Strengthening Oversight for Veterans Act of 2021 This bill gives the Department of Veterans Affairs Office of Inspector General (VA OIG) the authority to subpoena the attendance and testimony of witnesses as necessary to carry out the duties of the office. The bill prohibits the VA OIG from subpoenaing the attendance and testimony of current federal employees or witnesses as part of any criminal proceeding. Under the bill, the VA OIG must notify the Department of Justice (DOJ) and the intended witness of the intent to issue a subpoena. If DOJ objects to the subpoena because it will interfere with an ongoing investigation, the VA OIG may not issue the subpoena.

Burn Pit Registry Enhancement Act This bill authorizes specified individuals to update the Airborne Hazards and Open Burn Pit Registry with the cause of death of a registered individual. The Department of Veterans Affairs established the burn pit registry to allow certain veterans and service members to document their exposures and report health concerns. The registry is for individuals who may have been exposed to toxic airborne chemicals and fumes caused by open burn pits (areas used for burning solid waste in open air without equipment) while deployed in certain locations (e.g., Afghanistan or Iraq). Specifically, the bill authorizes a designee of a registered individual or an immediate family member to update the registry with the cause of death of the individual.

Veterans' Pathway to Citizenship Act of 2021 This bill waives certain requirements for eligible noncitizens seeking U.S. citizenship through service in the Armed Forces and addresses related issues. Currently, a noncitizen who served honorably during a designated period of hostilities may acquire citizenship on an expedited basis, subject to certain requirements. Under this bill, such a noncitizen shall be deemed to be a lawful permanent resident and to have fulfilled all residency and physical presence requirements for naturalization purposes if that noncitizen meets all other naturalization requirements. In addition, for such a noncitizen seeking naturalization, any prior removals from the United States shall not affect the noncitizen's eligibility for any immigration benefit or in determining whether the alien is deportable or inadmissible. Similarly, if such a noncitizen has received a pardon for an offense, that offense shall not affect the noncitizen's naturalization application unless the pardoned offense led to the noncitizen's separation from the Armed Forces in any manner other than honorable. Furthermore, when a noncitizen becomes eligible for naturalization through military service during hostilities, the Department of Homeland Security shall notify the noncitizen and submit an application on the noncitizen's behalf, unless the noncitizen requests otherwise. If a noncitizen is eligible for citizenship through this path but had filed an untimely application, that application shall be treated as timely and reviewed. This provision shall be in effect for a one-year period starting from this bill's enactment.

Veterans Burn Pits Exposure Recognition Act of 2021 This bill requires the Department of Veterans Affairs (VA) to concede, for the purposes of health care benefits and wartime disability compensation, that a veteran was exposed to certain toxic substances, chemicals, and hazards from burn pits if such veteran served on active duty in a covered location during a specified time frame (unless there is affirmative evidence to establish that the veteran was not exposed during such service). A burn pit is an area used for burning solid waste in open air without equipment. Specifically, the bill covers the following locations and corresponding time periods: Iraq between August 2, 1990, and February 28, 1991, as well as from March 19, 2003, until burn pits are no longer used in this location; Somalia and Southwest Asia (including Kuwait, Saudi Arabia, Oman, and Qatar) from August 2, 1990, until burn pits are no longer used in these locations; and Afghanistan, Syria, Jordan, Egypt, Lebanon, Yemen, Uzbekistan, the Philippines, and Djibouti from September 11, 2001, until burn pits are no longer used in these locations. Under the bill, if an exposed veteran submits insufficient evidence to establish a service-connection for purposes of disability compensation, the VA shall provide a medical examination and request a medical opinion regarding a causal link between the disability and a toxin, chemical, or hazard.

VA Police Improvement and Accountability Act This bill requires the Department of Veterans Affairs (VA) to establish policies and procedures related to the accountability and staffing of its police force. Specifically, the bill requires the VA to publish specified summaries, statistics, and contact information related to the activities of VA police officers from the previous five-year period. The VA must ensure that each of its police forces is able to provide VA employees and members of the public who contact the force with contact information to directly contact the police force regarding the arrest, ticketing, detainment, use of force, or other police matters pertaining to the individual. The bill requires VA police officers to wear body cameras that record and store audio and video. Additionally, the VA's guidance on the use of body cameras must be made publicly available. Under the bill, the VA is required to track and analyze the following information regarding its police force: arrests made and tickets issued; prosecutions, ticketing, and other actions relating to such arrests; the use of force and weapon discharges; and complaints, investigations, and disciplinary actions. The VA must ensure each incident of the use of force is promptly reported to the Assistant Secretary with responsibility for operations, preparedness, security, and law enforcement functions. The Assistant Secretary must review and investigate each incident (including allegations) of the use of force by a VA police officer, including such situations where any person receives medical attention. The VA must develop a plan that establishes minimum standards for police staffing at its facilities.

Specifically, the bill authorizes the VA to enter into agreements with specified entities (e.g., nonprofit organizations or tribal entities) through September 30, 2025, to assist homeless veterans and their families in acquiring shelter or permanent housing. Under the bill, the VA may enter into agreements where an entity that is buying, leasing, or receiving property agrees to sell or rent the property directly to homeless veterans or veterans at risk of homelessness.

Veterans Fellowship Act This bill requires the Veterans' Employment and Training Service within the Department of Labor to implement a pilot program under which states may use grants or contracts to carry out a short-term fellowship program. The Government Accountability Office must report on the pilot program within four years after it commences.

Conceding Our Veterans' Exposures Now And Necessitating Training Act of 2021 or the COVENANT Act of 2021 This bill establishes a presumption of service-connection for certain illnesses related to exposure to airborne hazards or open burn pits and addresses the care available through the Department of Veterans Affairs (VA) for veterans with illnesses they assert to be related to exposures during their service. Specifically, the bill establishes a presumption of service-connection for certain illnesses becoming manifest in covered veterans to a degree of 10% or more. Under a presumption of service-connection, specific conditions diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded. A covered veteran is any veteran who served on or after August 2, 1990, in Bahrain, Iraq, Kuwait, Oman, Qatar, Saudi Arabia, Somalia, or the United Arab Emirates; or served on or after September 11, 2001, in Afghanistan, Djibouti, Egypt, Jordan, Lebanon, Syria, Yemen, Uzbekistan, the Philippines, or other countries the VA determines to be relevant. Among other elements, the bill requires the VA to provide medical examinations for veterans who submit a claim for disability compensation for an illness not listed in the bill but that is asserted to be related to airborne hazard or open burn pit exposure; authorizes the VA to stay pending claims for disability compensation related to the service and illnesses covered by this bill until the implementation of the bill; and provides VA hospital care, medical services, and nursing home care to covered veterans.

Presumptive Benefits for War Fighters Exposed to Burn Pits and Other Toxins Act of 2021 This bill establishes a presumption of service-connection for specified diseases associated with exposure to burn pits (an area used for burning solid waste in open air without equipment) and other toxins by veterans who were awarded specified medals on or after August 2, 1990. Under a presumption of service-connection, specific conditions diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded. Under the bill, if the Department of Veterans Affairs (VA) receives a written petition to add a disease to the list, the VA must request a determination by the National Academies of Sciences, Engineering, and Medicine with respect to whether there is a positive association between the exposure of humans to a covered toxin and the occurrence of the disease in humans. The bill makes disability or death of certain employees from specified diseases compensable as a work injury. Specifically, such employees are those who were employees of the Department of State, the Department of Defense, or an element of the intelligence community on or after August 2, 1990, and carried out job responsibilities for at least 30 days during a contingency operation.

Advancing Conservation and Education Act This bill allows the states of Alaska, Arizona, California, Colorado, Idaho, Montana, New Mexico, North Dakota, Oregon, South Dakota, Utah, Washington, or Wyoming to relinquish state land grant parcels wholly or primarily within eligible areas and select, in exchange, public land within the state. Eligible areas are areas within the outer boundaries of units or components of the National Park, National Wilderness Preservation, National Wildlife Refuge, or National Landscape Conservation Systems, areas identified by the Bureau of Land Management (BLM) as having wilderness characteristics, certain designated lands within the National Forest System or administered by the BLM, and sentinel landscapes designated by the Department of Agriculture, Department of Defense, or Department of the Interior. Interior shall create a process for the relinquishment of such parcels. States may select in exchange, and Interior may convey, lands that are mineral in character. The overall value of the state land grant parcels and the public land to be conveyed shall be equal or made equal. The bill sets forth requirements regarding hazardous materials on land to be conveyed, water rights, grazing permits, road rights-of-ways, and protection of Indian rights.

These risks can include disinformation, identity theft, scams, and fraud spread via the internet or social media. Additionally, the VA must seek to enter an agreement with a federally funded research and development corporation to perform a study that assesses (1) the vulnerability of veterans to cyber risks, (2) the availability and efficacy of resources to assist veterans in combatting such risks, and (3) the efficacy of the VA's outreach campaign. The study must also recommend ways the VA can reduce cyber risks to veterans.

Energy Innovation and Carbon Dividend Act of 2021 This bill imposes a fee on the carbon content of fuels, including crude oil, natural gas, coal, or any other product derived from those fuels that will be used so as to emit greenhouse gases into the atmosphere. The fee is imposed on the producers or importers of the fuels and is equal to the greenhouse gas content of the fuel multiplied by the carbon fee rate. The rate begins at $15 per metric ton of CO2-e in 2021, increases by $10 each year, and is subject to further adjustments based on the progress in meeting specified emissions reduction targets. The bill includes exemptions for fuels used for agricultural or nonemitting purposes, exemptions for fuels used by the Armed Forces, rebates for facilities that capture and sequester carbon dioxide, and border adjustment provisions that require certain fees or refunds for carbon-intensive products that are exported or imported. The fees must be deposited into a Carbon Dividend Trust Fund and used for administrative expenses and dividend payments to U.S. citizens or lawful residents. The fees must be decommissioned when emissions levels and monthly dividend payments fall below specified levels.

Military Hunger Prevention Act This bill requires the Department of Defense (DOD) to pay a basic needs allowance to certain low-income members of the Armed Forces. Specifically, those eligible for the basic needs allowance are members who (1) have completed initial entry training, (2) have a gross household income that did not exceed an amount equal to 130% of the federal poverty guidelines of the Department of Health and Human Services (HHS), and (3) do not elect to decline the allowance. In situations where a household contains two or more eligible members, the bill specifies that only one allowance may be paid per year to one member they jointly elect. The amount of the allowance must be the aggregate amount equal to 130% of the HHS federal poverty guidelines minus the gross household income of the covered member during the preceding year divided by 12. The Defense Finance and Accounting Service (DFAS) of DOD must notify, in writing, individuals determined to be eligible for the allowance. The notice must include information regarding financial management and assistance programs administered by DOD for which the individuals are also eligible. Individuals who seek to receive the allowance must submit specified information to DFAS.

Department of Veterans Affairs Information Technology Reform Act of 2021 This bill addresses the management and implementation of information technology projects and investments of the Department of Veterans Affairs (VA). Specifically, the bill prohibits the VA from obligating or expending funds for any major information technology project that begins after the date of enactment of this bill unless a report is submitted that includes information on the cost, schedule, and performance of the project. The information in the report must be used as a baseline against which changes or variances are measured and reported on during the life cycle of the project. Projects must be managed by an interdisciplinary team that includes a certified project manager, a functional lead, a technical lead, a contracting officer, and other appropriate personnel. The VA's Chief Information Officer must (1) exercise authority over the management, governance, and oversight processes relating to information technology of the VA's Financial Services Center; and (2) supervise the information technology employees and contractors of the center. Finally, the VA must assess all of its information technology investments to determine the suitability for migration to a cloud computing service.

The bill extends through September 30, 2030, the requirement for the Department of Veterans Affairs (VA) to make determinations and submissions related to the connection between herbicide exposure and occurrence of disease. Additionally, the VA is prohibited from taking the costs of compensation into account when determining the association between exposure to an herbicide agent and occurrence of a disease. The bill requires the VA to determine within 120 days (currently 60) whether a presumption of service-connection is warranted for diseases covered by a National Academy of Sciences report.

Finally, the bill requires DOD to enter into a contract with the National Academy of Sciences to study extending to 2050 the life of Minuteman III intercontinental ballistic missiles.

Military Retiree Survivor Comfort Act This bill addresses the overpayment of retired or retainer pay to a joint account (bearing the name of the decedent and the decedent's designated beneficiary) during the month of the death of a retired member of the armed forces. Specifically, the bill authorizes the Department of Defense (DOD) to forgive or offset the overpayment if the decedent was enrolled in the Survivor Benefit Plan (SBP). In the case of an offset, each of the first 12 SBP annuity payments after the death of the retired service member must be reduced by one-twelfth of the overpayment. If the decedent was not enrolled in the SBP, DOD is authorized to forgive the overpayment.

The GAO must also develop recommendations to facilitate better data collection on such disparities associated with race and ethnicity. Within one year, the GAO must brief Congress on the initial results of the study. The GAO must also submit a final report on the study following the briefing.

This bill addresses disability compensation and care issues for Persian Gulf War veterans. First, the bill expands eligibility for disability compensation from the Department of Veterans Affairs (VA) to Persian Gulf War veterans who have a qualifying chronic disability that became manifest to any degree at any time. Next, the VA must develop a Disability Benefits Questionnaire to be used by health care personnel to identify Gulf War illness if a Persian Gulf veteran presents with any one symptom associated with such illness. The bill also expands who qualifies as a Persian Gulf veteran by including those who served in Afghanistan, Israel, Egypt, Turkey, Syria, or Jordan during the Persian Gulf War. Under current law, Persian Gulf veteran refers only to individuals who served on active duty during the Persian Gulf War in particular areas of the Arabian Peninsula. Finally, the VA must ensure its health care personnel are appropriately trained to provide care to Persian Gulf veterans.

Puppies Assisting Wounded Servicemembers Act of 2021 or the PAWS Act of 2021 This bill requires the Department of Veterans Affairs (VA) to implement a grant program for the purpose of pairing service dogs with eligible veterans. Organizations that receive grants shall provide veterinary health insurance coverage, hardware, and travel expenses for each service dog and veteran participating in the program. Eligible veterans are those who (1) are enrolled in the VA health care system, (2) have been evaluated and treated for post-traumatic stress disorder (PTSD) but remain diagnosed with PTSD, (3) may benefit from a service dog, and (4) agree to successfully complete training provided by an eligible organization. Veterans are required to see a VA health care provider at least once every 180 days to determine whether the veteran continues to benefit from a service dog. Eligible organizations are nonprofit organizations that are accredited by a widely recognized accreditation organization, meet publicly available standards set forth by the Association of Service Dog Providers for Military Veterans, have expertise in the needs of veterans with PTSD, agree to cover all costs in excess of the grant amount to guarantee the benefits of the program, agree to reaccept or replace a service dog provided to a veteran, and submit an application to the VA. Any improvement in PTSD symptoms as a result of the provision of a service dog shall not affect the veteran's eligibility for any other VA benefits. The Government Accountability Office must report on the grant program.
