Vietnam Veterans Federal Employment Act

Vietnam Veterans Federal Employment Act - Authorizes the director at a government agency to make an excepted appointment, to be known as a Vietnam veterans appointment, to any position in the competitive civil service, up to and including GS-6, or the equivalent thereof, of a veteran or disabled veteran who served on active duty in the Armed Forces of the United States during the Vietnam era; and is found qualified to perform the duties of the position. Requires an employee given such an appointment to serve subject to the satisfactory performance of assigned duties and to participate in the training or educational program to which he may be appointed. Provides that an employee who completes the training or educational program or who has satisfactorily completed one year of substantially continuous service under a Vietnam veterans appointment shall be converted to career-conditional or career employment. Prohibits, in the selection of an applicant for appointment under the provisions of this Act, discrimination because of race, color, religion, sex, national origin, or political affiliation. Limits eligibility for appointment under this Act to a period within two years of seperation from the armed forces.

Provides that a member or former member of a uniformed service: (1) who is sixty years of age or older, and is retired for reasons other than physical disability, whose disability is finally determined to be of a permanent nature and less than 30 percent under the disability rating system, and is entitled to retired pay computed under the rates of basic pay in effect before January 1, 1972; or (2) who is entitled to retired pay for physical disability, whose disability was finally determined to be of permanent nature and at least 30 percent under the schedule of rating disabilities, and whose retired pay is computed under rates of basic pay in effect after October 11, 1949 and before January 1, 1972, is entitled to have that pay recomputed upon the rates of basic pay in effect on January 1, 1972.

Provides that if the veteran is married and living with or reasonably contributing to the support of his spouse, or has a child or children, the monthly rate of pension under this Act shall be $150. Provides that if the veteran is unmarried (or married but not living with or reasonably contributing to the support of his spouse) and has no child, the monthly rate of pension shall be $135. Provides that if the veteran has a disability by reason of which he is permanently housebound, the monthly rate hereunder shall be increased by $50. Provides that veterans in need of regular aid and attendance shall have their monthly rates increased by $125. Directs the Administrator to pay to widows of veterans, receiving benefits under this Act at time of death, pension benefits at a schedule provided in this Act.

Defines the term "foreign agent". Requires authorization for interception of wire or oral communications in national security cases. Sets forth the procedure for interception of such communications relating to national security by requiring applications for an order authorizing or approving the interception of a wire or oral communication to be made in writing upon oath or affirmation to a judge of competent jurisdiction. Specifies the content required in any such application.

States that after general dabate, which shall be confined to the bill and shall continue not to exceed one hour, to be equally divided and controlled by the chairman and ranking minority member of the Committee on Post Office and Civil Service, the bill shall be read for amendment under the five-minute rule. Stipulates that it shall be in order to consider the amendment in the nature of a substitute recommended by the Committee on Post Office and Civil Service now printed in the bill as an original bill for the purpose of amendment under the five-minute rule. Requires that, at the conclusion of such consideration, the Committee shall rise and report the bill to the House with such amendments as may have been adopted and any Member may demand a separate vote in the House on any amendment adopted in the Committee of the Whole to the bill or to the Committee amendment in the nature of a substitute. Provides that the previous question shall be considered as ordered on the bill and amendments thereto to final passage without intervening motion except one motion to recommit with or without instructions.

Authorizes the President to appoint administrative and staff personnel in the White House and the Executive Residence without regard to provisions of law governing appointments in the competitive service. Authorizes the President to fix the pay of such personnel without regard to provisions of law relating to classification and General Schedule pay rates. States that the President may appoint and fix the pay of: (1) fifteen of such personnel at level II of the Executive Schedule rates; (2) twenty-five of such personnel at level III of the Executive Schedule rates; and (3) such other personnel as he considers necessary at respective rates not more than the maximum rate of basic pay then currently paid under the General Schedule. Authorizes to be appropriated each fiscal year to the President: (1) such sums as necessary to pay official reception, entertainment, and representation expenses, to be expended at the discretion of the President and accounted for solely on his certificate; and (2) such sums as necessary for allocation within the Executive Office for official reception and representation expenses. Authorizes to be appropriated each fiscal year such sums as are necessary to enable the Vice-President to provide assistance to the President in connection with the discharge of Executive duties. Authorizes to be appropriated such sums as may be necessary to enable the President, in his discretion, to deal with emergencies involving the national interest, security, or defense. Increases the annual travel allowance of the President from $40,000 to $100,000.

Increases the rates of veterans educational assistance allowances. States that in the event that the period of entitlement under this Act of an eligible veteran who is enrolled in a program of education ends prior to such veteran's attainment or a predetermined and identified educational, professional, or vocational objective, the Administrator of Veterans' Affairs may extend such veteran's period of eligibility to the completion of such program of education or for nine months, whichever is the lesser period. Requires the Administrator of Veterans' Affairs to reimburse any eligible veteran enrolled in a fulltime or part-time program of education for costs above $400 incurred by such veteran for tuition, exclusive expenses incurred for fees, books, supplies, or other expenses. Limits such payments to $600 for an ordinary school year. Establishes a Vietnam Era Veterans Communication Center. States that it shall be the duty of the Communications Center to make an initial and periodic evaluation of the effectiveness of the veterans outreach services program. Requires the results of such evaluations to be reported to the President and to the Congress. Directs the Communications Center to advise and assist in connection with all Federal programs pertaining to veterans of the Vietnam era. Establishes the Vietnam Era Veterans Advisory Committee to advise and consult with the Communication Center regarding any and all matters pertaining to the duties and responsibilities of the Communications Center under this Act.

Authorizes the Administrator of Veterans' Affairs, upon the recommendation of the Chief Medical Director, to utilize the services of patients and members in Veterans' Administration hospitals and domiciliaries for therapeutic and rehabilitative purposes, at nominal remuneration. Provides that such patients and members shall not under such circumstances be held or considered as employees of the United States for any purpose. Directs the Administrator to prescribe the conditions for the utilization of such services. Authorizes the Administrator, upon the recommendation of the Chief Medical Director, to obtain work or work projects from non-Veterans' Administration sources, and prescribe terms and conditions for the participation of patients and members in Veterans' Administration hospitals, out-patient clinics and domiciliaries, in such work or work projects as part of their therapeutic or rehabilitation program. Authorizes the Administrator or his designee to enter into contracts to obtain work or work projects suitable for the compensated work therapy program, which shall not be subject to the Federal Property and Administrative Service Act of 1949. Directs the Administrator or his designee to pay out of the Veterans' Administration Special Therapeutic and Rehabilitation Activities Fund, established under this Act, moneys to patients and members participating in the compensated work therapy program authorized at such rate as he shall determine. Provides that for the purposes of the Internal Revenue Code of 1954 any remuneration received by patients and members participating in the compensated work therapy program authorized under this Act shall not be subject to Federal employment taxes or the income tax withholding provisions of such Code, nor shall any Federal, State, or other taxing authorities levy any tax on such earnings as income. Establishes in the Treasury of the United States a revolving fund known as the Veterans' Administration Special Therapeutic and Rehabilitation Activities Fund for the purpose of carrying out the provisions of this Act. Authorizes the appropriation of up to $5,000,000 for the establishment of such Fund.

Establishes the National Commission on the Prevention of Raw Material Shortages within the legislative branch of Government. States that the duties of the Commission shall be to investigate and report to the Congress on the raw materials which the United States presently imports at the rate of 10 percent or more of annual consumption, those raw materials which are likely to be imported at such rate by 1985, and any other raw materials which in the judgment of the Commission may become in short supply sufficiently by 1985 to seriously affect realization of national economic goals of the United States. Requires such report to include an analysis of: (1) the possiblity of the supply of such raw materials being disrupted by shortage in supply or the actions of countries or companies engaged in the production or transportation of such raw materials; (2) the probable economic impact of shortages in such raw materials; (3) the availability of substitute materials for such raw materials, the economic impact of such substitution, and the research in progress which could result in the increased availability of substitute materials; (4) actions and policies of companies involved in the supply and distribution of such raw materials to determine if these actions and policies will increase the available supply of such raw materials; and (5) the policies, laws, and actions of the United States Government to determine whether they are consitent with the national policy of anticipating and avoiding shortages in such raw materials. States that such report shall make recommendations for changes in laws which affect scientific research, foreign trade, taxation, raw material exploration, government procurement, national economic policy, national environmental policy, and any other domestic or foreign policy of the United States Government affecting supply of such raw materials. Requires such report to be made to the Congress of the United States within two years of the establishment of the Commission. Specifies the composition of the Commission and the powers of its members and agents. Gives the Commission the power to hold hearings and to issue subpoenas compelling the attendance and testimony of witnesses and the production of any evidence that relates to any matter under investigation by the Commission. Allows the Commission to obtain official data from any department or agency of the United States to carry out the provisions and purposes of this Act, to accept gifts, and to use the mails in the same manner and upon the same conditions as other Federal agencies. Authorizes to be appropriated the sums necessary to carry out the provisions of this Act.

Armed Services Discharge Review Procedure Act

Armed Services Discharge Review Procedure Act - Directs the Secretary of Defense to provide for the establishment of regional boards of review throughout the United States to review the discharge or dismissal under specified conditions of any former member of an armed force upon motion of any such board or upon request of the former member, or, if deceased, the surviving spouse or other specified persons. Provides for a procedure whereby a Judge Advocate may be appointed to represent a person requesting a review under this Act before a board established under the provisions of this Act. Provides that a person who requests a review under this Act shall be promptly advised in writing, upon filing his application, of his right to make a personal appearance before the board, and of his right to be represented by counsel, of his own choosing or appointed by the Judge Advocate or by an accredited representative. Directs that no information (in code or otherwise) shall be included on any discharge certificate by any military department if such information in any way indicates the attitude, opinion, or decision of the military department concerned with respect to whether the person to whom such certificate was issued should be accepted for reenlistment in the armed forces. Requires that all such information shall be treated as strictly confidential and may be released to another department or agency of the Government only on a need-to-know basis. Directs the Secretary of each military department and the Secretary of Transportation (with respect to the Coast Guard) to the maximum extent practicable, to issue new discharge certificates to all former members of such department whose last discharge certificate contains any information (in code or otherwise) described in this Act. Directs the Secretary of Defense to, within sixty days after the date of enactment of this Act, initiate and carry out a comprehensive nationwide program designed to contact and inform all former members of the armed forces who have been issued discharge certificates with the type of information thereon described in this Act and who have not been contacted and issued new discharge certificates as provided in this Act. Directs the Secretary to consult with the Administrator of Veterans' Affairs in carrying out such program, and the Administrator shall utilize the full services and facilities of the Veterans' Administration to assist in contacting such former members. Provides that any action taken by the Administrator of Veterans' Affairs shall be in addition to, and not in lieu of, action to be taken by the Secretary of Defense. Provides that not later than sixty days after the date of enactment of this Act the Secretary of Defense shall submit a written report to the Congress disclosing the plan to be carried out by him under this Act.

Provides that a member or former member of a uniformed service: (1) who is sixty years of age or older, and is retired for reasons other than physical disability, whose disability is finally determined to be of a permanent nature and less than 30 percent under the disability rating system, and is entitled to retired pay computed under the rates of basic pay in effect before January 1, 1972; or (2) who is entitled to retired pay for physical disability, whose disability was finally determined to be of permanent nature and at least 30 percent under the schedule of rating disabilities, and whose retired pay is computed under rates of basic pay in effect after October 11, 1949 and before January 1, 1972, is entitled to have that pay recomputed upon the rates of basic pay in effect on January 1, 1972.

Directs the Administrator of Veterans' Affairs to pay a pension to each veteran who served in the active military, naval, or air service at any time during World War I and who is not eligible for other pension benefits. Defines World War I as meaning the period beginning on April 5, 1917, and ending on July 2, 1921. Provides for a schedule of pension payments under this Act. Provides that if the veteran is married and living with or reasonably contributing to the support of his spouse, or has a child or children, the monthly rate of pension under this Act shall be $150. Provides that if the veteran is unmarried (or married but not living with or reasonably contributing to the support of his spouse) and has no child, the monthly rate of pension shall be $135. Provides that if the veteran has a disability by reason of which he is permanently housebound, the monthly rate hereunder shall be increased by $50. Provides that veterans in need of regular aid and attendance shall have their monthly rates increased by $125. Directs the Administrator to pay to widows of veterans, receiving benefits under this Act at time of death, pension benefits at a schedule provided in this Act.
