Specifically, the bill: (1) requires prescription drug plan sponsors to establish drug management programs for at-risk beneficiaries; (2) requires electronic prescription programs to enable the secure transmittal of prior authorization requests for covered drugs; and (3) establishes individuals who are identified as at-risk beneficiaries for prescription drug abuse as qualifying participants in medication therapy management programs. The bill also requires the Centers for Medicare & Medicaid Services (CMS) to establish a secure online portal to allow: (1) data sharing among the CMS, Medicare prescription drug benefit plans, and Medicare Advantage (MA) plans; and (2) referrals by such plans of substantiated fraud, waste, or abuse in order to initiate or assist investigations by contracted entities under the Medicare Integrity Program. The CMS must also: (1) identify outlier prescribers of opioids under Medicare prescription drug benefit plans and MA plans, based on specialty and geographic area; and (2) annually notify such prescribers of their status and provide them with resources on proper prescribing methods.

Additionally, for plan years beginning on or after January 1, 2021, MA organizations must submit information to the CMS regarding investigations or other actions taken by MA plans against providers that prescribe high volumes of opioids (as determined by the CMS).

Prescription Drug and Medical Device Price Review Board Act of 2018 This bill establishes the Prescription Drug and Medical Device Price Review Board within the Food and Drug Administration. Each manufacturer of a prescription drug or medical device that is sold in the United States must submit to the board: each type of prescription drug and medical device that it sells in the United States, or in a country that is a member of the Organization for Economic Co-operation and Development; the price charged by the manufacturer for the drug or device; and the costs of the manufacturer to produce them. The board must establish a formula for determining whether the average manufacturer price of a prescription drug or medical device over an annual quarter is an excessive price. Manufacturers may not charge excessive prices. Individuals may petition the board to determine whether the price for a prescription drug or medical device is excessive. The board may subject violators to reduced patent terms, civil penalties, and increased Medicaid rebates payable to states. The bill amends the Internal Revenue Code to impose a tax on the sale of prescription drugs or medical devices that have excessive prices. The board must allow individuals to import from approved counties prescription drugs and devices that are comparable to prescription drugs and devices with excessive prices.

CAREER Act

Comprehensive Addiction Recovery through Effective Employment and Reentry Act or the CAREER Act This bill amends the Public Health Service Act to require the Department of Health and Human Services (HHS) to establish a pilot program to award grants to states in order to assist individuals with the transition from substance use disorder treatment programs to independent living and the workforce. Eligible grant activities include outpatient treatment programs, care coordination services, and vocational training. HHS may award five-year grants to up to five states (based in part on specified unemployment and overdose data) and one-year grants to states and Indian tribes (based on criteria determined by HHS). Additionally, the bill amends the Housing and Community Development Act of 1974 to include temporary housing services for individuals transitioning from substance use disorder treatment programs as qualifying activities for which states may use federal funds. The bill also amends the Workforce Innovation and Opportunity Act and the Rehabilitation Act of 1973 to allow states to use federal funds for career and training services for such individuals, including career counseling, employee assistance programs, and educational resources for employers.
