Digital TV Transition Fairness Act

Digital TV Transition Fairness Act - Requires the Department of Commerce to implement and administer a program to obtain coupons that can be applied toward: (1) the cost to install a digital-to-analog converter box; (2) the purchase and installation of an indoor or outdoor antenna, or both if needed, to facilitate the reception and display of signals of channels broadcast in digital television service; and (3) the cost to install, or the cost of any other equipment needed to receive and display, basic broadcast television service. Sets forth consumer and product eligibility criteria. Provides for a website and telephone hotline to provide relevant information to assist consumers that have degraded or lost signals or channels as a result of the full power transition from analog to digital television that is to occur on February 17, 2009. Requires the Federal Communications Commission (FCC) to promulgate rules requiring that each multichannel video programming distributor providing broadcast television for a local market provide to eligible consumers in that local market access to basic broadcast television service. Directs the FCC to carry out an education and outreach campaign to inform and educate consumers on the availability, benefits, and advantages of the programs and requirements established under this Act.

Retooling the Health Care Workforce for an Aging America Act of 2008 - Amends the Public Health Service Act to require the Secretary of Health and Human Services to expand training for health professionals in the fields of geriatrics, long-term care, and chronic care management. Requires an analysis of the health and long-term care workforce. Amends the Workforce Investment Act of 1998 to provide for information to adults and dislocated workers about health care and long-term care occupations. Provides for information to veterans about training, internship, and employment opportunities in geriatrics, gerontology, and long-term care. Amends the Older Americans Act of 1965 to require the Assistant Secretary for Aging to: (1) develop family caregiver training materials; and (2) provide for the establishment and operation of a National Resource Center on Volunteers, Students, and Seniors to promote partnerships between entities in the aging network and institutions of higher education and secondary schools. Requires the Secretary to: (1) provide for the development of core training competencies for personal or home care aides and additional training content for nurse aides and home health aides; and (2) establish a panel of long-term care workforce experts. Provides for the development of information and referral protocols for family caregivers of Medicare beneficiaries. Amends title XIX (Medicaid) of the Social Security Act to provide for coverage of assessments of family caregiver support needs. Provides for studies on: (1) the mental health workforce; (2) the aging network's capacity to meet current and future needs; (3) retention and tenure of nurse aides and home health aides; and (4) spending by the National Institutes of Health (NIH) on conditions and illnesses that disproportionately impact the health of older individuals.

William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008

William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 - Amends the the Trafficking Victims Protection Act of 2000 to direct the Secretary of State to establish within the Department of State an Office to Monitor and Combat Trafficking. (Current law authorizes such Office's establishment.) Directs the President to implement: (1) programs to prevent trafficking in persons; and (2) an anti-trafficking program monitoring system. Authorizes the President to establish the Presidential Award for Extraordinary Efforts to Combat Trafficking in Persons. Sets forth protections for aliens who: (1) may be trafficking victims or who may testify against traffickers; (2) are domestic workers or other nonimmigrants; or (3) are employees of foreign diplomatic or other government personnel, or employees of international organization personnel. Sets forth provisions respecting: (1) assistance for trafficking victims, including child victims and U.S. citizens; (2) offenses of trafficking, forced labor, enticement into slavery, sex trafficking of children, and sex tourism. Directs the Secretary to develop: (1) policies and procedures to ensure that unaccompanied alien children in the United States are safely repatriated to their country of nationality or of last habitual residence; and (2) a safe repatriation pilot program for alien children. States, with specified exceptions, that the care and custody of unaccompanied alien children in the United States shall be the responsibility of the Secretary of Health and Human Services. Sets forth related provisions and authorizations of appropriations. Authorizes passport restrictions for persons convicted of transporting a minor with intent to engage in criminal sexual activity. Child Soldiers Prevention Act of 2008 - Prohibits, with a national interest waiver, funds for specified military and related areas from being made available to the government of a country identified by the Department as having governmental armed forces or government supported armed groups that recruit and use child soldiers. Authorizes the President to reinstate assistance upon certifying to Congress that a government is implementing: (1) compliance measures; and (2) mechanisms to prohibit future use of child soldiers. Authorizes the President to provide assistance to a country for international military education and training otherwise prohibited under this Act upon certifying to Congress that such assistance is for implementation of measures to demobilize child soldiers and for programs to support professionalization of the military.

Bipartisan Electronic Voting Reform Act of 2008

Bipartisan Electronic Voting Reform Act of 2008 - Amends the Help America Vote Act of 2002 to require any voting system other than one using paper ballots personally marked by the voter to permit independent verification of cast ballots by various specified means, including paper or electronic. Requires each state to conduct an audit of every federal election to ensure that each certificate of election is justified by the vote totals. Directs the Federal Election Commission to establish an Audit Guidelines Development Task Force to assist the Commission in developing model audit guidelines. Prescribes election security requirements for voting systems, including: (1) chain of custody protocols; (2) disclosure of election-dedicated software; and (3) minimum state standards to ensure the integrity of the voting process and education and training of poll workers. Directs the National Institute of Standards and Technology (NIST) to establish a Voting System Software Review Committee which, upon request by the Commission or a state's chief election official, shall review voting system software that has not been certified by the Commission. Establishes accreditation requirements for laboratories involved in testing of voting system hardware and software. Directs the Commission to establish the Election Assistance Commission Voting System Testing Revolving Fund for payments to accredited laboratories for testing of such hardware and software. Requires the Commission to make grants for: (1) development and testing of new voting systems, technologies, and innovations to meet independent verification requirements under this Act; and (2) pilot programs for such testing. Directs the Commission to establish a task force to study and develop recommendations regarding the appropriate level of funding for requirements payments. Amends the Uniformed and Overseas Citizens Absentee Voting Act to prohibit state refusal to accept voter registration and absentee ballot applications and federal write-in absentee ballots for failure to meet nonessential requirements.

Authorizes the Secretary of Health and Human Services to: (1) make grants for the training of primary care physicians teaching in community-based settings; (2) provide for programs that improve clinical teaching and research in primary care; (3) provide for community health needs assessments; (4) provide for the establishment of Primary Care Training Institutes within academic health centers; and (5) provide for approved professional training programs in the field of general or pediatric dentistry. Revises provisions governing area health education centers, including to require the Secretary to make awards to improve the effectiveness and capabilities of existing programs. Authorizes the Secretary to provide for the development and implementation of interdisciplinary training of psychology graduate students to provide behavioral and mental health services. Requires the Secretary to: (1) establish the National Center for Health Workforce Analysis; (2) designate regional workforce analysis centers; (3) award grants or contracts to regional centers for research on high-priority workforce questions; (4) provide for monitoring of the supply, need for, and diversity and distribution of health professionals; and (5) establish the Advisory Committee on Health Workforce Information, Evaluation, and Assessment. Requires the Secretary, acting in conjunction with the Director of the Centers for Disease Control and Prevention (CDC), to award competitive grants to establish Academic Health Departments to provide for collaboration between the academic and practice aspects of public health.

National Principal Recruitment Act

National Principal Recruitment Act - Directs the Secretary of Education to establish a National Principal Recruitment program awarding matching grants to up to three partnerships each of which consist of a nonprofit organization working with a research organization and local educational agencies to: (1) recruit new principals for high-need schools and provide them with a year-long preservice residency and ongoing support and professional development; and (2) rigorously research, evaluate, and report on such activities so that successful practices can be replicated and each grantee's success in improving student academic performance can be measured. Increases a grant by 50% after the third full school year of its implementation if: (1) such research and evaluation demonstrates that students in high-need schools led, for at least two years, by principals recruited, trained, and supported by the grantee are making greater academic gains than comparable students elsewhere; and (2) the grantee has the capacity to scale up its services. Terminates a grant by the end of the fourth year of its implementation if the students in high-need schools led, for at least two years, by such principals are not making greater academic gains than comparable students elsewhere. Defines "high-need schools" as public elementary or secondary schools where at least 40% of the students receive a free or reduced price lunch under the school lunch program.

POWER Act

Prisoner Opportunity, Work, and Education Requirement Act or the POWER Act - Amends the Crime Control Act of 1990 to require federal prison inmates to: (1) work for not less than 50 hours weekly; and (2) engage in job training and educational and life skills preparation study. Requires Federal Prison Industries (a government corporation) to employ inmates in manufacturing activities by subcontracting with private sector contractors. Requires inmate wages earned in a 50-hour work week program to be used for the costs of incarceration, victim restitution, inmate expenses, and related state and local prisoner programs. Repeals certain provisions restricting the funding of, and purchase of products from, Federal Prison Industries and prohibiting a public private competition for work performed by employees of the Bureau of Prisons and Federal Prison Industries. Directs the Attorney General to establish the Foreign Labor Substitute Panel to review pilot projects by U.S. companies for the manufacture of goods by federal convicts that would otherwise be manufactured by foreign labor. Revises federal criminal code provisions to restate the mission, operating objectives, performance standards, and other requirements for Federal Prison Industries. Requires the Comptroller General to provide for annual independent evaluations of the operations of Federal Prison Industries and to report to Congress on such evaluations (currently, the Board of Directors of Federal Prison Industries is required to report to Congress).

Concussion Treatment and Care Tools Act of 2008 or the ConTACT Act of 2008 - Amends the Public Health Service Act to authorize the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC), to make grants to states for: (1) establishing, disseminating, and ensuring the implementation by schools of concussion management guidelines with respect to the prevention, identification, treatment, and management of sports-related concussions in student athletes, including standards for student athletes to return to play after a concussion; and (2) funding implementation by schools of computerized preseason baseline and post-injury neuropsychological testing for student athletes. Directs states to utilize, to the extent practicable, applicable expertise and services offered by local chapters of national brain injury organizations. Requires the Secretary, acting through the Director, to convene a conference of medical, athletic, and educational stakeholders to establish model concussion management guidelines with respect to student athletes.

Financial Literacy Improvement Act of 2008 - Amends the Elementary and Secondary Education Act of 1965 to direct the Secretary of Education to award formula matching grants to states or partnerships between states and experienced nonprofit providers of financial literacy or personal finance education programs. Requires grantees to use 25% of the grant funds to: (1) develop financial literacy standards and assessments for at least three grade levels; (2) create teacher training programs to embed financial literacy or personal finance education into core academic subjects; and (3) evaluate the impact such education has on students' financial literacy. Requires the remaining grant funds to be used for subgrants to local educational agencies (LEAs) or partnerships between LEAs and community organizations, local businesses, or other educational entities to implement such financial literacy activities, including student assessments and teacher training. Amends the Higher Education Act of 1965 to direct the Secretary to award competitive grants to institutions of higher education (IHEs) or partnerships between IHEs and experienced nonprofit providers of financial literacy or personal finance education programs for activities that increase student knowledge in consumer, economic, and personal financial concepts.

Foreclosure Diversion and Residential Mortgage Loan Modification Act - Amends the Emergency Economic Stabilization Act of 2008 to establish, in the Office of Domestic Finance of the Department of the Treasury, the Office of Foreclosure Evaluation (OFE), headed by a Director responsible for coordinating the foreclosure prevention responsibilities of the Department of the Treasury, the Department of Housing and Urban Development, the Federal Housing Administration, the Federal Housing Finance Agency, the Neighborhood Reinvestment Corporation, the Federal Deposit Insurance Corporation (FDIC), the Board of Governors of the Federal Reserve System, and other federal government entities. Requires the Director to study and report to Congress on: (1) the barriers to reasonable and timely residential mortgage loan modifications to prevent foreclosure of home loans; as well as (2) the success of programs designed to prevent foreclosures. Establishes a Working Group on Foreclosure Prevention, chaired by the Director, to: (1) improve coordination of federal government efforts to prevent foreclosure and permit homeowners to remain in their homes; (2) build the capacity of federal, state, and local entities and nonprofit organizations to offer housing counseling and pro bono legal services to homeowners in areas that lack sufficient services; (3) share information and best practices concerning foreclosure prevention programs; and (4) review and provide input regarding the criteria used by the Chairperson, as OFE Director, to certify foreclosure prevention programs. Amends the Housing and Economic Recovery Act of 2008 to allow the use of amounts available for redevelopment of abandoned and foreclosed homes to fund state and local mortgage foreclosure prevention programs that support or require counseling, conciliation, and mediation prior to sheriff sale or foreclosure. Makes organizations certified by the OFE eligible for grants to provide a range of financial education and counseling services to prospective homebuyers.

Economic Recovery Act of 2008 - Makes supplemental appropriations for FY2009 for infrastructure, energy, and economic recovery for: (1) the Department of Agriculture; (2) the Department of Commerce; (3) the Department of Justice (DOJ); (4) the National Aeronautics and Space Administration (NASA); (5) the Legal Services Corporation; (6) the Department of Defense (DOD) - Civil for the Department of the Army Corps of Engineer; (7) the Department of Energy (DOE); (8) the Department of the Treasury, including the Office of Inspector General; (9) the Commodity Futures Trading Commission (CFTC); (10) the General Services Administration (GSA); (11) the Small Business Administration (SBA); (12) the Department of Homeland Security (DHS); (13) the Department of the Interior; (14) the Smithsonian Institution; (15) the Department of Labor (DOL), Employment and Training Administration; (16) the Department of Health and Human Services (HHS); (17) the Department of Education; (18) DOD military construction, Navy and Marine Corps, and DOD family housing construction, Army and Air Force; (19) the Department of Transportation (DOT); and (20) the Department of Housing and Urban Development (HUD). Makes appropriations for FY2009 to the Secretary of Agriculture to provide a temporary increase in benefits under the Supplemental Nutrition Assistance Program. Farm Relief Act of 2008 - Amends the U.S. Troop Readiness, Veterans' Care, Katrina Recovery, and Iraq Accountability Appropriations Act, 2007 to make appropriations to the Secretary of Agriculture for emergency financial assistance to producers on a farm that incurred qualifying quantity or quality losses for the 2008 crop due a natural disaster or any related condition, particularly sugar and sugarcane crops in Florida and Louisiana. Prescribes: (1) a temporary increase in the federal medical assistance percentage (FMAP) title XIX (Medicaid) of the Social Security Act; and (2) a temporary reinstatement of authority to provide federal matching payments for state spending for child support incentive payments. Amends the Supplemental Appropriations Act, 2008 to increase and extend emergency unemployment compensation (EUC). Exempts weeks of unemployment between enactment of this Act and December 8, 2009, from the prohibition in the Federal-State Extended Unemployment Compensation Act of 1970 against federal matching payments to a state for the first week in an individual's eligibility period for which extended compensation or sharable regular compensation is paid if the state law of such state provides for payment (at any time or under any circumstances) of regular compensation to an individual for his or her first week of otherwise compensable unemployment. (Thus allows temporary federal matching for the first week of extended benefits for states with no waiting period.) National Park Centennial Fund Act - Establishes in the Treasury the National Park Centennial Fund. Amends the Emergency Economic Stabilization Act of 2008 (EESA) to direct the Secretary of the Treasury to make emergency direct loans of up to $25 billion in the aggregate to certain automobile manufacturers and component suppliers. Requires the Secretary, in allocating loan amounts, to prioritize applications based on the magnitude of the impact of the applicant's manufacturing operations in the United States on the overall U.S. economy and other segments of the automobile industry, including the impact on levels of employment, domestic manufacturing of automobiles and automobile components, and automobile dealerships. Authorizes the automobile manufacturer or component supplier, at the Secretary's discretion, to issue to the Secretary preferred stock in lieu of receiving a loan, on analogous terms and conditions as those described for such EESA loans. Requires any applicant automobile manufacturer or component supplier to submit to the Secretary a detailed plan on how the government funds requested will: (1) be utilized to ensure the long-term financial posture of the company; and (2) stimulate U.S. automobile production and improve the company's capacity to pursue the timely and aggressive production of energy-efficient advanced technology vehicles. Declares that the costs incurred by the federal government in making such loans, including credit subsidy costs and administrative expenses, shall be covered out of proceeds from the sale of government bonds and the third tranche of the $700 billion made available under EESA. Specifies timing of loan disbursements, and terms and conditions. Directs the Secretary to require any loan recipient to meet specified standards for executive compensation and corporate governance. Applies certain EESA oversight requirements to any loans made under this Act. Amends the Internal Revenue Code to allow a taxpayer, other than a corporation, an above-the-line deduction for interest, state sales tax, or excise tax paid or accrued during the taxable year on any indebtedness incurred after November 12, 2008, and before January 1, 2010, in acquiring any qualified motor vehicle which is secured by such vehicle. Designates each amount in this Act as an emergency requirement, necessary to meet certain emergency needs in accordance with the FY2008-FY2009 congressional budget resolutions.

Establishes an energy innovation grant program to provide grants, on a competitive basis, to private, nonprofit organizations, including institutions of higher education, that are capable to providing technical assistance relating to renewable and advanced energy efficiency systems, advanced transportation fuels, carbon capture and sequestration practices and technologies, and other energy efficiency technologies.

Directs the Secretary, acting through the Administrator of the Centers for Medicare and Medicaid Services and upon the request of the state of California, to extend approval, and full federal financial participation, of the state's Medicaid family planning demonstration project until June 30, 2009, under the eligibility requirements and processes that were in place before the project's first extension period. Amends title XVIII (Medicare) of the Social Security Act to increase funding for the Medicare Improvement Fund.

Directs the Secretary of HUD to complete the analysis of data collected for the National Survey on Lead and Allergens in Housing and the American Healthy Housing Survey. Directs the Administrator of the EPA to expand current indoor environmental monitoring efforts to establish baseline levels of indoor chemical pollutants and their sources. Requires the Director of the Centers for Disease Control and Prevention (CDC) to determine the data and resources needed to establish a healthy housing data collection system. Directs the Secretary of HUD to: (1) develop improved methods for evaluating, reducing, and preventing health hazards in housing; (2) support development of objective measures for a healthy residential environment; (3) promote the incorporation of healthy housing principles in post-disaster environments as well as ongoing practices and systems, and of health considerations into green and energy-efficient construction and rehabilitation; (4) improve the dissemination of healthy housing information; and (5) promote state and local level healthy housing efforts. Amends the Public Health Service Act with respect to the CDC Program Capacity on Housing-Related Health Hazard. Directs the Administrator of the EPA, acting through the director of the Office of Children's Health Protection and Environmental Education, to address health hazards in the home environment, with particular attention to children, the elderly, and families with limited resources. Directs the Secretary of HUD to award health hazard reduction grants to reduce significant structural, health, and safety hazards in the home. Directs the Secretary of Agriculture, acting through the Cooperative State Research, Education, and Extension Service, to establish a competitive grant program to promote education and outreach on housing-related health hazards. Amends the Housing and Community Development Act of 1992 with respect to enforcement of the lead disclosure rule. Establishes within the EPA voluntary products and materials and housing labeling programs. Specifies the duties of the EPA Administrator with respect to the Healthy Home Seal of Approval. Directs the EPA Administrator to provide public education and outreach on environmental health risks experienced by the elderly, and low-cost methods for addressing them. Extends through 2009 certain business-related tax provisions, including: (1) the tax credits for increasing research activities, Indian employment, railroad track maintenance, and the new markets tax credit; (2) accelerated depreciation for qualified leasehold and restaurant improvements, for motorsports racing track facilities, and for business property on Indian reservations; (3) expensing of environmental remediation and film and television production costs; (4) the tax deduction for income attributable to domestic production activities in Puerto Rico; (5) special rules for related controlled foreign corporations and for the tax treatment of certain payments to tax-exempt organizations by a controlled subsidiary; (6) issuance authority for qualified zone academy bonds; (7) tax incentives for investment in the District of Columbia; (8) the economic development credit for American Samoa; (9) the expanded tax deductions for charitable contributions of food and book inventories by noncorporate taxpayers; (10) the tax deduction for contributions of computer technology and equipment for educational purposes; (11) the special rule for reductions in the basis of S corporation stock for charitable contributions; (12) work opportunity tax credit eligibility for Hurricane Katrina employees (through August 28, 2009); (13) the subpart F income exemption for active financing income; and (14) the increase in alcohol excise taxes payable to Puerto Rico and the Virgin Islands. Makes permanent the authority of the Internal Revenue Service (IRS) to: (1) disclose tax return information related to terrorist activities; and (2) conduct undercover operations. Lowers in 2008 (from $10,000 to $8,500) the earned income threshold amount for determining the refundable portion of the child tax credit. Modifies certain provisions relating to the tax deduction for domestic film and television productions. Exempts from the excise tax on bows and arrows certain arrow shafts. Modifies the standards for imposing penalties on tax return preparers for understatements of tax. Modifies provisions of the Secure Rural Schools and Community Self-Determination Act of 2000 and authorizes appropriations for such Act. Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008 - Amends the Employee Retirement Income Security Act of 1974 (ERISA), the Public Health Service Act, and the Internal Revenue Code to require a group health plan that provides both medical and surgical benefits and mental health or substance use disorder benefits to ensure parity in the provision of such benefits. Extends through 2009 the 0.2% Federal Unemployment Tax Act (FUTA) surtax. Increases and extends through 2017 the Oil Spill Liability Trust Fund financing rate. Requires the inclusion in gross income for income tax purposes of employee compensation deferred under a nonqualified deferred compensation plan of certain foreign entities when there is no substantial risk of forfeiture of the rights to such compensation. Delays until 2018 the application of special rules for the worldwide allocation of interest for purposes of computing the limitation on the foreign tax credit. Amends the Tax Increase Prevention and Reconciliation Act of 2005 to increase the estimated tax payment due in the third quarter of 2012 for corporations with assets of at least $1 billion.

Authorizes the administrator to make grants to the Department to address mental health needs relating to the terrorist attacks. Amends the Air Transportation Safety and System Stabilization Act to: (1) make individuals eligible for compensation under the September 11 Victim Compensation Fund of 2001 for harm as a result of debris removal; and (2) extend the deadline for making a claim for compensation. Requires the labeling of a standard food item served or offered for sale in a food service establishment that is part of a chain that operates 20 or more establishments under the same trade name to disclose, in a clear and conspicuous manner, prior to the point of purchase: (1) the number of calories on a menu board, on a sign meeting certain requirements, in the menu, or as part of or supplement to the menu; (2) specified nutrient information, in writing and upon request; (3) a statement directing the consumer to the availability of additional nutrient information; and (4) a statement providing suggested daily caloric intake, on a menu or menu board that does not list calories. Declares a person to have knowingly or willfully violated the requirements of this Act if the person: (1) purposefully fails to make a disclosure required by this Act; or (2) makes a disclosure with the intent to deceive. Provides that a reasonable basis determination of nutrition information shall be required only once per standard food item if certain requirements are met. Preempts state laws not identical to this Act.

Preserving Patient Access to Primary Care Act - Amends the Higher Education Act of 1965 to authorize the Secretary of Education to award recruitment incentive grants or contracts to graduate medical schools to enable them to improve primary care education and training for medical students. Amends the Public Health Service Act (PHSA) to direct the Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration, to: (1) award grants to critical shortage health facilities to enable them to provide scholarships to individuals who agree to serve as physicians at such facilities after completing a residency in the field of family practice, pediatrics, or internal medicine; and (2) establish an educational loan repayment program for individuals who agree to serve as primary care physicians in an area that is not a health professional shortage area. Amends the Higher Education Act of 1965 to provide for deferment of education loans during medical residency and internships in family medicine, internal medicine, or pediatric medicine. Amends the Immigration and Nationality Technical Corrections Act of 1994 to make permanent the Conrad State J-1 Visa Waiver Program. Amends the Immigration and Nationality Act to exempt from the H-1 B Visa Limitation individuals awarded a medical speciality certification in internal medicine, pediatrics, or family medicine by the appropriate medical board based on post-doctoral training and experience in the United States. Amends the PHSA to direct the Secretary to award grants to eligible state and local government entities for the development of informational materials that promote careers in primary care. Amends title XIX (Medicaid) of the Social Security Act (SSA) to allow the use of Medicaid transformation payments for methods for improving medical assistance under Medicaid and SSA title XXI (Children's Health Insurance Program) (CHIP, formerly known as SCHIP) by encouraging certain medical practices to qualify as patient centered medical homes. Establishes the Medicaid and CHIP Payment and Access Commission (MACPAC). Amends SSA title XVIII (Medicare) to: (1) increase budget neutrality limits under the physician fee schedule to account for anticipated savings resulting from payments for certain services and the coordination of beneficiary care; and (2) require a separate Medicare payment for designated primary care services and comprehensive care coordination services. Amends SSA title XVIII, as amended by the Medicare Improvements for Patients and Providers Act of 2008, to cover patient-centered medical home services. Directs the Secretary to develop a methodology to increase payments for designated evaluation and management services provided by primary and principal care physicians. Requires: (1) additional incentive payments for primary care services furnished in health professional shortage areas; (2) permanent extension of the floor on the Medicare work geographic adjustment under the physician fee schedule; and (3) permanent extension of the Medicare incentive payment program for physician scarcity areas. Directs the Secretary to study and report to Congress on the process for determining relative value under the Medicare physician fee schedule. Eliminates cost sharing for preventive benefits and the time restriction for initial preventive physical examination. Directs the Secretary to study and report to Congress on: (1) facilitating the receipt of Medicare preventive services by Medicare beneficiaries; and (2) increasing the ability of the physician to assist Medicare beneficiaries in obtaining needed prescriptions under Medicare part D (Voluntary Prescription Drug Benefit Program). Requires additional payments to physicians for services to individuals with limited English proficiency (LEP). Requires various specified studies.

Exempts weeks of unemployment between enactment of this Act and December 8, 2009, from the prohibition in the Federal-State Extended Unemployment Compensation Act of 1970 against federal matching payments to a state for the first week in an individual's eligibility period for which extended compensation or sharable regular compensation is paid if the state law of such state provides for payment (at any time or under any circumstances) of regular compensation to an individual for his or her first week of otherwise compensable unemployment. (Thus allows temporary federal matching for the first week of extended benefits for states with no waiting period.) National Park Centennial Fund Act - Establishes in the Treasury the National Park Centennial Fund. Designates each amount in the Economic Recovery Act, 2008 as: (1) an emergency requirement and necessary to meet emergency needs; and (2) a supplemental appropriation for FY2008, or, if enacted after FY2008, for FY2009.

Every Student Counts Act - Amends the Elementary and Secondary Education Act of 1965 to require, beginning by the 2011-2012 school year, states, local educational agencies (LEAs), and secondary schools annually to include on the report cards required under title I of the Act: (1) their four-year adjusted cohort graduation rate; (2) their cumulative graduation rate; (3) the number of students graduating in more than four years with a regular secondary school diploma; (4) the number of students who have been removed from the adjusted cohort; (5) the percentage of students from an adjusted cohort who remain in secondary school after four years; and (6) the percentage of secondary school students in each grade, except the graduating grade, prepared to advance to the next grade. Requires such data, except for data on students who remain in secondary school after four years, to be disaggregated by race, ethnicity, gender, disability status, migrant status, English proficiency, and status as economically disadvantaged. Directs states, LEAs, and secondary schools in states that lack a statewide longitudinal data system with individual student identifiers to make certain annual interim graduation rate calculations; but prohibits the use of such interim calculations after the 2010-2011 school year. Requires the use of aggregate and disaggregated cumulative graduation rates in determining the success of each secondary school and LEA in making adequate yearly progress (AYP) toward state academic performance standards under the Act. Requires states, LEAs, and schools that have a cumulative graduation rate below 90% overall or for any of the student subgroups, to make specified yearly progress in improving such rate or be deemed as failing to make AYP.

Requires the inclusion of education information about advance directives in the annual notice of Medicare benefits sent to eligible individuals. Revises provisions concerning Medicare+Choice private fee-for-service plans related to access standards under the plans and utilization.

National Security Professionals Act of 2008 - Directs the President to establish a National Security Career Development Program to provide national security professionals access to integrated education, training, and professional experience interagency opportunities. Requires: (1) the Program to establish policies to identify a threshold of interagency experience, knowledge, skills, and abilities required to obtain a national security interagency certification; and (2) the certification to be a consideration for promotion. Requires the President's budget request to include funding requirements to establish and maintain the Program. Requires the Program to include: (1) a rigorous and effective set of educational opportunities for national security professionals; (2) training that refreshes or enhances such a professional's expertise in planning, coordinating, and executing national security missions through instruction, drills, and exercises that take into account the full spectrum of threats and hazards that comprise America's 21st century risk environment; and (3) opportunities for professional interagency experience and intergovernmental, interagency, and interoffice assignments, fellowships, and exchanges. Requires the program to: (1) link career advancement or other incentives to participation in rotational or temporary detail interagency assignments; and (2) establish appropriate career development programs for political appointees in national security positions.

Food Safety Modernization Act of 2007

Food Safety Modernization Act of 2007 [ sic ] - Establishes in the Department of Health and Human Services (HHS) the Food Safety Administration. Assigns all the authorities and responsibilities of the Secretary of Health and Human Services related to food safety to the Administrator of Food Safety. Transfers to the Administration all functions of specified federal agencies that relate to the administration or enforcement of food safety laws. Renames the Food and Drug Administration (FDA) the Federal Drug and Device Administration. Directs the Administrator to: (1) develop, administer, and annually update a national food safety program based on a comprehensive analysis of the hazards associated with different food and with the processing of different food; and (2) ensure that persons who produce, process, or distribute food meet their responsibility to prevent or minimize food safety hazards related to their products. Sets forth requirements for the Administrator to carry out such duties, including: (1) requiring food establishments to register and adopt preventive process controls; (2) establishing and enforcing performance standards for food safety; (3) establishing an inspection program of food and facilities; (4) requiring imported food to meet the same standards as U.S. food; and (5) establishing a national traceability system for food. Requires the Administrator to: (1) identify priorities for food safety research and data collection; (2) maintain a DNA matching system and epidemiological system dedicated to foodborne illness identification, outbreaks, and containment; (3) establish guidelines for a sampling system; (4) establish a national public education program on food safety; and (5) conduct research on food safety. Sets forth provisions regarding prohibited acts, administrative detention, condemnation, temporary holds, recalls, penalties for violations of food safety laws, whistleblower protections, and civil actions.

T-FELAS Act

Teaching Fellows for Expanded Learning and After-School Act of 2008 or the T-FELAS Act - Amends title IV (21st Century Schools) of the Elementary and Secondary Education Act of 1965 to create an Expanded Learning and After-School Fellows program under which the Secretary of Education shall award competitive three-year grants to partnerships between local educational agencies and community organizations, institutions of higher education, community learning centers or other entities to recruit, select, train, and support exemplary recent college graduates (Fellows) who: (1) establish, expand, or improve expanded learning initiatives, 21st century community learning center programs, or after-school programs in high-need schools; and (2) provide school-day support to teachers in such schools. Requires grantees to: (1) provide intensive, comprehensive, and experiential training that prepares Fellows in methods of youth development and offers them a promising career path in public education and youth development; (2) place Fellows in full-time positions where they serve for at least 30 weeks per year, and for a term sufficient to qualify the Fellow for a national service educational award; and (3) provide matching funds on the basis of a sliding scale that gauges the grantees' ability to raise funds. Favors grant applicants that agree to engage Fellows for two-year terms and arrange for them to earn an undergraduate or master's degree in education while serving. Directs the Secretary to conduct an external evaluation of this program every three years and publicize the best practices of program grantees through the Federal Youth Development Council. Amends the National and Community Service Act of 1990 to make Fellows eligible for national service educational awards.

SERV Act

Services, Education, and Rehabilitation for Veterans Act or the SERV Act - Requires the Director of the Office of National Drug Control Policy to delegate to the Department of Justice (DOJ) the authority to administer the veteran's treatment courts program established by this Act. Authorizes the Attorney General to make grants to states and other entities: (1) to develop, implement, or enhance veteran's treatment courts or to expand operational drug courts to serve veterans; and (2) for programs that involve continuing judicial supervision over nonviolent offenders with substance abuse or mental health problems who have served in the U.S. military. Requires such programs to include mandatory periodic testing for the use of drugs, substance abuse and mental health treatment, opportunities for diversion, probation, or supervised release, and programmatic, offender management, and aftercare services. Directs the National Drug Court Institute to conduct national training programs for state and local communities to improve the professional skills of drug court practitioners and provide comprehensive technical assistance to adult, juvenile, and family dependency drug courts.

Offshore Renewable Energy Development Act

Offshore Renewable Energy Development Act - Directs the Secretary of Energy to enter into agreements with specified persons to assess and identify sites in the coastal zone and in the exclusive economic zone of the United States for the location of facilities to generate renewable electric energy. Restricts such agreements to persons with no direct financial interest in any offshore renewable electric energy generation project. Establishes the Offshore Electric Power Generation Trust Fund to finance projects approved by the Secretary. Authorizes the Secretary to: (1) provide grants from the Fund to domestic private and public entities to stimulate development of offshore renewable electric energy generation; and (2) implement a program to provide job training and career assistance in the offshore renewable generation industry. Authorizes appropriations to: (1) assist coastal states in planning to identify sites for offshore renewable energy projects; (2) assist offshore renewable energy research and development, including technology development; (3) establish marine renewable energy centers and the testing and validation of offshore wave, wind, and tidal energy technologies; (4) streamline permitting for renewable energy technology that promotes technology interaction with certain permit issuing agencies; (5) address, through the National Renewable Energy Laboratory, regional strategic planning, public education, and outreach to promote improved public understanding of the benefits of offshore renewable energy; and (6) assess large-scale project siting issues.

Supporting Mentors, Supporting Our Youth Act of 2008 - Amends the Higher Education Act of 1965 to provide student loan forgiveness or cancellation under the Federal Family Education Loan or Direct Loan programs to student borrowers at institutions of higher education who volunteer to mentor an at-risk child for a period of at least one year. Provides $10 of loan forgiveness or cancellation for each hour of mentoring, but limits such forgiveness or cancellation to no more than $10,000 and no more than five years of mentoring for each borrower.

Protection for Participants in Research Act of 2008 - Amends the Public Health Service Act to require all human subject research conducted, supported, or otherwise subject to federal regulation, to be conducted in accordance with the Common Rule and the vulnerable-population rules, as set forth in the Code of Federal Regulations. Requires the Secretary of Health and Human Services to review and harmonize such regulations. Requires informed consent before an individual may be a subject of human research. Requires an Institutional Review Board to approve all human subject research proposals. Directs the Secretary to establish criteria for identifying and monitoring high-risk human subject research projects. Prohibits grants or awards to a public entity or private academic institution that does not have a program to educate investigators and Board members on the protection of human research subjects. Prohibits the use of federal funds for classified human subject research if: (1) the Board has waived the informed consent requirement; or (2) the research is exempt from Board review. Establishes the Office of Human Research Protections within the Office of the Secretary. Requires the Director of the Office to: (1) provide for the protection of human research subjects; (2) establish criteria regarding assurance of compliance with Common Rule requirements; and (3) coordinate federal activities with respect to the protection of human research subjects. Authorizes the Director to make grants for a model education program. Requires the Secretary to: (1) promulgate regulations enhancing the protection of people with diminished decisionmaking capacity participating in human subject research; and (2) study whether the number of certain members of Institutional Review Boards should be increased.

Job Creation and Unemployment Relief Act of 2008 - Makes supplemental appropriations for FY2009 for infrastructure investments for: (1) transportation to the Department of Transportation (DOT); (2) clean water to the Environmental Protection Agency (EPA); (3) flood control and water resources to the Department of Defense (DOD) - Civil for the Department of the Army Corps of Engineers and the Department of the Interior Bureau of Reclamation; (4) for 21st century green high-performing public school facilities to the Department of Education; (5) for public and Indian housing and the Public Housing Capital Fund to the Department of Housing and Urban Development (HUD); (7) energy development to the Department of Energy (DOE); and (8) the Department of Labor (DOL), Employment and Training Administration, for job training and employment services, as well as state unemployment insurance and employment service operations. Amends the Supplemental Appropriations Act, 2008 to increase and extend unemployment compensation (UC). Prescribes: (1) a temporary increase in the federal medical assistance percentage (FMAP) title XIX (Medicaid) of the Social Security Act; and (2) an adjustment in computation of Medicaid FMAP to disregard an extraordinary employer pension contribution. Makes appropriations for FY2009 to the Secretary of Agriculture to provide a temporary increase in benefits under the Supplemental Nutrition Assistance Program.
