Veteran Readiness and Employment National Emergency Extended Deadline Act or the VR&E NEED Act This bill extends a veteran's eligibility for the Veteran Readiness and Employment program when educational institutions are temporarily or permanently closed due to an emergency situation, or there is another reason that prevents a veteran from participating. Specifically, the period of eligibility must not run during the period the veteran is prevented from participating in the program. The period must resume on a date, determined by the Department of Veterans Affairs, that is not earlier than the first day after the veteran is able to resume participation and not later than 90 days after that day.

Veterans Health Care Freedom Act

Veterans Health Care Freedom Act This bill requires the Center for Innovation for Care and Payment within the Department of Veterans Affairs (VA) to implement a three-year pilot program to improve the ability of veterans who are enrolled in the VA health care system to access hospital care, medical services, and extended care services through the covered care system by providing such veterans with the ability to choose health care providers. Under the bill, the covered care system includes VA medical facilities, health care providers participating in the Veterans Community Care Program (VCCP), and eligible entities or providers that have entered into a Veterans Care Agreement. A veteran participating in the program may elect to receive care at any provider in the covered care system. The pilot program removes certain requirements (e.g., location of the veteran) to access care at VA and non-VA facilities. After four years, the bill permanently phases out the requirements for accessing care under the VCCP and Veterans Care Agreements and requires the VA to provide such care under the same conditions of the pilot program. Additionally, after four years, veterans may receive care at a VA medical facility regardless of whether the facility is in the same Veterans Integrated Service Network as the veteran.

VA Beneficiary Debt Collection Improvement Act

VA Beneficiary Debt Collection Improvement Act This bill addresses the administration of debt related to Department of Veterans Affairs (VA) programs and benefits. Specifically, the bill prohibits an individual from incurring a debt to the United States that arises from participation in a VA benefits program and is attributable to the failure of the VA to process information according to its timeliness standards. The VA must notify an individual if it has made an overpayment to the individual and include in the notice information on the right to dispute the overpayment or request a waiver of indebtedness. The VA is prohibited from taking action regarding an overpayment until 90 days after the notice is issued, except in specified circumstances. The VA is prohibited from charging interest or administrative costs for debts related to its disability compensation program, pension program, or educational assistance program. The bill extends from 180 days to one year the deadline by which an individual may request a waiver for relief from paying a debt related to VA benefits. Additionally, the VA is prohibited from seeking to recover a debt if it determines the cost to the VA to recover the debt would exceed the amount of the debt itself. The VA must establish an administrative process for the dispute of a debt's existence or the amount of the debt. The VA is prohibited from deducting from an individual's VA benefits to offset a debt if the amount of the debt is being disputed.

VA Medicinal Cannabis Research Act of 2021 This bill requires the Department of Veterans Affairs (VA) to conduct clinical trials of the effects of medical-grade cannabis on the health outcomes of covered veterans diagnosed with chronic pain and those diagnosed with post-traumatic stress disorder. Covered veterans are those who are enrolled in the VA health care system. The trials must include a control group and an experimental group that are of similar sizes and structures and represent the demographics of the veteran population. Data collected in the trials must be preserved to facilitate further research. Under the bill, participation in the clinical trials does not affect a covered veteran's eligibility or entitlement to other VA benefits.

Among other elements, the bill provides that the determinations on the preferral, disposition, and referral of charges for specified offenses under the UCMJ must be made by a commissioned officer of the Armed Forces who is designated as a court-martial convening authority (in grade O-6 or higher) and who is available for detail as trial counsel, has significant trial experience, and is outside the chain of command of the member subject to the charges.

The RANGE Program serves veterans in rural areas who are experiencing mental illness. The bill requires the Government Accountability Office to conduct a study and report on whether the VA has sufficient resources to serve rural veterans who need mental health care that is more intensive than traditional outpatient therapy.

World Press Freedom Protection and Reciprocity Act This bill establishes requirements related to the protection and support of journalists and media personnel abroad. Specifically, the President must establish a plan to (1) negotiate access for U.S. news and media organizations and their employees globally, and (2) work to enhance reciprocity for news and media organizations operating in the United States. The President may impose visa-blocking sanctions on any foreign person who is responsible for the jailing, killing, or torture of journalists or media personnel or significant efforts to harass or restrict the activities, terminate the visas, or threaten the safety of journalists or media personnel. Identification statements required to be placed on informational materials distributed in the United States by an agent of a foreign principal on behalf of such principal must be labeled, marked, or stamped conspicuously at the top of the first page of such materials. The annual country reports on human rights and development assistance and human rights and security assistance must include an assessment of freedom of expression with respect to electronic information in foreign countries. Lastly, the bill establishes the Global Press Freedom Defense Fund to provide assistance to foreign journalists and media personnel who are victims of restrictions on the internationally recognized right to freedom of expression, including assistance to pay for legal and other related expenses.

Military Hunger Prevention Act

Military Hunger Prevention Act This bill requires the Department of Defense (DOD) to pay a basic needs allowance to certain low-income members of the Armed Forces. Specifically, those eligible for the basic needs allowance are members who (1) have completed initial entry training, (2) have a gross household income that did not exceed an amount equal to 130% of the federal poverty guidelines of the Department of Health and Human Services (HHS), and (3) do not elect to decline the allowance. In situations where a household contains two or more eligible members, the bill specifies that only one allowance may be paid per year to one member they jointly elect. The amount of the allowance must be the aggregate amount equal to 130% of the HHS federal poverty guidelines minus the gross household income of the covered member during the preceding year divided by 12. The Defense Finance and Accounting Service (DFAS) of DOD must notify, in writing, individuals determined to be eligible for the allowance. The notice must include information regarding financial management and assistance programs administered by DOD for which the individuals are also eligible. Individuals who seek to receive the allowance must submit specified information to DFAS.

This bill requires the Department of Veterans Affairs (VA) to submit a plan for obligating and expending covered funds, which are funds made available to the VA for response to the COVID-19 (i.e., coronavirus disease 2019) pandemic. The bill requires the VA to submit biweekly reports regarding obligations, expenditures, and planned uses of the funds until seven days after the VA has expended all covered funds. The Inspector General of the VA must submit reports examining the obligations and expenditures made using covered funds during the specified reporting period. Finally, the Government Accountability Office must submit an interim report and final report containing a review of obligations and expenditures made using covered funds.

Recognizing Military Service in PSLF Act This bill requires the Department of Education to count each month for which a borrower's federal student loan payment was in deferment or forbearance during a period of active duty, including certain National Guard duty, as a qualifying payment for the purpose of the Public Service Loan Forgiveness (PSLF) program. Under current law, a borrower who is a service member is eligible to receive student loan forgiveness under the PSLF program; however, if the borrower places their loan into deferment or forbearance while they are on active duty, that period of time does not count as a qualifying payment for the PSLF program.

Protecting Critical Boards and Electronics Through Transparency and Enduring Reinvestment Act of 2021 or the PCBETTER Act of 2021 This bill provides funding for and otherwise addresses the electronics industry as it relates to national security and Department of Defense (DOD) programs. The bill establishes in the Department of the Treasury the Electronics Supply Chain Fund to create a commercially competitive electronics industry in the United States that is capable of meeting national security needs. Among other activities, the fund must be available for DOD to (1) fund the construction, expansion, or modernization of facilities to develop or manufacture semiconductors, microelectronics, advanced electronic packaging, and printed circuit boards; and (2) carry out a program (established by this bill) to test DOD systems for vulnerabilities to foreign interference, sabotage, espionage, and attack. Providers of certain electronic systems must provide DOD with a list of the printed circuit boards in their system that includes an attestation of whether (1) the printed circuit board was partially or fully manufactured and assembled in China, Russia, North Korea, or Iran; (2) the printed circuit board was fully manufactured outside of those nations; or (3) the provider cannot determine where the printed circuit board was manufactured and assembled. DOD must designate a senior official to remediate any vulnerabilities discovered by the established testing program. DOD must promulgate regulations to require contractors selling goods or services to DOD (e.g., printed circuit boards) to undertake such due diligence as DOD considers appropriate to prevent the occurrence of vulnerabilities.

Bioeconomy Research and Development Act of 2021 This bill directs the Office of Science and Technology Policy (OSTP) to implement a National Engineering Biology Research and Development Initiative to advance societal well-being, national security, sustainability, and economic productivity and competitiveness. Among other activities, the initiative must include sustained support for research centers, individual investigators, technologies, and training. The initiative shall include outreach to primarily undergraduate and minority-serving institutions about initiative opportunities, and shall encourage the development of research collaborations between research-intensive universities and such institutions. The OSTP shall designate an interagency committee to coordinate initiative activities as appropriate. The interagency committee shall submit triennial reports to Congress through FY2028 in support of the initiative. The National Science Foundation (NSF) shall seek to enter into an agreement with the National Academies of Sciences, Engineering, and Medicine to conduct a review of, and make recommendations with respect to, the ethical, legal, environmental, safety, security, and other appropriate societal issues related to engineering biology research and development. The NSF, National Institute of Standards and Technology, Department of Energy, Department of Defense, National Aeronautics and Space Administration (NASA), Department of Agriculture, and Department of Health and Human Services shall carry out related activities as part of the initiative.

Pharmaceutical Supply Chain Defense and Enhancement Act This bill requires the Department of Health and Human Services (HHS) to enter into contracts with U.S. entities to manufacture certain critical drugs within the United States. The Food and Drug Administration (FDA) must periodically report to Congress a list of drugs that are critical to public health or national security. The Biomedical Advanced Research and Development Authority within HHS must enter into contracts for qualified U.S. entities to manufacture in the United States the drugs on this list (and ingredients for such drugs). Such contracts must impose certain conditions, such as requiring the manufacturing entity to (1) develop and maintain a redundancy risk management and continuity of business plan, and (2) commit to selling the drugs and ingredients manufactured under the contract at reasonable prices. Beginning in FY2025, certain federal agencies, including the Department of Defense and the Bureau of Prisons, must give priority, in procuring drugs on the FDA critical drugs list, to those that are manufactured in the United States and of high quality. The bill also requires the Federal Trade Commission to submit annually to Congress a report on foreign investment in the U.S. pharmaceutical industry. The report must address, among other topics, the effect of the industry's reliance on foreign manufacturing.

Working to Integrate Networks Guaranteeing Member Access Now Act or the WINGMAN Act This bill directs the Department of Veterans Affairs (VA) to provide veterans with the option to grant read-only access to their records in the databases of the Veterans Benefits Administration to covered congressional employees. The covered congressional employees must be employed in the office of the Member of Congress who represents the district where the veteran resides. Under the bill, a covered congressional employee is (1) a permanent, full-time employee of a Member of Congress who is responsible for assisting constituents with federal agencies and departments; (2) designated by the Member; and (3) someone who satisfies the criteria required by the VA for recognition as an agent or attorney. However, the bill specifies that a covered congressional employee may not be recognized as an agent or attorney with respect to veterans' benefit claims.

Captain James C. Edge Gold Star Spouse Equity Act This bill addresses restrictions on benefits for surviving spouses of service members. Specifically, the bill prohibits the termination of the payment of an annuity under the Survivor Benefit Plan for certain surviving spouses of service members who died while on active duty solely because the surviving spouse remarries. The Department of Defense must resume payment of an annuity to surviving spouses who remarried before the age of 55 and before the enactment of this bill. The remarriage of a surviving spouse of a veteran does not bar the provision of dependency and indemnity compensation, regardless of their age when they remarried. The Department of Veterans Affairs must resume payment of dependency and indemnity compensation to surviving spouses who remarried before the age of 57 prior to the enactment of this bill.

Fort McClellan Health Registry Act This bill requires the Department of Veterans Affairs (VA) to establish and maintain the Fort McClellan Health Registry, which must include a list of names of those who were stationed at Fort McClellan, Alabama, between January 1, 1935, and May 20, 1999, and are seeking specified health care or benefits from the VA. Specifically, the registry must include those who apply for hospital, nursing home, domiciliary, or medical care from the VA; file a claim for compensation for service-connected disability; die and are survived by a spouse, child, or parent who files a claim for dependency and indemnity compensation; request a VA health examination; or receive a VA health examination and request to be included in the registry. The registry must also include relevant medical data of the listed individuals if they grant permission or are deceased at the time they are listed. Individuals who have submitted applications, requests, or claims prior to the enactment of this bill must be included in the registry to the extent feasible. The VA must periodically notify individuals listed in the registry of significant research developments on the health consequences of potential exposure to toxic substances or environmental hazards related to service at Fort McClellan. Additionally, the VA must reach out to individuals regarding the provision of health examinations and consultation and counseling services. In establishing and maintaining the registry, the VA must consult with the Department of Defense to acquire necessary information.

Specifically, contracts entered into by the Departments of Homeland Security, Health and Human Services, Defense, Education, or Veterans Affairs for the procurement of PPE must be for a duration of at least three years, including a base period and all option periods, to incentivize investment in the production of PPE, and materials and components of PPE, in the United States. The bill provides exceptions (1) where a nonavailability determination has been made, (2) where a sufficient quantity of a satisfactory quality cannot be procured as and when needed at U.S. market prices, and (3) where the department certifies every 120 days that it is necessary to procure PPE under alternate procedures to respond to the immediate needs of a public health emergency. Such departments may transfer to the Strategic National Stockpile any excess PPE acquired under a contract.

Solid Start Act of 2021 This bill permanently authorizes and expands the Solid Start program, which is an outreach program for veterans in their first year of separation from the military. Specifically, the bill requires the Department of Veterans Affairs (VA) to coordinate with the Department of Defense to collect updated contact information during transition classes or separation counseling for members of the Armed Forces who are separating from service; explain the existence and purpose of the program; call veterans three times within the first year of separation; publish information about the program in booklets and on the VA website; provide women veterans with information tailored to their health care and benefit needs; provide information on access to state and local resources, such as Vet Centers; gather and analyze data that assesses the effectiveness of the program; ensure calls are tailored to each veteran's needs by conducting quality assurance tests; and prioritize outreach to veterans who have accessed mental health resources prior to separation from the Armed Forces. Under the bill, the VA is authorized to (1) encourage members of the Armed Forces to provide additional contact information if they are unreachable following their separation, (2) follow up on missed phone calls, and (3) reach out to veterans who separated prior to the initiation of the Solid Start program.

Among other elements, the information published on the website should include statistics related to patient wait times, effectiveness of care, and staffing and vacancy information. The website must be (1) directly accessible from the main VA website and the main websites of each VA medical center, and (2) understandable and usable by the general public. The VA must implement a self-auditing process to assess the accuracy and completeness of the data available on the website.

Daniel J. Harvey Jr. and Adam Lambert Improving Servicemember Transition to Reduce Veteran Suicide Act This bill requires the Department of Defense (DOD) and the Department of Veterans Affairs (VA) to jointly implement a five-year pilot program to assess the feasibility and advisability of providing specified counseling and services as part of the Transition Assistance Program for members of the Armed Forces as a means of reducing the incidence of suicide among veterans. Specifically, the pilot program would involve a three-hour counseling module and the provision of contact information for a counseling or similar facility in the locality where the veteran intends to reside. Additionally, the participating veterans must submit medical records in connection with their service in the Armed Forces, regardless of whether they intend to file a claim for benefits for a service-connected disability. Under the program, a social worker or behavioral health coordinator from the VA must contact the veteran within 90 days after the member is discharged or released from service to schedule a follow-up appointment. At least 10 DOD Transition Assistance Centers must be jointly selected to carry out the pilot program.

Veterans Claim Transparency Act of 2021 This bill requires the Department of Veterans Affairs (VA) to provide the representative of a veteran with an opportunity to review a proposed determination regarding a claim for compensation or benefits before such determination becomes final. The VA must notify the representative in writing that a proposed determination is ready for review and may not make a final determination until the review period has ended. Under the bill, a representative has up to 48 hours to review the proposed determination.
