Partnerships for Energy Security and Innovation Act of 2021 This bill requires the Department of Energy (DOE) to establish the Foundation for Energy Security and Innovation. It also authorizes the establishment of the National Energy Technology Laboratory. The Foundation for Energy Security and Innovation, a nonprofit corporation, must support DOE's mission and increase private and philanthropic sector investments that support efforts concerning the development, deployment, and commercialization of innovative technologies that address crosscutting national energy challenges. The foundation may award fellowships and grants for activities relating to research, development, demonstration, maturation, or commercialization of energy and other technologies supported by DOE. In addition, the National Energy Technology Laboratory may establish a nongovernmental Federal Laboratory-Associated Foundation to advance U.S. energy security as specified by the bill.

The office shall establish an integrated system of geographically diverse field research sites in order to improve the quantity and quality of observational data and that encompass the major land-water interfaces of the United States, including the Great Lakes region, the Pacific coast, the Atlantic coast, the Arctic, and the Gulf Coast.

Additionally, USDA must establish a program to award grants to governmental organizations and private entities in the agricultural sector to carry out at least 10 pilot projects with the potential to reduce or sequester greenhouse emissions that convert and valorize tree nut harvest by-products and waste into multiple higher value biocarbon products, including sustainable industrial applications, agrochemicals, repurposing process heat, energy, and construction materials.

Plugging Orphan Wells and Environmental Restoration Act of 2021 or the POWER Act of 2021 This bill addresses orphaned, abandoned, or idled oil and gas wells on federal, tribal, state, or private lands. Specifically, the bill reauthorizes through FY2026 the program to remediate, reclaim, and close orphaned, abandoned, or idled oil and gas wells located on federal land. Additionally, the Department of the Interior must establish a program to provide grants to states and Indian tribes to remediate, reclaim, and close orphaned oil and gas wells located on state, tribal, or private lands. In providing grants, priority must be given to states and Indian tribes that already have an established program to carry out such activities. Finally, the Department of Energy must provide technical assistance to oil and gas producing states and Indian tribes to ensure practical and economical remedies for environmental problems caused by orphaned or abandoned oil and gas well sites on state, tribal, or private land.

During this time, FERC is prohibited from authorizing construction-related activity that is related to the order, and the holder of a certificate of public convenience and necessity that is the subject of the order may not exercise the right of eminent domain to acquire land or other property to carry out the pipeline project.

This bill prohibits the U.S. International Development Finance Corporation from prohibiting or restricting the source of energy used by a power-generation project that has as its purpose the provision of affordable electricity in certain countries. Such countries are those that are eligible for support either solely from the International Development Association (IDA) or jointly from the IDA and the International Bank for Reconstruction and Development. Further, the corporation (1) may not reject a power-generation project in such a country based on the source of energy used by the project; and (2) must promote a technology- and fuel-neutral energy development strategy for such countries that includes the use of oil, natural gas, coal, hydroelectric, wind, solar, and geothermal power and other sources of energy.

Agriculture Environmental Stewardship Act of 2021 This bill allows energy tax credits through 2023 for investments in (1) qualified biogas property, or (2) qualified manure resource recovery property. Qualified biogas property comprises a system that (1) uses anaerobic digesters or other specified processes to convert biomass into a gas which is at least 52% methane, and (2) captures the gas for use as a fuel. The term includes property that cleans and conditions the gas for use as a fuel. Qualified manure resource recovery property comprises a system that uses specified processes to recover the nutrients nitrogen and phosphorus from a non-treated digestate or animal manure by reducing or separating at least 50% of the nutrients, excluding any reductions during the incineration, storage, composting, or field application of the non-treated digestate or animal manure. The term also includes certain processing equipment. The Department of the Treasury must enter into an agreement with the National Renewable Energy Laboratory for a study of biogas and report to Congress on the study.

Credit Access and Inclusion Act of 2021 This bill allows for the reporting of certain positive consumer-credit information to consumer reporting agencies. Specifically, a person or the Department of Housing and Urban Development may report information related to a consumer's performance in making payments either under a lease agreement for a dwelling or pursuant to a contract for a utility or telecommunications service. However, information about a consumer's usage of any utility or telecommunications service may be reported only to the extent that the information relates to payment by the consumer for such service or other terms of the provision of that service. Furthermore, an energy-utility firm may not report a consumer's outstanding balance as late if the firm and the consumer have entered into a payment plan and the consumer is meeting the obligations of that plan. Specified provisions that establish civil liability with respect to furnishers of information to consumer reporting agencies shall not apply to any violation of the bill. The Government Accountability Office must report on the consumer impact of such reporting.

The bill directs the Department of Commerce to establish the Regional Technology and Innovation Hub Program to encourage collaboration among local, state, and federal government entities, institutions of higher education, the private sector, nonprofit organizations, and others to promote inclusive regional innovation initiatives; designate eligible consortia as hubs and facilitate activities by such consortia in implementing their regional innovation strategies; and develop best practices for regional development and competitiveness in technology and innovation. Additionally, the Department of Energy shall establish the Regional Clean Energy Innovation Program to enhance the economic, environmental, and energy security of the United States; accelerate the pace of innovation of clean energy technologies through regional clean energy innovation partnerships; improve the competitiveness of U.S. clean energy technology research, development, demonstration, and commercial application; and support the development of tools and technologies best suited for use in diverse regions of the United States, including in rural, tribal, and low-income communities.

Department of Defense Climate Resiliency and Readiness Act This bill requires the Department of Defense (DOD) to address climate resiliency and energy and resource efficiency. Each DOD contract for the procurement of property or services entered into on or after October 1, 2021, must include specified information related to energy consumption and energy sources. When deciding whether to enter into a contract, DOD must consider whether the contractor verifiably produces as much renewable energy as the total energy it consumes and whether there is any order against the contractor for a violation of an environmental law or regulation. Among other elements, the bill requires DOD to achieve aggregate net zero energy in use of energy by non-operational sources by December 31, 2031; DOD to give preference to contractors and small businesses that use green manufacturing technology; DOD to administer the Energy and Climate Resiliency Fund established by the bill; DOD and the military departments to consider climate change risks when making strategic decisions related to any military installation; DOD and other relevant federal agencies to incorporate climate change into the National Defense Strategy, the National Military Strategy, and DOD's operational plans; and DOD to conduct a program of research, development, and demonstration of hybrid microgrid systems and electric grid energy storage. The Government Accountability Office must report on the individual and aggregate uses of DOD's authority to give preference to contractors that use green manufacturing technology and small businesses that verifiably use green manufacturing technology or operate with net zero energy.

Hydraulic fracturing or fracking is a process to extract underground resources such as oil or gas from a geologic formation by injecting water, a propping agent (e.g., sand), and chemical additives into a well under enough pressure to fracture the geological formation. Hydraulic fracturing on federal land must comply with the law of the state in which the land is located.

Strategic Competition Act of 2021

Bioeconomy Research and Development Act of 2021 This bill directs the Office of Science and Technology Policy (OSTP) to implement a National Engineering Biology Research and Development Initiative to advance societal well-being, national security, sustainability, and economic productivity and competitiveness. Among other activities, the initiative must include sustained support for research centers, individual investigators, technologies, and training. The initiative shall include outreach to primarily undergraduate and minority-serving institutions about initiative opportunities, and shall encourage the development of research collaborations between research-intensive universities and such institutions. The OSTP shall designate an interagency committee to coordinate initiative activities as appropriate. The interagency committee shall submit triennial reports to Congress through FY2028 in support of the initiative. The National Science Foundation (NSF) shall seek to enter into an agreement with the National Academies of Sciences, Engineering, and Medicine to conduct a review of, and make recommendations with respect to, the ethical, legal, environmental, safety, security, and other appropriate societal issues related to engineering biology research and development. The NSF, National Institute of Standards and Technology, National Oceanic and Atmospheric Administration, Department of Energy, National Aeronautics and Space Administration (NASA), Department of Agriculture, Environmental Protection Agency, and Department of Health and Human Services shall carry out related activities as part of the initiative.

Energy Infrastructure Act This bill addresses energy infrastructure, clean energy supply chains, carbon capture and storage, ecosystem restoration, and western water infrastructure. Specifically, the bill establishes new programs or expands existing programs to support energy infrastructure, including (1) the electric grid (e.g., infrastructure to prevent power outages, enhance grid cybersecurity, and integrate renewable energy); (2) nuclear energy (e.g., infrastructure for micro or small modular reactors); (3) hydropower; (4) solar and other clean energy; (5) clean hydrogen; and (6) energy efficiency in buildings. The bill also establishes programs to support supply chains for clean energy technologies, such as supply chains for rare earth minerals, critical minerals, and batteries for electric vehicles. In addition, the bill provides for the capture, utilization, storage, and transportation of carbon dioxide. It also provides for the restoration of ecosystems, including efforts to reduce methane from orphaned well sites on federal land, clean up waste from abandoned coal mines, and reduce the risk of wildfires. Finally, the bill provides for western water infrastructure, including water storage projects, water recycling and reuse projects, desalination projects, and drought contingency plans.

Green New Deal for Public Schools Act of 2021

Green New Deal for Public Schools Act of 2021 This bill provides environmental and educational resources to public elementary and secondary schools and Bureau of Indian Education (BIE) schools. Specifically, the bill requires the Department of Energy's (DOE's) Office of Energy Efficiency and Renewable Energy to provide climate capital facilities grants to eligible entities (e.g., public schools and BIE schools). Grant recipients must use these funds to construct new, or convert existing facilities into, healthy zero-carbon schools. Healthy zero-carbon school refers to a school with highly energy-efficient facilities that produce or procure sufficient carbon-free and pollution-free renewable energy to meet the school's needs. Next, the bill directs the Department of Education (ED) to award resource block grants to qualified local educational agencies (LEAs) to hire and retain educators and support staff in high-need schools. ED must award grants to eligible consortia of LEAs for educational equity planning and implementation. In addition, ED must establish the Climate Change Resiliency Program to increase the resiliency of public and BIE schools during climate change-related events, natural disasters, and public health crises. Further, ED must establish a related grant program for state educational agencies. Grant recipients must use these funds for certain activities (e.g., green infrastructure projects). The bill establishes the Office of Sustainable Schools within ED to (1) administer the resource block grant and educational equity grant programs, and (2) coordinate with DOE and the White House Office of Domestic Climate Policy on climate capital facilities grants and the Climate Change Resiliency Program.

Green Retrofits Act

Green Retrofits Act This bill reauthorizes a Department of Housing and Urban Development (HUD) water and energy conservation demonstration program through FY2027. Prior to its FY2019 expiration, the program allowed HUD to execute agreements with specified entities to reduce utility costs through improvements at multifamily subsidized housing projects. The reauthorization makes a number of changes to the original program, including increasing the cap on eligible residential units from 20,000 to 35,000 and extending the cap on agreement terms from 12 to 15 years. The bill also creates a green retrofit program that allows HUD to provide grants or loans to owners of multifamily subsidized housing projects. The grants or loans must be used to perform in-home health and green retrofits to the property.

Department of Defense Climate Resiliency and Readiness Act

Department of Defense Climate Resiliency and Readiness Act This bill requires the Department of Defense (DOD) to address climate resiliency and energy and resource efficiency. Each DOD contract for the procurement of property or services entered into on or after October 1, 2021, must include specified information related to energy consumption and energy sources. When deciding whether to enter into a contract, DOD must consider whether the contractor verifiably produces as much renewable energy as the total energy it consumes and whether there is any order against the contractor for a violation of an environmental law or regulation. Among other elements, the bill requires DOD to achieve aggregate net zero energy in use of energy by non-operational sources by December 31, 2031; DOD to give preference to contractors and small businesses that use green manufacturing technology; DOD to administer the Energy and Climate Resiliency Fund established by the bill; DOD and the military departments to consider climate change risks when making strategic decisions related to any military installation; DOD and other relevant federal agencies to incorporate climate change into the National Defense Strategy, the National Military Strategy, and DOD's operational plans; and DOD to conduct a program of research, development, and demonstration of hybrid microgrid systems and electric grid energy storage. The Government Accountability Office must report on the individual and aggregate uses of DOD's authority to give preference to contractors that use green manufacturing technology and small businesses that verifiably use green manufacturing technology or operate with net zero energy.

Twenty-First Century Dams Act

Twenty-First Century Dams Act This bill addresses dam infrastructure and safety. First, the bill provides resources for programs related to state dam safety, the rehabilitation of high hazard potential dams, and the inspection of dams. In particular, the bill reauthorizes through FY2026 the National Dam Safety Program. In addition, the bill reauthorizes through FY2026 a program related to the rehabilitation of structural measures and a program related to water infrastructure. The bill directs the Department of the Army to establish a program to carry out dam removal projects. Further, the bill establishes the Dam Removal Council to (1) coordinate with participating federal agencies to annually notify all known dam owners of the availability of dam removal funding and provide guidance on the existing programs of participating agencies; (2) evaluate and submit to Army recommendations for dam removal projects, technical assistance programs, and funding allocations; and (3) develop a dam removal strategy. The bill requires certain dam assessments, including a joint assessment by the U.S. Geological Survey and the Department of Energy. The bill also authorizes specified federal agencies to undertake certain activities related to federal dam infrastructure.
