BIOSECURE Act

BIOSECURE Act This bill prohibits entities that receive federal funds from using biotechnology that is from a company associated with a foreign adversary. Specifically, federal agencies and recipients of federal funds (e.g., grantees) may not procure or use any biotechnology equipment or service that is from a biotechnology company of concern and may not contract with any entities that do so. A  biotechnology company of concern is an entity that is under the control of a foreign adversary and that poses a risk to national security based on its research or multiomic data collection (e.g., collection of genomic information). The Office of Management and Budget (OMB) must, in coordination with the Department of Defense (DOD) and other specified agencies, develop a list of prohibited companies; the list must include five particular companies, as specified in the bill. OMB and DOD may approve waivers of these restrictions on an as-needed basis, which are valid for up to one year and may be extended once for an additional 180 days. In addition, the Office of the Director of National Intelligence must report on the national security risks posed by (1) multiomic data collection by foreign adversaries in connection with biotechnology equipment or services, and (2) biotechnology companies that have such data.

Comprehensive Addiction Resources Emergency Act of 2024 This bill establishes programs, grants, and other activities to address substance use disorders. Specifically, the Department of Health and Human Services (HHS) must establish a program for purchasing and distributing opioid overdose reversal drugs for states and Indian tribes. HHS must also award grants for and otherwise support addressing substance use, particularly in states, tribes, territories, and localities with disproportionately high drug overdose rates; increasing access to preventive, medical, recovery, and related services; developing innovative models of delivering treatment and harm reduction services; and expanding the treatment capacity of Medicaid providers. In addition, HHS must issue model standards of care for treatment services and recovery residences and may award grants for training health care professionals. The bill also supports prevention and treatment services for workers, addiction and pain management research, and data collection on substance use disorders. Further, dispensers, distributors, and manufacturers of schedule II controlled substances (e.g., oxycodone), with the exception of opioid treatment programs, must certify that they maintain effective drug diversion controls. Violators are subject to specified civil and criminal penalties. Collected penalties shall be used for the grant programs and other substance use disorder activities established under the bill.

Essential Caregivers Act of 2024

Essential Caregivers Act of 2024 This bill prohibits certain health care facilities from limiting the access of essential caregivers to residents of those facilities, including during designated emergency periods. Essential caregivers are individuals who are designated by facility residents to provide them with daily living assistance or emotional support or companionship.  Specifically, the bill generally prohibits Medicare skilled nursing facilities, Medicaid nursing facilities, Medicaid intermediate care facilities, and associated inpatient rehabilitation facilities from restricting the access of essential caregivers to residents of the facilities, including during emergency periods in which visitation rights are otherwise restricted. During emergency periods, facilities may restrict access for an initial period of up to seven days and for one additional maximum seven-day period (if the additional period is approved by the state health department). Facilities may restrict access for a total of 7 days (or 14 days with the approval of the state health department) during an emergency period. Essential caregivers must agree to comply with any safety protocols set by the facility, which may be no more stringent for caregivers compared to those for staff. Caregivers who fail to comply with these requirements may be denied access, subject to an appeals process.
