COVID-19 in Immigration Detention Data Transparency Act This bill requires U.S. Immigration and Customs Enforcement (ICE), U.S. Customs and Border Protection (CBP), and the Office of Refugee Resettlement (ORR) to collect and report various information about detained individuals, including data on COVID-19 (i.e., coronavirus disease 2019) testing. During the COVID-related declared public health emergency and for one year after, ICE, CBP, and ORR shall publicly post on a website certain data about its detention facilities, including COVID-19 testing numbers for detained individuals and detention facility staff, COVID-19 case outcomes, and COVID-related information about detained individuals who were released or removed from the United States. The Centers for Disease Control and Prevention (CDC) shall issue guidance as to the COVID-related data that ICE, CBP, and ORR must collect and report weekly to the CDC. The CDC shall periodically report to Congress a summary of this data and an analysis of the trends and pattern of the spread of the disease. ICE, CPB, and ORR shall also ensure that each detained individual receives all medical records related to any COVID-19 test administered to the individual. ICE, CPB, and ORR shall also report to Congress on (1) the COVID-19 safety protocols in their facilities, and (2) their efforts to ensure that each detained individual has access to legal counsel. This bill's data collection and reporting requirements that apply to ICE, CPB, and ORR shall also apply to any contract facilities that they use to hold detained individuals.

Protection of Born-Alive Abortion Survivors Act This bill establishes requirements for the degree of care a health care practitioner must exercise in the event a child is born alive following an abortion or attempted abortion. A health care practitioner who is present must exercise the same degree of care as reasonably provided to another child born alive at the same gestational age. The bill also requires a health care practitioner or other employee to immediately report any failure to comply with this requirement to law enforcement. A person who violates the requirements is subject to criminal penalties—a fine, up to five years in prison, or both. Additionally, an individual who intentionally kills or attempts to kill a child born alive is subject to prosecution for murder. The bill bars the criminal prosecution of a mother of a child born alive for conspiracy to violate these provisions, for being an accessory after the fact, or for concealment of a felony. A woman who undergoes an abortion or attempted abortion may file a civil action for damages against an individual who violates this bill.

The PASTEUR Act

The Pioneering Antimicrobial Subscriptions To End Up surging Resistance Act of 2020 or The PASTEUR Act This bill authorizes the Department of Health and Human Services (HHS) to enter into subscription contracts for critical-need antimicrobial drugs, provides $11 billion in appropriations for activities under the bill, and contains other related provisions. A manufacturer of a Food and Drug Administration-approved antimicrobial drug may apply to HHS to have the drug designated as a critical-need antimicrobial, and HHS may enter into a subscription contract for such a critical-need antimicrobial. The bill imposes certain requirements related to such contracts, including a mechanism to lower payments under the contract in certain instances to limit the manufacturer's revenue from the drug. Furthermore, HHS and the Centers for Disease Control and Prevention shall award grants to support efforts to encourage the appropriate use of antimicrobial drugs and efforts to combat antimicrobial resistance. HHS shall also establish a Committee on Critical Need Antimicrobials. The committee shall develop a list of prioritized infections for which new antimicrobial drug development is needed, among other duties. Within six years of the bill's enactment, the Government Accountability Office shall report to Congress a study on the bill's effectiveness in developing priority antimicrobial drugs.

Further Continuing Appropriations Act, 2021, and Other Extensions Act This bill provides continuing FY2021 appropriations to federal agencies through December 18, 2020, and extends several expiring health programs. It is known as a continuing resolution (CR) and prevents a government shutdown that would otherwise occur if the FY2021 appropriations bills have not been enacted when the existing CR expires on December 11, 2020. The bill includes provisions that extend several public health, Medicare, Medicaid, and Food and Drug Administration authorities and programs; require the Centers for Medicare & Medicaid Services to share Medicare Advantage and Medicare prescription drug benefit enrollment information with liability insurers in response to Medicare secondary payer inquiries; and require the Drug Enforcement Administration to revise regulations so as to allow a practitioner to dispense up to a three-day supply of narcotic drugs to one person or for one person's use at one time for the purpose of initiating maintenance treatment or detoxification treatment, or both.

SAFE TO WORK Act

Safeguarding America's Frontline Employees To Offer Work Opportunities Required to Kickstart the Economy Act or the SAFE TO WORK Act This bill limits liability for injuries related to COVID-19 (i.e., coronavirus disease 2019). Generally, an individual alleging harm from exposure to coronavirus or related medical treatment occurring before October 1, 2024, may sue only under the causes of action created by this bill, with limited exceptions. However, the bill does not preempt any law that imposes stricter limits on liability or otherwise provides greater protections to defendants. An individual or entity engaged in business or other activities may be liable for injuries resulting from coronavirus exposure only if the plaintiff proves by clear and convincing evidence that (1) the defendant did not make reasonable efforts to comply with government standards and guidance, (2) the defendant's actions constitute gross negligence or willful misconduct, and (3) actual exposure caused the plaintiff's injury. (The clear and convincing evidence standard is a higher standard of proof than is typically required in a civil action.) Similarly, a health care provider may be liable for injuries connected to coronavirus-related services only if the plaintiff proves by clear and convincing evidence that (1) the provider's actions constituted gross negligence or willful misconduct, and (2) such actions directly caused the injury. The bill also contains various coronavirus-related protections for defendants, including protections that (1) exempt an employer or operator of public accommodations that meets certain requirements from liability under certain federal laws, (2) impose limitations on coronavirus-related class action lawsuits, and (3) limit liability for certain injuries related to workplace coronavirus testing.

COVID-19 Data Accuracy Act This bill directs the Government Accountability Office (GAO) to initiate an inquiry within seven days and report on the impact of certain changes to hospital reporting requirements for COVID-19 (i.e., coronavirus disease 2019) on data quality, transparency, and access. The White House's Coronavirus Task Force revised the process for hospitals to report COVID-19 data on July 13, 2020; previously, hospitals reported data to the Centers for Disease Control and Prevention (CDC) instead of to the Department of Health and Human Services (HHS). To facilitate the inquiry, HHS must provide the GAO with direct access to relevant information systems. The GAO must present its findings within 45 days, and HHS must then respond to the findings and rectify any issues identified within 7 days. HHS must also, in coordination with the CDC, develop a process within 30 days to correct inaccuracies in the COVID-19 data. In addition, the GAO must issue reports that address, for example, the impact of the changes to reporting requirements on federal and nonfederal entities, such as hospitals, states, and other jurisdictions, and information about how the decision to change those requirements was made.

Hospitality and Commerce Job Recovery Act of 2020 This bill establishes new tax credits and revises existing credits and deductions to protect the hospitality and restaurant industries. Specifically, the bill allows a convention and trade show restart tax credit for (1) the costs of participation in a convention, seminar, or similar meeting, a business meeting, or a trade show that takes place after 2020; and (2) the costs of reopening an entertainment facility closed due to the COVID-19 (i.e., coronavirus disease 2019) pandemic. It also allows a business-related tax credit for the costs of reopening restaurants or food service businesses forced to close down or reduce operations due to COVID-19. The bill modifies, and increases the rate of, the tax credit for the retention of employees for an employer whose business has been affected by a disaster or public health emergency. It also repeals the increased limitations on the tax deduction for meals and entertainment expenses enacted in 2017. Finally, the bill allows individual taxpayers a new tax credit for travel expenses relating to entertainment activities occurring in the United States between January 1, 2021, and December 31, 2023.

End Transfers of Detained Immigrants Act This bill imposes requirements related to individuals in U.S. Immigration and Customs Enforcement (ICE) custody during the COVID-19 (i.e., coronavirus disease 2019) public health emergency declared by the Department of Health and Human Services. ICE may not transfer an individual between ICE facilities until the COVID-19 transmission rate in the United States meets or drops below a certain threshold. In addition, ICE may not apprehend or transfer an individual between an ICE detention facility and a facility operated by an outside entity, such as a state or local prison, unless the individual is tested for COVID-19 and placed in quarantine (1) for 14 consecutive days, or (2) until the test comes back negative. These two requirements shall not prohibit the transfer of (1) an individual solely to process that individual's release from custody, or (2) a minor from ICE custody to the custody of the Office of Refugee Resettlement. If ICE cannot ensure compliance with Centers for Disease Control and Prevention guidelines for mitigating the spread of COVID-19 (including maintaining social distancing requirements at all times) in any ICE facility, ICE shall (1) immediately review the custody of all detained individuals in that facility, and (2) release individuals found eligible for release.
