Investing in State Energy Act of 2023 This bill revises requirements concerning the distribution of funds under the Weatherization Assistance Program (WAP) and the State Energy Program (SEP) to state agencies and local partners that implement energy initiatives. Under WAP, the Department of Energy (DOE) reduces energy costs for low-income households by increasing the energy efficiency of their homes. Under SEP, DOE supports state energy conservation plans and energy security. This bill requires DOE, upon receiving state or area plans under WAP or SEP, to distribute funds to the recipients of the funding as quickly as practicable. Within 60 days of Congress making the funds available for WAP and SEP, DOE must (1) provide application guidance for financial assistance, and (2) publish the allocation of financial assistance to be provided to states under the programs.

Justice for Black Farmers Act of 202 3 This bill directs the Department of Agriculture (USDA) to provide a variety of assistance to address historical discrimination and disparities in the agricultural sector. For example, the bill establishes an equity commission in USDA to examine discrimination by the agency against Black farmers and ranchers and recommend actions to end the systematic disparities in the treatment of Black farmers and ranchers. USDA must also establish a Farm Conservation Corps to provide young adults who are from socially disadvantaged groups with the skills necessary to pursue careers in farming and ranching. The bill provides funding for historically Black colleges and universities to commence and expand courses of study that are focused on careers in agriculture or related disciplines. The bill also increases the authorization of appropriations for a program to resolve issues relating to ownership and succession on farmland. Additionally, it expands credit assistance for socially disadvantaged farmers and ranchers. Further, the bill (1) establishes that a minimum of 50% of a covered packer's (not including a packer that owns only one livestock processing plant) daily volume of livestock slaughter must be purchased through spot market sales from nonaffiliated producers; (2) increases funding for the Local Agriculture Market Program; and (3) gives priority to socially disadvantaged farmers and ranchers for conservation technical assistance, the Conservation Stewardship Program, and the Rural Energy for America Program.

Facilitating the Reshoring of Energy Grid Component Manufacturing Act of 2023 This bill directs the Department of Energy (DOE) to establish a loan program for the production of energy grid products or components. Under the program, DOE may provide loans for activities related to projects that reequip, expand, or establish manufacturing facilities to produce energy grid products or their components. Energy grid products include large power transformers or any other electrical equipment commonly used for the transmission or distribution of electric energy by public electric utilities.

Obtaining National and Secure Homeland Operations for Rare Earth Manufacturing Act of 2023 or the ONSHORE Manufacturing Act of 2023 This bill sets forth provisions to support secure supply chains of rare earth elements. A rare earth element means a natural element associated with (1) the metallic element scandium, with atomic number 21; (2) the metallic element yttrium, with atomic number 39; or (3) any of the series of 15 metallic elements between lanthanum, with atomic number 57, and lutetium, with atomic number 71, on the periodic table. The Department of Energy (DOE) must establish a program that provides financial assistance for facilities located in the United States that produce finished rare earth products from purified rare earth elements. Financial assistance may be provided to (1) construct such facilities, (2) support workforce development for the facilities, or (3) support site development and technological upgrade for facilities. The Department of the Treasury may establish the Minerals Security Partnership Fund to support the development and adoption of a secure supply chain for rare earth elements. DOE must also establish an initiative with educational, workforce training, and apprenticeship programs relating to advanced rare earth element mining, separation, processing, metallurgy, and advanced equipment maintenance capabilities. In addition, the President must develop a plan of action for using the authorities available under the Defense Production Act of 1950 to establish or enhance a domestic production capability for finished rare earth products and related technologies.

Strategic Production Response Act or the SPR Act This bill limits the drawdown of petroleum in the Strategic Petroleum Reserve (SPR) until the Department of Interior issues a plan or updates a previously issued plan to increase the production of oil and gas on federal land. However, Interior may drawdown petroleum in the SPR if there is a severe energy supply interruption. The bill defines federal land to (1) include Outer Continental Shelf land; and (2) exclude land otherwise not available for oil and gas development within the National Park System, the National Wildlife Refuge System, the National Wilderness Preservation System, a National Marine Sanctuary, or Indian land.

Fracturing Regulations are Effective in State Hands Act or the FRESH Act This bill gives states the sole authority to promulgate or enforce any regulation, guidance, or permit requirement regarding hydraulic fracturing on or under any land within their boundaries. Hydraulic fracturing or fracking is a process to extract underground resources such as oil or gas from a geologic formation by injecting water, a propping agent (e.g., sand), and chemical additives into a well under enough pressure to fracture the geological formation. Hydraulic fracturing on federal land must comply with the law of the state in which the land is located.

Federal Land Freedom Act of 2023 This bill sets forth a process that allows a state (including the District of Columbia) to seek to transfer the responsibility of energy development on federal land within its boundaries from the federal government to the state. Federal land does not include land that, as of May 31, 2013, is (1) held for the benefit of an Indian tribe, (2) in the National Park System, (3) in the National Wildlife Refuge System, or (4) in a congressionally designated wilderness area. To qualify for such a transfer of responsibility, a state must have a program that regulates the exploration and development of oil, natural gas, and other forms of energy on its land. The federal responsibility transfers to the state once the state submits to the Department of the Interior, the U.S. Department of Agriculture, and the Department of Energy a declaration that it has such a program and that it seeks to transfer the responsibility. Any action taken by a state to lease, permit, or regulate the exploration and development of energy on federal land in lieu of the federal government is not subject to the Administrative Procedure Act, the National Historic Preservation Act, the Endangered Species Act of 1973, or the National Environmental Policy Act of 1969.

Promoting Cross-b order Energy Infrastructure Act This bill establishes a new process for approving the construction and operation of energy infrastructure across an international border of the United States and replaces the existing process established under specified executive orders. Specifically, this bill requires a person to obtain a certificate of crossing before constructing, connecting, operating, or maintaining a border-crossing facility for the import or export of oil, natural gas, or electricity across a U.S. border between Canada or Mexico. A certificate must be obtained from the Federal Energy Regulatory Commission (FERC) for a facility consisting of oil or natural gas pipelines or the Department of Energy (DOE) for an electric transmission facility. As a condition of issuing a certificate, DOE must require that an electric transmission facility be constructed, connected, operated, or maintained consistent with specified policies and standards. FERC and DOE must meet a deadline for issuing a certificate as set forth by this bill. The bill also requires FERC to meet a deadline for approving applications to import or export natural gas to or from Canada or Mexico.

Secure Auction For Energy Reserves Act of 2023 or the SAFER Act of 2023 This bill limits the sale and exportation of petroleum products (e.g., crude oil) from the Strategic Petroleum Reserve (SPR). Specifically, the bill directs the Department of Energy (DOE) to require, as a condition of auction sales, that the petroleum products not be exported to countries that are designated as countries of particular concern for religious freedom under the International Religious Freedom Act of 1998. In addition, the bill establishes limits on auction sales of petroleum products from the SPR to state-owned entities if DOE determines that, as of the dates of the auctions, there are bans on, or the imposition of sanctions by the United States with respect to, the purchase of crude oil from countries. Under such circumstances, state-owned entities must certify that they have not purchased petroleum products from countries subject to such bans or sanctions later than 15 days after the date on which the ban or sanctions went into effect in order to be able to bid in auctions. If DOE determines state-owned entities participating in the auctions have purchased crude oil from such countries after that time period, then DOE may not sell petroleum products from the SPR to such entities.

California Central Coast Conservation Act This bill prohibits the Bureau of Land Management from administering an oil and gas leasing and development program on the Central Coast of California (e.g., Fresno, Monterey, and San Benito Counties) until it completes and publishes a supplemental environmental impact statement (EIS) assessing the environmental effects of such leasing and development, including the effects on air quality, seismicity, and greenhouse gas emissions. In addition, the bill establishes requirements for the Environmental Protection Agency's review of the EIS.

Tennessee Valley Authority Transparency Act of 2023 This bill revises the duties of the Tennessee Valley Authority (TVA) Board of Directors to include holding public meetings. The board must provide public notice at least six days before such a meeting, unless the meeting is designated as an emergency. The TVA provides low-cost electricity in seven southeastern states. It also provides flood control, navigation, and land management for the Tennessee River system.

Buy Low and Sell High Act This bill revises requirements concerning the Strategic Petroleum Reserve (SPR) and sets forth provisions to reduce the demand for petroleum fuel and increase fuel supply. For example, the bill directs the Department of Energy (DOE) to establish within the SPR an Economic Petroleum Reserve of up to 350 million barrels of crude oil. DOE must also establish a national network of Strategic Refined Petroleum Product Reserves to store up to 250 million barrels of gasoline and diesel fuel, which may be sold when there is a severe fuel supply interruption within the district in which the reserve is located. In addition, the bill increases the cap on the amount of barrels of petroleum distillate that may be stored in the Northeast Home Heating Oil Reserve from two million to four million. It also establishes limits on the sale and exportation of petroleum products from such reserves. Further, the bill establishes provisions concerning electrifying the transportation sector, zero-emission vehicles, and a program to increase the amount of crude oil refined in oil refineries in certain countries in the Western Hemisphere.

Unleashing American Energy Act This bill requires a minimum amount of oil and gas lease sales a year on certain submerged lands of the Outer Continental Shelf (OCS) and limits delays on federal oil and gas leases on such lands. Specifically, this bill requires the Department of the Interior to annually conduct a minimum of two region-wide oil and gas lease sales in each of the following regions of the OCS: (1) the Gulf of Mexico region in the Central Gulf of Mexico Planning Area and the Western Gulf of Mexico Planning Area, and (2) the Alaska region. In addition, the bill requires the President to obtain congressional approval before delaying federal oil and gas leases on the OCS.

Banning Oil Exports to Foreign Adversaries Act This bill requires the Department of Energy (DOE) to prohibit the export or sale of petroleum products (e.g., crude oil) from the Strategic Petroleum Reserve to (1) China, North Korea, Russia, and Iran; (2) any other country the government of which is subject to sanctions imposed by the United States; and (3) any entity owned, controlled, or influenced by such countries or the Chinese Communist Party. However, DOE may issue a waiver of the prohibition if the export or sale of petroleum products is in the national security interests of the United States.

Public Housing Emergency Response Act This bill authorizes additional assistance from the Public Housing Capital Fund to public housing agencies (PHAs) based upon capital needs as determined by the PHA's most recent physical needs assessment. Permitting for Mining Needs Act of 2023 This bill expedites the review of mining projects on federal lands and limits judicial review of mining projects. For example, the bill expands the federal permitting and review processes under the Infrastructure Investment and Jobs Act for critical minerals. Under the act, the Bureau of Land Management (BLM) and the U.S. Forest Service, to the maximum extent practicable, must complete the federal permitting and review processes related to critical mineral mines on federal lands with maximum efficiency and effectiveness. This bill expands this process to include all minerals as defined by the bill, not only critical minerals. The bill also establishes deadlines for completing the review of mining projects under the National Environmental Policy Act of 1969. In addition, the bill also expands the meaning of covered projects under the Fixing America's Surface Transportation (FAST) Act to include (1) certain mineral production projects, and (2) certain actions taken by the Department of Defense. Such projects qualify for expedited environmental review. It also establishes requirements to expedite the review or authorization of certain mineral projects, such as (1) mineral exploration activities with a surface disturbance of no more than five acres of public lands, (2) ancillary mining activities, and (3) uranium projects. Finally, the bill limits judicial review of a permit, license, or approval issued by a lead agency for a mining project by requiring the filing of claims within a certain time period.

Public Land Renewable Energy Development Act of 2023 This bill sets forth provisions regarding development of geothermal, solar, or wind energy on public lands. The Department of the Interior shall establish priority areas on its land for geothermal, solar, and wind energy projects, consistent with the principles of multiple use and the renewable energy permitting goal. Among applications for a given renewable energy source, proposed projects located in priority areas for that renewable energy source shall be given the highest priority for incentivizing deployment, and be offered the opportunity to participate in any regional mitigation plan developed for the relevant priority areas. The bill provides for the disposition of revenues from the development of wind or solar energy. The bill establishes the Renewable Energy Resource Conservation Fund to make funds available to federal, state, and tribal agencies for distribution in regions in which renewable energy projects are located on federal land for (1) restoring and protecting natural water bodies and fish and wildlife habitat and corridors, and (2) preserving and improving recreational access to federal land and water in an affected region.

Save America’s Valuable Energy Act or the SAVE Act This bill directs the Department of Energy (DOE) to prohibit the sale of petroleum products (e.g., crude oil) from the Strategic Petroleum Reserve (SPR) to certain entities. Specifically, DOE must prohibit the sale of petroleum products from the SPR to entities headquartered in Russia. Further, DOE must prohibit the sale of petroleum products from the SPR to entities headquartered in countries (Belarus, Burma, China, Cuba, Iran, North Korea, Syria, and Venezuela) that are subject to certain prohibitions concerning exports of defense articles and services under the Department of State's International Traffic in Arms Regulations.
