REFINE Act

Reserving Energy For Independence and Empowerment Act or the REFINE Act This bill sets forth provisions to limit the sale and export of petroleum products from the Strategic Petroleum Reserve (SPR), increase energy production from energy producers in the United States, and make related requirements. Specifically, the bill requires the Department of Energy (DOE) to issue regulations prohibiting the export of petroleum products (e.g., crude oil) sold from the SPR to (1) any country that is subject to a U.S. arms embargo as specified by the bill, (2) any country that is a state sponsor of terrorism, and (3) any entity that is owned by China. Before DOE may sell, exchange, or loan crude oil from the SPR, DOE must first develop a plan to increase the percentage of federal land (including submerged land of the Outer Continental Shelf) leased for oil and gas production by the same percentage as the percentage of petroleum in the SPR that is to be drawn down. In addition, the President must rescind the Executive Order titled Protecting Public Health and the Environment and Restoring Science To Tackle the Climate Crisis . The President must also direct federal agencies to (1) identify and repeal any of their regulations that have the intent or effect of substantially reducing the energy independence of the United States, and (2) issue regulations and guidance to reduce the regulatory burden for energy producers in the United States and to increase the energy output by those producers.

LIHEAP Act

Lowering Inflated Heating, Energy, and Air Conditioning Prices Act or the LIHEAP Act This bill increases for FY2023-FY2024 the federal income eligibility threshold for the Low-Income Home Energy Assistance Program, which provides federal grants to states, tribes, and territories to assist low-income households pay for heating and cooling costs. Currently, households are eligible with incomes at or below 150% of the poverty rate or 60% of the median income of their applicable state, tribe, or territory. This bill permits payments to households with incomes that are 75% of the applicable median income.

Of inquiry requesting the President, and directing the Secretary of Energy, to transmit to the House of Representatives certain information relating to plans to protect baseload bulk power system generation and transmission to maintain bulk power system reliability.

REDUCE Act

Responsive Energy Demand Unlocks Clean Energy Act or the REDUCE Act This bill requires organizations that operate electric grid transmission facilities (e.g., Regional Transmission Organizations or Independent System Operators) to accept bids in a power market from demand response programs of a certain size. In a demand response program, end-use electricity customers are typically remunerated for voluntarily decreasing their short-term electrical consumption generally in response to compromised grid reliability or high wholesale electricity prices.

AERO Act

Aviation Emissions Reduction Opportunity Act or the AERO Act This bill requires the Department of Transportation to award competitive grants for projects in the United States that support the production and deployment of sustainable aviation fuel or the development of low-emission aviation technologies. Eligible grantees include, among others, state or local governments, air carriers, and research institutions. None of the funds made available may be used for a project unless all of the iron, steel, manufactured products, and construction materials used in the project are produced in the United States, subject to waivers where inconsistent with the public interest, where not produced in sufficient quantities or satisfactory quality, or where such inclusion will increase the cost of the project by more than 25%. The bill also reauthorizes through FY2027 the Continuous Lower Energy, Emissions, and Noise Program of the Federal Aviation Administration.

Fueling Our Nuclear Future Act of 2022

Bicameral Congressional Trade Authority Act of 2022

Bicameral Congressional Trade Authority Act of 2022 This bill requires congressional approval for a presidential import adjustment due to a national security threat from an import related to military equipment, energy resources, or critical infrastructure essential to national security. Specifically, the bill requires the President to submit a proposal to Congress, which Congress may approve by a joint resolution. Under current law, the President determines whether any adjustment of an import is necessary and must submit to Congress the reasons for any action taken or not taken. The Department of Defense (currently, the Department of Commerce) must investigate the effect of these imports on national security. The bill retroactively applies to any proposed action made four years before enactment of this bill. In general, any rate of duty modification occurring in the time period beginning six years before and ending the day before enactment of this bill must revert to the previous rate unless it receives congressional approval.

Tribal Energy Investment Act of 2022

Security to Avoid Violence in Educational Settings Act or the SAVES Act This bill transfers certain funds to the Department of Justice (DOJ) to carry out a grant program for school safety and security. Specifically, the bill transfers funds appropriated for energy efficiency and renewable energy improvements at public school facilities (currently known as the Department of Energy's Renew America's Schools Program) to DOJ for the grant program. DOJ must award grants to states (and states must provide subgrants to eligible entities, such as local educational agencies and schools) for planning and designing school buildings and facilities, installing infrastructure, and implementing technology or other measures that strengthen security on school premises.

INSPECT Act

Increasing Nuclear Safety Protocols for Extended Canister Transfers Act or the INSPECT Act This bill requires the Nuclear Regulatory Commission to assign a resident inspector to each commercial nuclear power plant that has permanently ceased operation. The inspector must (1) conduct inspections of decommissioning activities and spent nuclear fuel transfer activities, and (2) remain at the plant until all fuel is transferred from its spent fuel pools.

Arctic Commitment Act

Arctic Commitment Act This bill expands a variety of Arctic-focused provisions pertaining to national security, shipping, and trade. For example, the bill directs the Department of Transportation (DOT) to establish the Arctic Shipping Federal Advisory Committee to advise DOT on matters related to Arctic maritime transportation, including Arctic seaway development. It also requires the Department of the Navy to ensure that the Port of Nome in Alaska is usable for the implementation of the National Strategy for the Arctic Region and military service strategies for the Arctic. Additionally, the U.S. Coast Guard and Navy must jointly submit to Congress a report that outlines the requirements to establish a persistent, year-round presence of the Navy and Coast Guard in the Arctic region, including at the Port of Nome and any other deepwater port that would facilitate such a presence. The bill also requires the Committee on Maritime Transportation System to submit to Congress a report that describes the control and influence of the Russian Federation on shipping in the Arctic and includes a plan for eliminating or preventing a Russian monopoly on shipping in the region to enable an increased U.S. presence in the Arctic shipping domain. Further, the bill expresses the sense of Congress that (1) Arctic countries are important partners of the United States, and (2) the United States International Development Finance Corporation should make investments in Arctic countries to facilitate technologies that contribute to energy security and sustainable opportunities for indigenous groups.

Airport Energy Resiliency and Renewable Energy Act of 2022

A microreactor is a nuclear reactor with at most 20 megawatts of thermal energy generating capacity. Specifically, such strategy must include an assessment of the effectiveness of utilizing diesel generators to assist with natural disaster response efforts; a comprehensive, research-based, and long-term discussion of goals, objectives, and priorities for utilizing microreactors instead of diesel generators to assist with such efforts; a Department of Defense analysis regarding the use of such microreactors to assist with such efforts; recommendations on how the Nuclear Regulatory Commission may expedite the approval of designs for microreactors and issuing licenses; an assessment of the challenges and barriers to deploying microreactors to assist with such efforts and solutions; and recommendations on how to utilize microreactors as charging stations for electric vehicles in the event of a mass evacuation resulting from a natural disaster.

ACE Act

Airspace Clearinghouse Enhancement Act or the ACE Act This bill addresses structures interfering with air commerce or national security near military installations. Specifically, the bill requires the Department of Defense to elicit written testimony from the base commander of each military installation within a certain radius of a structure or sanitary landfill when making a determination of whether the construction, alteration, establishment, or expansion of such a facility will result in an unacceptable risk to U.S. national security; and any person that submits an application for an energy project near a military installation to disclose if they have a relationship with a foreign principal or an agent of a foreign principal.

Banning Oil Exports to Foreign Adversaries Act This bill requires the Department of Energy (DOE) to prohibit the export or sale of petroleum products (e.g., crude oil) from the Strategic Petroleum Reserve to (1) China, North Korea, Russia, and Iran; (2) any other country the government of which is subject to sanctions imposed by the United States; and (3) any entity owned, controlled, or influenced by such countries or the Chinese Communist Party. However, DOE may issue a waiver of the prohibition if the export or sale of petroleum products is in the national security interests of the United States.

This bill limits the sale and exportation of petroleum products (e.g., crude oil) from the Strategic Petroleum Reserve (SPR). Specifically, the bill directs the Department of Energy (DOE) to require, as a condition of auction sales, that the petroleum products not be exported to countries that are designated as countries of particular concern for religious freedom under the International Religious Freedom Act of 1998. In addition, the bill establishes limits on auction sales of petroleum products from the SPR to state-owned entities if DOE determines that, as of the dates of the auctions, there are bans on, or the imposition of sanctions by the United States with respect to, the purchase of crude oil from countries. Under such circumstances, state-owned entities must certify that they have not purchased petroleum products from countries subject to such bans or sanctions while the bans or sanctions were in effect in order to be able to bid in auctions. If DOE determines state-owned entities participating in the auctions have purchased crude oil from such countries while the bans or sanctions were in effect, then DOE may not sell petroleum products from the SPR to such entities.

Further, DOE must prohibit the sale of petroleum products from the SPR to entities headquartered in countries (Belarus, Burma, China, Cuba, Iran, North Korea, Syria, and Venezuela) that are subject to certain prohibitions concerning exports of defense articles and services under the Department of State's International Traffic in Arms Regulations.

Federal Data Center Enhancement Act of 2022 This bill modifies requirements relating to data centers of federal agencies and extends the sunset of provisions regarding the federal data center consolidation initiative. Specifically, the General Services Administration (GSA) must establish minimum requirements for new data centers, including regarding the availability and use of new data centers; the use of sustainable energy sources; uptime percentage; protections against power failures, including on-site energy generation and access to multiple transmission paths; protections against physical intrusions and natural disasters; and information security protections. During the development and planning lifecycle of a new data center, an agency must report to the GSA and Congress upon determining it is likely to make a management or financial decision relating to such center. An agency must (1) regularly assess the application portfolio of the covered agency and ensure that each legacy application is updated, replaced, or modernized, as appropriate, to take advantage of modern technologies; and (2) prioritize and, to the greatest extent possible, leverage commercial cloud environments rather than acquiring, overseeing, or managing custom data center infrastructure. An agency must oversee and manage the data center portfolio and the information technology strategy of the agency in accordance with federal cybersecurity guidelines and directives.

No Oil for CCP Act

Energy grid products include large power transformers or any other electrical equipment commonly used for the transmission or distribution of electric energy by public electric utilities.

Food and Energy Security Act This bill provides requirements for specified federal financial agencies when regulating activity that could impact the extension of capital or investments to agricultural- or energy-related businesses. Specifically, an agency must analyze the economic impact of any such regulation. If the analysis estimates that the regulation would increase prices, and if the consumer price index exceeds a certain level, the agency is prohibited from implementing the regulation.

Access to Consumer Energy Information Act or the E-Access Act This bill revises federal guidelines for state energy conservation plans, including by authorizing such plans to include programs that (1) enhance consumer access to, and understanding of, electric energy and natural gas usage and cost information, including consumers' own residential and commercial retail electric energy and natural gas information; and (2) facilitate the development and adoption of innovative products and services to assist consumers in managing energy consumption and expenditures.

Protecting America’s Strategic Petroleum Reserve from China Act

Protecting America's Strategic Petroleum Reserve from China Act This bill prohibits the sale and export of crude oil from the Strategic Petroleum Reserve (SPR) to China. Specifically, the bill prohibits the Department of Energy (DOE) from selling petroleum products (e.g., crude oil) from the SPR to any entity that is under the ownership, control, or influence of the Chinese Communist Party. Further, DOE must require as a condition of any sale of crude oil from the SPR that the oil not be exported to China.
