Access to Rare Indications Act of 2021 This bill provides for coverage under the Medicare prescription drug benefit, Medicaid, and private health insurance of certain drugs that are used to treat rare diseases or conditions (i.e., diseases or conditions that affect 200,000 or fewer individuals). Such drugs must be supported by peer-reviewed research or medical experts and must not have been reviewed unfavorably in specified compendia or used in a way that conflicts with approved labels.

Supporting Health Care Providers During the COVID-19 Pandemic Act This bill makes several budgetary and technical changes in relation to Medicare. Specifically, the bill continues to exempt Medicare from sequestration until March 31, 2022. (Sequestration is a process of automatic, usually across-the-board spending reductions under which budgetary resources are permanently cancelled to enforce specific budget policy goals.) The bill also temporarily extends other provisions under Medicare, including a payment increase under the physician fee schedule.

Improving Care for Vulnerable Older Citizens and People with Disabilities through Workforce Advancement Act of 2021 This bill establishes demonstration projects to improve care and service delivery through the use of direct care workers (e.g., nursing assistants and home health aides) for older adults and individuals with disabilities who have chronic illness or are at risk of institutional placement. The Health Resources and Services Administration (HRSA) must award grants to partnerships of health care providers, long-term care facilities, and other organizations to carry out the projects. Specifically, HRSA must award grants for incorporating direct care workers into interdisciplinary care coordination teams to support transitions in care and prevent unnecessary hospital readmissions. HRSA must also award grants for (1) using the abilities of direct care workers to manage and improve the health of individuals with multiple chronic conditions and long-term care needs; or (2) training direct care workers to take on greater responsibilities in managing specific diseases, such as Alzheimer's disease and diabetes.

Critical Infrastructure Manufacturing Feasibility Act This bill requires the Department of Commerce to study and report on products that are in high demand across the critical infrastructure sectors. Critical infrastructure sectors are those whose assets, systems, and networks are vital to national security, the economy, public health or safety, or any combination of those matters. The study must (1) identify the products in high demand across those sectors that are being imported due to manufacturing, material, or supply chain constraints; and (2) analyze the costs, benefits, and feasibility of manufacturing those products in the United States.

CBD Product Safety and Standardization Act of 2021 This bill requires the Food and Drug Administration (FDA) to regulate food containing cannabidiol (CBD) derived from hemp as a food additive. (The FDA has determined that food containing added CBD cannot be sold in interstate commerce.) Under this bill, in order to be sold, a food containing CBD derived from hemp must conform with current FDA requirements pertaining to food additives or be generally recognized as safe (GRAS). (Under current law, a food additive with the GRAS designation is not subject to FDA premarket review and approval requirements.) In addition, such a food must comply with all other relevant FDA and labeling requirements. Such a food shall be exempt from an existing provision that prohibits the sale of a food containing an additive that is (1) an FDA-approved drug or biological product, or (2) subject to certain clinical investigations. The FDA must issue regulations pertaining to such foods that specify (1) the maximum amount of CBD derived from hemp per serving, (2) labeling and packaging requirements, and (3) any conditions for intended use.

Charlotte Woodward Organ Transplant Discrimination Prevention Act This bill expressly prohibits health care providers and other entities involved in matching donated organs with recipients from denying or restricting an individual's access to organ transplants solely on the basis of the individual's disability, except in limited circumstances. Specifically, these entities may consider an individual's disability when making decisions about transplants only if a physician finds, based on an individualized evaluation, that the individual's physical or mental disability is medically significant to the provision of the transplant. A disability shall not be considered medically significant if the individual has an adequate support system in place to comply with transplant-related medical requirements. These entities must also make reasonable changes to their policies to make transplants and related care more available to individuals with disabilities. Aggrieved individuals may bring claims of discrimination to the Office of Civil Rights of the Department of Health and Human Services or before a federal court. The bill provides for expedited resolutions of these claims.

Black Lung Benefits Improvement Act of 2021 This bill revises requirements for miners' claims for pneumoconiosis (black lung disease) benefits. Specifically, the bill requires the Department of Labor to pay the attorneys' fees of specified parties on a qualifying benefit claim, give a claimant the opportunity to substantiate a claim for benefits through a pulmonary evaluation, authorize a CT (computerized tomography) scan in diagnosing complicated pneumoconiosis, educate certain individuals who work on black lung benefits about medical evidence relevant to claims, establish criteria that a mining operator must meet to self-insure against claims, and develop a strategy to reduce delays in adjudication of black lung disease benefits claims. The bill also requires the Government Accountability Office to report on barriers to health care faced by coal miners with black lung disease. The bill authorizes (1) black lung disease clinics to use federal funds to help individuals file claims, and (2) certain previously denied claimants to file a new claim for black lung disease benefits within one year. The bill prohibits a person from (1) knowingly and willfully making a false statement or misrepresentation in increasing or reducing black lung disease benefits, or (2) threatening or misleading a participant in a proceeding regarding such benefits. Further, the bill revises (1) the standards of medical evidence that establish a presumption that a miner is totally disabled by black lung disease, and (2) payments to such miners. Lastly, the bill provides statutory authority for the Office of Workers' Compensation Programs.

PrEP Access and Coverage Act This bill requires private health insurance plans to cover prescription drugs that prevent HIV, including related screenings, diagnostic procedures, administrative fees, and clinical follow-ups, without any cost-sharing obligation for the plan holder. Further, insurance plans must not impose any preauthorization requirement for this coverage. These coverage requirements also apply to public health insurance programs, including Medicare, Medicaid, and the Children's Health Insurance Program. Additionally, the bill prohibits denying, limiting, or qualifying coverage or increasing premiums for disability insurance, long-term care insurance, or life insurance policies based on an individual taking medication for HIV prevention. The bill further requires the Department of Health and Human Services to award grants to states, or directly to eligible local organizations, to provide uninsured individuals and underinsured individuals access to prescription drugs and related services that prevent HIV. The Centers for Disease Control and Prevention also must develop a public awareness campaign that focuses efforts in communities with a high need for HIV prevention treatment.

Post-9/11 Veterans' Mental Health Care Improvement Act of 2021 This bill addresses mental health care provided by the Department of Veterans Affairs (VA), including by requiring the VA to expand access to mental health care, expand its mental health workforce, and conduct studies and research. Among other requirements, the VA must increase the number of full-time equivalent employees at Vet Centers, expand specified scholarships and loan repayment programs for mental health providers and students, offer mental health consultations to certain veterans, improve the assessment and treatment of veterans with sleep disorders, and perform various studies and research related to mental health issues and care.

Strategies To Address Antibiotic Resistance Act or the STAAR Act This bill expands various initiatives to address antibiotic resistance. The bill reestablishes the interagency Antimicrobial Resistance Task Force to coordinate and develop efforts addressing antibiotic resistance. The Department of Health and Human Services must encourage health care facilities to implement antimicrobial stewardship programs to evaluate and improve the use of antimicrobial drugs. The bill also requires the Centers for Disease Control and Prevention (CDC) to use the National Healthcare Safety Network to collect and report data about the usage of antibiotic drugs, changes in resistance to such drugs, and other trends impacting patient outcomes. Additionally, the bill increases nationwide efforts to monitor, research, and prevent the spread of infection from resistant organisms by establishing the Antibiotic Resistance Surveillance and Laboratory Network in at least seven geographic regions, establishing the Clinical Trials Network on Antibacterial Resistance to conduct clinical research, and requiring the CDC to collaborate with state and local agencies to support health care facilities that focus on preventing the spread of antibiotic-resistant bacteria.

Compacts, Access, and Responsible Expansion for Mental Health Professionals Act or the C.A.R.E. for Mental Health Professionals Act This bill establishes a grant program to promote interstate licensure compacts for mental health professionals. These are licensure agreements enacted by two or more states to mutually recognize the licenses of counselors, psychiatrists, psychologists, or pediatric mental health professionals. The Health Resources and Services Administration must award grants to interstate compact commissions or professional licensing boards. Recipients may use grants for projects to (1) incentivize mental health professionals to practice in states with interstate licensure compacts, and (2) develop or maintain interstate compact commissions.

Healthcare Extension and Accessibility for Developmentally disabled and Underserved Population Act of 2021 or the HEADs UP Act of 2021 This bill authorizes the Department of Health and Human Services (HHS) to award grants to support health centers that provide services for individuals with developmental disabilities, including dental care. Grant recipients must provide specialized treatment to individuals with developmental disabilities as necessary. The bill also provides statutory authority for HHS to designate individuals with developmental disabilities as health-professional shortage population groups for the purposes of the National Health Service Corps (NHSC). The NHSC provides scholarships and student loan repayment awards to eligible providers who agree to work with designated populations or in areas that face shortages of primary care, dental care, and mental health care providers.

Conscience Protection Act of 2021 This bill provides statutory authority for certain protections for health care providers that refuse to participate in abortions based on religious beliefs or other convictions. Health care providers include individual professionals, medical facilities, health insurance organizations, and social services providers that refer clients to health care services. The federal government and entities that receive federal funding for health-related activities, including state and local governments, may not discriminate against a health care provider that refuses to be involved in, or provide coverage for, abortions. Currently, similar requirements apply to various related activities, including certain employment or personnel decisions (the Church Amendments), abortion services training (the Coats-Snowe Amendment), qualified health plans offered through health insurance exchanges, and annual appropriations bills for the Department of Health and Human Services (HHS) and other federal agencies (the Weldon Amendment). The HHS Office for Civil Rights must investigate complaints of this kind of discrimination. Furthermore, HHS may terminate or reduce HHS funding for health-related activities if a person or entity fails to comply with nondiscrimination requirements. Additionally, the Department of Justice or any entity adversely affected by such discrimination may bring a civil action to obtain appropriate relief. A plaintiff does not need to seek or exhaust administrative remedies before bringing the action. A plaintiff may also bring an action, including one for money damages, against a governmental entity. In many cases, principles of sovereign immunity shield states and some localities from these kinds of actions.

Parental Rights Protection Act This bill restricts government entities from requiring that individuals age 18 or younger receive certain COVID-19 vaccines that were authorized through emergency use and related procedures. Specifically, a federal, state, tribal, territorial, or local government entity (including a local educational agency) that receives funding from either the Department of Education or the Department of Health and Human Services may not require such COVID-19 vaccinations for individuals age 18 or younger. In particular, a local educational agency that mandates COVID-19 vaccinations for students loses its eligibility for federal education funding. The bill also requires the prior, informed, written consent of a parent or guardian before administration of such COVID-19 vaccines to an individual age 18 or younger.

Healthy Maternity and Obstetric Medicine Act or the Healthy MOM Act This bill expands health insurance coverage availability for pregnant individuals. It requires health insurers, health insurance exchanges, and group health plans to offer a special enrollment period to pregnant individuals. The special enrollment period offered by an insurer or exchange must begin when the pregnancy is reported to the insurer or exchange. The special enrollment period offered by a group health plan must begin when the pregnancy is reported to the plan or is confirmed by a health care provider. The bill also makes pregnancy a qualifying life event for the purpose of enrolling in a federal employee health benefit plan. Additionally, a group health plan or health insurer that covers dependents must provide coverage for maternity care to all covered individuals. Any individual who is eligible for Medicaid and is, or becomes, pregnant maintains such eligibility for one year after the end of the pregnancy. The bill revises the range in which a state must establish a maximum level of family income for pregnant women and infants to be eligible for Medicaid. The upper limit of the range is eliminated and the lower limit is set to the level in place on January 1, 2014.

Cures 2.0 Act This bill addresses pandemic preparedness and public health issues, caregiver and patient engagement, drug development, insurance coverage, and biomedical research. The Department of Health and Human Services (HHS) must undertake research and other activities concerning COVID-19 and develop a strategy for future pandemics and declared emergencies. Additionally, the bill specifies actions to combat antimicrobial resistance. HHS may award grants for caregiver training. The bill also addresses diversity in clinical trials, collecting patient experience data during clinical trials, and coverage for care related to participation in specified clinical trials. The bill modifies the timeframe and requires additional guidance relating to expedited approval of certain breakthrough drugs, devices, or products. It also establishes two intercenter institutes within the Food and Drug Administration (FDA) focused on particular diseases that meet specified criteria. The bill also addresses (1) coverage in Medicare, Medicaid, and the Children's Health Insurance Program for telehealth, genetic and genomic testing, and other services; (2) electronic prescribing standards for Medicare drug benefits; and (3) access to Medicare and Medicaid claims data by certain registries. Furthermore, the bill prohibits the use of geographic tracking or biometrics in Medicaid electronic visit verification systems. The bill establishes the Advanced Research Projects Agency for Health (ARPA-H) within the National Institutes of Health to accelerate biomedical research and innovation through grants, contracts, cash prizes, and other means. The FDA may work with ARPA-H to expedite the development of medical products through specified activities.

Access to Birth Control Act This bill requires pharmacies to comply with certain rules related to ensuring access to contraceptives. Specifically, pharmacies must provide without delay a customer with any contraceptive or related medication that is in stock. If the contraceptive is not in stock, the pharmacy must immediately inform the customer and either order the contraceptive or refer the customer to a pharmacy that has it in stock. Laws in some states provide pharmacists with the right to refuse to dispense contraceptive-related drugs on religious or conscience grounds. Pharmacies may refuse to provide a contraceptive to a customer (1) if the customer lacks a valid prescription for a prescription contraceptive or is unable to pay for the contraceptive, or (2) based on a pharmacy employee's professional clinical judgment. The bill also establishes a private cause of action and civil monetary penalties for violations of the bill.

Pregnancy Loss Mental Health Research Act of 2021 This bill expands research and related activities that address mental health complications following a pregnancy loss (i.e., miscarriage, stillbirth, or abortion). Specifically, the National Institutes of Health and the National Institute of Mental Health (NIMH) must expand and intensify research on mental health complications following pregnancy loss. In particular, NIMH must conduct a longitudinal study to determine the prevalence and other information about such mental health complications. Additionally, the Department of Health and Human Services must award grants to health providers, state or local governments, or other appropriate nonprofits to deliver services to individuals with mental health conditions following a pregnancy loss. Funding made available under this bill may not be provided to an entity (or an entity's affiliate, subsidiary, successor, or clinic) that performs abortions other than in the case of a pregnancy (1) that is the result of rape or incest; or (2) when the life of the woman is in danger due to a physical disorder, injury, or illness.

Respecting Our Frontline Workers Act This bill prohibits federal agencies from requiring the staff of health care facilities or other settings to be vaccinated against COVID-19 in order to participate in Medicare, Medicaid, or the Children's Health Insurance Program (CHIP). On November 5, 2021, the Centers for Medicare & Medicaid Services issued a rule titled Medicare and Medicaid Programs; Omnibus COVID-19 Health Care Staff Vaccination . The rule requires health care providers, as a condition of Medicare and Medicaid participation, to ensure that staff are fully vaccinated against COVID-19.
