Oversight of Medicare Billing Code Cost Act This bill requires the Office of the Inspector General of the Department of Health and Human Services to report on the processes for adding, modifying, and removing billing codes under Medicare. The report must include recommendations for administrative and legislative changes that may improve the transparency and oversight of these processes. In addition, the Centers for Medicare & Medicaid Services must annually publish on its website a list of billing codes that were added under Medicare during the previous year, as well as the associated volume and expenditures for such codes.

ACO Assignment Improvement Act of 2024 This bill establishes additional requirements for assigning Medicare fee-for-service beneficiaries to accountable care organizations (ACOs) under the Medicare shared savings program. Under current law, the program enables ACOs to receive payments for savings stemming from care coordination and management. The bill requires the basis for assignment to reflect beneficiaries' utilization of not only primary care services provided by ACO physicians, but also those provided by other ACO practitioners—specifically, physician assistants, nurse practitioners, and clinical nurse specialists.

This bill establishes the Advisory Committee on Lesbian, Gay, Bisexual, Transgender, and Queer Veterans to consult with the Department of Veterans Affairs regarding the administration of benefits for lesbian, gay, bisexual, transgender, and queer (LGBTQ) veterans, reports and studies pertaining to LGBTQ veterans, and the needs of such veterans with respect to compensation, health care, rehabilitation, outreach, and other benefits and programs.

Personal Needs Allowance Modernization Act or the PNA Modernization Act This bill increases the minimum monthly personal needs allowance under Medicaid for an institutionalized individual and couple from $30 to $60 and from $60 to $120, respectively. (The personal needs allowance is deducted from an individual's total income when determining the individual's contribution to the cost of institutionalized care under Medicaid.)

Medicaid Bump Act This bill increases the Medicaid federal matching rate, also known as the Federal Medical Assistance Percentage (FMAP), for behavioral health expenses that exceed prior levels (i.e., as of March 31, 2019). The Centers for Medicare & Medicaid Services must specify which services are eligible for the increased FMAP. States must use funds to supplement state funding for programs in effect as of April 1, 2021, and to increase the capacity, efficiency, and quality of services.

Telehealth Modernization Act of 2024 This bill modifies requirements relating to coverage of telehealth services under Medicare. Specifically, the bill permanently extends certain flexibilities that were initially authorized during the public health emergency relating to COVID-19. Among other things, the bill allows (1) rural health clinics and federally qualified health centers to serve as the distant site (i.e., the location of the health care practitioner); (2) the home of a beneficiary to serve as the originating site (i.e., the location of the beneficiary) for all services (rather than for only certain services); and (3) all types of practitioners to furnish telehealth services, as determined by the Centers for Medicare & Medicaid Services.

Stopping Addiction and Falls for the Elderly Act or the SAFE Act This bill incorporates risk assessments and prevention services for falls into annual wellness visits and initial preventive physical exams under Medicare, as well as associated services provided by physical therapists and occupational therapists.

Expand the Behavioral Health Workforce Now Act This bill requires the Centers for Medicare & Medicaid Services to issue guidance for states on ways to increase education, training, recruitment, and retention of mental health and substance use disorder providers under Medicaid and the Children's Health Insurance Program (CHIP), particularly in rural and underserved areas.

Community Health Worker Access Act This bill provides for coverage of community health services under Medicare. Community health services are services provided by a community health agency in accordance with an individual needs assessment, including preventive services (e.g., screenings) and services to address social determinants of health (e.g., educational home visits). Community health agencies include nonprofits, federally qualified health centers, and other organizations that employ health workers (in accordance with certain labor standards) who have lived experience in the communities served. The bill also allows state Medicaid programs to cover these services and provides for an increased Medicaid federal matching rate, also known as the Federal Medical Assistance Percentage (FMAP), for these services.

Food Traceability Enhancement Act This bill modifies requirements relating to recordkeeping and traceability of foods that may cause outbreaks of foodborne illnesses. Specifically, the bill reduces the maximum time for which food manufacturers or processors must retain records of high-risk foods (i.e., those that are prone to causing outbreaks of foodborne illnesses) from two years to one year. It also specifies that recordkeeping requirements for high-risk foods may not require restaurants, retail food establishments, or related warehouses to keep or share information about traceability lot codes. The Food and Drug Administration (FDA) must conduct pilot projects with members of the retail food industry to evaluate the effectiveness of investigations of outbreaks of foodborne illnesses without using traceability lot codes, as well as the feasibility of using low-cost food tracing technologies. The bill also specifies that the FDA's rule titled Requirements for Additional Traceability Records for Certain Foods , which was published on November 21, 2022, may not be implemented until two years after the pilot projects are completed (the rule establishes the recordkeeping requirements for manufacturers or processors of high-risk foods, which include keeping and sharing traceability lot codes). The FDA must also report on any barriers that prevent the FDA from sharing information with the retail food industry about investigations into outbreaks of foodborne illnesses.

Stop Unfair Medicaid Recoveries Act This bill prohibits state Medicaid programs from using estate recovery to recoup the costs of benefits. States must withdraw property liens within 90 days of the bill's enactment and notify affected individuals of the withdrawals.

Helping States Integrate Medicare and Medicaid Act This bill requires state Medicaid programs to integrate and coordinate Medicaid and Medicare coverage for individuals who are dually eligible for both, including with respect to enrollment, quality measures, and access to care. The bill provides funds for FY2025 for planning grants and related implementation.

Nurse Overtime and Patient Safety Act of 2024 This bill requires certain providers, as a condition of Medicare participation, to limit mandatory overtime for nurses. Specifically, the bill prohibits hospitals, ambulatory surgical centers, home health agencies, rural health clinics, federally qualified health centers, and other specified providers from requiring nurses to work (1) more than a previously scheduled shift, 48 hours in a workweek, or 12 consecutive hours in a 24-hour period; or (2) during the 10 hours immediately following the 12th hour worked in a shift during a 24-hour period. Qualifying work hours include time spent in training, on call, and on standby. The bill's provisions do not apply during declared emergencies or disasters, subject to specified conditions, and do not preclude voluntary overtime. The bill also establishes (1) certain protections for nurses who file complaints against providers, (2) documentation and notice requirements for providers, and (3) potential civil penalties for violations.

National Public Health Act This bill requires the Department of Health and Human Services (HHS) to take a series of actions relating to the impact of certain products on public health. Specifically, HHS must (1) contract with the National Academy of Medicine, or a similar entity, to develop a list of public health crises; (2) develop a list of products that have a specified fiscal impact on the national public health system; and (3) require manufacturers of such products to develop and implement a plan to mitigate the effects of the products on public health.

Long-term Opportunities for Advancing New Studies for Biomedical Research Act or the LOANS for Biomedical Research Act This bill requires the Department of the Treasury to establish the BioBonds Program to support loans for clinical trials for eligible drugs and medical devices for unmet medical needs. Under the program, fiscal agents purchase loans (up to $25 million per recipient) and issue collateralized bonds that are sold to investors and that are guaranteed by Treasury. An eligible borrower under this program is one conducting (or seeking to conduct) research related to a drug or device that is (1) intended to meet an unmet medical need; and (2) under investigation in certain types of controlled clinical trials, including a trial to investigate the safety and effectiveness of the drug or device. The Government Accountability Office (GAO) and Treasury must report on the program; GAO must also study whether similar programs should be established for other biomedical research projects.
