K2 Veterans Care Act of 2020 This bill establishes a presumption of service-connection for certain diseases becoming manifest in a veteran who served on active duty at Karshi-Khanabad (K2) Air Base in Uzbekistan between January 1, 2001, and December 31, 2005. Specifically, there must be a presumption of service-connection for veterans who manifest illnesses that have a positive association with exposure to jet fuel, volatile organic compounds, high levels of particulate matter, depleted uranium, asbestos, or lead-based paint, as determined by the National Academies of Sciences, Engineering, and Medicine (NASEM). Under a presumption of service-connection, specific conditions diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded. Veterans who served at K2 Air Base during the specified period are eligible for Department of Veterans Affairs (VA) hospital care, medical services, and nursing home care for an illness that has been determined by NASEM to have a positive association with exposure to jet fuel, volatile organic compounds, high levels of particulate matter, depleted uranium, asbestos, or lead-based paint. The bill also expands the definition of an open burn pit, for purposes of the VA's open burn pit registry, to include burn pits located on land in Uzbekistan. A burn pit is an area used for burning solid waste in open air without equipment.

K2 Veterans Toxic Exposure Accountability Act of 2020 This bill addresses the exposure of members of the Armed Forces to toxic substances at Karshi-Khanabad (K2) Air Base in Uzbekistan between October 1, 2001, and December 31, 2005. Specifically, the bill requires the Department of Defense (DOD) to study and report on the exposure of members of the Armed Forces to toxic substances at K2 Air Base during the specified period. The bill also expands the definition of an open burn pit, for purposes of the Department of Veterans Affairs (VA) open burn pit registry, to include burn pits located on land in Uzbekistan. A burn pit is an area used for burning solid waste in open air without equipment. DOD and the VA must ensure that individuals deployed to K2 Air Base during the specified time period are covered by the Depleted Uranium Follow-Up Programs of the departments. Such programs study the health effects of depleted uranium exposure and provide treatment. Upon request by the National Academies of Sciences, Engineering, and Medicine, DOD and the VA must provide information for the performance of a study on the exposure of humans to toxic substances at K2 Air Base during the specified period.

If the VA updates the questionnaire form, previous versions of the form filed by claimants must be accepted for up to one year after the form was updated. The VA may waive interagency approval processes required to approve a modification to a form if such requirement applies by reason of the form being made public on the website as required by the bill. The Inspector General of the VA must, through 2026, annually report on the use of such forms.

Restrictions on Intelligence Assets in Protests Act This bill limits when the intelligence community or federal law enforcement may conduct surveillance of protesters in the United States and requires a report on surveillance conducted in relation to protests after the death of George Floyd. (George Floyd was a Black man who died while restrained by a police officer in Minneapolis, Minnesota.) In general, no intelligence community element may investigate or conduct surveillance of individuals in the United States involved in First Amendment-protected protest activities. However, this prohibition shall not apply to (1) an investigation by the Federal Bureau of Investigation that is not solely based on the protected protest activity; (2) a National Guard member's active service while assigned to a unit with an intelligence community element; or (3) an activity in support of the Armed Forces pursuant to the Insurrection Act, if the Office of the Director of National Intelligence (ODNI) notifies Congress no later than one year after the start of such support activities. (The Insurrection Act authorizes the President to call upon the Armed Forces during an insurrection.) No federal law enforcement agency may support any other law enforcement agency in investigating or conducting surveillance of individuals involved in such protest activities if such support is beyond the mission, scope, or purpose of the supporting agency. The ODNI shall report to Congress on any intelligence community asset used to support any law enforcement agency or the National Guard during the U.S. protests occurring after the death of George Floyd.

The bill's provisions include those requiring each intelligence community element to notify Congress before conducting certain activities, including providing support to a government response to a domestic civil disturbance, with some exceptions, or engaging in an activity pursuant to a presidential emergency action document; generally prohibiting the intelligence community from awarding a contract for a national security satellite that uses a star tracker not produced in the United States; providing for paid leave for a civilian intelligence community employee to address a serious health condition; establishing the Office of the Ombudsman for Analytic Objectivity; requiring the Department of Homeland Security to establish an intelligence and cybersecurity diversity fellowship program, which may provide an eligible individual with a paid internship or employment offer upon graduation; imposing certain protections related to intelligence community inspectors general, such as by limiting when the President may remove such an inspector general and limiting who may serve as an acting inspector general; providing for criminal penalties in certain instances for a federal government employee or officer who knowingly and willfully discloses the identity of an intelligence community whistleblower; requiring a political committee to report certain foreign contacts and establishing criminal penalties for violations of such requirements in certain instances; and prohibiting the use of funds made available to the intelligence community for FY2021 to enable or assist air strikes in Yemen by the Saudi Arabia-led coalition.

This bill provides for the removal of certain statues and busts from display in the Capitol. The bill directs the Joint Committee on the Library to remove the bust of Roger Brooke Taney in the Old Supreme Court chamber of the Capitol and replace it with a bust of Thurgood Marshall. The committee must remove the statues of Charles Brantley Aycock, John Caldwell Calhoun, and James Paul Clarke and the bust of John Cabell Breckinridge from areas of the Capitol accessible to the public. The Architect of the Capitol (AOC) must store the statues and bust until it arranges their return to the states that provided them. Additionally, the bill prohibits the display of statues in National Statuary Hall of persons who served as officers or voluntarily with the Confederate States of America or of the military forces or government of a state while it was in rebellion against the United States; requires the AOC to identify such statues and arrange for their transfer and delivery from the Capitol to the Smithsonian Institution; requires the Smithsonian to follow its preexisting policies and procedures regarding the storage and display of such transferred statues; requires each statue to be returned to the providing state, including its ownership, if the state requests and agrees to pay any transportation-related costs; and permits a state that has a statue removed to replace the statue.

The State Department shall also establish a U.S.-Europe Working Group on Ukraine. The President shall appoint a Special Envoy for Ukraine, who shall engage in diplomatic activities related to the peace process between Ukraine and Russia and dialogue with countries in the Black Sea region. The bill also authorizes the State Department for FY2021-FY2025 to (1) provide grants and loans to Ukraine for acquiring U.S. defense equipment and services through the Foreign Military Financing program, and (2) provide training for Ukraine's military through the International Military Education and Training program. From FY2021-FY2025, Ukraine shall have priority access to excess U.S. defense articles.

Onshoring Rare Earths Act of 2020 or the ORE Act This bill allows permanent expensing of property used in the extraction of certain critical minerals and metals within the United States and of nonresidential real property used in extracting such minerals and metals. Expensing is the treatment of expenditures as operating costs deductible in full in the current taxable year. The bill allows a new tax deduction for 200% of the cost of purchasing or acquiring such critical minerals and metals extracted from deposits in the United States. The bill requires the Department of Defense (DOD) to establish a pilot project grant program for the development of critical minerals and metals in the United States. A grant awarded under such program may not exceed $10 million. In awarding grants, DOD must give priority to projects determined to be economically viable over the long term and must allot 30% of grants funds to the secondary recovery of critical minerals and metals.

The American PPE Supply Chain Integrity Act This bill requires the federal government to purchase medical supplies and personal protective equipment from the United States, with exceptions for small purchases. Specifically, the bill requires the Department of Health and Human Services, the Department of Homeland Security, and the Department of Veterans Affairs to purchase specified medical supplies (including disinfecting wipes and natural fiber products) and personal protective equipment (including surgical masks, face shields, and foot coverings) from products that are 100% grown, reprocessed, reused, or produced in the United States. The bill makes an exception for purchases for amounts not greater than $150,000. The bill applies the Berry Amendment (which requires the Department of Defense to give preference in procurement to domestically produced, manufactured, or home-grown products) to specified supplies and equipment, such as surgical dressing materials, hospital and surgical clothing, and textile medical supplies and equipment.

Specifically, the ODNI shall report to Congress a National Intelligence Estimate (a type of intelligence community assessment) about Iran's support for proxy forces and the increased risks that this support poses to Israel and U.S. regional interests. The estimate shall address certain specific issues, including a description of Iran-affiliated forces operating in Iraq, Syria, and Lebanon and an analysis of the missile and rocket production capabilities of such forces.

Protecting American Heroes Act of 2020 This bill provides funding for the Strategic National Stockpile and expands certain authorities under the Defense Production Act of 1950 to support domestic supply chains for medical countermeasures and other supplies procured for the stockpile. It also makes changes to reporting requirements, threat-based reviews, and other aspects of the administration of the stockpile. Specifically, it authorizes the Secretary of Health and Human Services and the Administrator of the Federal Emergency Management Agency to use authorities under the Defense Production Act of 1950 during a declared public health emergency to the same extent as the President is authorized to do so. Currently, that act confers upon the President a broad set of authorities to influence domestic industry in order to provide essential materials and goods needed for the national defense. In addition, the Government Accountability Office must assess any plans related to the domestic supply chain in its annual reports on the stockpile.

This corps includes, among others, the Commissioned Corps of the U.S. Public Health Service, the Medical Reserve Corps, and certain personnel of the Federal Emergency Management Agency appointed to respond to disasters and emergencies. Specifically, HHS must award grants to governmental health departments to recruit and train personnel to serve in the federal public health reserve corps and assist with COVID-19 testing, contact tracing, and treatment. To carry out these grants, health departments may establish partnerships with institutions that offer medical training and public health programs, giving priority to partnerships with historically Black colleges and universities and other minority-serving institutions. HHS must also develop a training program, in consultation with the Department of Defense, that addresses activation and surge capacity of the reserve corps to respond to COVID-19. In addition, HHS must award grants, in consultation with the Department of Labor, to local workforce development boards to develop career plans and other activities to facilitate the transition of reserve corps personnel to other health-related occupations.

VA Police Improvement and Accountability Act This bill updates the staffing and responsibilities of police forces of the Department of Veterans Affairs (VA). Specifically, the bill requires the VA to ensure that each of its police forces designates an employee to serve as a point of contact for its employees and the public regarding (1) statistical information (e.g., the use of force and weapons discharge), (2) complaints and investigations regarding officers at the facility, and (3) the provision of information to a person regarding personal arrest or other police matters. The bill also requires the VA to provide information on the public websites of police facilities regarding specified statistical information and directions on how to contact the point of contact or receive information about specific matters. The VA must provide annual training on (1) recognizing, defining, understanding, and avoiding racial profiling and implicit bias and best practices regarding the duty to intervene; and (2) preventing suicide among the population served by police officers. Finally, the bill requires VA police officers to wear body cameras that have a field of view at least as broad as the officers' vision and capture footage of the officers' activities. The audio and video of the camera must be activated whenever an officer is responding to a call for service or other stop, except in situations where it is impossible or dangerous for the officer to do so. The VA's guidance on body cameras must be made publicly available.

Protective orders may be issued to protect a victim of an alleged sex or domestic violence offense, or a family member or associate of the victim, from a person subject to the Uniform Code of Military Justice who is alleged to have committed such an offense. The Department of Defense (DOD) shall establish a military-civilian task force on domestic violence to analyze and develop recommendations for implementation by DOD regarding the risk of domestic violence at various stages of military service.

U.S. Military Right to Carry Act This bill requires a state that receives funds under the Edward Byrne Memorial Justice Assistance Grant Program to have implemented (1) a law or policy authorizing members of the Armed Forces who are outside of their state of residence under orders to renew a permit to carry a concealed firearm through the mail, and (2) a law or policy that treats members of the Armed Forces on active duty in the state as residents of the state for purposes of issuing a permit to carry a concealed firearm in the state. The Department of Justice must reduce by 5% the amount that a state would otherwise receive under the grant program if the state fails to comply with either requirement.
