USACE Military Personnel Augmentation Act of 2021 This bill expands the types of Army personnel entitled to receive certain pay and allowances while assigned to the U.S. Army Corps of Engineers on nonmilitary public works projects. Currently, regular Corps officers and reserve Army officers assigned to the Corps are entitled to receive pay and allowances from funds appropriated for the project that they are working on. The bill entitles warrant officers and enlisted members of the Army, whether regular or reserve, to receive such pay and allowances when assigned to the Corps.

Sgt. Isaac Woodard, Jr. and Sgt. Joseph H. Maddox GI Bill Restoration Act of 2021 This bill expands eligibility for Post-9/11 GI bill educational assistance benefits and the Department of Veterans Affairs (VA) home loan program. Specifically, the bill explicitly includes the following persons as eligible veterans: Black veterans who served on active duty during World War II who can certify they were denied a specific benefit on the basis of race; and the living surviving spouses, children, grandchildren, or other direct descendants of such veterans described above who can certify the veteran was denied a specific benefit on the basis of race. Such veterans described above must apply for educational or home loan benefits within the five-year period after the passage of this bill to be eligible for benefits. The Government Accountability Office must report on the number of individuals who received educational or housing loan benefits and the total value of such benefits administered by the VA due to the amendments made by the bill. Finally, the VA must appoint a panel of independent experts to develop recommendations regarding additional benefits and assistance for female and minority members of the Armed Forces.

Veteran Deportation Prevention and Reform Act This bill limits the deportation of noncitizen veterans and addresses related issues. No federal agency may initiate removal proceedings without asking the individual facing removal whether the individual is a member of the Armed Forces, a veteran, or a spouse, parent, or minor child of such an individual. If an individual responds in the affirmative, that individual may not be removed until (1) the relevant Department of Homeland Security (DHS) agency has transferred that individual's case files to an advisory committee created under this bill, and (2) that committee has provided recommendations as to the outcome of the case. DHS must create a system to share information across various agencies about noncitizen veterans who may be subject to removal to ensure that such a veteran's military service is taken into consideration in immigration-related cases. DHS shall also create a system for (1) identifying noncitizens who are or may be veterans, and (2) collecting data relating to such noncitizens who are in removal proceedings or may have been removed. DHS and the Department of Defense must jointly carry out a program to naturalize a noncitizen (and certain family members) if the noncitizen serves on active duty in the Armed Forces and is not otherwise ineligible for citizenship if that noncitizen submits an application. DHS must also establish a program for eligible noncitizen veterans (generally those not convicted for certain serious crimes) to obtain permanent resident status. Similarly, the Department of Justice must provide permanent resident status to such eligible veterans in removal proceedings.

Coast Guard Combat-Injured Tax Fairness Act This bill extends the provisions of the Combat-Injured Veterans Tax Fairness Act of 2016 to the Department of Homeland Security, with respect to the U.S. Coast Guard when it is not operating in the Department of the Navy. That act directed the Department of Defense to identify (1) certain disability severance payments paid after January 17, 1991, to veterans with combat-related injuries, from which it withheld amounts for tax purposes; and (2) the individuals to whom such severance payments were made.

Restoring Benefits to Defrauded Veterans Act This bill requires the Department of Veterans Affairs (VA) to pay certain reissued benefits (i.e., benefits that were misused by a fiduciary) to a beneficiary's estate in situations where a beneficiary predeceases a payment. The VA must pay such benefits to an individual or entity in the following order: the estate of the beneficiary, a successor fiduciary serving the beneficiary when the beneficiary died, or the next inheritor determined by a court of competent jurisdiction.

Improving Protections for Midshipmen Act This bill addresses sexual harassment and sexual assault at the U.S. Merchant Marine Academy and provides for greater diversity and inclusion at the academy and within the maritime transportation system workforce. The Department of Transportation (DOT) shall establish a Sexual Assault Advisory Council to review the academy's policy on sexual harassment, dating violence, domestic violence, sexual assault, and stalking and other relevant matters related to sexual assault and sexual harassment. The DOT's Maritime Administration shall (1) establish an information management system to track the number of sexual assault or sexual harassment incidents every fiscal year at the academy, and (2) implement comprehensive in-person sexual assault risk-reduction and response training for all midshipmen at the academy. Additionally, the bill designates a Special Victims' Counsel to provide legal assistance to any cadet of the academy who is the victim of a sex-related offense. Further, the Coast Guard shall assess the feasibility of implementing a program modeled on the Catch a Serial Offender program of the Department of Defense. The bill also expands the authority of the Coast Guard to suspend or revoke a mariner's license on grounds related to sexual harassment or assault. With respect to diversity and inclusion, DOT shall establish an interagency task force to discuss and share tools and practices that promote diversity and inclusiveness within the maritime transportation system workforce. The Maritime Administration shall promulgate a Diversity and Inclusion Action Plan to increase recruiting efforts in historically underrepresented communities.

Creating Hope and Opportunity for Individuals and Communities through Education Act or the CHOICE Act This bill expands school choice programs for elementary and secondary school students. Specifically, the bill authorizes the Department of Education (ED) to award grants to support the design and implementation of state programs that allow the parent of a child with a disability to choose the appropriate public or private school for their child. It also outlines the requirements for program eligibility. Further, if the state has established a program that allows parents to use public or private funds to assist with the cost of their child attending a private school, then the state may supplement those funds with federal special education funds. Additionally, the Department of Defense must carry out a five-year pilot program to award scholarships to enable military dependent students who live on military installations to attend the public or private elementary or secondary schools their parents choose. The bill also requires ED to return to the Treasury specified amounts made available for salaries and expenses.

This bill modifies the process for repaying service members and veterans who paid to keep benefits under the Montgomery GI Bill, but later chose to utilize Post-9/11 GI Bill benefits. Specifically, the bill removes the requirement for the Department of Veterans Affairs (VA) to issue the repayments with the last monthly housing stipend under the Post-9/11 GI Bill. This requirement has limited the repayments to individuals who are receiving stipends. Under the bill, the VA must make such a repayment before the exhaustion of the individual's entitlement to education assistance.

Wounded Warrior Access Act This bill requires the Department of Veterans Affairs (VA) to establish and maintain a secure, internet-based website to enable a claimant or their representative to make records requests related to VA claims and benefits. Protecting our Veterans' Memories Act This bill requires the Department of Veterans Affairs (VA) to pay a state, state agency, or political subdivision of a state $525 as a plot or internment allowance for spouses and children of veterans who are buried in a cemetery owned by the state, agency, or political subdivision. Specifically, the bill requires the VA to pay a plot or internment allowance for spouses, surviving spouses (including if they have remarried), or minor children (those under 21 or under 23 if they are attending an approved educational institution). The VA may pay the allowance for unmarried adult children of certain veterans.

Veterans Heroin Overdose Prevention Examination Act or the Veterans HOPE Act This bill requires the Department of Veterans Affairs (VA) to complete a review of the deaths of all covered veterans who died from opioid overdoses during the five-year period preceding the enactment of this bill. Covered veterans are those who received VA hospital care or medical services during the five-year period preceding the death of the veteran. The VA shall report on the results of the review and make such report publicly available.

VA Overpayment Accountability Act This bill prescribes procedures by which the Department of Veterans Affairs (VA) and debt collectors shall correct errors submitted to consumer reporting agencies about the indebtedness of certain veterans. Specifically, the bill requires these corrections for veterans who are indebted due to participation in a VA benefits program. The bill also requires the VA to update its information technology for the processing of VA benefits. Lastly, the bill requires the VA to self-audit to determine the frequency by which overpayments are made to individuals participating in VA benefits programs.

Veterans' Preference Parity Act This bill modifies the eligibility criteria for certain veterans to qualify for a preference in the federal hiring process. Specifically, an individual who is honorably discharged from active duty service is eligible for a veterans' preference, if the active duty service was performed for more than 180 total days (currently, consecutive days). Additionally, a retired member of the Armed Forces is eligible for a veterans' preference, even if the retiree (1) is not a disabled veteran and (2) retired at or above the rank of major or its equivalent.

Veteran Entrepreneurs Act of 2021 This bill allows a business-related tax credit of 25% of up to $400,000 of the franchise fees paid or incurred by an eligible veteran for the purchase of a franchise. The bill reduces the amount of such credit if the veteran does not own 100% of the stock or capital or profits interest of the franchisee. An eligible veteran is a person who served in the active military, naval, or air service; was discharged or released under conditions other than dishonorable; and who pays or incurs a franchise fee in connection with a franchise agreement with a franchisor. The veteran may elect to transfer the credit to an eligible franchisor in exchange for a discount in the franchise fee commensurate with the value of the credit. The Small Business Administration and the Department of Veterans Affairs must provide information about the tax credit allowed by this bill to veterans service organizations and veteran advocacy groups.

Reform and Update Rural Access to Local Exams Act of 2021 or the RURAL Exams Act of 2021 This bill updates policies and procedures related to covered medical disability examinations provided by the Department of Veterans Affairs (VA) and its contractors. Under the bill, covered medical disability examinations are those that are required for purposes of adjudicating specified VA benefits. First, the bill requires the VA to begin collecting data to improve veterans' access to covered medical disability examinations. The VA must study rural veterans' access to covered medical disability examinations and submit a plan to improve access. Additionally, the VA must ensure that contracts for the provision of covered medical disability examinations by contractors include specified elements. Specifically, such contracts must (1) include financial incentives to encourage timeliness in medical disability examination appointments for rural or housebound veterans, (2) include financial disincentives to encourage timeliness, and (3) require contractors to cooperate with inspections. Finally, the VA must establish a program of periodic inspections of sites, locations, and facilities where medical disability examinations are provided by VA contractors.

A covered state is each state (including Puerto Rico, the District of Columbia, and any territory or possession of the United States) that has a ratio of one or fewer Vet Centers per 100,000 or more veterans residing in the state or territory. Vet Centers are community-based counseling centers that provide social and psychological services to eligible veterans, active duty service members, and their families. The VA must also report on the marketing and outreach funding of Vet Centers in covered states.
