Ensuring Lasting Smiles Act This bill requires private health insurance plans to cover the diagnosis and treatment of craniofacial, oral, or maxillofacial congenital anomalies and birth defects. Coverage must include services and items that functionally improve, repair, or restore any body part that is medically necessary for normal bodily functions or appearance, as determined by the treating physician. Coverage limits and cost-sharing requirements for such services and items may not be more restrictive than those applicable to all medical and surgical benefits under the plan.

Mental Health Reform Reauthorization Act of 2022 This bill reauthorizes through FY2027 various activities related to mental health services and resources. Specifically, the bill reauthorizes a policy laboratory housed within the Substance Abuse and Mental Health Services Administration (SAMHSA) that promotes evidence-based practices and service delivery models. Additionally, the bill reauthorizes and modifies grants and similar assistance for treatment and other services for adults with serious mental illnesses and children with serious emotional disturbances, mental and behavioral health programs in the criminal justice system, priority mental health needs of regional and national significance, education and training for mental and behavioral health care providers, and integrated primary care and behavioral health care. The bill also addresses insurance coverage for mental and behavioral health. This includes (1) grants for assessing health insurance plans for compliance with requirements related to parity in the coverage of mental health, (2) applying the parity requirements to self-funded, nonfederal government health plans, and (3) requiring specified agencies to provide states with guidance about coverage recommendations for mental and behavioral health services. Additionally, the Centers for Medicare & Medicaid Services must review claims data to assess the degree to which mental and behavioral health treatment aligns with evidence-based recommendations and standards of care. Other matters addressed by the bill include first episode psychosis activities (interventions to improve symptoms, reduce relapse episodes, and prevent deterioration and disability among individuals suffering from psychotic illness) and improving data collection and reporting of SAMHSA's activities.

Restoring Hope for Mental Health and Well-Being Act of 202 2 This bill reauthorizes through FY2027, expands, and otherwise modifies various programs, grants, and related activities that focus on mental and behavioral health. Specifically, the bill reauthorizes and modifies the Comprehensive Community Mental Health Services for Children with Serious Emotional Disturbances Program, the Community Mental Health Services Block Grant, the Substance Abuse Prevention and Treatment Block Grant, the Pediatric Mental Health Care Access Grant, grants for screening and treating maternal depression and related behavioral disorders, grants related to suicide prevention, and grants to support the behavioral health workforce. Additionally, the bill expands access to opioid and other substance use disorder treatments and recovery support services. For example, the bill (1) eliminates a provision that generally requires individuals to be addicted to opioids for at least a year before being admitted to an opioid treatment program, and (2) promotes access to high-quality recovery housing. Other matters addressed by the bill include activities to coordinate federal efforts related to behavioral health; best practices for a crisis response continuum of care; identification and treatment of eating disorders; prevention and treatment of mental health and substance use disorders for tribal populations; compliance by self-funded, nonfederal insurance plans with federal mental health parity requirements; and integration of behavioral health in primary care settings.

Food and Drug Amendments of 2022 This bill reauthorizes Food and Drug Administration (FDA) user fee programs for certain drugs and devices, establishes requirements to increase diversity in clinical trials, and modifies requirements relating to the overall supply chain for drugs and devices. Specifically, the bill reauthorizes through FY2027 the FDA user fee programs for prescription drugs, medical devices, generic drugs, and biosimilars. The bill also requires the development of action plans and related reporting to increase the diversity of participants in clinical trials. In addition, the bill requires the FDA to inform generic drug applicants, upon request or during review, whether the drug is qualitatively and quantitatively the same as the listed brand-name drug (and if not, the reasons why). The bill also (1) establishes requirements and reauthorizes programs to support the development of specific categories of drugs and devices (e.g., pediatric drugs) and inspections of drug manufacturing facilities; and (2) establishes and revises requirements relating to the approval of drugs and devices, including requirements for postapproval studies and guidance about using real-world evidence to support drug and device applications.

Advancing Student Services In Schools Today Act or the ASSIST Act This bill requires the Department of Health and Human Services to award grants to, among others, local educational agencies to increase the number of mental health and substance use disorder care providers in schools and school-based health centers. It also increases the federal government's share of Medicaid costs for behavioral health services furnished in those settings.

Drug Shortages Shelf Life Extension Act This bill requires the Food and Drug Administration (FDA) to issue or revise guidance to address issues relating to extending drug expiration dates. Specifically, the guidance must address recommendations to drug companies relating to (1) submitting stability testing data in applications for market approval for drugs or biological products; (2) establishing on drug labels the longest feasible expiration date scientifically supported by such data, taking into consideration how extended expiration dates may help prevent or mitigate drug shortages and affect product quality; and (3) using innovative approaches to stability modeling to support initial product expiration dates and expiration date extensions. The FDA must also periodically report to Congress certain information about requests to change the expiration date on a drug label, including the number of such requests from the FDA to the manufacturer and the rationale for each request.

Women's Health Protection Act of 2022 This bill prohibits governmental restrictions on the provision of, and access to, abortion services. Specifically, governments may not limit a provider's ability to prescribe certain drugs, offer abortion services via telemedicine, or immediately provide abortion services when the provider determines a delay risks the patient's health. Furthermore, governments may not require a provider to perform unnecessary medical procedures, provide medically inaccurate information, comply with credentialing or other conditions that do not apply to providers whose services are medically comparable to abortions, or carry out all services connected to an abortion. In addition, governments may not (1) require patients to make medically unnecessary in-person visits before receiving abortion services or disclose their reasons for obtaining such services, or (2) prohibit abortion services before fetal viability or after fetal viability when a provider determines the pregnancy risks the patient's life or health. The bill also prohibits other governmental measures that are similar to the bill's specified restrictions or that otherwise single out and impede access to abortion services, unless a government demonstrates that the measure significantly advances the safety of abortion services or health of patients and cannot be achieved through less restrictive means. The Department of Justice, individuals, or providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations. The bill applies to restrictions imposed both prior and subsequent to the bill's enactment.

Mindless Mask Mandate on Planes Act of 2022 This bill prohibits the Department of Health and Human Services from mandating the wearing of masks, face coverings, or other accessories during domestic air travel. It also retroactively mitigates penalties associated with refusing to comply with such a mandate during the COVID-19 pandemic. Within 30 days of the bill's enactment, federal agencies and private air carriers must remove from their no-fly lists any individual placed on a list solely because of a refusal to comply with a mask mandate. Federal agencies must also refund within 30 days any fines issued to individuals solely based on such a refusal. An individual who does not receive a refund in that time frame may sue for compensatory and punitive damages.

Emerging Signals Modernization Act of 2022 This bill establishes certain requirements relating to the Food and Drug Administration's (FDA's) public notices on the potential new risks of approved medical devices (i.e., emerging signals), including with respect to the standards of evidence needed for such notices. The FDA must update its current guidance on emerging signals to align with the bill's requirements.

Modern Authentication of Pharmaceuticals Act of 2022 This bill requires each dose of a pharmaceutical product that is a controlled substance and that is taken orally in solid form (i.e., pills) to include a physical chemical identifier. The bill applies to products manufactured on or after January 1, 2026.

Preventive Care Awareness Act of 2022 This bill requires activities to promote the use of preventive health care services with a particular focus on decreasing disparities in accessing preventive services for individuals in rural and underserved communities who delayed or forewent recommended preventive services during the COVID-19 pandemic. Specifically, the Department of Health and Human Services (HHS) must carry out a campaign to increase public awareness about and use of recommended preventive services. HHS must also convene a task force to develop recommendations regarding preventive services during and after the COVID-19 pandemic and future pandemics. The recommendations must address, among other considerations, reducing disparities in health outcomes and identifying barriers to implementing the recommendations. Additionally, the bill allows states, Indian tribes, and territories to use a portion of their Preventive Health and Health Services Block Grant funding for FY2023 and FY2024 on activities to increase patient uptake of recommended preventive services.

Protecting Health Care for All Patients Act of 2022 This bill prohibits all federal health care programs, including the Federal Employees Health Benefits Program, and federally-funded state health care programs (e.g., Medicaid) from using prices that are based on quality-adjusted life years (i.e., measures that discount the value of a life based on disability) to determine relevant thresholds for coverage, reimbursements, or incentive programs.

These are legal documents that set out decisions about the type and extent of medical care an individual would accept or refuse in the event the individual is unable to make such decisions.

Overdose Review Team Act This bill provides funding to the Department of Health and Human Services for grants that support drug overdose fatality review teams in states, Indian tribes, territories, and localities. These multidisciplinary teams track fatal and nonfatal drug overdoses that occur in the jurisdiction to identify relevant trends and patterns and recommend policies and practices for preventing and reducing drug overdoses.

Humanitarian Standards for Individuals in U.S. Customs and Border Protection Custody Act This bill imposes requirements and standards related to the care of aliens in U.S. Customs and Border Protection (CBP) custody. CBP must conduct an initial health screening of each individual in custody to identify those with acute conditions and high-risk vulnerabilities and to provide appropriate healthcare. CBP must conduct the screening within 12 hours of each individual's arrival at a CBP facility, and within 6 hours for certain priority individuals such as children and individuals with disabilities. The bill imposes various requirements related to providing such screenings, such as providing interpreters, chaperones, and mental health treatment when necessary. CBP must ensure detainees have access to drinking water, toilets, sanitation facilities, hygiene products, food, and shelter. The bill imposes certain standards relating to such requirements, such as the minimum amount of drinking water for each detainee and the acceptable temperature range of the shelters. The Department of Homeland Security (DHS) must enter into memoranda of understanding with various government agencies to address instances when surge capacity is necessary. The DHS Office of the Inspector General must conduct unannounced inspections of ports of entry, border patrol stations, and detention facilities and report the results to Congress. The Government Accountability Office must assess CBP's management of such facilities, whether CBP and DHS processes are in compliance with this bill's requirements, and the behavior of CBP personnel in carrying out this bill. DHS shall publicly release on its website, on a quarterly basis, aggregate data on complaints of sexual abuse at CBP facilities.

Telehealth Extension and Evaluation Act This bill expands and otherwise modifies coverage of telehealth services under Medicare until two years after the end of the COVID-19 public health emergency. Specifically, the bill (1) allows federally qualified health centers and rural health clinics to serve as the distant site (i.e., the location of the health care practitioner), (2) allows for Medicare payment of certain audio-only services and of outpatient critical access hospital services consisting of telehealth behavioral therapy, (3) conditions payment for certain high-cost laboratory tests and durable medical equipment that are ordered via telehealth on at least one in-person visit during the preceding 12-month period, and (4) allows Schedule II through V controlled substances to be prescribed online if a practitioner has conducted a telehealth evaluation with video. The bill also generally extends any Medicare telehealth flexibilities that were granted during the COVID-19 public health emergency until two years after the emergency ends. The Centers for Medicare & Medicaid Services (CMS) must report on the effects of changes that were made during the emergency period with respect to the provision or availability of telehealth services under Medicare. The CMS must also award grants to state Medicaid programs to allow them to report on similar information.

Reduce and Eliminate Mental Health Outpatient Veteran Copays Act or the REMOVE Copays Act This bill prohibits the Department of Veterans Affairs (VA) from imposing or collecting any co-payment for the first three mental health outpatient care visits in a calendar year for a veteran who is enrolled in the VA health care system.

Health Equity and Accountability Act of 2022 This bill directs the Department of Health and Human Services (HHS) and others to undertake efforts to reduce health disparities. For example, the bill (1) requires more detailed reporting of demographic and health disparities data, including related to public health emergencies; (2) directs certain components of HHS to support health workforce diversity; and (3) increases access to culturally and linguistically appropriate health care. The bill also modifies eligibility and other requirements for Medicare, Medicaid, private health insurance, nutrition assistance, and other programs to reduce health disparities among vulnerable populations. The bill includes specific provisions with respect to noncitizens; maternal, infant, and child health; mental and behavioral health; specified conditions that disproportionately affect racial and ethnic minority groups, such as certain cancers, HIV/AIDS, kidney disease, and diabetes; investments in communities facing health and other inequities; and nondiscrimination in the provision of services in federally supported health programs. Additionally, the bill (1) revises health information technology programs to address health disparities, and (2) supports health impact assessments and other efforts pertaining to environmental justice and social determinants of health (i.e., nonmedical factors that influence health outcomes, such as income and educational attainment). The bill also requires various studies and reports on issues related to health care and health disparities, including a report by the Government Accountability Office on health workforce diversity.

CDC Tribal Public Health Security and Preparedness Act This bill allows tribes and tribal organizations to apply directly to the Centers for Disease Control and Prevention (CDC) for Public Health Emergency Preparedness (PHEP) program funds. Currently, only states and certain local entities may apply for PHEP funds to respond to public health emergencies, such as COVID-19. The CDC must award at least 10 cooperative agreements to tribal applicants. Additionally, the CDC must consult with tribes and tribal organizations to ensure the PHEP program enables these entities to respond to public health emergencies. The CDC may make certain modifications to the program after the consultation.

Health Equity and Middle Eastern and North African Community Inclusion Act of 2022 or the Health Equity and MENA Community Inclusion Act of 2022 This bill adds Middle Easterners and North Africans to the definition of racial and ethnic minority group for purposes of activities carried out by the Office of Minority Health and federally supported health care and public health programs.

Securing the Border for Public Health Act of 2022 This bill authorizes the Department of Health and Human Services (HHS) to restrict migration and imports from foreign countries to prevent the introduction of illicit drugs into the United States. Current law authorizes HHS to restrict migration and imports from foreign countries to prevent the introduction of communicable diseases. Under this bill, HHS may also restrict migration and imports from a country if HHS determines that introduction of certain controlled substances (e.g., opiates, stimulants, or fentanyl-related substances) from that country poses a risk to public health. HHS must consult with the Department of Justice in making the determination.

Protecting Americans from Unnecessary Spread upon Entry from COVID-19 Act of 2022 or the PAUSE Act of 2022 This bill maintains immigration restrictions put in place under public health emergency authorities to prevent the introduction of COVID-19 from foreign countries. Specifically, the bill prohibits the Department of Health and Human Services from rescinding or reducing the stringency of the restrictions. It also prohibits the Department of Homeland Security from stopping or reducing enforcement of the restrictions. These prohibitions remain in effect until (1) federal and state COVID-19 emergency orders are lifted, and (2) the risk of introducing COVID-19 in or from Canada and Mexico is minimal.

Dietary Supplement Listing Act of 2022 This bill imposes various requirements on dietary supplements, including by requiring the person (an individual or entity) responsible for introducing a supplement into interstate commerce to register the supplement with the Food and Drug Administration (FDA). Under this bill, the responsible person must register with the FDA specified information about each dietary supplement to be offered for sale, including (1) a list of all ingredients required by regulation to appear on the label; (2) the conditions of use; (3) any warnings and precautions; (4) certain claims characterizing the relationship between certain nutrients in the supplement and a disease or a health-related condition; (5) the responsible person's contact information; and (6) the locations where the supplement is manufactured, packaged, labeled, or held. For a supplement that is offered for sale on the date that is 18 months after this bill's enactment (the effective date), the responsible person must submit the required information to the FDA no later than 60 days after the effective date. A supplement that is not offered for sale on the effective date may not be offered for sale until the responsible person has submitted the required information. The FDA must establish a system that provides a unique identifier for each registered dietary supplement and a publicly accessible electronic database that allows a user to obtain certain information about a registered supplement.
