Trade Adjustment Assistance For Workers Reauthorization Act of 2020 This bill revises and reauthorizes through FY2027 the Trade Adjustment Assistance Program. Specifically, the bill provides trade adjustment assistance for workers, including staffed workers and teleworkers, who experience an employment loss because of supply chain disruptions or weak demand during a public health emergency. Such assistance also extends to workers similarly affected by retaliatory tariff increases. The bill authorizes the Department of Labor to reimburse workers for certain out-of-pocket training expenses. Labor must take necessary action to apprise eligible workers of available benefits, and affected workers must be provided with information about registered apprenticeship programs and other on-the-job training opportunities in their area. The bill extends the duration of income support for workers enrolled in a registered apprenticeship program, associate's degree program, or other qualified training program, and it authorizes benefits to be paid to certain workers whose annual income is below a specified threshold. Employees shall not be considered to have experienced an employment loss due to a plant closing or mass layoff if such closing or layoff is the result of the relocation or consolidation of the employer's business and, prior to such closing or layoff, the employer offers to transfer the employees to certain other sites of employment. If such loss of employment is caused by conditions justifying trade adjustment assistance, the employer must notify its employees of the availability of such assistance. The bill also extends the tax credit for health insurance costs through 2026 and increases the percentage of such credit.

Coronavirus Aid, Relief, and Economic Security Act or the CARES Act This bill addresses economic impacts of, and otherwise responds to, the COVID-19 (coronavirus) outbreak. The bill authorizes emergency loans to distressed businesses, including air carriers, and suspends certain aviation excise taxes. With respect to small businesses, the bill establishes, and provides funding for, forgivable bridge loans; and provides additional funding for grants and technical assistance. The bill also provides funding for $1,200 tax rebates to individuals, with additional $500 payments per qualifying child. The rebate begins phasing out when incomes exceed $75,000 (or $150,000 for joint filers). The bill establishes limits on requirements for employers to provide paid leave. With respect to taxes, the bill establishes special rules for certain tax-favored withdrawals from retirement plans; delays due dates for employer payroll taxes and estimated tax payments for corporations; and revises other provisions, including those related to losses, charitable deductions, and business interest. With respect to health care, the bill provides additional funding for the prevention, diagnosis, and treatment of COVID-19; limits liability for volunteer health care professionals; prioritizes Food and Drug Administration (FDA) review of certain drugs; allows emergency use of certain diagnostic tests that are not approved by the FDA; expands health-insurance coverage for diagnostic testing and requires coverage for preventative services and vaccines; revises other provisions, including those regarding the medical supply chain, the national stockpile, the health care workforce, the Healthy Start program, telehealth services, nutrition services, Medicare, and Medicaid. With respect to education, the bill temporarily suspends payments for federal student loans; and  otherwise revises provisions related to campus-based aid, supplemental educational-opportunity grants, federal work-study, subsidized loans, Pell grants, and foreign institutions. The bill also authorizes the Department of the Treasury to temporarily guarantee money-market funds.

Specifically, USDA may grant waivers allowing participants under WIC to get certified or recertified without being physically present at a WIC clinic; defer anthropometric and bloodwork requirements necessary to determine nutritional risk; and grant waivers from administrative requirements for WIC if it determines that the requirement cannot be met by a state due to COVID-19, and the waiver is necessary to provide assistance under WIC. USDA authority under this bill expires on July 31, 2020.

In addition, the bill (1) temporarily requires state Medicaid programs to provide Medicare cost-sharing assistance to certain individuals who qualify for, or are enrolled in, the low-income subsidy program under the Medicare prescription drug benefit; and (2) authorizes a grant program to support Medicaid home- and community-based services during the public health emergency.

Reciprocity Ensures Streamlined Use of Lifesaving Treatments for Coronavirus Patients Act of 2020 This bill establishes a reciprocal marketing approval process that allows for the sale of a drug, biological product, or medical device that has not been approved by the Food and Drug Administration (FDA) if the product is approved for sale in another country for the treatment or prevention of COVID-19 (i.e., coronavirus disease 2019) and there is an unmet need relative to certain diseases. Specifically, the bill requires the product's sponsor to demonstrate, among other things, that the product has been approved for the treatment or prevention of COVID-19 or another disease of epidemic potential, the approval is in one of the specified countries, the FDA and listed countries have not withdrawn approval because of safety or effectiveness concerns, and there is a public health or unmet medical need for the product. The FDA may only decline approval if the FDA determines that the product is not safe or effective. The FDA must make such a determination not later than 30 days after receiving a request. Congress may pass a joint resolution to grant reciprocal marketing approval of a product that the FDA declines to approve through the reciprocal process.

The bill also allows states to transfer funds, in greater amounts and without prior approval, between congregate and home-delivered nutrition programs, The Department of Health and Human Services must prioritize home-delivered nutrition services for individuals who are unable to obtain nutrition as a result of the emergency, such as those under quarantine, just as it prioritizes delivery to individuals who are homebound by illness.

Strengthening America's Supply Chain and National Security Act This bill requires the Department of Defense (DOD) and the Department of Health and Human Services (HHS) to take specified actions concerning the importation of pharmaceutical products from China and any other countries selected by DOD. DOD must submit to Congress a classified report that addresses, among other issues, the percentage of pharmaceutical products used by DOD that are made by such countries and recommendations related to the domestic manufacturing capacity and the resiliency of the supply chain for such products. An unclassified summary of this report must be published on a DOD website. A manufacturer of a pharmaceutical product that has received market approval must annually submit to HHS specified information about the product's active and inactive pharmaceutical ingredients, including the sources of such ingredients and the percentage of the aggregate amount of such ingredients from China and other countries selected by DOD. HHS shall provide such information to DOD. In addition, the bill revises certain statutory tests used to determine the country of origin of a pharmaceutical product. Specifically, a pharmaceutical product shall be deemed to have the same country of origin as the product's active pharmaceutical ingredient (API). (A recent court case held that a drug manufactured in the United States using an API from India is considered a U.S.-made product for procurement purposes.)

The bill also requires such plans to cover services related to the disease or condition resulting in the public health emergency including, if applicable, vaccines, diagnostic testing, and treatment and care for the disease or condition. Such coverage does not require a positive diagnosis of the disease or condition and cost sharing must be comparable to similar services covered outside the circumstance of a public health emergency.

Specifically, states may (1) allow certain families that have incomes of up to 400% of the federal poverty level and that have experienced reduced incomes because of COVID-19 to receive TANF assistance, and (2) provide additional cash payments to these and other TANF recipients. The Department of Health and Human Services must increase state and tribal TANF grants to offset increased expenditures that result from these changes. The bill provides appropriations for this purpose. The bill also suspends TANF work requirements and other conditions during the emergency.

ACCESS Act

Advancing Connectivity during the Coronavirus to Ensure Support for Seniors Act or the ACCESS Act This bill (1) provides appropriations for the Telehealth Resource Center Program of the Office for the Advancement of Telehealth within the Federal Office of Rural Health Policy in the Health Resources Services Administration (HRSA) to develop telehealth capacity for certain nursing facilities, and (2) directs other activities to increase access to telehealth services in such facilities during the COVID-19 (i.e., coronavirus disease 2019) public health emergency. HRSA shall award grants, in coordination with the Federal Communications Commission (FCC), to skilled nursing facilities and other nursing facilities to support virtual visits to residents during the emergency. The FCC shall waive requirements that apply to certain funding for telecommunication and broadband services for health care providers if those requirements prevent facilities that receive grants from carrying them out. The Department of Health and Human Services must also provide recommendations related to immediately increasing access, during the emergency, to telehealth services for which Medicare and Medicaid payments are available in skilled and other nursing facilities.

Under current law, the FDA regulates the safety and effectiveness, as well as quality of design and manufacture, of laboratory-developed tests, while the CMS regulates clinical laboratories and testing processes. Historically, the FDA has exercised enforcement discretion and not enforced certain statutory and regulatory requirements with respect to these tests. The CMS must hold a public meeting to solicit recommendations to update existing regulations related to clinical laboratories, and the Department of Health and Human Services must report specified information to Congress, including an assessment of the availability and use of laboratory-developed testing procedures during the COVID-19 (i.e., coronavirus disease 2019) response.

Supporting Students in Response to Coronavirus Act This bill establishes and provides funds for grant programs to respond to safety and health risks presented by qualifying emergencies, including COVID-19 (i.e., coronavirus disease 2019). Specifically, the bill authorizes (1) the Department of Education (ED) to award grants to states and the Bureau of Indian Education (BIE), and (2) the Department of Health and Human Services (HHS) to award grants to agencies that administer Child Care Development block grants and Head Start agencies. ED grant recipients must award subgrants to BIE schools, local educational agencies, and institutions of higher education (IHEs). HHS grant recipients must award subgrants to early care and education programs. Subgrants under each grant program must be used for certain activities, such as coordinating preparedness and response efforts with public health departments; purchasing supplies to sanitize and clean facilities to minimize the spread of infectious diseases; and providing mental health services and supports to children, students, and staff. Additionally, ED must award grants to IHEs for creating and expanding emergency financial-aid grant programs that address the unexpected expenses related to basic needs (e.g., housing, food, and certain one-time costs) of enrolled students during a qualifying emergency. IHEs must use grant funds to make emergency financial-aid grants to eligible students. HHS must also award supplemental grants for certain organizations to address emergency-related child traumatic stress. ED may waive certain financial-aid requirements for students affected by qualifying emergencies. Such requirements include those related to subsidized usage limits, Pell Grant duration limits, leaves of absence, and satisfactory progress. The bill also authorizes ED to permit foreign IHEs to offer distance education during an emergency. No such program may be deemed ineligible.

Protecting Vulnerable Americans in Times of Crisis Act of 2020 This bill increases the Medicaid Federal Medical Assistance Percentage (FMAP) for all states and U.S. territories during the public health emergency declared on January 31, 2020, relating to COVID-19 (i.e., coronavirus disease 2019), in accordance with specified conditions. For example, in order to receive the increased FMAP, a state Medicaid program may not require standards for eligibility that are more restrictive than the standards that were in effect on January 1, 2020. The bill also increases Medicaid funding for U.S. territories for FY2020-FY2021.

Pandemic School Nurse Training to Protect Students and Communities Act of 2020 This bill authorizes the Department of Health and Human Services to make grants to, and enter into contracts with, state and local education agencies to train elementary and secondary school nurses to serve as first responders and crisis managers in the event of a biological or chemical attack at a school or an outbreak of pandemic influenza among individuals under their care. The training must prepare school nurses to (1) protect and preserve life; (2) notify public health authorities to help contain or mitigate the effects of an attack or outbreak; and (3) take other appropriate and feasible actions, such as preserve evidence of an attack.

However, such liability protection shall not apply if (1) the harm was caused by willful or criminal misconduct, gross negligence, reckless misconduct, or a conscious flagrant indifference to the rights or safety of the individual harmed; or (2) the health care professional provided services under the influence of alcohol or an intoxicating drug.

The CDC must award at least 10 cooperative agreements to tribal applicants. Additionally, the CDC must consult with tribes and tribal organizations to ensure the PHEP program enables such entities to respond to public health emergencies. The CDC may make modifications to the program after such consultation.

Specifically, beginning on enactment of this bill and ending 26 weeks after the COVID-19 public health emergency expires, the Department of Labor must enter into an agreement with a state under which Labor shall finance 100% of such state's unemployment benefit assistance to unemployed workers who are not eligible for other federal or state unemployment insurance; meet certain conditions related to being unemployed, partially unemployed, or unable to work due to COVID-19; are not able to telework; and are not receiving other paid leave.
