Participating hospitals must (1) have a proportionally high number of Medicare or Medicaid patients, and (2) develop a plan and related quality metrics for innovations to provide coordinated care and address social determinants of health for individuals with serious mental illness or emotional disturbance and physical comorbidities (e.g., chronic conditions).

Woman's Right To Know Act This bill requires health care providers to perform an ultrasound and obtain certain informed consent before performing an abortion procedure. Specifically, before performing an abortion, providers must first perform an ultrasound and share the results with the woman, and also present the woman with an authorization form at least 24 hours before performing the abortion procedure. The form must (1) include specified information concerning gestational age, associated developmental characteristics, and medical risks; (2) include a statement that an ultrasound has been performed and the results were shared with the woman; (3) disclose penalties that providers may face for failing to comply with the bill's requirements; and (4) include an affirmation that the individual signing the form understands the information. The form must be signed and witnessed in person and retained in the medical file. The bill's requirements do not apply if, in reasonable medical judgment, compliance would pose a greater risk of death or substantial physical impairment of a major bodily function, excluding psychological or emotional conditions, of the pregnant woman. The bill also establishes civil penalties for providers who do not comply with these requirements.

Program of All-Inclusive Care for the Elderly Expanded Act or the PACE Expanded Act This bill modifies requirements regarding Programs of All-Inclusive Care for the Elderly (PACE). PACE is a program under Medicare and Medicaid that provides in-home and community services for certain individuals as an alternative to nursing home care. The bill allows Medicare beneficiaries to enroll in a PACE program at any time and provides states with the option to allow Medicaid beneficiaries to do the same. Entities may also apply to become PACE providers at any time, upon specified assurances relating to staffing and other requirements. The bill also (1) allows the Center for Medicare and Medicaid Innovation to test a model for expanded PACE eligibility that targets high-need and high-cost populations, and (2) requires an evaluation of the effectiveness of PACE in rural and underserved areas.

Medicare Patient Empowerment Act of 2023 This bill allows any Medicare beneficiary to enter into a contract with an eligible professional, regardless of whether the professional is a participating or non-participating physician or practitioner, for any item or service covered by Medicare. Such beneficiaries may submit a claim for Medicare payment in the amount that would otherwise apply, except that, where the professional is considered to be non-participating, payment shall be paid as if the professional were participating. An eligible professional is a physician, physician assistant, nurse practitioner, clinical nurse specialist, certified registered nurse anesthetist, certified nurse-midwife, clinical social worker, clinical psychologist, registered dietitian or nutrition professional, physical or occupational therapist, qualified speech-language pathologist, or qualified audiologist. A Medicare beneficiary must agree in writing in such a contract to (1) pay the eligible professional for a Medicare-covered item or service; and (2) submit, in lieu of the eligible professional, a claim for Medicare payment. However, a beneficiary may negotiate, as a term of the contract, for the eligible professional to file such claims on the beneficiary's behalf. The bill preempts state laws from limiting the amount of charges for physician and practitioner services for which Medicare payment is made.

Home-Based Telemental Health Care Act of 2023 This bill establishes a grant program to fund demonstration projects to provide in-home mental health and substance use services to medically underserved individuals in rural areas or in the farming, fishing, and forestry industries. Specifically, the Department of Health and Human Services (HHS) must award grants to public or nonprofit telemental health provider networks to deliver, and evaluate the impact of, home-based telemental health and substance use services for such individuals. HHS must consult with the Rural Health Liaison of the Department of Agriculture on the grants.

Medicare Economic Security Solutions Act This bill modifies provisions relating to enrollment periods for Medicare medical services. Among other things, the bill establishes a late enrollment penalty of 15% of monthly premiums and applies the penalty for a period equal to twice the number of months in each 12-month period during which the individual was not enrolled. Currently, the late enrollment penalty is 10% of monthly premiums for each 12-month period during which the individual was not enrolled, and the penalty continues to apply for as long as the individual is enrolled in Medicare medical services. The bill also expands the special enrollment periods to individuals who have health insurance coverage other than through their employer.

Health Disparity Zones Act of 2023

Health Disparity Zones Act of 2023 This bill provides for the designation of Health Disparity Zones in certain geographic areas with documented and measurable health disparities. This designation, which expires 10 fiscal years after the bill's enactment, confers eligibility for certain grants, student loan repayment programs, and tax credits for those working to reduce health disparities and improve health outcomes in these zones. Specifically, community-based nonprofits or local government agencies, in coalition with health care providers, social service organizations, and others, may apply to the Department of Health and Human Services (HHS) for the designation. The application must include a plan to reduce health disparities and achieve other outcomes. In implementing the program, HHS must consult with, among others, the Department of Housing and Urban Development. When approving applications, HHS shall consider factors including geographic diversity and the commitment of supporting funds from the private sector. HHS (1) may award grants to organizations or agencies that applied for the designation to support activities aligned with their plans, and (2) must carry out a student loan repayment program for health care providers who agree to provide services in a Health Disparity Zone. In addition, the bill establishes tax credits for employers that hire, and individuals who work as, Health Disparity Zone workers.
