to national emergencies, including by limiting the period of a declared emergency to 30 days unless Congress authorizes an extension. The bill also establishes procedures for approving or disapproving an extension, requires the President to provide more detailed reports to Congress about national emergencies, and sets out specific provisions for terminating an emergency.

Defense Community Teacher Support Act This bill makes certain teachers who teach in military impacted communities eligible for student loan forgiveness. A school in a military impacted community is served by a local educational agency for which at least 20% of the students in average daily attendance in all schools served by the agency during the preceding school year had a parent on active duty. Specifically, the bill directs the Department of Education to cancel up to $17,500 of federal student loans for a borrower who is an elementary or secondary school teacher employed for five consecutive years in a school in a military impacted community. In addition, a teacher who is required to move due to a permanent change in duty station of their spouse may meet the five-year teaching requirement by teaching in multiple schools in different military impacted communities.

Office for Access to Justice Establishment Act of 2021 This bill establishes the Office for Access to Justice within the Department of Justice (DOJ) to advise on matters relating to justice for low-income and other underrepresented people in the criminal and civil justice systems. Additionally, DOJ must establish a Legal Aid Interagency Roundtable to raise the awareness of executive branch agencies of the ways in which civil legal aid and indigent defense can help advance federal objectives, including those related to employment, family stability, housing, consumer protection, health services, and public safety.

Uniting Families Act of 2021 This bill establishes a nonimmigrant visa category for the adult alien children of a U.S. citizen who served in the Armed Forces. To obtain a visa, the alien's citizen parent must petition and receive approval from the Department of Homeland Security. The petition shall include (1) DNA evidence establishing the parent-child relationship, (2) a written statement that the parent will provide financial support until the alien receives lawful permanent resident status, and (3) proof of the parent's U.S. citizenship and active duty with the Armed Forces abroad. If the parent is deceased, an adult sibling of the alien may file the petition if the sibling is capable of providing financial support until the alien receives lawful permanent status. Such a petition must include evidence that the petitioner and the alien are siblings, such as birth certificates showing at least one common parent. The period of authorized admission for aliens with the visa is five years, and 5,000 principal aliens may be admitted each fiscal year. Holders of such a visa may adjust to lawful permanent resident status after meeting various requirements, such as being admissible as an immigrant.

Veterans' Access to Care Concerning Inoculations Needed in Emergency Situations Act or the VACCINES Act This bill requires the Department of Veterans Affairs (VA) to furnish specified care during a public health emergency declared by a federal authority. Specifically, during such emergency, the VA must furnish to veterans (1) diagnostic products to detect the disease relating to the emergency, and (2) vaccinations for such disease. The VA may not require any copayment or other cost sharing for any diagnostic product or vaccine furnished under this bill. Additionally, the VA must conduct outreach to ensure that veterans are aware of the diagnostic products and vaccines available during the public health emergency.

The bill also provides appropriations to several related agencies, including the Committee for Purchase From People Who Are Blind or Severely Disabled, the Corporation for National and Community Service, the Corporation for Public Broadcasting, the Federal Mediation and Conciliation Service, the Federal Mine Safety and Health Review Commission, the Institute of Museum and Library Services, the Medicaid and CHIP Payment and Access Commission, the Medicare Payment Advisory Commission, the National Council on Disability, the National Labor Relations Board, the National Mediation Board, the Occupational Safety and Health Review Commission, the Railroad Retirement Board, and the Social Security Administration. This bill authorizes the Office of the National Cyber Director to accept officers or employees of the United States or members of the Armed Forces on a detail from an element of the intelligence community or from another element of the federal government on a nonreimbursable basis for up to three years. The Office of the National Cyber Director is the principal advisor to the President on cybersecurity policy and strategy and, among other duties, leads the coordination and implementation of national cyber policy and strategy.

Religious Freedom Peace Tax Fund Act This bill directs the Department of the Treasury to establish the Religious Freedom Peace Tax Fund for the deposit of income, gift, and estate taxes paid by or on behalf of taxpayers (1) who are designated conscientious objectors opposed to participation in war in any form based upon their sincerely held moral, ethical, or religious beliefs or training (within the meaning of the Military Selective Service Act); and (2) who have certified their beliefs in writing. Amounts deposited in the fund shall be allocated annually to any appropriation not for a military purpose. Treasury shall report to the House and Senate Appropriations Committees on the total amount transferred into the fund during the preceding fiscal year and the purposes for which such amount was allocated. The privacy of individuals using the fund shall be protected.

Survey Our Servicemembers Act or the SOS Act This bill directs the Department of Veterans Affairs (VA) to contract with an experienced nongovernment entity to conduct an annual survey to determine the experiences of veterans in obtaining hospital care and medical services at each VA medical facility. Such surveys must be conducted over a five-year period and must include questions related to the experiences of veterans in seeking care at both VA and non-VA facilities. The VA shall make the survey results publicly available on its website.

Improving Veterans Access to Congressional Services Act of 2021 This bill requires the Department of Veterans Affairs (VA) to permit a Member of Congress (upon request) to use a VA facility to meet with constituents. The VA and the General Services Administration must jointly identify available spaces in VA facilities for such purposes. The VA must prescribe regulations regarding such use of a VA facility by a Member of Congress.

Access to Infertility Treatment and Care Act This bill requires private health insurance plans to cover (1) specified infertility treatments (e.g., in vitro fertilization), if the plan also covers obstetrical services; and (2) fertility preservation services for individuals who undergo medically necessary treatment that may cause impairment of fertility. Private health insurance plans must apply cost sharing for such services that does not exceed the amount for similar services covered by the plan. Further, plans are prohibited from (1) providing incentives for plan holders to forego infertility treatment, or (2) reducing the reimbursement rate to providers of such treatments. The bill also extends infertility treatment and fertility preservation coverage to Medicaid enrollees, federal employees, members of the military, and veterans.

Biosecurity Information Optimization for Defense Act of 2021 This bill directs the President to establish a cabinet-level interagency forum to be known as the National Biodefense Directorate. The directorate must develop a (1) national biodefense strategy and implementation plan, and (2) national strategy for combating public health misinformation and disinformation that threatens the national security and associated implementation plan. The directorate must submit to the National Security Council and Congress a report including the National Biodefense Strategy and associated implementation plans. The Government Accountability Office must review the report and submit to Congress a report that identifies gaps in such strategies and plans and that makes recommendations to address such gaps.

AI in Counterterrorism Oversight Enhancement Act This bill expands the responsibilities of the Privacy and Civil Liberties Oversight Board to include oversight of the use of artificial intelligence (AI) in counterterrorism and addresses related issues. Specifically, the board must continually review any AI-enabled technologies used in counterterrorism efforts and determine whether such technologies protect privacy and civil liberties and adhere to relevant policies. The bill also expands the board's authorities to access or subpoena information to include information about AI-enabled technologies used for counterintelligence, such as the training and testing processes for such technologies. Furthermore, the bill expands the responsibilities of privacy and civil liberties officers to include responsibilities related to AI-enabled technologies used in counterterrorism. (Currently, the statute requires certain departments and agencies, including the Department of Justice and the Office of the Director of National Intelligence, to each designate one senior officer as a privacy and civil liberties officer to provide certain information to the board.)

Veterans and Servicemember Consumer Protection Act of 2021 This bill directs the Federal Trade Commission (FTC) to designate a coordinator within the Bureau of Consumer Protection to advise the FTC on preventing fraud targeting military veterans and service members and to assist the FTC in monitoring the market for mail, television, internet, telemarketing, and recorded message telephone call (robocall) fraud targeting those individuals. The coordinator must (1) disseminate to veterans, service members, and their families and caregivers information about the most common fraud schemes, including methods of reporting complaints to the FTC; (2) make complaints immediately available to relevant law enforcement authorities; (3) publish information regarding the FTC's enforcement actions; and (4) maintain a website as a resource for information on fraud targeting those individuals.
