Strengthening Supply Chains for Servicemembers and Security Act This bill addresses Department of Defense (DOD) supply chain risk management, specifically risk management related to pharmaceuticals. The bill requires the Office of the Under Secretary of Defense for Acquisition and Sustainment within DOD to develop and issue implementing guidance for risk management for DOD supply chains for materiel (e.g., pharmaceuticals) and identify supply chain information gaps regarding reliance on foreign suppliers of drugs. After such guidance is issued, the Defense Health Agency must develop and publish implementing guidance for risk management for DOD's supply chain for pharmaceuticals and establish a working group to assess risks to the pharmaceutical supply chain, identify the pharmaceuticals most critical to beneficiary care at military treatment facilities, and establish policies for allocating scarce pharmaceutical resources. Finally, the Defense Logistics Agency must modify Defense Logistics Agency Instructions 5025.03 and 3110.01 to require Defense Logistics Agency Troop Support to coordinate annually with customers in the military departments to test responsiveness of the agency's contingency contracts for pharmaceuticals and to include the results of the testing in the annual Warstopper Program reports.

Taiwan Deterrence Act

Taiwan Deterrence Act This bill authorizes defense-related assistance for Taiwan and addresses related issues. For FY2023-FY2032, the Department of State may provide foreign military financing grant assistance to Taiwan if (1) Taiwan commits to match such spending on a dollar-for-dollar basis, and (2) the United States and Taiwan agree to conduct joint long-range planning for capability development and on the expenditure of the funds. Furthermore, for the purposes of certain arms export control laws, Taiwan shall receive treatment identical to NATO member countries, Australia, Japan, South Korea, Israel, and New Zealand. (Currently, such countries receive benefits in regards to defense article transfers, such as the waiver of certain requirements and eligibility for assistance and fee waivers.) The State Department must report to Congress on U.S. priorities for building more capable Taiwan security forces and organizations. The State Department and the Department of Defense must jointly report to Congress on an annual basis on Taiwan's enhancement of its self-defense capabilities.

DOD must brief the congressional defense committees on the implementation of this pilot program.

Defense of Environment and Property Act of 2021

Defense of Environment and Property Act of 2021 This bill revises the scope, jurisdiction, and requirements of the Clean Water Act. It specifies the types of water bodies that are navigable waters and therefore receive protection. It defines navigable waters as waters of the United States that are (1) navigable-in-fact; or (2) permanent, standing, or continuously flowing bodies of water that form geographical features commonly known as streams, oceans, rivers, and lakes that are connected to waters that are navigable-in-fact. The bill limits the jurisdiction of the U.S. Army Corps of Engineers and the Environmental Protection Agency (EPA) over such waters, including by stating that ground water is under the jurisdiction of states. The bill prohibits the EPA from using a significant nexus test to determine federal jurisdiction over navigable waters and waters of the United States. The bill nullifies the Migratory Bird rule and a 2008 guidance document about the definition of waters under the jurisdiction of the Clean Water Act. The bill prohibits the EPA and the Corps from issuing new rules or guidance that expands or interprets the definition of navigable waters unless expressly authorized by Congress. Federal agencies must obtain consent from private property owners to collect information about navigable waters on their land. If regulations relating to navigable waters or waters of United States diminish the value of a property, then the federal government must pay the property owner an amount equal to twice the value of the loss.

Jamal Khashoggi Human Rights Act

Jamal Khashoggi Human Rights Act This bill imposes sanctions on individuals involved in the killing of journalist Jamal Khashoggi, establishes requirements for arms transfers to Saudi Arabia, and addresses other related issues. The bill imposes sanctions on persons named in an Office of the Director of National Intelligence report assessing the role of Saudi Arabia's government in Khashoggi's killing. The President may waive the sanctions for national security interests on a case-by-case basis upon providing certain information and certifications to Congress. Such a waiver may last for up to 90 days and may be renewed. If the President determines that Saudi Arabia's government has engaged in a pattern of intimidation and harassment against U.S. persons or their family members, the President must suspend the provision of certain defense-related assistance until the pattern has ceased. The Department of State must provide certain information to Congress before concluding a sale or authorizing the export or transfer of controlled defense articles (or defense services) to Saudi Arabia, including a certification that Saudi Arabia's government has provided a written commitment to not use such articles to violate human rights. The U.S. government may not provide or authorize the export of services for military, paramilitary, security, or intelligence-gathering activities to Saudi Arabia, with certain exceptions. The State Department may annually present the Jamal Khashoggi Press Freedom Award to recognize extraordinary efforts in journalism in the face of harassment, detention, or obstruction by foreign governments or non-state actors.

Onward to Opportunity Act

Onward to Opportunity Act This bill requires the Department of Defense to implement a pilot program to provide grants for eligible entities to supplement the Transition Assistance Program by providing job opportunities for industry-recognized certifications, job placement assistance, and related employment services. Eligible entities are those that (1) follow a job training and placement model; (2) have a well-developed and rigorous practice of program measurement and evaluation; (3) have established partnerships with entities to provide the necessary services; and (4) have online training capability to reach rural veterans, reduce costs, and comply with new conditions forced by COVID-19. The program must be implemented at five military installations in the United States with successful economic opportunity program models.

Reservists Opportunity Act of 2021

Reservists Opportunity Act of 2021 This bill requires the Department of the Army to ensure that members of its reserve components may access the Tour of Duty system using a personal internet-enabled device. The Tour of Duty system is an online system of listings for opportunities to serve on active duty for members of the reserve components of the Army through which such members may apply for the listed opportunities. The Department of the Army may restrict access to the system on personal devices if the restriction is necessary for security reasons.

Autonomy for Disabled Veterans Act

Autonomy for Disabled Veterans Act This bill increases the maximum amount authorized under the Home Improvements and Structural Alterations (HISA) grant program to $10,000 for veterans with a service-connected disability and $5,000 for those with disabilities that are not service-connected. The HISA grant program provides medically necessary improvements and structural alterations to veterans' (or service members') primary residence for specified purposes (e.g., allowing for entrance to their home). The bill requires the Department of Veterans Affairs to increase the dollar amount of the grant in accordance with inflation as determined by the Consumer Price Index.

Arm Taiwan Act of 2021

Arm Taiwan Act of 2021 This bill requires the Department of Defense (DOD) to establish the Taiwan Security Assistance Initiative to accelerate Taiwan's deployment of asymmetric defense capabilities to the level required to deter or defeat an invasion by China. From FY2023 through FY2027, the bill requires DOD to use appropriations provided for the initiative to provide assistance to accelerate Taiwan's asymmetric defense capabilities so that Taiwan, with limited initial U.S. Armed Forces support, is able to (1) delay, degrade, and deny attempts by China's army to enter or transit the Taiwan Strait (and adjoining seas) or seize control of key territory in Taiwan; and (2) prevent China from neutralizing or rendering ineffective Taiwan's government. The bill imposes certain requirements related to such assistance, such as periodic certifications by DOD to Congress that Taiwan's government has committed to (and has made progress toward) spending at least 3% of Taiwan's national gross domestic product on defense on an annual basis by the end of FY2027.

The bill also requires designated senior DOD officials to conduct annual assessments of workforce, infrastructure, and industrial base capabilities and capacity to support a strategy to support domestic manufacturing and industrial base capabilities to support future defense requirements. The Government Accountability Office must brief Congress and report on, among other topics, its findings related to the strategy, effectiveness, and responsibilities of the Assistant Secretary of Defense for Industrial Base Policy.

Circumspectly Reducing Unintended Consequences Impairing Alliances and Leadership Act of 2021 or the CRUCIAL Act of 2021 This bill establishes requirements relating to the President's ability to impose sanctions on individuals or entities that engage in a significant transaction with the defense or intelligence sectors of Russia's government if the transaction involves a member of the Quadrilateral Security Dialogue. (The dialogue is a coalition comprised of the governments of the United States, Japan, India, and Australia.) Specifically, before imposing such sanctions for a transaction involving a member of the dialogue, the President must certify to Congress that the government in question is not participating in the dialogue on security matters that are critical to U.S. strategic interests.

Childcare Expansion for Military Families Act of 2021

Childcare Expansion for Military Families Act of 2021 This bill addresses the provision of child care and development services by the Department of Defense (DOD) for children of members of the Armed Forces (military children). First, the bill requires DOD to establish a program to carry out minor military construction projects to construct child development centers, in amounts up to $15 million per project. DOD must establish procedures for the review and approval of requests from the military departments to implement construction projects for child development centers. DOD must conduct a comprehensive assessment of the availability of government-provided early childhood education and infant and early childhood mental health consultation services on and in the vicinity of certain military installations to identify and address the needs of military children. DOD is authorized to conduct one or more demonstration projects to evaluate improved approaches to the provision of educational and infant and early childhood mental health services to military children to evaluate the efficacy of such services to improve social-emotional development outcomes. DOD may authorize the development of a comprehensive professional development curricula for specified purposes. Finally, DOD must evaluate each demonstration project to assess the (1) extent of positive outcomes for military children, (2) improvements in services and continuity of care for such children, and (3) improved military family readiness and enhanced military retention.

Cold War Service Medal Act

Cold War Service Medal Act This bill authorizes the military department concerned to issue Cold War Service Medals to eligible persons who served during the Cold War (September 2, 1945, to December 26, 1991) and meet other requirements. Specifically, eligible persons are those who (1) served on active duty for at least 24 consecutive months during the Cold War, (2) were deployed as members of the armed forces outside of the United States for at least 30 days during the Cold War, (3) were members of a reserve component and called or ordered to active duty related to the Cold War, or (4) performed other service in the armed forces during the Cold War. The military department concerned may issue the medal to the next-of-kin if the eligible recipient is deceased.

COMFORT Act

Comforting Our Military Families through On-base or Remote Treatment Act or the COMFORT Act This bill authorizes the Office of Military Family Readiness Policy within the Department of Defense (DOD) to coordinate programs and activities for the provision of nonmedical counseling services to military families through the DOD Military and Family Life Counseling Program. Under the bill, nonmedical counseling services means mental health care services that are nonclinical, short-term, and solution-focused to address topics related to personal growth, development, and positive functioning. The bill authorizes mental health professionals to provide non-medical counseling services regardless of where the provider or recipient is located so long as the provision of service is within the scope of the authorized duties of the provider. For purposes of the bill, mental health professionals include licensed or certified mental health professionals or members of the uniformed services, civilian DOD employees, or DOD contractors.

The program must (1) monitor and combat China's malign influence in foreign countries, (2) monitor China's military trends abroad and counter its activities and advancements in foreign nations that pose a threat to U.S. interests and the rules-based order, and (3) strengthen U.S. government capacity to engage with foreign countries and international organizations to counter China's malign influence. Under this program, the State Department must place officers in select U.S. diplomatic and consular posts to engage with Chinese and third-party nationals, as well as host governments and nongovernment entities, on the above-referenced matters.

Support Our Military Working Dogs Act

Support Our Military Working Dogs Act This bill addresses provisions regarding the care and study of military working dogs. First, the bill authorizes the Department of Defense (DOD) to accept donations for the purpose of providing long-term care for retired military working dogs that have been adopted. The bill authorizes DOD to enter into a multi-year agreement with a veterans service organization or nonprofit entity to solicit, accept, and transfer funds to provide long-term care for adopted military working dogs. The bill prohibits charging a fee for the adoption of a military animal. The bill updates the duties of the Joint Trauma Education and Training Directorate. Specifically, the bill requires the directorate to develop a comprehensive trauma care registry with respect to military working dogs. Additionally, the directorate must inform and advise the conduct of research on the leading causes of morbidity and mortality of military working dogs in combat. Finally, DOD must establish a personnel management plan for veterinary care.

Customer Non-Discrimination Act

Customer Non-Discrimination Act This bill prohibits discrimination based on sex, sexual orientation, and gender identity with respect to public accommodations and facilities. Specifically, the bill defines and includes sex, sexual orientation, and gender identity among the prohibited categories of discrimination or segregation. The bill expands the definition of public accommodations to include places or establishments that provide (1) exhibitions, recreation, exercise, amusement, gatherings, or displays; (2) goods, services, or programs; and (3) transportation services. Protections against discrimination based on race, color, religion, sex, sexual orientation, gender identity, or national origin shall include protections against discrimination based on (1) an association with another person who is a member of such a protected class; or (2) a perception or belief, even if inaccurate, that an individual is a member of such a protected class. The bill prohibits the Religious Freedom Restoration Act of 1993 from providing a claim, defense, or basis for challenging such protections. The bill prohibits an individual from being denied access to a shared facility, including a restroom, a locker room, and a dressing room, that is in accordance with the individual's gender identity. The bill also prohibits the provision of less favorable treatment with respect to pregnancy, childbirth or related medical conditions as compared to other physical conditions.

Taiwan ASSURE Act

Taiwan Actions Supporting Security by Undertaking Regular Engagements Act or the Taiwan ASSURE Act This bill authorizes activities pertaining to Taiwan and requires reports on related topics. This bill authorizes from FY2022 through FY2025 (1) activities and trainings to increase Taiwan's economic and international integration, and (2) Department of State activities to support strategic dialogues facilitated by independent nonprofit organizations to discuss stability issues related to China and Taiwan. The Department of Defense (DOD) must report to Congress on (1) the feasibility and advisability of establishing a partnership between the U.S. National Guard and Taiwan's Armed Forces Reserve Command, and (2) an assessment of the implementation of Taiwan's asymmetric defense strategy. The State Department, in coordination with DOD, must report annually on (1) military-to-military dialogues and confidence-building measures between the United States and China, and (2) diplomatic engagements with China that involved discussions about issues concerning China and Taiwan.

VA Infrastructure Powers Exceptional Research Act of 2021

VA Infrastructure Powers Exceptional Research Act of 2021 or the VIPER Act of 2021 This bill addresses research activities of the Department of Veterans Affairs (VA), particularly those within the Veterans Health Administration (VHA). First, the bill provides statutory authority for the VHA's Office of Research and Development to serve veterans through a full spectrum of research, technology transfer, and application. Next, the bill exempts VA research activities from the Paperwork Reduction Act, including research conducted via the Office of Research and Development The VA is authorized to appoint statisticians, economists, data scientists, and other professionals within the VHA. The bill provides a three-year authorization for the VA to enter into transactions, other than contracts, cooperative agreements, and grants, with nontraditional contractors to carry out extramural basic or applied research. Such transactions must meet specified criteria (e.g., the research must not be duplicative of other VA research under another program). Additionally, the VA must notify Congress within 30 days of entering into a transaction and must provide specified information and records to the Government Accountability Office (GAO) and Congress upon request. The Office of Research and Development is authorized to establish a grant program for certain individuals employed by specified research institutions to conduct research related to health care furnished by the VA. The GAO must study the amount of time dedicated for research for clinician-scientists appointed by the VA. Finally, the bill updates the process by which the VA uses commercial institutional review boards in sponsored clinical trials.

Afghanistan Security Through Intelligence Act

Afghanistan Security Through Intelligence Act This bill requires reports concerning the situation in Afghanistan and other specified countries. The National Intelligence Council within the Office of the Director of National Intelligence (ODNI) must submit to Congress a National Intelligence Estimate (a type of intelligence community assessment about a specific issue) on topics including (1) the presence of certain countries, including China, Iran, and Russia in Afghanistan and other specified countries, such as India and the Gulf Cooperation Council countries; (2) any change to threats to the United States as a result of the withdrawal of U.S. Armed Forces from Afghanistan on August 31, 2021; and (3) the political composition and stability of the governing body of Afghanistan. The ODNI must periodically report to Congress on issues such as (1) the intelligence community's collection posture with respect to issues involving Afghanistan, including the detection and prevention of any increased threat to the United States as a result of the U.S. military withdrawal from Afghanistan; (2) any plans or efforts to improve the intelligence collection posture in Afghanistan; and (3) the effect of publicly documenting the Taliban's abuses.

Veterans Pro Bono Corps Act of 2021

Veterans Pro Bono Corps Act of 2021 This bill requires the Department of Veterans Affairs (VA) to implement a five-year pilot program to assess the feasibility and advisability of providing assistance to eligible recipients to establish or maintain programs that assist veterans applying for compensation for a service-connected disability. Eligible recipients are accredited entities that are administering a medical residency or medical fellowship program in the United States or a territory of the United States. Grants disbursed under the pilot program must be used to establish or maintain programs in which medical residents or fellows provide pro bono medical examinations and opinions to assist veterans in applying for service-connected disability benefits. The VA must partner with veterans service organizations to provide outreach regarding the availability of services under the pilot program.

To authorize the Secretary of Veterans Affairs to furnish seasonal influenza vaccines to certain individuals, and for other purposes.

This bill authorizes the Department of Veterans Affairs (VA) to furnish a seasonal influenza vaccine to covered individuals during the COVID-19 public health emergency. Under the bill, covered individuals are veterans who are not eligible to enroll in the VA health care system; specified veterans who are eligible for hospital care, medical services, and nursing home care abroad; beneficiaries who are eligible for care due to a specified disability or death of a veteran; family caregivers of veterans who are participating in the VA's Program of Comprehensive Assistance for Family Caregivers; caregivers of veterans participating in the VA's Program of General Caregiver Support Services; caregivers of veterans participating in the VA's Medical Foster Home Program, Bowel and Bladder Program, Home Based Primary Care Program, or Veteran Directed Care Program; and the spouses of veterans. The VA must prioritize the vaccination of (1) veterans who are enrolled in the VA health care system, (2) veterans who fail to enroll but receive hospital care and medical services for specified disabilities in their first 12 months of separation from service, and (3) caregivers accompanying such prioritized veterans. Under the bill, the VA is authorized to determine the timing for offering a vaccine to the spouse of a veteran.

Servicemembers and Veterans Empowerment and Support Act of 2021

Servicemembers and Veterans Empowerment and Support Act of 2021 This bill modifies and implements policies and procedures related to Department of Veterans Affairs (VA) health care and benefits for veterans who have experienced military sexual trauma (MST), which is generally defined as physical assault of a sexual nature, battery of a sexual nature, or sexual harassment that occurred while the veteran was serving in the military. The VA must revise its regulations to update the definition of MST to include matters relating to technological abuse. In the case of any veteran who claims that a covered mental health condition (e.g., post-traumatic stress disorder) based on MST was incurred or aggravated by active service, the VA must accept specified diagnoses and evidence as proof of service-connection. The VA may not deny a veteran's claim of compensation for a covered mental health condition based on MST without first (1) advising the veteran that nonmilitary evidence and behavioral evidence may constitute credible corroborating evidence, and (2) allowing the veteran an opportunity to furnish the corroborating evidence or advise the VA of potential sources of such evidence. The Veterans Benefits Administration must conduct an annual special focus review on the accuracy of the processing of claims for disability compensation for disabilities relating to MST. Additionally, the bill (1) expands access to mental health care at VA facilities for survivors of MST, and (2) requires the VA and the Government Accountability Office to report on access to such care for MST survivors.
