Right to Contraception Act This bill sets out statutory protections for an individual's right to access and a health care provider's right to provide contraception and related information. Contraception refers to an action taken to prevent pregnancy, including the use of contraceptives (i.e., a device or medication used to prevent pregnancy), fertility-awareness based methods, and sterilization procedures. Generally, the bill prohibits measures that single out and impede access to contraception and related information. However, a party may defend against a claim that a measure violates the bill's prohibitions by demonstrating, through clear and convincing evidence, that the measure significantly advances the safety of contraception and cannot be achieved through less restrictive means. The bill also specifies that the prohibition preempts inconsistent state and local laws and applies in spite of other federal laws, including the Religious Freedom Restoration Act of 1993. The Department of Justice, individuals, or health care providers may bring a lawsuit to enforce this bill, and states are not immune from suits for violations.

Expanded Food Safety Investigation Act of 2023 This bill provides that the Food and Drug Administration (FDA) may, under specified circumstances, request access to a concentrated animal-feeding operation (i.e., a stabled or confined animal-feeding operation) to conduct microbial sampling. Specifically, the bill allows the FDA to request access if the FDA determines that sampling is necessary to facilitate an investigation of a foodborne-illness outbreak, determine the cause of the outbreak, or address other public health needs. The bill provides that such an operation shall be subject to penalties for refusing such a sampling.

Comprehensive Addiction Recovery through Effective Employment and Reentry Act of 2023 or the CAREER Act of 2023 This bill reauthorizes through FY2028 the Treatment, Recovery, and Workforce Support Grant Program and the Recovery Housing Program. The bill also specifies that the data used to determine which states to prioritize for grants (e.g., overdose mortality rates and unemployment rates) must be based on the five-year period immediately preceding the grant cycle. It also allows grants under the Treatment, Recovery, and Workforce Support Grant Program to be used for transportation services to and from the individual's work, training, or treatment or recovery services. The Treatment, Recovery, and Workforce Support Grant Program supports the ability of individuals who are in substance-use disorder treatment and recovery to live independently and participate in the workforce. The Recovery Housing Program supports the provision of transitional housing for those who are in recovery from a substance-use disorder for up to two years or until the individual finds permanent housing, whichever is earlier.

Patients Before Middlemen Act or the PBM Act This bill prohibits pharmacy benefit managers (PBMs) under the Medicare prescription drug benefit or Medicare Advantage from receiving any income for their services other than bona fide service fees. Specifically, PBMs may not receive any income other than flat, bona fide service fees that are specified in their contracts with prescription drug plan (PDP) sponsors. Such fees may not be based on drug prices, discounts, rebates, or any other remuneration. PBMs must turn over any excess amounts they receive to the Centers for Medicare & Medicaid Services. PDP sponsors and PBMs must annually certify their compliance with these requirements.

Healthy SNAP Act of 2023 This bill amends the Supplemental Nutrition Assistance Program (SNAP) to redefine the foods eligible for purchase with SNAP benefits. SNAP benefits may not be used for soft drinks, candy, ice cream, or prepared desserts, such as cakes, pies, cookies, or similar products. Further, the Department of Agriculture (USDA) must designate by regulation foods and food products to include in the SNAP definition of the term food . USDA must consider food and products that (1) based on nutrition research, contain nutrients lacking in the diets of people in the United States; and (2) promote the health of the population served by SNAP, based on relevant nutrition science, public health concerns, and cultural eating patterns. USDA must also, to the maximum extent practicable, ensure that the fat, sugar, and salt content of the food and food products are appropriate. At least every five years, USDA must review and amend the list. Prepared meals purchased with SNAP benefits must have nutritional values consistent with standards developed by USDA for the list of food and food products. A state agency may substitute different foods for food USDA designated under this bill, with USDA approval, so long as the foods are nutritionally equivalent; this is permitted to allow for different cultural eating patterns.

Foreign Adversary Gain-of-Function Research Prevention Act of 2023 This bill prohibits the use of federal funds by foreign adversaries for gain-of-function research involving pathogens that could cause a pandemic. ( Gain-of-function research is defined as research that enhances the pathogenicity or transmissibility of a pathogen in mammals.) Specifically, the bill prohibits federal funds from being used to support gain-of-function research involving potential pandemic pathogens by China, Russia, Iran, North Korea, or any other designated foreign adversary. Entities that violate the bill's requirements may not receive any funds from the Department of Health and Human Services (HHS) for three years and, for the following three years, may not receive any additional HHS funds unless they agree to give advance notice about how they intend to use the funds.

Substance Use Disorder Treatment and Recovery Loan Repayment Program Reauthorization Act of 2023 This bill reauthorizes through FY2028 the Substance Use Disorder Treatment and Recovery Loan Repayment Program. Under the program, certain health care providers may receive up to $250,000 in repayment assistance for higher education loans if they provide treatment or recovery services for those with substance use disorders. Providers must work full-time for at least six years at an approved facility that is in a locality with a higher-than-average rate of drug overdose deaths or that is in a mental health professional shortage area.

Studying Suboxone Act This bill requires the Department of Health and Human Services (HHS) and the Drug Enforcement Administration (DEA) to reevaluate the scheduling of buprenorphine-naloxone combination products (e.g., suboxone) under the Controlled Substances Act. These products are used to treat opioid addictions and are currently schedule III controlled substances. (A schedule III controlled substance is a drug, substance, or chemical that has less potential for abuse than a schedule I or II substance; that has a currently accepted medical use; and that has low or moderate risk of dependence if abused.) Specifically, the bill requires HHS to review scientific and medical evaluations relating to these products and update its scheduling recommendations accordingly. The DEA must review the recommendations of HHS and make appropriate scheduling changes.

Territories Medicare Prescription Drug Assistance Equality Act of 2023 This bill makes certain income-based subsidies under the Medicare prescription drug benefit available to individuals who reside in Puerto Rico or another U.S. territory and are otherwise eligible. Current law makes such individuals ineligible for premium and cost-sharing subsidies, but establishes a process for U.S. territories to apply for financial assistance with respect to the provision of Medicare prescription drugs. The bill retains a process for U.S. territories to apply for such assistance, but alters the formula by which the amount of assistance is calculated. Specifically, the bill phases in modifications to the formula that more closely align how assistance is calculated for U.S. territories with how it is calculated for the 50 states and the District of Columbia.

Fairness in Medicare Part B Enrollment Act of 2023 This bill exempts an individual from late-enrollment penalties for Medicare medical services if the individual resided in Puerto Rico as of the date of eligibility and the individual enrolls within five years of such date. Currently, the late enrollment penalty is 10% of monthly premiums for each 12-month period during which the individual was not enrolled, and the penalty continues to apply for as long as the individual is enrolled in Medicare medical services.

Naloxone Affordability Act of 2023 This bill requires the Government Accountability Office to study access to and affordability of naloxone (a medication that temporarily reverses opioid overdoses). The study must address matters related to out-of-pocket costs that consumers pay for naloxone and coverage for naloxone as an over-the-counter drug through Medicare, Medicaid, and private health insurance. Historically, naloxone required a prescription and so was typically covered by health insurance. However, the Food and Drug Administration approved Narcan (a naloxone hydrochloride nasal spray) for use without a prescription on March 29, 2023, and health insurance does not generally cover over-the-counter medications.

Halting the Epidemic of Addiction and Loss Act of 2023 or the HEAL Act of 2023 This bill requires the Department of Health and Human Services (HHS) to ensure that references in its grant programs to opioid overdose reversal agents are inclusive of any such agents that have been approved by the Food and Drug Administration (FDA). Specifically, HHS must ensure that regulations, guidance, and other documents for grant programs that include references to opioid overdose reversal agents (e.g., naloxone) encompass any opioid overdose reversal agent that has been approved by the FDA. HHS must also update such references with respect to materials that were previously issued for State Opioid Response Grants, Tribal Opioid Response Grants, and Programs of Regional and National Significance for substance use disorder prevention.

Stop Government Overreach in Ranching Act This bill repeals the guidance that was issued by the Food and Drug Administration (FDA) on June 11, 2021, relating to over-the-counter (OTC) antimicrobial drugs for animals. The guidance provides information for sponsors of medically important antimicrobial new animal drug products who wish to change the status of these drugs from OTC to veterinary prescription, in accordance with the FDA's recommendation that these drugs be administered with veterinary oversight to reduce the possibility of antimicrobial resistance.

Relieving Economic Strain to Enhance American Resilience and Competitiveness in Higher Education and Research Act or the RESEARCHER Act This bill requires executive guidance and policy changes with respect to the compensation and benefits afforded to graduate and postdoctoral researchers. Specifically, the White House's Office of Science and Technology Policy must develop a set of policy guidelines for federal agencies to address the financial instability of graduate and postdoctoral researchers. The guidelines must address certain issues, including stipends that are appropriately indexed to cost-of-living adjustments, health care benefits, and affordable housing and child care. Federal agencies must develop policies that are consistent with such guidelines within six months of the guidelines' issuance. Additionally, the National Science Foundation must (1) provide awards to institutions of higher education or nonprofits to collect data on the financial instability of graduate and postdoctoral researchers, and (2) contract with the National Academies of Sciences, Engineering, and Medicine to report on stipends for graduate and postdoctoral researchers relative to their cost-of-living expenses. The Government Accountability Office must report on the implementation of relevant policy changes.

Helping Emergency Responders Overcome Act or the HERO Act This bill establishes and authorizes behavioral health programs for law enforcement officers, firefighters, emergency medical services personnel, 9-1-1 operators, and other public safety officers. Specifically, the Fire Administration within the Federal Emergency Management Agency must develop resources for educating mental health care providers about treating firefighters and emergency medical services personnel. In addition, the Department of Health and Human Services (HHS) must develop best practices and resources for identifying, preventing, and treating post-traumatic stress disorder and co-occurring disorders in public safety officers. HHS must work with relevant federal departments to incorporate these resources into federal training programs for public safety officers. The bill also authorizes HHS to set up a public safety officer suicide-reporting system and a grant program for peer-support behavioral health and wellness programs within fire departments and emergency medical services agencies.
