Facial Recognition and Biometric Technology Moratorium Act of 2020 This bill imposes limits on the use of biometric surveillance systems, such as facial recognition systems, by federal and state government entities. A federal agency or official may not in an official capacity acquire, possess, or use in the United States any such system or information obtained by such a system unless Congress passes an act that specifically authorizes such a use. Such an act of Congress must contain certain provisions, such as provisions naming the specific authorized entity and auditing requirements relating to the system. Information obtained in violation of this bill shall not be admissible by the federal government in any proceeding or investigation, except in a proceeding alleging a violation of this bill. An individual aggrieved by a violation of these restrictions shall have the right to sue. Any state officer authorized to sue on behalf of the state's residents shall also have the right to sue on behalf of the state's aggrieved residents. A state or local government unit shall not receive certain federal law enforcement grants unless the government unit complies with a law or policy that is substantially similar to this bill's restrictions on acquiring and using biometric surveillance systems.

RISE Act

Research Investment to Spark the Economy Act or the RISE Act This bill authorizes the Departments of Agriculture, Commerce, Defense, Education, Energy, the Interior, and Health and Human Services and the National Aeronautics and Space Administration (NASA), National Science Foundation, and Environmental Protection Agency to provide support for research regarding COVID-19 (i.e., coronavirus disease 2019) or research disrupted by the COVID-19 pandemic. Support under this bill shall be provided through federal science agencies with at least $50 million in basic and applied research obligations in FY2020. Support may be used to provide supplemental funding to extend the duration of a grant to a research institution or national laboratory that was awarded prior to the enactment of this bill, or to expand the purposes of such a grant as specified; provide supplemental funding through existing competitively awarded cooperative agreements and contracts to cover the increased costs of construction of scientific facilities and equipment that have been delayed because of COVID-19; and award grants and cooperative agreements to institutions of higher education to conduct research on the behavioral, social, or economic effects of COVID-19 and the responses to the disease or on the effectiveness of such responses. Agencies must provide the support as rapidly as possible. Provided funds shall remain available for expenditure for up to two years.

Strengthening America's Health Care Readiness Act This bill establishes an emergency services demonstration program within the Department of Health and Human Services (HHS) to provide supplemental student loan repayment to current and former recipients of National Health Services Corps (NHSC) scholarships and student loan repayment awards who agree to participate in the National Disaster Medical System. (The NHSC provides scholarships and student loan repayment awards to health care providers who agree to work in areas with health care provider shortages, and the National Disaster Medical System is a partnership between HHS, the Department of Defense, and other federal departments that responds to public health and other emergencies, including by deploying medical response teams.) The bill also increases FY2020 funding for the NHSC, as well as similar programs for nurses, with a certain amount of funding reserved for individuals who are members of groups that are historically underrepresented in health care professions. The funds for the Nurse Corps Scholarship and Repayment Program are designated as an emergency requirement, which exempts the funds from discretionary spending limits and other budget enforcement rules.

The bill authorizes the FY2021 personnel strengths for active duty and reserve forces and sets forth policies regarding military personnel; acquisition policy and management; Space Force matters; international programs; National Guard and Reserve Forces facilities; compensation and other personnel benefits; health care; DOD organization and management; civilian personnel matters; matters relating to foreign nations; and strategic programs, cyber, and intelligence matters. The bill authorizes appropriations for base realignment and closure activities, and maritime matters. The bill also authorizes appropriations and sets forth policies for Department of Energy national security programs, including the National Nuclear Security Administration and the Defense Nuclear Facilities Safety Board.

Reforming Qualified Immunity Act This bill modifies the defense of qualified immunity in civil actions for deprivation of rights. Qualified immunity is a judicially created doctrine that protects government employees or those acting with state authority from being held personally liable for constitutional violations. The bill provides that under the statute allowing a civil action alleging deprivation of rights under color of law, it shall not be a defense or immunity to any such action that (1) the defendant was acting in good faith or believed that his or her conduct was lawful at the time it was committed; (2) the rights, privileges, or immunities secured by the Constitution or laws were not clearly established at the time of their deprivation; or (3) the state of the law was such that the defendant could not reasonably have been expected to know whether his or her conduct was lawful. A defendant sued in his or her individual capacity shall not be liable if specified conditions apply (concerning the defendant's belief that conduct was lawful or judicial decisions addressing the validity of laws), such as when the defendant establishes that, at the time the deprivation occurred, the conduct alleged to be unlawful was specifically authorized or required by a federal or state statute or regulation. A municipality or other unit of local government shall be liable for a violation by an agent or employee of the municipality or unit of local government acting within the scope of his or her employment.

Public Health Emergency Production Act of 2020 This bill modifies the administration of the Defense Production Act of 1950 and requires reporting on the use of authorities under the act during the COVID-19 (i.e., coronavirus disease 2019) emergency. (That act confers upon the President a broad set of authorities to influence domestic industry in order to provide essential materials and goods needed for the national defense.) Specifically, the Department of Health and Human Services (HHS) must require companies to prioritize the fulfillment of federal contracts or orders necessary for pandemic preparedness and response upon finding that (1) a material is essential to the public health, and (2) public health needs cannot be met through normal distribution channels. HHS must also establish, within the Office of the Assistant Secretary for Preparedness and Response, an office responsible for Defense Production Act of 1950 activities. Other changes include (1) eliminating a requirement to transfer any balance in excess of $750 million from the Defense Production Act Fund to the General Fund of the Department of the Treasury, and (2) enabling personnel to rotate between the Office of the Deputy Assistant Secretary of Defense for Industrial Policy and specified components of HHS. With respect to reporting, the Defense Production Act Committee must report general information concerning the use of Defense Production Act of 1950 authorities, and the Office of the Inspector General for the Department of Agriculture must report on the use of such authorities specifically with respect to the operations of meat processing facilities, during the COVID-19 emergency.

The President shall report to Congress a detailed account of the decisionmaking process behind the decision to withdraw Armed Forces members from Germany that was announced on June 15, 2020.

National Security Innovation Pathway Act This bill authorizes the Department of Homeland Security (DHS) to provide special immigrant status to a qualified alien involved with research critical to U.S. national security. Generally, a qualified alien is one who (1) is employed by a U.S. employer to work and protect the National Security Innovation Base, (2) is engaged in Department of Defense-funded research at a U.S. institution of higher education, or (3) possesses scientific or technical expertise that will advance the development of certain technologies critical to national security. In addition, the Department of Defense (DOD) must confirm to DHS that the alien's admission is essential to developing critical technologies or otherwise serves national security interests. The spouse and children of a qualified alien may also be admitted. (The National Security Innovation Base is a network of persons and organizations engaged in research and production of technologies that support U.S. national security.) DHS may admit up to 100 principal aliens for FY2021 as special immigrants under this bill. This number shall gradually increase until FY2025. For FY2025 and each subsequent fiscal year, DHS may admit 500 principal aliens. Aliens admitted under this bill shall not count against various annual numerical limits. The Government Accountability Office shall report to Congress on an evaluation of the program by October 1, 2025.

Civil Deployment Notification Act of 2020 This bill requires the President to provide Congress with notice of intent to use militia and armed forces to suppress an insurrection in a state or to enforce federal authority and a justification for exercising such authority. The bill provides that the President's authority to use such military force expires 14 days after it is exercised unless Congress enacts an extension of such authority.

Military HOMES Act

Military Housing Oversight, Maintenance, and Enhancement for Servicemembers Act or the Military HOMES Act This bill (1) requires mold mitigation measures for military families who are residing in military housing, (2) makes publicly available the criteria and metrics to be used by the Department of Defense (DOD) to analyze the performance of landlords that receive incentive fees, (3) establishes a working group to promulgate guidance regarding best practices for mold mitigation in privatized military housing and for determining when the presence of mold in such housing is an emergency situation requiring the relocation of the residents, (4) expands the uniform code of basic housing standards for privatized military housing to include government owned and controlled military family housing inside or outside the United States, (5) appoints at least one Exceptional Family Member Program housing liaison for each military department to assist military families, and (6) requires a report on the progress made by DOD in implementing the recommendations contained in a specified certain Government Accountability Office report regarding military housing.

PIPELINE Act of 2020

Pathway for Inclusive Participation of Emerging Leaders and Institutions in the NatSec Enterprise Act of 2020 or the PIPELINE Act of 2020 This bill requires the Department of Defense to establish a federal scholarship-for-service program to recruit, train, and diversify the next generation of national security professionals to meet the needs of federal, state, local, and tribal governments. Specifically, the program must (1) provide scholarships to students who are enrolled in programs of study related to national security at historically Black colleges and universities or at institutions of higher education with at least 50% of total student enrollment from ethnic groups that are underrepresented in the fields of science and engineering, (2) provide scholarship recipients with internship opportunities or other temporary appointments in the federal national security workforce, and (3) prioritize the employment placement of scholarship recipients in the federal government. Additionally, the post-award employment obligations of a scholarship recipient must include three years of work in a position related to national security at a federal, state, local, or tribal agency. A scholarship recipient may fulfill this condition by serving in the Armed Forces. Finally, a scholarship recipient who completes less than the required three years of service must repay the scholarship, or the scholarship must be treated as a Federal Direct Unsubsidized Stafford Loan that is subject to repayment.

Guaranteeing Resilient Installations for Defense Act of 2020 or the GRID Act of 2020 This bill directs the Department of Energy (DOE) to carry out a two-year pilot program under which DOE must implement mitigating actions to address vulnerabilities assessed at critical defense facilities and their associated defense critical electric infrastructure, after consultation with, and with the consent of, the owners of such infrastructure. DOE shall identify, designate, and mitigate vulnerabilities at facilities located in any state that are (1) critical to the defense of the United States, and (2) vulnerable to a disruption of the supply of electric energy provided to such facility by an external provider.

The Global Pandemic NIE Act of 2020 This bill requires reports to Congress related to the COVID-19 (i.e., coronavirus disease 2019) pandemic. The Office of the Director of National Intelligence (ODNI) shall report to Congress a classified, intelligence-based assessment on the threat of global pandemic disease, including an assessment of the possible courses of the COVID-19 pandemic in the 18 months following the report. The bill also requires the President to report to Congress on (1) a whole-of-government response to a potential second wave of the COVID-19 pandemic and to future pandemics, and (2) a global strategy for mobilizing international institutions to combat the COVID-19 pandemic. The reports shall also be publicly available, except that the publicly available ODNI assessment shall be an unclassified version of the classified report given to Congress.

VA FOIA Reform Act of 2020 This bill requires the Department of Veterans Affairs (VA) to reduce the backlog of Freedom of Information Act (FOIA) requests by 75% within three years of enactment of the bill. Additionally, the VA must reduce the backlog of Office of Special Counsel requests made to the VA by 75% within three years of the enactment of this bill. The VA must determine the types of documents, records, and information that are frequently requested under FOIA and must regularly make such documents, records, and information publicly available. Finally, the VA must request that the Office of Government Information Services within the National Archives and Records Administration conduct an assessment of the VA's compliance with FOIA.
