Protecting Access to Biosimilars Act of 2019 This bill excludes biological products that were initially licensed under the Federal Food, Drug, and Cosmetic Act (FD&C Act) (e.g., insulin) from the exclusivity protections that delay the licensure of biosimilar products under the Public Health Service Act (PHS Act). (The Biologics Price Competition and Innovation Act of 2009 generally requires that biological products approved under the FD&C Act are treated as though they were approved under the PHS Act through March 23, 2020.)

Second Chance at Life Act of 2019 This bill requires abortion providers administering chemical abortions to provide specified information about the possibility of reversing the effects of such procedure. Specifically, a patient must be informed at least 24 in advance that (1) reversing a chemical abortion may be possible after administering the first drug of a two-drug procedure and (2) additional information about chemical abortions is available through the Department of Health and Human Services. Further, after the first drug is administered, the physician must provide written discharge instructions to the patient that state it may be possible to reverse the abortion procedure before the second drug is taken, among other information. Such information also must be conspicuously posted inside the office or waiting area of clinics that provide chemical abortions. Abortion providers are not required to provide such information in the event that an abortion is necessary to save the life of a patient who is endangered due to a complication resulting from a pregnancy.

Removing Barriers to Allergy Diagnostic Testing Act of 2019 This bill requires equal coverage of two types of allergy tests under Medicaid and Medicare. Specifically, in vitro specific IgE tests (blood tests) and percutaneous tests (skin tests) must be treated equally with respect to (1) medical necessity or other coverage requirements, (2) frequency limits, and (3) allergen unit limits.

Medicare-X Choice Act of 201 9 This bill establishes and funds the Medicare Exchange health plan, which allows individuals who are not otherwise eligible for Medicare to enroll in a government-administered health insurance plan. The Centers for Medicare & Medicaid Services (CMS) must offer such plan in certain individual health insurance exchanges beginning plan year 2021 and offer it in all individual health insurance exchanges beginning plan year 2024. CMS must offer the plan in the small group market in all geographic areas for plan year 2025. The plan must meet the same requirements, including essential health benefits, as existing health insurance exchange plans. Unless they opt out, health care providers enrolled under Medicare or under a state Medicaid plan must participate in the plan and are reimbursed at Medicare rates. The bill establishes a grants program for community organizations, educational institutions, and health agencies to create service partnerships and establish interactive data systems for health care providers. Additionally, the bill expands the premium tax credit available for plans purchased through an exchange and eliminates the restriction on the Department of Health and Human Services negotiating prescription drug prices for Medicare.

Transparent Drug Pricing Act of 2019 This bill establishes several requirements relating to the prices of prescription drugs. For example, state Medicaid drug-use review programs must require pharmacists to disclose an individual's out-of-pocket cost for a prescription drug, and the price without health insurance, at the point-of-sale. Additionally, health insurers must publish the co-payment amount for each covered prescription drug prior to the annual open-enrollment period. The bill also temporarily prohibits the retail list price of drugs and biologics from exceeding the lowest retail list price among Canada, France, the United Kingdom, Japan, or Germany.

Ensuring FEDVIP and FLTCIP Coverage During Shutdowns Act This bill prohibits the termination of federal-employee dental, vision, and long-term-care insurance coverage as a result of unpaid premiums or other periodic charges in the event of a lapse in appropriations that results in an employee being placed in a nonpay status. This includes supplemental dental, vision, and long-term-care insurance policies.

Reducing Costs for Out-of-Network Services Act of 2019 This bill places limits on the cost to insurance plan holders for out-of-network health care services and on the amount charged for services provided to uninsured individuals. First, each state must select one of the following formulas for determining the maximum cost for a service: 125% of fee-for-service rate under Medicare, the 80th percentile of the cost for such service in the geographic area, or 100% of the allowed charges if the service had been provided in network. Health insurance issuers must set the cost-sharing amount for out-of-network services at no more than the state-selected rate for such service. Further, out-of-network health care providers may charge plan holders no more than the state-selected rate for a service. Each state also must set the maximum rate for services that health care providers may charge uninsured individuals at the lower of (1) 125% of the fee-for-service rate under Medicare, (2) the 80th percentile of the cost for such service in the geographic area, or (3) the rate otherwise applicable under state law. If a state does not select a maximum rate for a service provided to an insured or uninsured individual, the maximum rate a provider may charge is (1) 125% of the fee-for-service rate under Medicare, or (2) the rate established by the Department of Health and Human Services if such service is not covered under Medicare.

Veterans Posttraumatic Growth Act This bill requires the Department of Veterans Affairs (VA) to conduct a two-year pilot program to study the effectiveness of nonprofit post-traumatic growth programs to determine (1) the outcomes of such programs in contrast to traditional models of mental health care, (2) the possible integration of such nonprofit programs into VA mental health care programs, and (3) the budgetary impact of such integration. Post-traumatic growth is the positive psychological change that can result from struggling with traumatic events. The bill makes veterans who are not at immediate risk of attempting suicide and not participating in traditional mental health treatment eligible for such program.

Preserving Patient Access to Compounded Medications Act of 2019 This bill addresses regulations governing compounding pharmacies. The bill expands the circumstances under which a drug may be compounded (i.e., manufactured at small scale) to allow pharmacists and physicians to compound drugs for administration to patients in an office or clinical setting, in accordance with state law. (Compounded drugs are not required to meet certain federal requirements regarding manufacturing, labeling, or approval.) Dietary supplements may be used in the compounding of a drug. The bill exempts from interstate distribution limits the dispensing of a compounded drug from the facility where it is compounded to a patient or health facility. The bill limits the scope of Food and Drug Administration (FDA) inspections of compounding pharmacies to certain equipment, materials, containers, and labeling. This aligns the scope of inspections of compounding pharmacies with the scope of inspections of other pharmacies. (Currently, the scope of inspections of compounding pharmacies is the same as the scope of inspections of drug manufacturers.) The bill also eliminates the requirement for compounding pharmacies to register with the FDA as drug manufacturers.

Expanding Care for Veterans Act This bill requires the Department of Veterans Affairs (VA) to develop a plan to expand the scope of research and education on and delivery of complementary and integrative medicine services (products and practices that are not currently part of mainstream, conventional medical practice) for veterans. The bill also requires the VA to define in regulations the meaning of complementary and integrative medicine . The VA must implement a three-year program at not fewer than 15 VA medical centers to assess the feasibility and advisability of integrating the delivery of complementary and integrative medicine services for veterans with mental health conditions, chronic pain conditions, and other chronic conditions. The bill requires the VA to contract with a qualified independent entity to conduct studies of the barriers encountered by veterans in receiving (and administrators and clinicians in providing) complementary and integrative medicine services. The National Research Advisory Council must review the results of the studies and submit findings to the VA. Finally, the VA must implement a three-year grant program awarding grants to public or private nonprofit entities to assess the feasibility and advisability of using wellness programs to complement the provision of mental health care to veterans and family members who are eligible for readjustment counseling from the VA.

Conrad State 30 and Physician Access Reauthorization Act This bill modifies the Conrad 30 Waiver program, which incentivizes qualified foreign physicians to serve in underserved communities. It also extends statutory authority for the program through FY2021. Aliens coming to the United States under a J-1 nonimmigrant visa to receive medical training typically must leave the country and reside for two years abroad before being eligible to apply for an immigrant visa or permanent residence. The Conrad program waives this requirement for individuals who meet certain qualifications, including serving for a number of years at a health care facility in an underserved area. The bill increases the number of waivers that a state may obtain each fiscal year from 30 to 35 if a certain number of waivers were used the previous year, and provides for further adjustments depending on demand. An alien physician may be employed at an academic medical center to meet the Conrad program's employment requirements if the alien's work is in the public interest, even if the medical center is not in an underserved area. Employment contracts for alien physicians under the Conrad program shall contain certain information, such as the maximum number of on-call hours per week the physician shall have to work. Certain alien physicians (along with the physician's spouse and children) shall be exempt from the direct annual numerical limits on immigration, including those physicians that have met certain requirements related to visas for physicians to serve in underserved areas.

Public Buildings Renewal Act of 201 9 This bill allows tax-exempt financing of certain government-owned buildings by expanding the definition of "exempt facility bond" to include bonds used for qualified government buildings. A qualified government building is a government-owned building or facility that consists of one or more of the following an elementary or secondary school; a facility of a state college or university used for educational purposes; a public library; a court; a hospital or health care facility; a laboratory or research facility used by a governmental unit; a public safety facility; or an office for government employees. The bill excludes buildings or facilities that include specified recreational equipment or are used for the primary purpose of providing retail food and beverage services, recreation, or entertainment. The bill establishes (1) a $5 billion limit on the amount of tax-exempt financing which may be provided for government buildings, and (2) procedures for allocating and applying for the financing. The bill exempts the bonds for government buildings from the volume cap on private activity bonds.

Allowing Greater Access to Safe and Effective Contraception Act This bill permits health savings accounts, medical savings accounts, and employer reimbursements for medications to be used for over-the-counter drugs. The bill also removes the limit on employee contributions to flexible spending accounts offered under specified health plans established pursuant to a pretax salary reduction agreement with an employer (i.e., cafeteria plans). Further, the bill requires the Food and Drug Administration to give priority review, at no cost, to applications for modifications to already-approved contraceptive drugs that are intended for routine use and available over the counter. Such drugs, however, must require a prescription for individuals under the age of 18.

Space Frontier Act of 2019 The bill revises provisions relating to commercial space launch license applications and experimental permits. The Department of Transportation shall consolidate across federal agencies requirements to protect the public health and safety, safety of property, national security interests, and foreign policy interests of the United States relevant to any commercial space vehicle into a single application set that satisfies those requirements and expedites the coordination of commercial space services. NASA is authorized to establish a low-Earth orbit commercialization program. The bill revises and sets forth provisions relating to nongovernmental Earth observation activities. NASA must ensure that the International Space Station remains a viable and productive facility capable of potential U.S. use through at least FY2030.

Preserving Rehabilitation Innovation Centers Act of 2019 This bill directs the Centers for Medicare & Medicaid Services to publish and biennially update a list of all rehabilitation innovation centers. The bill defines rehabilitation innovation centers as nonprofit or government-owned rehabilitation facilities that (1) hold specified federal research and training designations for traumatic brain injury, spinal cord injury, or stroke rehabilitation research; and (2) serve at least a certain number of Medicare patients. The Medicare Payment Advisory Commission must analyze the three most recent years of cost report data for all rehabilitation innovation centers and assess the payment adequacy for such innovation centers under Medicare.

Specified institutions that provide education and training to health care professionals and focus on maternal mortality are eligible for funding through the program. The bill extends coverage for pregnant and postpartum women under Medicaid and the Children's Health Insurance Program for one year postpartum and such coverage is revised to include oral health services. Fair and Open Competition Act or FOCA Act This bill prohibits federal construction contracts or controlling documents for federally supported construction projects from requiring or prohibiting project labor agreements. Such documents also may not discriminate against or give preference to a bidder or contractor who signs or refuses to sign a project labor agreement. An agency may exempt a project from this prohibition to avert an imminent threat to public health or safety or to serve the national security.

Expanding Nutrition's Role in Curricula and Healthcare Act or the ENRICH Act This bill requires the Health Resources and Services Administration to establish a program of three-year competitive grants to accredited medical schools for the development or expansion of an integrated nutrition and physical-activity curriculum. Protecting Pre-Existing Conditions and Making Health Care More Affordable Act of 2019 This bill revises various requirements for private health insurance plans and associated plan-holder cost sharing. Specifically, the bill increases premium assistance for low-income households and specifies that the coverage affordability requirements for employer-sponsored plans extend to family members of employees based on the employee's required contribution as a percentage of the employee's income. Further, the bill prohibits specified agency actions that would weaken the requirements of the Patient Protection and Affordable Care Act (PPACA) with respect to (1) association health plans; (2) short-term, limited-duration health insurance plans; and (3) state applications to waive certain PPACA provisions. The bill also increases the minimum coverage requirements for private health insurance plans and requires the Department of Health and Human Services (HHS) to promote the availability of such plans. The health coverage navigator program also is revised to prioritize community and consumer-focused nonprofits and facilitate enrollment in federally supported insurance programs such as Medicaid. The bill establishes a fund for the Centers for Medicare & Medicaid Services to provide cost assistance to individuals who are enrolled in qualified health plans. Additionally, the bill provides new and additional grant funding for states to (1) plan and establish health insurance exchanges, (2) provide consumer assistance about available health insurance plans and coverage, and (3) increase health insurance plan enrollment. Improving HOPE for Alzheimer's This bill requires the Centers for Medicare & Medicaid Services (CMS) to conduct outreach to health care practitioners regarding comprehensive care planning services that are available under Medicare for individuals with Alzheimer's disease and related dementias. The CMS must report on its outreach efforts, as well as on the number of beneficiaries receiving such services and any barriers to access.

Family Health Care Affordability Act of 2019 This bill modifies the requirement for determining the affordability of employer-sponsored minimum essential health care coverage under the Patient Protection and Affordable Care Act (PPACA). (Under current law, the coverage is unaffordable, and an employee may be eligible for premium assistance tax credits, if the employee's required contribution for an individual plan exceeds 9.5% of household income.) The bill specifies that, with respect to an employee's family members who are eligible to enroll in the plan, affordability must be determined using the cost of family coverage rather than individual coverage to expand the eligibility of families for premium assistance tax credits.
