Ensuring Access to Lower-Cost Medicines for Seniors Act This bill requires prescription drug plans under the Medicare prescription drug benefit to include generic drugs and biosimilars on their formularies. Specifically, the bill requires plans that use formularies to include generic drugs and biosimilars on the formularies and without any requirements (e.g., prior authorization requirements) that are more restrictive as compared to those for brand-name drugs and biologics. Plans that use cost-sharing tiers must also have specific tiers for generic drugs and biosimilars, in accordance with certain limitations.

Red Hill Health Impact Act This bill requires the Department of Health and Human Services (HHS) to establish a registry and conduct a study of those impacted by the Red Hill Incident of November 20, 2021, in which fuel from a storage facility contaminated the water system of Joint Base Pearl Harbor-Hickam in Hawaii. Specifically, HHS must establish a voluntary registry of those impacted by the incident to collect data on the health effects of the contamination. HHS must also conduct an epidemiological study for at least 20 years to assess the long-term health impacts of the incident, based on an associated feasibility assessment.

Expanding Access to Family Planning Act This bill provides, subject to specified conditions, funding through FY2033 for federally funded family planning services and clinics. In particular, the funds must be used for (1) grants and contracts that support the provision of family planning services, and (2) clinic infrastructure (e.g., construction and renovation of clinics). Clinics that receive funding to provide family planning services must offer each patient with a positive pregnancy test the opportunity for nondirective counseling on (1) prenatal care and delivery; (2) infant care, foster care, and adoption; and (3) pregnancy termination. This counseling must include referrals if requested by a patient. Additionally, if a funding recipient makes subawards for the provision of family planning services, the recipient may not prohibit an entity from participating in a subaward program for reasons other than the entity's inability to provide family planning services.

Increase Support for Life-saving Endocrine Transplantation Act or the ISLET Act This bill removes pancreatic islets that are donated from human cadavers from regulation as a drug or biological product by the Food and Drug Administration (FDA). (Islets are groups of cells, including those that make insulin, in the pancreas, and islet transplantation is an experimental treatment for certain conditions, such as type 1 diabetes.) Current FDA guidance treats pancreatic islets as a biological product, which makes them subject to the biological license application process and related standards for manufacturing practices, safety, identity, purity, and potency. The bill, instead, treats human cadaveric islets as organs, which makes them subject to the regulatory framework that governs the allocation, safety, and efficacy of organ donation and transplantation. That framework, developed by the Health Resources and Services Administration, is carried out by contract through the Organ Procurement and Transplantation Network. (The network is a public-private partnership that links the professionals involved in the U.S. donation and transplantation system.) Specifically, the bill defines human cadaveric islets as organs and excludes them from definitions related to the regulation of drugs and biological products.

Medical Supply Chain Resiliency Act This bill authorizes actions to facilitate trade in medical goods (i.e., medical devices, pharmaceutical goods, or inputs for such devices or goods). Specifically, the bill authorizes the President to (1) negotiate, enter into, and enforce a trusted trade partner agreement with a country or countries with respect to medical goods; and (2) proclaim a modification of any existing duty, a continuance of existing duty-free or excise treatment, or additional duties to carry out the trade agreement. These actions may only be taken if the President determines, based on specified considerations, that the reciprocal elimination of existing duties or other import restrictions with respect to medical goods would contribute to U.S. national security and public health. A trusted trade partner agreement may include certain provisions, such as those to (1) reduce or eliminate duties, quotas, or other trade barriers; (2) diversify and expand supplier networks to secure a reliable supply of medical goods; and (3) harmonize regulatory procedures. Not later than 60 days before initiating negotiations with a trusted trade partner, the President must submit written notice to Congress. The bill requires congressional consultation and review of these trade agreements. A trade agreement shall not take effect if, during the required review period, Congress enacts a joint resolution of disapproval. The Office of the U.S. Trade Representative must monitor compliance by a trusted trade partner with the trade agreement's commitments and obligations. Further, the President may take certain actions in response to a failure to comply.

Consensual Donation and Research Integrity Act of 2023 This bill requires certain entities that acquire human bodies and sell for profit a whole human body or human body part to register with the Department of Health and Human Services. Registered entities must comply with record-keeping, labeling, packaging, and disposition requirements. The registration and related requirements do not apply to the Organ Transplantation Network (a public-private partnership that links the professionals involved in the U.S. donation and transplantation system) or its members; the preparation, transportation, and final disposition of human bodies or body parts by funeral service professionals; and schools of medicine, dentistry, and mortuary science and other research and training entities that do not sell whole human bodies or body parts for profit.

Veterans Exposed to Toxic PFAS Act or the VET PFAS Act This bill provides eligibility for Department of Veterans Affairs (VA) hospital care and medical services to veterans and their family members (including those in utero) who have specified conditions and resided at a military installation where individuals were exposed to perfluoroalkyl and polyfluoroalkyl substances, commonly known as PFAS. PFAS are man-made and may have adverse human health effects. Hospital care and medical services may not be furnished for a condition that is found to have resulted from a cause other than the exposure to PFAS at a military installation. The VA may provide reimbursement for hospital care or medical services provided to a family member only after the family member or provider has exhausted all claims and remedies otherwise available for payment of such care. For disability compensation purposes, the bill establishes a presumption of service-connection for specified conditions in veterans who served at a military installation at which individuals were exposed to PFAS. Under a presumption of service-connection, specific conditions diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded.

Reproductive Health Travel Fund Act of 2023 This bill authorizes a grant program to provide assistance with travel-related expenses for those seeking an abortion. Specifically, the Department of Treasury may award grants to nonprofit or community-based organizations to provide assistance to those seeking abortions with round-trip travel, lodging, meals, and other travel-related expenses. Priority must be given to organizations that serve individuals who are in jurisdictions that have banned or severely restricted abortion access or who travel to another jurisdiction for an abortion, or organizations that have or plan to have programs in place that help individuals access abortion services. In order to qualify for a grant, organizations must assist individuals seeking abortions through unbiased and medically and factually accurate programs, services, or activities. Organizations may not discourage individuals from seeking abortions. Additionally, federal entities that implement the grant program may not participate in any state, tribal, or local antiabortion proceedings (e.g., prosecutions) in connection with grant services.

Protect Lifesaving Anesthesia Care for Veterans Act of 2023 This bill prohibits the Department of Veterans Affairs (VA) from modifying its policy relating to anesthesia care in a manner that would provide any medical professional other than a physician anesthesiologist with full practice authority for the furnishment of anesthesia care to veterans under VA health care laws. The VA is also prohibited from finalizing, implementing, or enforcing the provisions relating to anesthesia care of the proposed rule titled Advanced Practice Registered Nurses (81 Fed. Reg. 33155), or any substantially similar rule.

Specifically, the bill expands Title II and Title VI of the Civil Rights Act of 1964 to prohibit public accommodations and federally funded programs, respectively, from discriminating based on sex, sexual orientation, or gender identity. It also includes stores, transit services, recreational facilities, and establishments that provide health care, accounting, or legal services as public accommodations under Title II. The bill also expands Title IV (desegregation of public schools) and Title VII (employment discrimination) to specifically include sexual orientation and gender identity. (The Supreme Court held in Bostock v. Clayton County that Title VII's prohibition of employment discrimination based on sex also prohibits employment discrimination based on sexual orientation or gender identity.) The bill similarly expands the Fair Housing Act (discrimination in public and private housing) to include sexual orientation and gender identity. It also prohibits discrimination based on sexual orientation or gender identity by creditors and with respect to jury selection. The bill defines sex for purposes of the aforementioned provisions to include sex stereotypes, pregnancy, childbirth, sexual orientation, gender identity, and sex characteristics.

Freedom to Travel for Health Care Act of 2023 This bill prohibits anyone from interfering with a person's ability to access out-of-state reproductive health care. ( Reproductive health care is defined as medical, surgical, counseling, or referral services and care related to pregnancy, including the prevention or termination of a pregnancy, and other reproductive care.) Specifically, the bill prohibits anyone from restricting, discriminating against, or otherwise disadvantaging anyone who receives, provides, or assists with out-of-state reproductive health care that is legal in the state in which it is provided. The bill allows the Department of Justice to bring a civil action and establishes a private right of action for violations. The bill specifically waives any applicable governmental immunity and preempts any contravening state laws.

Protect Patient Access to Pharmacies Act This bill establishes certain requirements with respect to payments to pharmacies by prescription drug plan (PDP) sponsors under the Medicare prescription drug benefit and Medicare Advantage. Specifically, the Centers for Medicare & Medicaid Services (CMS) must ensure that payments sufficiently cover a pharmacy's costs to acquire and dispense covered drugs so as to enable the pharmacy to participate as a network provider. The CMS must (1) use relevant data from pharmacies with respect to acquisition and dispensing costs for covered drugs, (2) establish payment parameters, and (3) establish an appeal process for pharmacies about payments. The CMS must also evaluate the performance measures used by PDP sponsors for pharmacy price concessions or other performance fees and develop standardized performance measures.

Among other provisions, the bill permanently removes geographic restrictions on originating sites (i.e., the location of the beneficiary) and allows the home of the beneficiary to serve as the originating site for all services; permanently allows federally qualified health centers and rural health clinics to serve as the distant site (i.e., the location of the health care practitioner); and allows the Centers for Medicare & Medicaid Services (CMS) to generally waive coverage restrictions during any public health emergency. Additionally, the CMS must post certain information about the effects of Medicare telehealth services on its website, including information about utilization, costs, and the outcome of services. The CMS must also (1) provide resources to health care professionals about the requirements for furnishing telehealth services under Medicare, including with respect to payment, patient privacy, and support for underserved populations; and (2) ensure certain quality measures are applied to telehealth services.

Men's Health Awareness and Improvement Act This bill establishes the Office of Men's Health within the Department of Health and Human Services (HHS) and requires other activities to improve men's health in the United States. The office must support and promote men's health programs and initiatives, including by working with relevant federal agencies (e.g., the Department of Defense and the Department of Veterans Affairs) and consulting with other HHS offices and agencies on activities related to men's health. HHS must issue associated guidance and recommendations on improving men's health outcomes that include short-term and long-term objectives for disease prevention, health promotion, and other areas of concern. The bill also requires studies and reports on men's health topics. The Office of the Assistant Secretary for Health must study men's use of health screenings and services, and the Government Accountability Office must report on the effectiveness of federal outreach related to men's health initiatives.

Maternal Health for Veterans Act This bill requires the Department of Veterans Affairs (VA) to report annually through FY2028 on its activities relating to the coordination of maternity health care. The reports must also include (1) data on the maternal health outcomes of veterans who receive medical care or services from the VA or a non-VA provider that is authorized to provide care or services under VA programs, and (2) VA recommendations to improve the maternal health outcomes of veterans. Lower Drug Costs for Families Act This bill applies certain Medicare prescription drug rebate requirements to prescription drugs that are available under private health insurance. Current law requires drug manufacturers to issue rebates to the Centers for Medicare & Medicaid Services for brand-name drugs without generic equivalents under Medicare that (1) cost $100 or more per year per individual, and (2) for which prices increase faster than inflation. Manufacturers that fail to comply are subject to civil penalties. The bill applies these requirements to prescription drugs that are available in the commercial market under private health insurance. It also indexes rebate calculations to drug prices in 2016 (as opposed to 2021).

Remote Opioid Monitoring Act of 2023 This bill requires the Government Accountability Office (GAO) to report on the use of remote monitoring of individuals who are prescribed opioids, including the efficacy and prevalence of remote monitoring with respect to these individuals. GAO must also recommend ways to improve the availability, access, and coverage of remote monitoring for these individuals.

This bill expands certain reporting requirements about the prevalence of substance use disorders in the Medicaid population to include data about mental health conditions. It also makes these reporting requirements permanent. Specifically, the bill requires the Transformed Medicaid Statistical Information System (T-MSIS) Substance Use Disorder Data Book, which is published by the Department of Health and Human Services (HHS), to include information about the prevalence of mental health conditions and related treatment services among Medicaid beneficiaries. Currently, the book focuses on substance use disorders, particularly opioid use disorders, and related services. The bill also permanently requires HHS to publish this book annually. Current law requires annual publication through 2024.

Comprehensive Addiction Recovery through Effective Employment and Reentry Act of 2023 or the CAREER Act of 2023 This bill reauthorizes through FY2028 the Treatment, Recovery, and Workforce Support Grant Program, which supports the ability of individuals who are in substance-use disorder treatment and recovery to live independently and participate in the workforce. The bill also specifies that the data used to determine which states to prioritize for grants (e.g., overdose mortality rates and unemployment rates) must be based on the five-year period immediately preceding the grant cycle. It also allows grants to be used for transportation services to and from the individual's work, training, or treatment or recovery services.
