Modernizing Aerial Fire Fighting Support (MAFFS) for the National Guard Act This bill requires the Department of the Air Force to include the Modular Airborne Fire Fighting System mission as part of its basing criteria for C-130J aircraft for the Air National Guard.

National Strategy to Utilize Microreactors for Natural Disaster Response Efforts Act This bill directs the President to develop a national strategy to utilize microreactors to assist with natural disaster response efforts. A microreactor is a nuclear reactor with at most 20 megawatts of thermal energy generating capacity. Specifically, such strategy must include an assessment of the effectiveness of utilizing diesel generators to assist with natural disaster response efforts; a comprehensive, research-based, and long-term discussion of goals, objectives, and priorities for utilizing microreactors instead of diesel generators to assist with such efforts; a Department of Defense analysis regarding the use of such microreactors to assist with such efforts; recommendations on how the Nuclear Regulatory Commission may expedite the approval of designs for microreactors and issuing licenses; an assessment of the challenges and barriers to deploying microreactors to assist with such efforts and solutions; and recommendations on how to utilize microreactors as charging stations for electric vehicles in the event of a mass evacuation resulting from a natural disaster.

Airspace Clearinghouse Enhancement Act or the ACE Act This bill addresses structures interfering with air commerce or national security near military installations. Specifically, the bill requires the Department of Defense to elicit written testimony from the base commander of each military installation within a certain radius of a structure or sanitary landfill when making a determination of whether the construction, alteration, establishment, or expansion of such a facility will result in an unacceptable risk to U.S. national security; and any person that submits an application for an energy project near a military installation to disclose if they have a relationship with a foreign principal or an agent of a foreign principal.

DOD Cyber Training Modernization Act This bill requires that the annual cyber awareness training provided to members in the Army, Navy, Marine Corps, Air Force, and Space Force include a digital literacy module regarding digital citizenship, media literacy, and protection against cyber threats.

Taiwan Democracy Defense Lend-Lease Act of 2022 This bill authorizes the President to lend or lease defense articles to Taiwan for protection against potential Chinese military aggression and requires the President to establish expedited procedures for delivering loaned or leased defense articles to Taiwan.

Pregnancy Resource Center Defense Act This bill increases criminal penalties (and authorizes additional civil remedies) for intentionally damaging or destroying the property of a facility that exclusively provides abortion-alternative services or that is a place of religious worship. It also establishes a mandatory minimum sentence for certain conduct involving fire or explosives used against such a facility or place of religious worship.

Stop the Cartels Act This bill addresses various issues including matters relating to immigration, law enforcement cooperation with Mexico, and drug cartels. The bill bars federal financial assistance for state or local jurisdictions that (1) restrict compliance with immigration detainers issued by the Department of Homeland Security, or (2) have any law or policy that violates immigration laws. Furthermore, under this bill, the detention of alien minors must be governed by specified sections of the Immigration and Nationality Act and not any judicial decree or settlement. (A 1997 settlement agreement imposes requirements related to the treatment of such minors, including limits on how long they may be detained under certain conditions.) The bill also makes various changes to asylum applications, including by (1) increasing the burden that an asylum applicant must meet to establish a credible fear of persecution, and (2) establishing refugee application and processing centers in Central America. In addition, certain Department of State and U.S. Agency for International Development assistance may not be made available to Mexico's government until the State Department certifies that Mexico has removed certain barriers to law enforcement cooperation and intelligence sharing between the United States and Mexico. The bill also establishes the foreign Special Transnational Criminal Organization designation and establishes penalties related to designated organizations, such as making it a crime to knowingly provide material support to such an organization. The State Department must designate specified organizations, including the Sinaloa Cartel, with the designation, and may designate other organizations that fit criteria established in this bill.

Will to Fight Act of 2022 This bill requires the Office of the Director of National Intelligence to submit a report to Congress examining the extent to which analyses of the military will to fight and the national will to fight informed broader analyses of the intelligence community. The bill specifies that the report consider analyses of how the armed forces and governments of Ukraine, Afghanistan, and Iraq would perform at key junctures.

Save America’s Valuable Energy Act or the SAVE Act This bill directs the Department of Energy (DOE) to prohibit the sale of petroleum products (e.g., crude oil) from the Strategic Petroleum Reserve (SPR) to certain entities. Specifically, DOE must prohibit the sale of petroleum products from the SPR to entities headquartered in Russia. Further, DOE must prohibit the sale of petroleum products from the SPR to entities headquartered in countries (Belarus, Burma, China, Cuba, Iran, North Korea, Syria, and Venezuela) that are subject to certain prohibitions concerning exports of defense articles and services under the Department of State's International Traffic in Arms Regulations.

Defense Production Oversight Act of 2022 This bill authorizes Congress to nullify the President's invocation of authorities under the Defense Production Act of 1950 by enacting a joint resolution disapproving of the invocation. It also outlines procedures for the consideration of the joint resolution. (The Defense Production Act of 1950 confers upon the President a broad set of authorities to influence domestic industry in order to provide essential materials and goods needed for the national defense.)

Safeguarding Military Bonuses Act This bill requires the military departments to grant to certain members of the Armed Forces (i.e., those who were involuntarily separated based on the refusal to receive a COVID-19 vaccination) an exception to the requirement that they must repay a bonus, incentive pay, or similar benefit that is contingent on the member's satisfaction of certain service or eligibility requirements. Specifically, this exception applies for such members if the bonus, incentive pay, or similar benefit was made before August 24, 2021.

Department of Defense Appropriations Act, 2023 This bill provides FY2023 appropriations to the Department of Defense (DOD) for military activities. (The bill excludes military construction, military family housing, civil works projects of the Army Corps of Engineers, and nuclear warheads, which are all considered in other appropriations bills.) Within the DOD budget, the bill provides appropriations for Military Personnel; Operation and Maintenance; Procurement; Research, Development, Test and Evaluation; and Revolving and Management Funds. The bill provides appropriations for other DOD programs and activities, including the Defense Health Program, Chemical Agents and Munitions Destruction, Drug Interdiction and Counter-Drug Activities, the Office of the Inspector General, and Support for International Sporting Competitions. In addition, the bill provides appropriations for related agencies, including (1) the Central Intelligence Agency Retirement and Disability System Fund, and (2) the Intelligence Community Management Account. The bill also sets forth requirements and restrictions for using funds provided by this and other appropriations acts.

Energy and Water Development and Related Agencies Appropriations Act, 2023 This bill provides FY2023 appropriations for U.S. Army Corps of Engineers civil works projects, the Department of the Interior's Bureau of Reclamation, the Department of Energy (DOE), and independent agencies such as the Nuclear Regulatory Commission. The bill provides appropriations for U.S. Army Corps of Engineers civil works projects, including for Investigations, Construction, Mississippi River and Tributaries, Operation and Maintenance, the Regulatory Program, the Formerly Utilized Sites Remedial Action Program, Flood Control and Coastal Emergencies, Expenses, the Office of the Assistant Secretary of the Army for Civil Works, and the Water Infrastructure Finance and Innovation Program. The bill provides appropriations to the Department of the Interior for the Central Utah Project and the Bureau of Reclamation. The bill provides appropriations to DOE for energy programs, including the Defense Production Act Domestic Clean Energy Accelerator; Energy Efficiency and Renewable Energy; Cybersecurity, Energy Security, and Emergency Response; Electricity; Nuclear Energy; Fossil Energy and Carbon Management; Energy Projects; Naval Petroleum and Oil Shale Reserves; the Strategic Petroleum Reserve; the Northeast Home Heating Oil Reserve; the Energy Information Administration; Non-Defense Environmental Cleanup; the Uranium Enrichment Decontamination and Decommissioning Fund; Science; Nuclear Waste Disposal; Technology Transitions; Clean Energy Demonstrations; the Advanced Research Projects Agency—Energy; the Title 17 Innovative Technology Loan Guarantee Program; the Advanced Technology Vehicles Manufacturing Loan Program; the Tribal Energy Loan Guarantee Program; Indian Energy Policy and Programs; Departmental Administration; and the Office of the Inspector General. The bill also provides appropriations to DOE for Atomic Energy Defense Activities of the National Nuclear Security Administration, Environmental and Other Defense Activities, and the Power Marketing Administrations. The bill provides appropriations to several independent agencies, including the Federal Energy Regulatory Commission and the Nuclear Regulatory Commission. Emergency Aircraft Act of 2022 This bill modifies the authority of the Department of Defense (DOD) related to the transfer of excess aircraft for wildfire emergencies, including to authorize DOD to transfer excess aircraft to a state for wildfire suppression, search and rescue, or emergency operations pertaining to wildfires.

Enhancing DHS Drug Seizures Act This bill addresses various issues related to border security. For example, the bill authorizes the Department of Homeland Security (DHS) to waive reimbursement for the salaries of DHS employees providing training to foreign-vetted law enforcement or national security units under an agreement with the Department of Defense; authorizes U.S. Customs and Border Protection to provide air and marine support to foreign governments for certain operations, such as an operation to stop illegal drugs from entering the United States; and makes it a crime to destroy or significantly damage physical or electronic devices (e.g., fences or cameras) used by the federal government to control a U.S. international border with the intent to achieve certain goals relating to securing financial gain and breaking federal laws.

Espionage Act Reform Act of 2022 This bill limits the scope of certain criminal offenses relating to classified information. Under the bill, the offense of disclosing classified information to an unauthorized person may be committed only by an individual who is authorized to receive the classified information and has signed a nondisclosure agreement regarding such classified information (i.e., a covered person), whereas under current law any individual may be charged with this offense. Under the bill, this offense shall not apply to disclosures of information to any Member of Congress, a federal court, an inspector general in the intelligence community, or certain bodies such as the Federal Trade Commission. Similarly, under the bill, certain offenses related to gathering, transmitting, or losing defense information may be committed only by a covered person or a foreign agent, whereas currently such offenses may be committed by any person. Under the bill, an individual who is not a foreign agent may not be criminally charged for such offenses unless the individual meets certain requirements, such as having committed a felony under federal law in the course of committing the offense. An offense related to obtaining and copying a document connected with the national defense shall apply only to an unlawfully obtained nonpublic document, whereas the current statute does not limit the scope of this offense to such documents. An offense related to dispensing certain public property of value shall apply only to tangible things, whereas the current statute does not limit the scope of this offense to tangible things.

Deter PRC Support to the Russian War Effort Act The bill authorizes the President to impose sanctions on persons associated with China for financial, material, or technological support contributing materially to Russia's military action in Ukraine. The sanctions include, for example, blocking transactions in U.S. property and prohibiting U.S. entry visas.

Commission on Reform and Modernization of the Department of State Act This bill establishes in the legislative branch a commission to examine the changing nature of diplomacy in the 21st century and ways the Department of State and its personnel can modernize to advance U.S. interests. The commission must offer recommendations related to topics such as (1) the State Department's organizational structure and infrastructure, (2) the link between diplomacy and other core U.S. interests such as defense, and (3) the core legislation that authorizes U.S. diplomacy. The commission must also periodically brief Congress on its work. Within 18 months of this bill's enactment, the commission must provide to Congress and the President its final report of findings, conclusions, and recommendations. The report must also examine all substantive aspects of State Department personnel, management, and operations. The commission shall terminate 180 days after the submission of the final report.

Economic and Commercial Opportunities and Networks Act of 2022 or the ECON Act This bill addresses economic issues in foreign relations and intellectual property (IP) infringement. The bill expands the criminal offense of trade secrets theft to include the unauthorized modifying or developing of a product in a way that would not be possible without another party's trade secret. This offense shall apply to non-U.S. conduct if the offender attempts to import the product into the United States. Furthermore, the President may impose sanctions against a foreign person (individual or entity) that has committed a significant theft of IP belonging to a U.S. person. The President must also establish or designate a multiagency committee to (1) review petitions alleging such acts of IP theft, and (2) recommend whether to impose sanctions for the alleged theft. The bill also prohibits foreign state-owned entities in international commerce from engaging in predatory pricing, defined in the bill as setting prices for a good below the average variable cost in a manner that may foreseeably harm competition. An injured party may sue in federal court. In deciding such cases, the court may consider the economic support and government subsidies provided by the entity's foreign state owner. Furthermore, the Department of State must establish a pilot program to create economic defense response teams to provide targeted support for countries facing an urgent or specific coercive economic threat from a U.S. adversary. The State Department must establish another pilot program to assist developing partner countries with identifying trade barriers and facilitating trade.

Faster Payments to Veterans' Survivors Act of 2022 This bill modifies policies and procedures related to the payment of benefits under certain life insurance programs administered by the Department of Veterans Affairs (VA). If a primary beneficiary has not made a claim for payment within one year (currently two years) after the death of the insured under the National Service Life Insurance (NSLI) program or the United States Government Life Insurance (USGLI) program, the VA is authorized to make payment to another designated beneficiary as if the primary beneficiary had predeceased the insured. If no designated beneficiary makes a claim within two years (currently four years) after the death of the insured, the VA is authorized to make a payment to a person the VA deems to be equitably entitled to such benefit. The bill also modifies the beneficiary designation process under NSLI and USGLI. Specifically, if a person does not designate a beneficiary for insurance, or if the designated beneficiary predeceases the insured person, the VA must determine the beneficiary in a specified order of succession. Additionally, the bill requires the VA to improve its processes and procedures with respect to identifying, locating, and disbursing undisbursed life insurance benefits to hard-to-find beneficiaries, including by improving its website search tools.

Countering Communist China's Financing of Russia's War on Ukraine Act This bill directs the President to impose sanctions on any entity that insures or registers a vessel engaged in the shipment or transshipment of any petroleum product or liquefied natural gas product from Russia to China. The sanctions terminate when Russia has withdrawn all military and paramilitary forces from Ukraine.

These efforts may include (1) bilateral cybersecurity training activities; (2) establishing a regional cybersecurity center; (3) actively defending military networks, infrastructure, and systems; (4) eradicating malicious cyber activity; and (5) leveraging U.S. commercial and military cybersecurity technology and services.

Build, Utilize, Invest, Learn, and Deliver for Veterans Act of 2022 or the BUILD for Veterans Act of 2022 This bill addresses Department of Veterans Affairs (VA) capital asset management, including by requiring the VA to ensure that each of its medical centers has a dedicated office and sufficient staff to conduct facility planning, long-range capital planning, and other relevant functions relating to VA capital assets.

Designated entities include those subject to specified U.S. sanctions, entities that have a relationship with China's military-industrial complex, and entities that produce communications equipment or services that pose unacceptable risks to U.S. national security.

Euro-Atlantic Solidarity and Major Democratic Ally Act of 2022 This bill establishes a new category under the Foreign Assistance Act of 1961, major democratic allies , giving certain countries a priority status in U.S. transfers of defense articles. The bill also requires the State Department to appoint a Special Advisor for Major Non-NATO Allies and Major Democratic Allies and requires U.S. representatives to NATO to advocate for the accession of Ukraine and Georgia to NATO.

Building More Housing for Servicemembers Act This bill addresses the availability and quality of housing for members of the Armed Forces. First, the bill requires the Department of Defense (DOD) to report to Congress on the housing shortage for members of the Armed Forces. DOD must prescribe guidance for eligible entities and landlords regarding acceptable housing standards for privatized military housing. Under the bill, an eligible entity is any private person, corporation, firm, partnership, company, or state or local government that is prepared to enter into a contract for the construction of housing units and ancillary supporting facilities. DOD must establish a five-year pilot program to assess the feasibility of using the rental partnership programs of the Armed Forces to assure tenants for eligible entities to secure financing to construct privatized military housing. Additionally, DOD must coordinate with the Department of Housing and Urban Development (HUD) to develop a five-year pilot program to provide financial incentives to eligible entities to build privatized military housing, or to purchase or lease existing facilities, to house members of the Armed Forces and their dependents and low-income individuals and families. Finally, DOD and HUD may jointly operate a grant program through the Office of Local Defense Community Cooperation within DOD to build housing for members of the Armed Forces and their dependents, and low-income individuals and families. Household income limits for eligible entities to receive a grant must not differ based on whether a household includes a member of the Armed Forces.

BAH Calculation Improvement Act This bill requires the Department of Defense to submit to Congress a report on the basic allowance for housing for members of the uniformed services that includes elements related to the calculation of such allowance.

BAH Restoration Act This bill increases the monthly amount of the basic housing allowance for members of the uniformed services inside the United States. Specifically, the monthly amount of allowance for a member must be the amount of the monthly cost of adequate housing in the area, as determined by the Department of Defense, for members of the uniformed services serving in the same pay grade and same dependency status as the member.

Toxic Exposure Education for Servicemembers Act of 2022 This bill requires the Department of Defense (DOD) to establish a new risk assessment for toxic exposure for members of the Armed Forces who are assigned to work near burn pits. DOD must also establish an outreach program to inform such members regarding toxic exposure. Additionally, DOD must publish on its website a list of resources for members and veterans who experienced toxic exposure while serving as a member of the Armed Forces, dependents and caregivers of such members and veterans, and survivors of such members and veterans who received death benefits.

Coast Guard Intelligence Operations Improvement Act of 2022 This bill authorizes the Coast Guard, with limitations, to expend funds appropriated for intelligence and counterintelligence activities without regard to other expenditure-related law or regulation, if it is spent on emergency, confidential, or extraordinary activities and the Coast Guard notifies the congressional intelligence committees. This authorization applies for three years after enactment.

Foreign Malign Influence Act of 2022 This bill modifies authorities related to the Social Media Data and Threat Analysis Center. For example, it increases the number of types of entities and organizations participating in the center, it increases the scope of activities which the center is to facilitate, and it requires the center to develop and make public criteria for examining social media which are consistent with civil liberties protections.

James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 This bill authorizes Department of Defense (DOD) activities for FY2023 and addresses other issues. For example, the bill authorizes the procurement of various items, including Ship-to-Shore Connector craft and replenishment oiler ships; limits or prohibits the retirement or reduction of certain weapons systems, including intercontinental ballistic missiles and certain aircraft; reduces inventory requirements for certain air refueling aircraft; requires the Government Accountability Office to assess the efforts to modernize the propulsion systems of the F-35 aircraft; requires DOD to conduct a pilot program on the use of sustainable aviation fuel; prescribes end strengths for the branches of the Armed Forces; expands Selective Service registration requirements, which currently apply only to qualifying male citizens, to cover all qualifying citizens; prohibits inducting any person into the Armed Forces under certain authorities without an act of Congress; requires the Army to establish sex-neutral fitness standards for combat military occupational specialties that are higher than those for noncombat specialties; requires DOD to reissue and update certain instructions relating to the confidentiality of servicemembers receiving mental health care; establishes regional centers of excellence for providing military specialty care; requires DOD to develop and issue implementing guidance for risk management for DOD pharmaceutical materiel supply chains; extends the authorities for certain activities in Iraq and Syria, including assistance to counter the Islamic State of Iraq and Syria; and prohibits using funds authorized by this bill for DOD participation in Saudi Arabia's offensive operations against the Houthis in Yemen unless specifically authorized by statute.

Discharge Review Board Outreach Improvement Act of 2022 This bill establishes the Department of Defense-Department of Veterans Affairs Discharge Review Board Committee to advise the Office of the Under Secretary of Defense for Personnel and Readiness and the Department of Veterans Affairs (VA) on matters relating to the boards that review the discharge or dismissal (other than a discharge or dismissal by sentence of a general court-martial) of any former member of an armed force. The committee must provide the Department of Defense (DOD) and the VA with recommendations on the strategic direction for the joint coordination and sharing efforts between and within DOD and the VA on matters regarding the review boards.

Driver Reimbursement Increase for Veteran Equity Act or the DRIVE Act This bill requires the Department of Veterans Affairs (VA) to adjust the mileage rate for beneficiary travel to or from a VA facility in relation to vocational rehabilitation, required counseling, or for the purpose of examination, treatment, or care. Such rate must be adjusted to be at least equal to the mileage reimbursement rate for vehicles that are privately owned by government employees on official business.
