International Pharmaceutical Transparency Act of 2019 This bill prohibits the sale of a drug if its label fails to list the country of origin of each of the drug's active ingredients.

Encouraging Innovative Benefit Design to Lower Costs for Seniors Act This bill allows prescription drug plan (PDP) sponsors under the Medicare prescription drug benefit to offer additional plans in a region. Specifically, the Centers for Medicare & Medicaid Services (CMS) must update guidance to allow PDP sponsors to offer up to four plans in a region; the CMS may also set a greater limit, as appropriate. PDP sponsors may offer up to two additional plans beyond this limit if the PDP sponsor ensures that, under at least one of the plans, pharmacy benefit managers do not receive any remuneration unless at least 10% of price reductions received from drug manufacturers are reflected at the point-of-sale or otherwise used to reduce beneficiary cost-sharing.

Supporting and Empowering the Nation to Improve Outcomes that Reaffirm Careers, Activities, and Recreation for the Elderly Act or the SENIOR CARE Act This bill expands eligibility for the Medicaid Ticket to Work Program to include individuals who are 65 years of age or older. (Under the current program, states may establish a Medicaid buy-in option for working individuals with disabilities whose income exceeds the customary limits and who are between the ages of 16 and 64.)

Effective Suicide Screening and Assessment in the Emergency Department Act of 2019 This bill establishes a competitive grant program for up to 40 hospitals with emergency departments and certain on-site professionals to help connect patients in emergency departments who are at risk of suicide with treatment and mental health services. Grants may be used to train emergency department providers and establish certain policies and procedures related to the identification, assessment, and treatment of, and care coordination for, individuals who are at risk of suicide. In awarding the grants, the Department of Health and Human Services may give preference to specified types of hospitals, such as critical access hospitals and hospitals in areas with suicide rates higher than the national average.

Safe Drinking Water Assistance Act of 2019 This bill addresses contaminants of emerging concern (emerging contaminants), which are not regulated under a national primary drinking water regulation and may have an adverse effect on human health. The Environmental Protection Agency (EPA) must review federal efforts to (1) identify, monitor, and assist in the development of treatment methods for emerging contaminants; and (2) assist states in responding to the human health risks posed by those contaminants. In addition, the EPA must establish a strategic plan for improving those efforts. The EPA and the Department of Health and Human Services must jointly establish an interagency working group to coordinate federal activities that identify and analyze the public health effects of emerging contaminants. The Office of Science and Technology Policy must establish a National Emerging Contaminant Research Initiative to (1) improve the identification, analysis, monitoring, and treatment methods of emerging contaminants; and (2) support the implementation of its cross-agency plan for addressing research gaps related to detecting, assessing exposure to, and identifying the adverse health effects of such contaminants. Specified federal agencies must make grants for research proposals that are likely to result in significant progress toward achieving the plan's objectives. The EPA must (1) report on actions it may take to increase technical assistance and support for states with respect to emerging contaminants in drinking water samples, and (2) develop a program to provide technical assistance and support to states for the testing and analysis of emerging contaminants.

Safety Net Health Plan Employee Student Loan Forgiveness Fairness Act This bill provides employees of safety net health plans with statutory eligibility for the Public Service Loan Forgiveness Program; safety net health plans are generally Medicaid managed care plans sponsored by a nonprofit organization as opposed to a commercial health plan.

Permanent Relief for Seniors and Medicare, Medicaid, Human Services Extension Act of 2019 This bill modifies several health care taxes (e.g., repeals the medical device excise tax) and temporarily extends several Medicare, Medicaid, and public health programs (e.g., outreach and enrollment programs). The bill also renames the Temporary Assistance for Needy Families program as the Jobs and Opportunity with Benefits and Services program, reauthorizes the program through FY2024, and makes changes relating to work requirements for beneficiaries.

Patient Shared Savings Act This bill allows a prescription drug plan (PDP) sponsor under the Medicare prescription drug benefit to share realized savings from an enrollee's switch to a lower-cost therapeutic alternative with the enrollee, in accordance with specified requirements. Among other requirements, the enrollee must have been taking the original prescription drug for at least two months and must have consulted with a physician before making the switch. PDP sponsors must share the savings in a tangible form that directly benefits the enrollee (e.g., a monetary rebate).

Lower Costs, More Cures Act of 2019 This bill establishes and modifies several requirements to address prescription drug prices under Medicare, Medicaid, and other programs. The bill generally limits payment amounts for drugs and biologics under Medicare medical services, reduces cost-sharing under the Medicare prescription drug benefit, modifies certain authorities and requirements under the Medicaid Drug Rebate Program, revises provisions relating to regulatory approval and commercial availability of generics and biosimilars, and establishes several reporting requirements for drug manufacturers with respect to drug prices.

Innovation Network and Capital Act of 2019 This bill establishes and provides funds through FY2025 for a grant program in the National Institutes of Health (NIH) to expand the commercialization of biomedical products. NIH shall award grants or contracts to entities that have received funding from either the Small Business Innovation Research Program or the Small Business Technology Transfer Program of NIH. Awardees must use the funds to support participation in specified NIH programs and activities related to the commercialization stage of research, later stage research and development, technology transfer, and commercialization technical assistance.

Disaster Assistance Equity Act of 201 9 This bill makes common interest communities, such as housing cooperatives (co-ops) and condominiums, eligible for the same assistance from the Federal Emergency Management Agency (FEMA) as other homeowners. Specifically, the bill adds definitions of residential common interest community, condominium, and housing cooperative to the Robert T. Stafford Disaster Relief and Emergency Assistance Act; requires FEMA to issue rules for the removal of debris or wreckage from real estate owned by a residential common interest community resulting from a major disaster and deems such removal to be in the public interest when a state or local government determines in writing that such debris or wreckage constitutes a threat to life, public health or safety, or the economic recovery of such community; and provides for the repair of essential common elements of a condominium or co-op damaged by a disaster under FEMA's Federal Assistance to Individuals and Households Program.

Ensuring Patient Access to Critical Breakthrough Products Act of 2019 This bill provides for Medicare coverage of medical devices that are approved under the Food and Drug Administration (FDA) Breakthrough Devices Program. (Under the program, manufacturers work with the FDA to expedite the review and approval of certain medical devices that provide for more effective treatment or diagnosis of life-threatening or irreversibly debilitating human diseases or conditions.) The bill allows designated medical breakthrough devices to be temporarily covered under Medicare during a three-year transitional period. The Centers for Medicare & Medicaid Services (CMS) must assign payment codes for such devices within three months of FDA approval. The CMS must also establish a process to allow for continued coverage after the transitional period has expired, taking into account any additional evidence or data the CMS deems necessary. The CMS must also provide for temporary and, where appropriate, permanent Medicare coverage of breakthrough devices for which there is no existing benefit category (i.e., classification).

Fairness in Nursing Home Arbitration Act This bill prohibits, and nullifies any existing, pre-dispute arbitration agreements with respect to Medicare skilled nursing facilities or Medicaid nursing facilities, home- and community-based services, or home health care services.

Public Health Infrastructure Modernization Act of 2019 This bill requires the Centers for Disease Control and Prevention to (1) update its public health data systems; and (2) provide grants to state and local public health agencies to increase collaboration and information sharing in support of disease and health condition detection and public health emergency preparedness, among other objectives.

Ensuring Seniors' Access to Quality Care Act This bill repeals certain restrictions under Medicare and Medicaid that prohibit the approval of nurse-aide training and competency evaluation programs in skilled nursing facilities that have been subject to specified regulatory actions (e.g., civil penalties) for substandard quality of care. The Centers for Medicare & Medicaid Services (CMS) must still disapprove such programs for up to two years; however, the CMS must rescind the disapproval upon completion of corrective action and may require additional oversight of the program for purposes of rescission. The bill also allows Medicaid and Medicare providers (e.g., skilled nursing facilities) to access, through the National Practitioner Data Bank, disciplinary information for affiliated physicians and other health care practitioners, as reported by state licensing authorities.

Social Determinants Accelerator Act of 2019 This bill establishes the Social Determinants Accelerator Interagency Council and provides funds for the council to (1) assist the Department of Health and Human Services (HHS) in awarding specified grants, (2) increase coordination among health and social service programs, and (3) provide program evaluation guidance and technical assistance to increase the impact of social service programs. Specifically, the bill provides funds for HHS to award up to 25 grants to state, local, or tribal health or human services agencies for the development of social determinants accelerator plans that address at least one health and one social outcome for a specified target population.

PBM Transparency in Prescription Drug Costs Act This bill requires group health plans or the pharmacy benefits manager (PBM) for the plans to periodically report certain prescription drug pricing and utilization data; it also requires PBMs to pass on to health plans all rebates and discounts received from drug manufacturers.

National Institute for Research on Safety and Quality Act This bill establishes the National Institute for Research on Safety and Quality within the National Institutes of Health and transfers the authorities, duties, obligations, and related legal and administrative functions of the Agency for Healthcare Research and Quality to that institute. In addition, the new institute must promote health care quality improvement and conduct research and demonstration projects focused on (1) the delivery of health care in inner cities and rural and frontier areas, and (2) health care for priority populations such as low-income groups and the elderly.

Cosmetic Safety Enhancement Act of 2019 This bill authorizes the Food and Drug Administration (FDA) to take various actions with respect to the regulation of cosmetics, such as collecting fees from manufacturers and distributors to fund cosmetics safety activities. The bill also authorizes the FDA to suspend the distribution of products that have a reasonable probability of causing serious adverse health consequences.

Fair Indexing for Health Care Affordability Act This bill revises the method for determining the annual per capita change in health insurance premiums for the purpose of determining the premium adjustment percentage that is used to establish the annual limits on cost sharing for health insurance plans.

Drug Price Transparency in Medicaid Act of 2019 This bill requires pass-through pricing models, and prohibits spread-pricing, for payment arrangements with pharmacy benefit managers under Medicaid. The bill also extends funding for retail pharmacy surveys and requires additional information with respect to price concessions, dispensing fees, and survey participation to be made publicly available.

This resolution acknowledges the maternal health crisis disproportionately affecting American Indian, Alaska Native, and Native Hawaiian women that has led to high rates of maternal mortality and morbidity. The resolution calls for urgent funding increases for the Indian Health Service, Tribally Operated Health Centers, Urban Indian Organizations, and Native Hawaiian health care programs to improve access to high-quality maternal health, prenatal care, and family planning services. Additionally, the resolution recognizes the federal government's failure to uphold tribal treaty rights pertaining to the provision of adequate health care services to American Indians and Alaska Natives. Finally, the resolution calls for the prioritization of policy for American Indian, Alaska Native, and Native Hawaiian women to reduce long-standing barriers to maternal health and family planning services.

Medicare Orthotics and Prosthetics Patient-Centered Care Act This bill revises payment rules and establishes several requirements relating to coverage of orthotics and prosthetics under Medicare. Specifically, the bill requires suppliers of orthotics and prosthetics to meet certain standards with respect to licensure and accreditation, physical facilities, and liability insurance. Orthotists and prosthetists may also issue written orders for commercial purposes that meet specified standards; such orders must be signed by the treating physician. The bill also prohibits payment under Medicare for certain prosthetics and orthotics that are delivered via drop shipment (i.e., direct shipment to a beneficiary who has not received corresponding patient care from a health care practitioner).

Telehealth Expansion Act of 2019 This bill requires the Federal Communications Commission to establish the Expanding Telehealth Program. The purposes of the program are to (1) support connected care services for low-income and rural individuals and veterans through telehealth services; (2) defray the costs of internet services to health care providers to provide connected care for such patients; (3) promote innovative telehealth services technologies through direct connection between health care providers and patients; and (4) gather data on telehealth services and how to improve the efficiency or effectiveness of the program.

Diabetic Vision Loss and Blindness Prevention Act of 2019 This bill provides for Medicare coverage of digital retinal imaging with remote interpretation, which is used to detect or assess a certain diabetic eye condition. The Centers for Medicare & Medicaid Services must ensure that beneficiaries who receive such services are also given information about available diabetes self-management training and that such training includes information about the importance of annual eye exams.

Veterans Burn Pits Exposure Recognition Act of 2019 This bill establishes a presumption, for purposes of Department of Veterans Affairs (VA) health care benefits and wartime disability compensation, that a veteran was exposed to certain toxins, chemicals, and hazards from burn pits if such veteran served on active duty in a covered location during a specified time frame. A burn pit is an area used for burning solid waste in open air. Specifically, the bill identifies the following covered locations and corresponding time periods Iraq, between August 2, 1990, and February 28, 1991, as well as from March 19, 2003, until burn pits are no longer used in this location; Southwest Asia (including Kuwait, Saudi Arabia, Bahrain, Oman, Qatar, and the United Arab Emirates), from August 2, 1990, until burn pits are no longer used in these locations; Afghanistan and Djibouti from September 11, 2001, until burn pits are no longer used in these locations; and other locations and time periods set forth by the Airborne Hazards and Open Burn Pit Registry or determined by the VA. Under the bill, if an exposed veteran submits insufficient evidence to establish a service-connection for purposes of disability compensation, the VA shall provide a medical examination and request medical opinions regarding a causal link between the disability and a toxin, chemical, or hazard.

NIMHD Research Endowment Revitalization Act of 2019 This bill expands research endowments available through the National Institute on Minority Health and Health Disparities to include former centers of excellence at certain historically black colleges and universities and at biomedical and behavioral research institutions with a significant number of minority students.

Researching and Ending Disparities by Understanding and Creating Equity Act of 2019 or the REDUCE Act of 2019 This bill requires the Centers for Disease Control and Prevention to implement a Health in All Policies demonstration project. States, territories, tribes, and certain local government entities may apply for grants through the project to establish or enhance collaborative approaches to improve the health of individuals and communities. The grant funds must be used to (1) integrate health considerations in policymaking across sectors; (2) address health, equity, and sustainability; and (3) target a significant proportion of Medicare beneficiaries, Medicare-Medicaid dual eligibles, or long-term care Medicaid recipients. The bill also directs the National Academies of Sciences, Engineering, and Medicine or another appropriate entity to produce a report on eliminating health disparities to improve health equity.

Opioid Settlement Accountability Act This bill establishes certain requirements with respect to the disposition of funds received by states from litigation against opioid manufacturers and distributors. Specifically, the bill requires states to use such funds to address opioid use, such as through (1) opioid prevention and treatment services, (2) health care practitioner training, (3) first responder equipment, and (4) social support services. Additionally, the bill prohibits the Centers for Medicare & Medicaid Services from considering such funds that are recovered or paid to a state on or after December 31, 2023, as an overpayment that reduces the state's payment, or that is subject to recoupment, under Medicaid. The bill applies retroactively.

Prescription Drug Price Reporting Act This bill requires that all prescription drug manufacturers submit certain information for every drug marketed in the United States to the Department of Health and Human Services (HHS). Specifically, manufacturers must provide information about cost, pricing, and rebates. Manufacturers are also required to submit any price changes to a prescription drug at least 30 days in advance. HHS must make this information available through a public database that enables consumers to subscribe to price change notifications for different types of prescriptions drugs.

Elijah E. Cummings Family Asthma Act This bill requires the Centers for Disease Control and Prevention (CDC) to collaborate with state and local health departments to (1) conduct activities regarding asthma, including deterring the harmful consequences of uncontrolled asthma, and disseminating health education and information regarding prevention of asthma episodes and strategies for managing asthma; and (2) develop state plans incorporating public health responses to reduce the burden of asthma, particularly regarding disproportionately affected populations. Additionally, the bill revises and expands requirements for asthma surveillance activities and requires the CDC to coordinate data collection activities to maximize the comparability of results. Further, the Department of Health and Human Services must submit an assessment of current activities related to asthma prevention, management, and surveillance that includes recommendations for the future direction of asthma activities.

Increasing Health Coverage through HRAs Act This bill provides statutory authority for the Department of the Treasury, the Department of Labor, and the Department of Health and Human Services rule dated June 20, 2019, which provides for the integration of health reimbursement arrangements and other account-based health plans with individual health insurance coverage or Medicare.

Accountable Care in Rural America Act This bill requires the Centers for Medicare & Medicaid Services (CMS) to exclude certain components from a methodology used under the Medicare Shared Savings Program. The program enables accountable care organizations (ACOs) to receive payments for savings stemming from care coordination and management. Specifically, the bill requires the CMS to exclude an ACO's assigned Medicare fee-for-service beneficiaries from certain regional adjustments to the ACO's benchmark for savings determinations, and to otherwise ensure that an ACO is not in a less favorable financial position due to its share of assigned beneficiaries in the region.

Expanded Food Safety Investigation Act of 2019 This bill provides that the Food and Drug Administration (FDA) may, under specified circumstances, request access to a concentrated animal-feeding operation (i.e., a stabled or confined animal-feeding operation) to conduct microbial sampling. Specifically, the bill allows the FDA to request access if the FDA determines that sampling is necessary to facilitate an investigation of a foodborne-illness outbreak, determine the cause of the outbreak, or address other public health needs. The bill provides that such an operation shall be subject to penalties for refusing such a sampling.

Puppies Assisting Wounded Servicemembers Act of 2019 or the PAWS Act of 2019 This bill requires the Department of Veterans Affairs (VA) to implement a grant program for the purpose of pairing service dogs with eligible veterans. Organizations that receive grants shall provide veterinary health insurance coverage, hardware, and travel expenses for each service dog and veteran participating in the program. Eligible veterans are those who (1) are enrolled in the VA health care system, (2) have been evaluated and treated for post-traumatic stress disorder (PTSD) but remain diagnosed with PTSD, (3) may benefit from a service dog, and (4) agree to successfully complete training provided by an eligible organization. Veterans are required to see a VA health care provider at least once every 180 days to determine whether the veteran continues to benefit from a service dog. Eligible organizations are nonprofit organizations that provide service dogs to veterans with PTSD, meet publicly available standards set forth by the Association of Service Dog Providers for Military Veterans, have expertise in the needs of veterans with PTSD, agree to cover all costs in excess of the grant amount to guarantee the benefits of the program, agree to reaccept or replace a service dog provided to a veteran, and submit an application to the VA. Any improvement in PTSD symptoms as a result of the provision of a service dog shall not affect the veteran's eligibility for any other VA benefits. The Government Accountability Office must report on the grant program.
