Green Bus Tax Credit Act of 2021 This bill allows a manufacturer a zero-emission bus tax credit through 2026. The credit is equal to 10% of the sales price of a zero-emission bus. The credit only applies to the first $1 million of a vehicle's sales price and to buses used primarily in the United States and its possessions. The bill defines zero-emission bus as a motor vehicle that has a gross vehicle weight rating of not less than 14,000 pounds, is not powered or charged by an internal combustion engine, is propelled solely by an electric motor that draws electricity from a battery or fuel cell, is designed to carry 15 or more passengers, and satisfies Buy America requirements.

Green Spaces, Green Vehicles Act of 2021 This bill directs the Department of Energy (DOE), the Forest Service, and the National Park Service (NPS) to collaborate on a Green Spaces, Green Vehicles Initiative to facilitate the installation and use of zero-emissions vehicle infrastructure, including on land that is not National Forest System land or NPS land. The agencies shall facilitate such installation and use, including by acquiring zero-emissions vehicles for the fleets of the Forest Service and the NPS. For purposes of determining whether the acquisition of alternative fueled vehicles is practical for the fleet of the Forest Service or the NPS, DOE shall take into account the availability on National Forest System land or NPS land, as applicable, of zero-emissions vehicle infrastructure.

Justice for Black Farmers Act of 2021 This bill directs the Department of Agriculture (USDA) to provide a variety of assistance to address historical discrimination and disparities in the agricultural sector. For example, the bill establishes an equity commission in USDA to examine discrimination by the agency against Black farmers and ranchers and recommend actions to end the systematic disparities in the treatment of Black farmers and ranchers. USDA must also establish a Farm Conservation Corps to provide young adults who are from socially disadvantaged groups with the skills necessary to pursue careers in farming and ranching. The bill provides funding for historically Black colleges and universities to commence and expand courses of study that are focused on careers in agriculture or related disciplines. The bill also increases the authorization of appropriations for a program to resolve issues relating to ownership and succession on farmland. Additionally, it expands credit assistance for socially disadvantaged farmers and ranchers. Further, the bill (1) establishes that a minimum of 50% of a covered packer's (not including a packer that owns only one livestock processing plant) daily volume of livestock slaughter must be purchased through spot market sales from nonaffiliated producers; (2) increases funding for the Local Agriculture Market Program; and (3) gives priority to socially disadvantaged farmers and ranchers for conservation technical assistance, the Conservation Stewardship Program, and the Rural Energy for America Program.

BRIGHT Act

Bulb Replacement Improving Government with High-efficiency Technology Act or the BRIGHT Act This bill expands requirements relating to the procurement and use of energy-efficient lighting in federal buildings. Under current law, public buildings that are constructed or managed by the General Services Administration (GSA) must be equipped with energy-efficient light bulbs and fixtures. Under the bill, buildings must be equipped with the most life-cycle cost effective and energy-efficient lighting systems available, including with respect to sensors, fixture distribution, and other elements. The bill also specifically establishes requirements relating to the procurement of such lighting systems and modifies other requirements accordingly. The bill also requires the GSA to provide information to federal, state, local, and tribal entities about procuring and using such lighting systems in furtherance of governmental efficiency.

A state energy security plan must contain specified content, including a risk assessment of energy infrastructure and cross-sector interdependencies and a risk mitigation approach to enhance reliability and end-use resilience. The plan must address potential hazards to each energy sector or system, including physical threats, and cybersecurity threats and vulnerabilities. Upon request of a state, DOE may provide information and technical assistance, and other assistance, in the development, implementation, or revision of a state energy security plan.

Energy Efficient Appliances Act This bill revises and expands the Appliance and Equipment Standards Program of the Department of Energy (DOE). Under the existing program, DOE sets minimum energy efficiency standards for product categories of certain consumer products (e.g., appliances) or industrial equipment. This bill expands the categories of appliances and equipment for which DOE may issue energy conservation standards. It also expands the meaning of energy conservation standard to include a performance standard that prescribes a minimum level of water efficiency or a maximum quantity of water use. In addition, the bill reduces the lead time for when the standards must come into effect after the standards are issued or updated. If DOE misses deadlines for issuing certain energy efficiency, energy use, or water use standards, then states may set higher standards than the national standard. Finally, the bill repeals the following rules issued by DOE: Energy Conservation Program for Appliance Standards: Procedures for Use in New or Revised Energy Conservation Standards and Test Procedures for Consumer Products and Commercial/Industrial Equipment , and Energy Conservation Program for Appliance Standards: Procedures for Evaluating Statutory Factors for Use in New or Revised Energy Conservation Standards .

Specifically, the bill addresses personnel matters within the State Department by, for example, requiring the State Department to submit a comprehensive five-year strategic staffing plan and otherwise modifying provisions related to home leave travel, employee assignment restrictions and preclusions, and the recall and reemployment of career members of the Foreign and civil service. Further, the bill establishes recruitment, retention, and promotion requirements to further the goal of achieving a more diverse workforce at the State Department. In addition, the bill modifies the organization and operations of the State Department by, among other things, (1) providing statutory authority for the Bureau of Consular Affairs and the Bureau of Population, Refugees, and Migration; and (2) authorizing the establishment of an Assistant Secretary of State for Energy Resources to handle global energy-related issues. The bill also establishes measures to address State Department information and data security, revises procedures and requirements related to the overseas construction of embassies and consulates, and requires the State Department to report on the efforts of the Coronavirus Repatriation Task Force.

National Climate Bank Act This bill establishes and capitalizes a National Climate Bank. The independent, nonprofit bank must invest in clean energy technologies and infrastructure to reduce greenhouse gas emissions. The national bank's investments and procurements division must seek to facilitate affordable investment and procurement, including in low-income communities and communities of color, in key project areas (e.g., renewable energy or climate resiliency measures). The national bank's start-up division must support the creation of new green banks by states or other political subdivisions. The new banks must be public or nonprofit specialized finance entities that use finance tools to mitigate climate change. The national bank may provide financing for such entities. In addition, the bank must explore the establishment of a cash for carbon program to remove greenhouse gas emissions from the power system. The program may use market mechanisms to expedite the retirement of carbon-intensive power generation facilities (e.g., coal-fired power generation facilities), acquire carbon assets for the purpose of reducing emissions, and invest in communities negatively affected by the loss of those facilities or assets.

Essential Transportation Employee Safety Act of 2021 This bill requires the Department of Transportation (DOT) to support the efforts of state and local governments to prioritize COVID-19 (i.e., coronavirus disease 2019) testing of transportation workers who are categorized as essential critical infrastructure workers. Essential critical infrastructure employees include those who work in industries such as medical and health care, telecommunications, information technology systems, defense, food and agriculture, transportation and logistics, energy, water and wastewater, law enforcement, and public works. Additionally, during the COVID-19 pandemic, DOT must require (1) the owners and operators of equipment or facilities used by passenger or freight transportation employers to implement personal protective equipment and disinfection and sanitization procedures; and (2) an air carrier to submit to the Federal Aviation Administration (FAA) a proposal to permit pilots to wear masks or protective face coverings in the flight deck, including a safety risk assessment with respect to such proposal. The bill sets forth requirements for owners or operators who cannot acquire necessary personal protective equipment due to market unavailability. For the duration of the COVID-19 national emergency, the FAA must (1) provide certain employees, including air traffic controllers and airway transportation systems specialists, with personal protective and sanitizing equipment; (2) ensure that air traffic control facilities are cleaned, disinfected, and sanitized frequently; and (3) ensure its contractors provide their employees with personal protective equipment.

Agencies must provide the support as rapidly as possible. Provided funds shall remain available through FY2021.

Protecting American Energy Jobs Act This bill limits the President's authority to prohibit or withdraw federal land or waters from energy production activities. Specifically, the bill requires the President and federal agencies to obtain the approval of Congress before prohibiting or substantially delaying certain new energy or mineral leases or permits on federal lands, including oil and gas leases, coal leases, hard rock leases, or critical minerals leases. In addition, the President and agencies must obtain the approval of Congress before withdrawing certain federal lands from mineral and geothermal leasing activities. Further, the bill repeals the President's authority to withdraw unleased lands on the outer Continental Shelf from oil and gas leasing. The bill nullifies Executive Order 13990 titled Protecting Public Health and the Environment and Restoring Science To Tackle the Climate Crisis; Executive Order 14008 titled Tackling the Climate Crisis at Home and Abroad; and the Department of the Interior's Secretarial Order 3395 concerning a temporary suspension of delegated authority to all of Interior's Bureaus and Offices, including the authority to approve leases.

Climate action plans must demonstrate that the measures proposed to be implemented through the grants will do at least two of the following: improve energy efficiency at ports or port facilities, deploy technology or processes that reduce idling of vehicles at ports or port facilities, or reduce the direct emissions of greenhouse gases and other air pollutants with a goal of achieving zero emissions.

Renewable Fuel Infrastructure Investment and Market Expansion Act of 2021 This bill establishes programs and requirements to expand access to renewable fuel. Specifically, the U.S. Department of Agriculture must establish a program to award grants for the deployment of renewable fuel infrastructure as specified by this bill. In addition, the Environmental Protection Agency (EPA) must finalize a 2021 proposed rule titled E 15 Fuel Dispenser Labeling and Compatibility With Underground Storage Tanks . When finalizing the rule, the EPA must eliminate the labeling requirements for fuel pumps that dispense E 15 fuel (i.e., gasoline that contains 15% ethanol).

Clean Energy and Sustainability Accelerator Act

Clean Energy and Sustainability Accelerator Act This bill establishes and capitalizes a Clean Energy and Sustainability Accelerator. The independent, nonprofit accelerator must invest in clean energy technologies and infrastructure to reduce greenhouse gas emissions. The accelerator must make capital available to state, territorial, or local green banks. The banks must be public or nonprofit specialized finance entities that use finance tools to mitigate climate change. The accelerator may also provide technical assistance and funding to states and other political subdivisions that do not have green banks to establish such banks. When investing in projects that mitigate greenhouse gas emissions, the accelerator must prioritize investments that serve climate-impacted communities (e.g., communities of color or low-income communities). In addition, the accelerator must explore the establishment of a program to provide low-interest and zero-interest loans, up to 30 years in length, to any school, metropolitan planning organization, or nonprofit organization seeking financing for the acquisition of zero-emissions vehicle fleets or associated infrastructure. Finally, the accelerator must explore the establishment of an accelerated clean energy transition program to (1) expedite the transition within the power sector to zero-emissions power generation facilities or assets, and (2) invest in local economic development in communities affected by this transition away from carbon-intensive facilities or assets.

Climate Emergency Act of 2021

National Climate Emergency Act of 2021 or the Climate Emergency Act of 2021 This bill directs the President to declare a national emergency with respect to climate change. The President, in responding to the emergency, must ensure that the government invests in large scale mitigation and resiliency projects; makes investments that enable a racially and socially just transition to a clean energy economy by ensuring that at least 40% of investments flow to historically disadvantaged communities; avoids solutions that increase inequality or violate human rights; creates jobs that conform to labor standards that provide family sustaining wages and benefits and ensure safe workplaces; prioritizes local and equitable hiring and contracting that creates opportunities for marginalized communities; combats environmental injustice; and reinvests in existing public sector institutions and creates new public sector institutions to strategically mobilize and channel investments at the scale and pace required by the national emergency. The President shall report annually on actions taken in response to the national emergency.

This bill expedites the approval process for renewable fuels under the renewable fuel standard (RFS) program. The existing RFS program requires transportation fuel to contain a minimum volume of renewable fuel. Producers must register renewable fuels under the program. The bill considers an application to register a renewable fuel under the RFS program to be approved by the Environmental Protection Agency (EPA) if the fuel has been approved under any state renewable fuel program. It also establishes a deadline for the EPA to make a decision on any pending application for a renewable fuel that has not yet been approved under any state program. In addition, the bill establishes deadlines for the EPA to make decisions on pending pathway petitions by producers to register biofuels. If the EPA does not make decisions on the petitions by the deadlines, then petitions are automatically approved.

Growing Renewable Energy and Efficiency Now Act of 2021 or the GREEN Act of 202 1 This bill provides tax incentives for investment in renewable energy resources and energy efficiency programs. Among other provisions, the bill extends for five years the tax credit for production of electricity from certain renewable resources (e.g., wind facilities, biomass, landfill trash facilities), allows an election to treat certain tangible property as energy property for purposes of the energy tax credit, and modifies certain provisions of the energy tax credit and expands the credit for four years; expands the 30% energy tax credit to include energy storage technology or qualified biogas property; extends for one year the tax credit for carbon oxide sequestration; allows elective payments in lieu of certain energy-related tax credits; modifies the phaseout provisions of the income and excise tax credits for biodiesel and renewable diesel and alternative fuels and extends the termination date for such credits; extends and increases the tax credits for nonbusiness energy property and the new energy efficient home tax credit; extends for five years the residential energy efficient property tax credit; increases the tax deduction for energy efficient commercial buildings; modifies the limitations on new qualified plug-in electric drive motor vehicles tax credit and allows a new credit for such vehicles that are previously-owned; allows a new tax credit for zero emission heavy vehicles (vehicles with a gross weight rating of not less than 14,000 pounds and not powered by an internal combustion engine); extends for five years the tax credits for qualified fuel cell motor vehicles and alternative fuel cell refueling property; provides for additional allocations of the advanced energy project tax credit; allows a new tax credit for the labor costs of installing mechanical insulation property; allows a new tax credit to promote environmental justice programs (programs to improve health and economic outcomes of individuals residing in low-income areas or areas populated disproportionately by racial or ethnic minorities); and requires the Department of the Treasury to report on the utility of data from the Greenhouse Gas Reporting Program for determining the amount of greenhouse gases emitted by taxpayers for purposes of imposing a fee on them for such emissions.

On January 27, 2021, the President issued an executive order that includes a moratorium on new oil or gas leases on public lands or in offshore waters. This bill exempts New Mexico from such moratorium. On January 20, 2021, the Department of the Interior issued a secretarial order that includes a suspension on the authority of its bureaus and offices to issue any onshore or offshore fossil fuel authorization, including permits to drill. This bill exempts New Mexico from the suspension.
