Freedom of Commerce Act This bill repeals provisions restricting the sale, transport, and distribution of switchblade knives. In addition, the bill prohibits all ballistic knives (i.e., knives with detachable blades that are propelled by spring-operated mechanisms) from being deposited in, carried by the mails, or delivered by any officer or employee of the U.S. Postal Service, except to certain military and governmental officials and manufacturers, under specified conditions.

Secure 5G and Beyond Act of 2019 This bill requires the President, in consultation with relevant federal agencies, to develop a strategy to secure and protect U.S. fifth and future generations (5G) systems and infrastructure. Such strategy shall (1) ensure the security of 5G mobile telecommunications systems and infrastructure within the United States; (2) assist mutual defense treaty allies, strategic partners, and other countries in maximizing the security of 5G systems and infrastructure; and (3) protect the competitiveness of U.S. companies, privacy of U.S. consumers, and integrity of standards-setting bodies against political influence.

Ensuring Quality Access to Legal Defense Act of 2019 or the EQUAL Defense Act of 2019 This bill establishes and modifies certain programs that support the delivery of public defense services (i.e., legal services for criminal defendants who cannot afford counsel). Specifically, the bill directs the Department of Justice (DOJ) to award grants to state and local governments, tribal organizations, and public defender offices for public defense. A grant recipient must use the grant to establish a data collection process, develop workload limits, and satisfy specified compensation requirements (e.g., pay parity between public defenders and prosecutors). The bill also directs DOJ to award grants to nonprofits and government organizations to train public defenders, court-appointed attorneys, and contract attorneys. Additionally, a state that receives Edward Byrne Memorial Justice Assistance Grant program funds must annually submit to DOJ information related to the legal representation of defendants in criminal cases. It also reauthorizes through FY2022 the student loan repayment program for prosecutors and public defenders and otherwise revises the program, including by increasing the maximum benefit amount.

Veterans Affairs Transfer of Information and Sharing of Disability Examination Procedures With DOD Doctors Act This bill addresses the sharing of medical information and disability examination procedures between the Departments of Defense (DOD) and Veterans Affairs (VA). It requires that if a member of the Armed Forces who is required to receive a physical examination upon separation from active duty and has or is believed to have a medical condition that may make the member eligible for veterans' disability compensation and benefits, the examination must be performed by a VA-certified health care provider. If the condition is discovered during the physical examination and the examining health care provider is not VA-certified, the examination must be completed by a VA-certified provider. An eligibility determination made as part of such an examination shall be binding on the VA and be used as the basis for assigning the member's disability rating. The VA and DOD shall jointly establish a system to share data and maintain the medical and personnel records of Armed Forces members and veterans.

Veterans Collaboration Act This bill requires the Department of Veterans Affairs (VA) to carry out a two-year pilot program in states with the highest veteran populations to promote collaboration between the VA, nonprofit organizations, and institutions of higher learning. The VA shall emphasize collaboration with (1) veterans service organizations that provide personnel with appropriate credentials to assist veterans in filing disability compensation claims and appeals with the VA, and (2) educational institutions that provide veterans with pro bono legal assistance.

Veteran's Choice Accountability Act This bill requires the Department of Veterans Affairs (VA) to evaluate VA programs that furnish hospital care, medical services, and nursing home care to ensure that the most intensively used specialized care programs are maintained as centers of excellence. The bill also requires the VA to submit an evaluation of the VA's implementation of the VA Budget and Choice Improvement Act.

VA Community Infrastructure Act This bill authorizes a 10-year pilot program under which the Department of Veterans Affairs (VA) may assist state and local governments in addressing deficiencies in community infrastructure that is supportive of VA medical facilities by making grants, concluding cooperative agreements, and supplementing funds available under other federal programs. Community infrastructure includes any (1) transportation project; (2) flood or natural disaster mitigation project; (3) hospital, police, fire, emergency response, or other community support facility; or (4) utility infrastructure projects owned by a state or local government. Assistance shall be available where the VA determines such assistance will enhance the resilience of the medical facility or quality of life of veterans eligible to receive care at such facilities.

Armament Graduate School Act This bill provides authority to the United States Army Armament Graduate School to grant degrees. A degree conferred by the school shall meet the following conditions: it must be approved by the Department of Education in accordance with the Federal Policy Governing Granting of Academic Degrees by Federal Agencies, and the school must be accredited by the appropriate civilian accrediting agency or organization to award the degree. The establishment and modification of degree-granting authority are subject to certain congressional notification processes.

Heroes Entering Roles Of Education Service Act or the HEROES Act This bill revises and expands the Troops-to-Teachers Program, which supports the transition of current and former military personnel to employment positions in education. The program places personnel in (1) elementary and secondary schools that serve more than a certain percentage of lower-income students or those who qualify for aid under the Individuals with Disabilities Education Act, and (2) Bureau of Indian Affairs-funded schools. The bill renames the program as the Troops-To-Support-Education Program and expands the positions covered to include a number of teaching support, administrative, and security personnel. Excluded from eligibility are positions performed outside the grounds of a school or for a contractor. For placement in non-teacher positions, the service member must obtain credentials required by the state in which the position is located. The bill increases the total number of stipends and bonuses provided. It also increases the limit on the amount of obligations for the program for each fiscal year. The Department of Defense may enter into partnership agreements with tax-exempt charitable organizations to assist with the placement of participants.

Service Pilot Protection Act This bill addresses the process of consultation with military installations in cases of applications for wind farm projects filed with the Department of Transportation. It provides that, with respect to an application for a wind farm project, the Military Aviation and Installation Assurance Siting Clearinghouse shall (1) verify whether the appropriate commander, in consultation with each such installation, approved or objected to the application; (2) publish the procedures for notifying each installation of the application; and (3) at least annually, report to Congress a list of approvals and objections and an assessment of whether approved wind farm projects impacted the training capabilities, operations, or readiness of the military department concerned.

Veterans Preventive Health Coverage Fairness Act This bill eliminates veterans' copayments for medication, hospital care, and medical services related to preventive health services provided by the Department of Veterans Affairs. The bill expands the definition of preventive health services to include (1) evidence-based items or services that have an A or B rating in the recommendations of the United States Preventive Services Task Force; (2) immunizations that have a recommendation from the Advisory Committee on Immunization Practices of the Centers for Disease Control and Prevention with respect to the individual involved; and (3) with respect to women, the preventive care and screenings provided for in the Health Resources and Services Administration Preventive Services Guidelines in effect as of January 1, 2017.

Military Voting Protection Act This bill requires military departments to provide members of the Armed Forces with a federal write-in absentee ballot together with instructions on the appropriate use of the ballot with respect to the state in which the member is registered to vote. Members intending to vote in a state that does not accept the federal write-in absentee ballot as a simultaneous application and acceptable ballot for federal elections must be provided a briefing on, and an opportunity to fill out, the official post card form for absentee voter registration application and absentee ballot application.

Fly Smart Act This bill establishes standards for airline travel by federal employees for official business, including a general requirement to use coach-class accommodations and a ban on military aircraft for domestic official travel. It allows use of first-class and business class for federal employees under certain circumstances, such as to accommodate a disability or special need or because of exceptional security circumstances.

Improving Preparation and Resources for Occupational, Vocational, and Educational Transition for Servicemembers Act or the IMPROVE Transition for Servicemembers Act This bill revises provisions that require the Department of Defense (DOD) and, with respect to the Coast Guard, the Department of Homeland Security (DHS) to operate a program providing individual pre-separation counseling and services to assist members of the Armed Forces who are transitioning to civilian life. The bill's changes include (1) revising various deadlines in the transition program, (2) requiring the use of surveys and electronic systems to track the progress of participating individuals, and (3) establishing a program to provide Armed Forces members with information about the transition program and about career and educational opportunities available during military service. DOD and DHS must annually report on the furnishing of such pre-separation counseling, information, and services. The Government Accountability Office must report on service member participation in transition assistance programs at small and remote military installations.

Filipino Veterans Fairness Act of 2019 This bill deems certain service performed before July 1, 1946, in the organized military forces of the Philippines and the Philippine Scouts, to be active military service for purposes of eligibility for veterans benefits through the Department of Veterans Affairs (VA). In determining eligibility under this bill, the VA must take into account any relevant service documentation, including documentation other than the Missouri List (certain military service records).

Dream Act of 2019 This bill provides certain aliens with a path to receive permanent resident status and contains other immigration-related provisions. The Department of Homeland Security (DHS) or the Department of Justice (DOJ) shall provide conditional permanent resident status for 10 years to a qualifying alien who entered the United States as a minor and (1) is deportable or inadmissible, or (2) has deferred enforced departure status or temporary protected status. The bill imposes various qualifying requirements, such as the alien being continuously physically present in the United States since four years before this bill's enactment, passing a background check, and being enrolled in or having completed certain educational programs. DHS shall remove the conditions placed on permanent resident status granted under this bill if the alien applies and meets certain requirements, such as completing certain programs at an educational institution, serving in the military, or being employed. An alien shall have the right to administrative and judicial review of the denial or revocation of an immigration status granted under this bill. Furthermore, an alien shall be appointed counsel upon request when seeking judicial review of a provisional denial of an application for permanent resident status under this bill. DHS may not use information from applications filed under this bill or for Deferred Action for Childhood Arrivals status for immigration enforcement purposes. DHS shall establish a grant program for nonprofit organizations that assist individuals with certain immigration-related issues.

AUMF Clarification Act This bill expresses the sense of the House of Representatives that Congress has not authorized the use of military force against Iran. It further specifies that no previous authorization for the use of military force against anyone associated with the terrorist attacks of September 11, 2001, may be construed to provide authorization for the use of such force against Iran.

Vietnam-Era Veterans Hepatitis C Testing Enhancement Act of 2019 This bill requires the Department of Veterans Affairs (VA) to carry out a one-year pilot program to make hepatitis C testing available to certain veterans at events organized by veterans service organizations. To be eligible, a veteran must have served in the active military, naval, or air service between February 28, 1961, and May 7, 1975, and must have been discharged or released under conditions other than dishonorable. The program shall be carried out in two rural and three urban Veterans Integrated Service Networks (regional VA health care administrative areas). The VA shall expand the program to all networks if at least 350,000 veterans are tested for hepatitis C by the program's termination date.

Building Supportive Networks for Women Veterans Act This bill permanently extends the Department of Veterans Affairs program that provides reintegration and readjustment services in group retreat settings to women veterans who are recently separated from military service after a prolonged deployment. This program is currently a pilot program that is scheduled to expire at the end of FY2020. Services provided under the program include, but are not limited to, information and counseling on stress reduction.

Access to Infertility Treatment and Care Act This bill requires private health insurance plans to cover (1) specified infertility treatments (e.g., in vitro fertilization), if the plan also covers obstetrical services; and (2) fertility preservation services for individuals who undergo medically necessary treatment that may cause impairment of fertility. Private health insurance plans must apply cost sharing for such services that does not exceed the amount for similar services covered by the plan. Further, plans are prohibited from (1) providing incentives for plan holders to forego infertility treatment, or (2) reducing the reimbursement rate to providers of such treatments. The bill also extends infertility treatment and fertility preservation coverage to Medicaid enrollees, federal employees, members of the military, and veterans.

This bill revises the housing allowance for uniformed service members in the U.S. Virgin Islands. Specifically, the Department of Defense must provide to a service member serving in the U.S. Virgin Islands the basic housing allowance, rather than the overseas housing allowance. Currently, a service member on duty in the U.S. Virgin Islands receives the overseas housing allowance, which is limited to cost reimbursement. By contrast, service members in the 50 states and the District of Columbia receive the basic housing allowance, which offers a fixed amount for each locality and grade/rank.

At least annually, the DOD Inspector General shall inspect the oversight of privatized military housing at no fewer than 15 randomly selected installations. Additionally, DOD shall study ways to improve privatized military housing and the oversight and execution of contracts in order to improve housing conditions for Armed Forces members and their families.

Prevention of Sexual Assault in the Armed Forces Act This bill addresses sexual assault in the armed forces. It directs the Department of Defense to establish a Defense Advisory Committee for the Prevention of Sexual Misconduct. Upon a determination not to refer a case of alleged sexual assault for trial by court-martial, the commander making such determination shall notify the victim, at least monthly, of the status of further action. The bill also allows each military department to detail certain enlisted members meeting requirements for acceptance of a commission as commissioned officers as students at accredited U.S. law schools for a period of legal training leading to a law degree. A service member agreeing to such training will, upon completion, accept a commission as a judge advocate or law specialist. Selections shall be on a competitive basis for active duty for a two-year period (in addition to any other service obligation).

Department of Defense Ethics and Anti-corruption Act of 2019 This bill addresses the conduct of Department of Defense (DOD) officials regarding relationships with military contractors. With respect to certain DOD officials involved in contracting, the bill increases the following: (1) the period during which an official leaving DOD and seeking compensation from a contractor must obtain an ethics opinion concerning post-employment restrictions, (2) the length of time such requests must be retained in a central repository, and (3) the frequency of Inspector General reviews of providing and retaining opinions. Each procurement contract of a value exceeding $10 million must require the contractor to annually report information (including concerning lobbying activities) about former officials and military officers who received compensation within four years after leaving service. Such a contract shall include a clause prohibiting the contractor from receiving the compensation. Contracts with contractors that received an average of more than $1 billion in revenue in the previous three years from DOD or the Department of Energy (related to the U.S. nuclear program) shall prohibit the employment or payment of certain DOD officials within four years of leaving DOD service. In addition, the bill includes restrictions and conditions concerning: lobbying by former officials and officers; stock ownership and trading; employment that is subject to the emoluments clause of the Constitution; work by certain senior officials for a foreign entity (including work that conflicts with U.S. national security interests); financial disclosure by large prospective contractors; and public disclosure of information regarding the identification of general or flag officers and their finances and conduct.

VA Newborn Emergency Treatment Act This bill authorizes the Department of Veterans Affairs (VA) to furnish transportation in connection with the receipt of covered health care services for a newborn child of a woman veteran (and the child's parents). The bill expands covered health care services to include services furnished at health care facilities other than the facility where the child was delivered. Under the bill, the VA may furnish more than seven days of health care services and transportation to such services if a child is in need of additional care. Expenses incurred for transportation furnished in order for a newborn child of a veteran to receive health care services prior to the enactment of this bill may be waived or reimbursed to the veteran by the VA.

Supporting Eating disorders Recovery through Vital Expansion Act or the SERVE Act This bill provides coverage of the treatment of eating disorders under the TRICARE program. The services include both inpatient and outpatient care and shall be furnished without regard to age of a military dependent or whether there is a primary diagnosis of the disorder. As part of the process for referrals for mental health evaluations of members, the Department of Defense (DOD) shall encourage commanders and supervisory personnel to undertake mental health early identification training, to include recognition of warning signs and symptoms of an eating disorder. DOD shall establish that a facility may receive expedited authorization to provide services if the facility is affiliated with an authorized TRICARE facility or provider and it only provides mental health services.

This bill restricts military construction authority used in the event of a declaration of war or a declaration by the President of a national emergency. It limits to $250 million the amount that may be expended for military construction projects in the event of a national emergency declaration for its duration. Additionally, any appropriated funds used must be otherwise not executable. It restricts authority to waive or disregard a requirement that would otherwise apply to such a construction project. The bill requires any decision to undertake such a project to congressional notification requirements that include an explanation of why the use of the Armed Forces is required to respond to a national emergency, how a project supports the needs of members of the Armed Forces, estimates of construction costs, determinations to waive or disregard other law affecting construction authority, and reference to projects that would be subject to cancellation or deferment in order to provide construction funds to address such an emergency.

Department of Defense Climate Resiliency and Readiness Act This bill requires the Department of Defense (DOD) to provide a strategy to achieve aggregate net zero energy by non-operational sources by no later than December 31, 2029. The term "net zero energy" means a reduction in overall energy use, maximized energy efficiency, implementation of energy recovery and cogeneration capabilities, and an offset of the remaining demand for energy with production of energy from onsite renewable energy sources. Annual DOD budget submissions must include an item for climate-related adaptation and mitigation, as well as an estimate of adverse impacts to readiness and costs. Regarding DOD procurement (1) contracts must contain an estimate of total projected energy consumption and a statement concerning renewable energy and energy efficiency investments; (2) contractors must evaluate climate change risks, including by describing relevant corporate governance processes; and (3) a contractor will be assessed a fee if it consumes more energy than it produces. DOD must develop a vulnerability and risk assessment tool to measure risks to systems, installations, and operational capabilities. Strategic decisions regarding an installation must consider risks associated with climate change, and DOD shall incorporate these into the National Defense Strategy, the National Military Strategy, and operational plans. DOD shall conduct a research and development program concerning hybrid microgrid systems and electric grid energy storage. With respect to base realignment and closure activities, DOD shall consider current and potential vulnerabilities to military installations and operations resulting from climate change and their resilience. The bill establishes the position of Assistant Secretary of Defense of Energy and Climate Resiliency.

Developing the National Security Workforce Act This bill requires the Department of Defense (DOD) to develop investment incentives for a contractor that implements a qualified training program to develop its workforce in a manner consistent with DOD needs. The system used to record contractor past performance shall include an analysis of the availability, quality, and effectiveness of a training program as part of a contractor's past performance rating.

Military Construction, Veterans Affairs, and Related Agencies Appropriations Act, 2020 This bill provides FY2020 appropriations for military construction, the Department of Veterans Affairs (VA), and related agencies. The bill provides appropriations to the Department of Defense (DOD) for military construction for the Army; the Navy and Marine Corps; the Air Force; Defense-wide agencies and activities; the Army and Air National Guard; and the Army, Navy, and Air Force Reserves. The bill also provides appropriations to DOD for the North Atlantic Treaty Organization (NATO) Security Investment Program; the Base Closure Account; Construction and Operation and Maintenance of Family Housing for the Army, the Navy and Marine Corps, the Air Force, and Defense-wide agencies and activities; the Family Housing Improvement Fund; and the Military Unaccompanied Housing Improvement Fund. The bill provides appropriations to the VA for the Veterans Benefits Administration, the Veterans Health Administration, the National Cemetery Administration, and Departmental Administration. The bill provides appropriations for related agencies and programs, including the American Battle Monuments Commission, the U.S. Court of Appeals for Veterans Claims, Cemeterial Expenses of the Army, and the Armed Forces Retirement Home. The bill provides appropriations to specified DOD military construction accounts for (1) Overseas Contingency Operations, and (2) Natural Disaster Relief. The bill also sets forth requirements and restrictions for using funds provided by this and other appropriations Acts.

Constitutional Authorities Resolution This joint resolution directs the President to report to Congress before introducing the Armed Forces into Iran. The report shall explain (1) the necessity of such an action, (2) the constitutional and legislative authority supporting it, and (3) the estimated scope and duration of the hostilities.
