National Infrastructure Development Bank Act of 2021 This bill establishes the National Infrastructure Development Bank as a government corporation to finance energy, environmental (e.g., drinking water or waste facilities), telecommunications, and transportation infrastructure projects. The bill establishes the National Infrastructure Development Bank Board, which must oversee the infrastructure projects. The board may make loans and loan guarantees to assist in financing infrastructure projects. Further, the board must establish an executive committee, a risk management committee, an audit committee, and a compliance office. To be eligible for financial assistance from the bank, an infrastructure project (1) must have a public benefit, as determined by the board; and (2) may not have a sole use or purpose that is private. An infrastructure project must use iron, steel, and manufactured products that are made in the United States. The bill also establishes accounting and reporting requirements. In particular, the Government Accountability Office must, within five years of this bill's enactment, submit a report to Congress evaluating the bank's activities.

Carbon Capture Improvement Act of 2021 This bill authorizes the issuance of tax-exempt facility bonds for the financing of qualified carbon dioxide capture facilities. A qualified carbon dioxide capture facility is any equipment installed in an industrial carbon dioxide facility that satisfies specified capture and storage requirements and (1) is used for the capture, treatment and purification, compression, transportation, or on-site storage of carbon dioxide produced by the industrial carbon dioxide facility; or (2) is integral or functionally related and subordinate to a gasification process that converts a product from coal, petroleum residue, biomass, or other materials that are recovered for their energy or feedstock value into a synthesis gas composed primarily of carbon dioxide and hydrogen for direct use or subsequent chemical or physical conversion.

Demand-Response Management Act of 2021 This bill requires electric utilities to promote the use of demand-response practices by commercial, residential, and industrial consumers to reduce electricity consumption during periods of unusually high demand. It also provides a variety of incentives for demand-response technologies and practices.

This bill requires the Department of Energy (DOE) to study the types and commercial applications of codes and standards applied to stationary and mobile energy storage systems as well as those that move between stationary and mobile applications, such as electric vehicle batteries. In addition, DOE must establish a demonstration project for second-life applications of electric vehicle batteries as aggregated energy storage installations to provide services to the electric grid.

Clean Energy Protection Act This bill sets forth provisions to enable the Diablo Canyon nuclear power plant in California to remain in operation. Specifically, it directs California and the Nuclear Regulatory Commission to issue any permits or licenses that are necessary to enable the power plant to remain in operation.

Twenty-First Century Dams Act This bill addresses dam infrastructure and safety. First, the bill provides resources for programs related to state dam safety, the rehabilitation of high hazard potential dams, and the inspection of dams. In particular, the bill reauthorizes through FY2026 the National Dam Safety Program. In addition, the bill reauthorizes through FY2026 a program related to the rehabilitation of structural measures and a program related to water infrastructure. Next, the bill allows a new tax credit for maintaining and enhancing hydroelectric dams that is equal to 30% of the basis of any qualified dam safety, environmental, and grid resilience enhancement property placed in service in a taxable year. It also allows a 30% credit for qualified obsolete river obstruction removal expenditures for demolishing and removing certain nonpowered or hydroelectric dams. The bill directs the Department of the Army to establish a program to carry out dam removal projects. Further, the bill establishes the Dam Removal Council to (1) coordinate with participating federal agencies to annually notify all known dam owners of the availability of dam removal funding and provide guidance on the existing programs of participating agencies; (2) evaluate and submit to Army recommendations for dam removal projects, technical assistance programs, and funding allocations; and (3) develop a dam removal strategy. The bill requires certain dam assessments, including a joint assessment by the U.S. Geological Survey and the Department of Energy. The bill also authorizes specified federal agencies to undertake certain activities related to federal dam infrastructure.

Reducing Exposure to Burn Pits Act This bill requires the Department of Defense (DOD) to provide budget information regarding incinerators and waste-to-energy waste disposal alternatives to burn pits. DOD must include the information as a dedicated budget line item in the President's FY2022 budget.

Department of the Interior, Environment, and Related Agencies Appropriations Act, 2022 This bill provides FY2022 appropriations for the Department of the Interior, the Environmental Protection Agency (EPA), and several related agencies. The bill provides appropriations to Interior for the Bureau of Land Management, the U.S. Fish and Wildlife Service, the National Park Service, the U.S. Geological Survey, the Bureau of Ocean Energy Management, the Bureau of Safety and Environmental Enforcement, the Office of Surface Mining Reclamation and Enforcement, the Bureau of Indian Affairs, the Bureau of Indian Education, the Office of the Special Trustee For American Indians, Departmental Offices, and Department-Wide Programs. The bill also provides appropriations to the EPA and the Forest Service. Within the Department of Health and Human Services, the bill provides appropriations for the Indian Health Service, the National Institute of Environmental Health Sciences, and the Agency for Toxic Substances and Disease Registry. The bill provides appropriations to several related agencies, including the Council on Environmental Quality and Office of Environmental Quality, the Chemical Safety and Hazard Investigation Board, the Office of Navajo and Hopi Indian Relocation, the Institute of American Indian and Alaska Native Culture and Arts Development, the Smithsonian Institution, the National Gallery of Art, the John F. Kennedy Center for the Performing Arts, the Woodrow Wilson International Center for Scholars, the National Endowment for the Arts, the National Endowment for the Humanities, the Commission of Fine Arts, the Advisory Council on Historic Preservation. the National Capital Planning Commission, the U.S. Holocaust Memorial Museum, the Presidio Trust, the World War I Centennial Commission, and the U.S. Semiquincentennial Commission Additionally, the bill sets forth requirements and restrictions for using funds provided by this and other appropriations acts.

Uranium Seawater Extraction Research and Development Act This bill requires the Department of Energy (DOE) to support research and development of technology for the extraction of uranium from seawater. In addition, DOE must conduct demonstrations of such technology in order to further performance enhancement and reduce costs.

Clean Energy Innovation and Deployment Act of 2021 This bill sets forth provisions to reduce greenhouse gas emissions, including by establishing (1) a Clean Energy Deployment Administration within the Department of Energy; (2) a zero-emission electricity standard; and (3) incentives, such as tax credits and grants, to power companies for the accelerated deployment of 80% and 100% zero-emission electricity systems. It also reauthorizes through FY2026 and revises the Weatherization Assistance Program.

American Energy First Act This bill addresses the onshore and offshore production of traditional (e.g., oil and gas) and alternative (e.g., solar and wind) energy resources and establishes requirements for distributing revenues generated from energy production, including revenues to states and territories for conservation efforts. For example, the bill limits the President's authority to (1) withdraw areas of the Outer Continental Shelf (OCS) from oil and gas leasing, and (2) declare new marine national monuments. In addition, the Department of the Interior must obtain congressional approval before declaring a moratorium on issuing leases on federal lands or waters for oil, gas, or coal. Further, the bill requires Interior to defer to state regulations, guidance, and permit requirements for all activities regarding hydraulic fracturing (i.e., fracking) relating to oil, gas, or geothermal production activities on federal land. Interior may delegate decisions about issuing oil and gas drill permits on federal land to states. Interior must also establish certain federal land as geothermal, solar, and wind energy leasing priority areas. The bill also allows Interior to conduct certain lease sales, such as offshore wind lease sales on the OCS in the U.S. Exclusive Economic Zone adjacent to U.S. territories, and establishes requirements for distributing revenues from such leases to the Treasury, the Coral Reef Conservation Fund established by this bill, and U.S. territories.

Electric Vehicle Mobility Area Planning Act or the EV MAP Act This bill requires the Department of Energy to establish a grant program to assist electric utilities and other eligible entities in identifying locations for electric vehicle charging stations to meet the needs of electric vehicle drivers.

Small Refinery Exemption Clarification Act of 2021 This bill states that a small refinery may submit a petition to the Environmental Protection Agency for an exemption from the requirements of the Renewable Fuel Program only if that refinery has received an exemption continuously since 2011. Thus, small refineries may not request extensions of exemptions if previous exemptions are already expired.

Pipeline Seismic Safety Study Act This bill requires the Department of Transportation (DOT) to contract with the National Academy of Sciences for a study evaluating federal requirements for pipeline facilities concerning seismicity, erosion, and other dynamic geological conditions. DOT must consult with the Federal Energy Regulatory Commission on the study.

Abandoned Well Remediation Research and Development Act This bill requires the Department of Energy to establish a research, development, and demonstration program with respect to (1) data collection on the location of abandoned oil or gas wells; (2) the plugging, remediation, reclamation, and repurposing of the wells; and (3) mitigating potential environmental impacts of documented and undocumented abandoned wells.

Energy Poverty Prevention and Accountability Act This bill addresses energy poverty (i.e., insufficient access to affordable energy) in at-risk communities. An at-risk community is a community that is low-income, minority, rural, elderly, or Native American. The Department of the Interior must report on (1) barriers to the ability of at-risk communities that live on or near federal land or tribal land to access reliable and affordable energy, including how the presence of adequate energy transmission infrastructure affects such access; and (2) actions that it and the Forest Service may take to reduce such barriers. In addition, certain executive actions may not be carried out until Interior conducts energy poverty studies for such actions. The Congressional Budget Office must report on how a bill or resolution will affect the cost of energy for at-risk communities. The Government Accountability Office must (1) analyze federal energy and environmental laws and regulations, and state renewable portfolio standards, to determine how such laws, regulations, and standards affected electricity prices, home heating prices, gasoline prices, motor vehicle prices, natural gas prices, and household appliance prices in at-risk communities; and (2) develop criteria to determine whether an at-risk community is experiencing energy poverty. The Office of Management and Budget must review and publish each applicable energy regulation to determine if any regulation imposes, relative to the general population, disproportionate costs on at-risk communities.

Restoring Communities Left Behind Act This bill directs the Department of Housing and Urban Development to establish a grant program for local partnerships to carry out neighborhood revitalization support activities in economically distressed areas. Eligible activities include weatherization and energy efficiency improvements; housing accessibility improvements for seniors and persons with disabilities; purchasing delinquent mortgages; purchasing and developing vacant or distressed properties to create affordable rental housing and for other purposes; and improving parks, sidewalks, and street lighting.

This bill requires the Secretary of Energy to assign energy emergency and energy security functions to an Assistant Secretary, including responsibilities with respect to infrastructure and cybersecurity. The Department of Energy must ensure that such functions are performed in coordination with relevant federal agencies.

As part of the selection criteria for a grant or loan from the program, USDA must consider the potential of a project to reduce greenhouse gas emissions and provide other climate benefits. The bill also prohibits USDA from imposing restrictions on the quantity of energy that is generated under a grant or loan. Further, the bill expands the program by making agricultural producer cooperatives, electric cooperatives, and nongovernmental organizations eligible for financial assistance under the program. The bill also (1) increases from 25% to 50% the portion of a project's cost that may be covered by a grant, and (2) establishes a reserve fund to provide grants and other financial assistance related to underutilized renewable energy technologies. In addition, USDA must study dual-use energy systems (i.e., systems where both renewable energy and agricultural production occur on the same piece of land) and ensure that grant and loan recipients receive outreach, technical assistance, and education concerning such systems.

Clean Energy Future Through Innovation Act of 2021 This bill establishes a variety of incentives and programs to reduce carbon dioxide emissions from the power sector, including incentives and programs to (1) develop low- and zero-carbon power technologies (e.g., technologies to capture, use, and store carbon from coal and natural gas); (2) support certain renewable energy, energy-efficiency, energy storage, and clean electricity technologies; and (3) support nuclear energy.

Appalachian Regional Energy Hub Initiative Act This bill authorizes the Appalachian Regional Commission through FY2026. It also requires the commission to provide technical assistance and grants to individuals or entities in the Appalachian region for projects and activities (1) to conduct research and analysis regarding the impact of an ethane storage hub in the region, (2) with the potential to significantly contribute to the economic resilience of the area where the project is located, and (3) that will help establish a regional energy hub in the region for natural gas and natural gas liquids.

Green Neighborhoods Act of 2021 This bill requires the Department of Housing and Urban Development (HUD) to establish incentives that encourage participants in HUD programs to increase energy efficiency in new and existing housing.

U.S.-Greece Defense and Interparliamentary Partnership Act of 2021 This bill authorizes programs to provide defense-related assistance to Greece and addresses related issues. The bill authorizes providing to Greece from FY2022-FY2026 (1) assistance through the European Recapitalization Incentive Program to help Greece meet its defense needs and transition away from Russian-produced military equipment; and (2) International Military Education and Training assistance for various purposes, including to train future leaders and to establish rapport between the U.S. Armed Forces and Greece's military. The President may expedite the delivery of future purchases of F-35 aircraft by Greece. The bill also establishes a group consisting of Senators and Members of the House of Representatives to meet annually with representatives from Cyprus, Greece, and Israel to discuss various issues such as maritime security, defense cooperation, and energy.

Biofuel Infrastructure and Agricultural Product Market Expansion Act of 2021 This bill directs the Department of Agriculture to establish a grant program for expanding the market for biofuels derived from domestic agricultural products. Entities eligible for the grants include (1) state, local, and tribal governments; (2) authorities, agencies, partnerships, and instrumentalities of such governments; and (3) groups of such entities.

Sustainable Skies Act This bill allows a business-related tax credit through 2031 for each gallon of sustainable aviation fuel used by a taxpayer in the production of a qualified mixture (i.e., a mixture of sustainable aviation fuel and kerosene that is sold for use in certain U.S. aircraft). The bill generally defines sustainable aviation fuel as liquid fuel that consists of synthesized hydrocarbons, meets certain recognized international standards, is derived from biomass, waste streams, renewable energy sources, or gaseous carbon oxides, is not derived from palm fatty acid distillates, and achieves at least a 50% life cycle greenhouse gas emissions reduction in comparison with petroleum-based jet fuel. To be eligible for such credit, a taxpayer must meet certification requirements showing that the sustainable aviation fuel conforms with one of the life cycle greenhouse gas emissions reduction tests set forth in this bill.

Community Wood Facilities Assistance Act of 2021 This bill makes changes to grant programs administered by the Forest Service to promote wood products. Specifically, the bill reauthorizes through FY2026 and modifies a program that supports capital costs for installing community wood energy systems and building innovative wood products facilities, including by increasing the maximum grant amount per facility. The bill also modifies a program that provides grants to develop and expand the market for innovative wood products. Specifically, the bill (1) modifies the grant priorities, and (2) increases the portion of a project's cost that may be covered by such a grant.

Protect American Power Infrastructure Act This bill prohibits certain transactions that involve using bulk-power equipment to provide power for defense critical electric infrastructure in the United States if a foreign adversary owns or exercises influence over the equipment, including transactions that (1) involve equipment designed, developed, manufactured, or supplied by persons owned by, controlled by, or subject to the direction of a foreign adversary; and (2) pose an undue risk of catastrophic effects on the security or resiliency of such infrastructure. However, the Department of Energy may approve transactions if it designs or negotiates measures to mitigate such risks.

504 Modernization and Small Manufacturer Enhancement Act of 2021 This bill modifies the Small Business Administration (SBA) 504 Loan Program, which provides a small business with SBA financing—through a certified development company (CDC) intermediary—for expansion or modernization. Specifically, the bill adds policy goals, at least one of which a CDC must demonstrate to be eligible for assistance. These include (1) enhancing the ability of a small business to reduce costs by using energy efficient products and generating renewable energy, and (2) aiding the revitalization of any area for which a disaster has been declared or determined. The bill also authorizes a CDC to take specified actions to facilitate the closing of a 504 loan, such as correcting borrower or lender information on loan documents or reallocating up to 10% of the cost of a project. For small manufacturers, the bill (1) increases the maximum loan amount from $5.5 million to $6.5 million, (2) reduces the amount that they must contribute to project costs, (3) increases job retention requirements, and (4) revises collateral requirements and debt refinancing considerations. Further, each SBA district office must partner with a resource partner to provide certain training for small manufacturers.

Advancing the Clean Hydrogen Future Act of 2021 This bill requires the Department of Energy (DOE) to establish a research, development, demonstration, and deployment program to improve the efficiency, increase the durability, and reduce the cost of producing hydrogen using electrolyzers. Electrolyzers are systems that produce hydrogen using electrolysis, a process that uses electricity to split water into hydrogen and oxygen. The goal of the program is to reduce the cost of hydrogen produced using electrolyzers to less than $2 per kilogram of hydrogen by 2026. In carrying out the program, DOE must award grants for projects that DOE determines would provide the greatest progress toward achieving the goal. In addition, DOE must fund demonstration projects under the program to (1) demonstrate technologies that produce hydrogen using electrolysis; and (2) validate information on the cost, efficiency, durability, and feasibility of commercial deployment of those technologies.

Cyber Sense Act of 20 20 [ sic ] This bill requires the Department of Energy to establish a voluntary Cyber Sense program to test the cybersecurity of products and technologies intended for use in the bulk-power system. The bulk-power system includes facilities and control systems necessary for operating an interconnected electric energy transmission network, and electric energy from generation facilities needed to maintain transmission system reliability.

Efficient Grid Interconnection Act of 2021 This bill establishes requirements concerning (1) the equitable allocation of costs for electric grid upgrades; and (2) the deployment of grid enhancing technology or equipment that increases the capacity, efficiency, or reliability of a transmission facility or transmission system. Specifically, it directs the Federal Energy Regulatory Commission (FERC) to issue regulations that require public electric utilities to allocate the cost of upgrades to the electric grid, such as upgrades to interconnect renewable generation projects, among all customers that benefit from the upgrades. In determining which parties benefit, FERC must consider all material benefits of the network upgrade, including environmental benefits and those that cannot be directly quantified. In addition, FERC must issue regulations that apply to regional transmission organizations, independent system operators, or transmission planning coordinators when they are processing requests to interconnect generation projects or energy storage projects to the electric grid. The regulations must require such organizations, operators, and coordinators to study deploying technology or equipment that increases the capacity, efficiency, or reliability of a transmission facility or transmission system.

Public Engagement Opportunity on Public Land Exploration Act of 2021 or the PEOPLE Act of 2021 This bill expands requirements related to issuing oil and gas leases on federal land. Specifically, the bill expands requirements related to public notice and comment periods with respect to oil and gas lease sales, including by requiring information about the person or entities submitting bids for leases. The bill also requires the lease sales to be reviewed under the National Environmental Policy Act of 1969. In addition, the Department of the Interior may only issue such leases to exploration and drilling operators if the operators sign post-lease surface use agreements with the surface estate owners. Under the agreements, operators must agree to reclaim the land and provide compensation for any damages resulting from the exploration and drilling operations.

Solar Energy Manufacturing for America Act This bill allows a new tax credit for the production of solar property in the taxpayer's trade or business. The credit is allowed for certain solar components, including photovoltaic cells and wafers, solar grade polysilicon, and a non-integrated solar module able to generate electricity when exposed to sunlight.

Using Sustainable Energy Resources to Fund Equitable e-Transportation Act or the USER FEE Act This bill imposes an additional tax on the use of a specified electric highway vehicle (i.e., any highway motor vehicle, including a plug-in hybrid vehicle, that is propelled to a significant extent by an electric motor drawing electricity from a rechargeable battery that has a capacity of not less than four kilowatt hours). The bill requires the tax revenues generated by this bill to be transferred to the Highway Trust Fund.

Clean Energy Production Parity Act This bill modifies the tax credit for investments in energy property to make qualified fuel cell property (certain fuel cell power plants) that uses an electromechanical process or includes a linear generator assembly eligible for the credit.

Reinvesting In Shoreline Economies and Ecosystems Act of 2021 or the RISEE Act of 2021 This bill increases the percentage of revenue generated from offshore energy projects that is shared with adjacent coastal states. For example, the bill dedicates a percentage of the revenue generated from offshore wind leases for coastal states. Currently, this revenue is deposited in the U.S. Treasury. In addition, the bill increases the amount of revenue generated from offshore oil and gas leases that is shared with states under the Gulf of Mexico Energy Security Act. Coastal states must use the funding from the revenue for specified purposes, such as coastal restoration, conservation, or infrastructure.

Clean Energy for America Act This bill provides for tax incentives for investments in clean electricity, clean transportation, energy efficiency, and the termination of certain provisions relating to oil, gas, and other fossil fuels. Among other provisions, the bill allows new tax credits for investment in clean energy facilities and for the production of electricity from clean energy and clean fuel; allows a new tax credit for expenditures for clean energy property used in connection with a principal residence; allows a new tax credit for sustainable aviation fuel; allows an alternative motor vehicle tax credit for fuel cell motor vehicles, electric vehicles, and for refueling property; allows a tax credit for the production of electricity from clean hydrogen; extends for one year the second generation biofuel producer tax credit and the tax credit for alternative fuels; modifies existing tax credits for energy efficient residential buildings, energy efficient home improvement expenditures, geothermal heat pumps, and the tax deduction for energy efficient commercial buildings; terminates certain provisions relating to oil, gas, and other fossil fuels; requires that at least 15% of the total workforce labor hours be performed by qualified apprentices; requires that projects receiving federal assistance comply with federal prevailing wage requirements; and allows the issuance of tax-exempt private activity bonds for qualified carbon dioxide capture facilities.

Protecting Natural Gas Consumers from Overcharges Act of 2021 This bill provides authority for the Federal Energy Regulatory Commission to establish a refund effective date and order refunds for natural gas rates that are unjust, unreasonable, unduly discriminatory, or preferential.
