Ban Surprise Billing Act This bill places certain limits on the cost-sharing amount for health insurance plan holders for certain services received from out-of-network providers that are based on the median in-network rate for similar services. The bill also establishes requirements related to the practice of billing plan holders for the difference between the out-of-network rate and the in-network rate for certain services; the bill provides for an independent dispute resolution process for services with a median contracted rate of $750 or greater, among other provisions.

HIV Epidemic Loan-Repayment Program Act of 2020 or the HELP Act of 2020 This bill directs the Health Resources and Services Administration (HRSA) to carry out a loan repayment program for certain health care providers who agree to provide HIV treatment or HIV dental care in (1) a designated health professional shortage area, (2) a clinical site that is funded under the Ryan White HIV/AIDS Program, or (3) an area that meets requirements specified by HRSA. For each qualifying year of service, HRSA pays one-fifth of the principal and interest on any eligible loan, with total loan repayment after five years; repayment is capped at $250,000 per borrower.

Fair and Honest Advance Cost Estimate for Patients Act of 2020 This bill requires health care providers and private health insurance plans to provide certain estimates for the costs of services that are scheduled three or more business days in advance. Specifically, providers must inquire whether an individual scheduling such service is enrolled in a health plan, including a government health care program, and intends to seek benefits for the service under the plan. Within a specified time period prior to administering such service, the provider must submit to the individual’s plan, or to the individual if the individual is not enrolled in a plan, an estimate of expected charges for the service. Providers are subject to a maximum fine of $10,000 for each failure to provide such an estimate. Within a specified time period after receiving an estimate from a provider for a service, private health insurance plans must provide the plan holder with specified benefits information that includes but is not limited to the provider's estimated charge, whether the provider is in-network, the plan's estimated share of the amount, the plan holder's estimated cost-sharing amount, and the estimated amount remaining to meet the plan holder's deductible or out-of-pocket maximum.

Continuing Care for Patients Act of 2020 This bill requires private health insurance plans to continue providing benefits to continuing care patients when the contractual relationship with the provider or facility treating such patient changes or terminates. Continuing care patients include individuals undergoing (1) inpatient care, (2) care for pregnancy, (3) nonelective surgery, (4) treatment for a terminal illness, or (5) treatment for other serious condition that requires prolonged medical care. Among other requirements, health insurance plans must notify continuing care patients about a termination of coverage and permit such patients to continue treatment under the plan, including transition to another health care setting, for not more than 90 days after that date that such notice is provided.

Know Your Provider Act of 2020 This bill requires private health insurance plans to establish publicly available databases listing the contact information for providers and facilities delivering services under the plan, periodically verify and update the information on such databases, include notice in other provider directories that the most current information is available through the database, and establish procedures for responding promptly to inquiries from plan holders. Further, providers and facilities must establish processes for submitting current information to contracted health plans.

VA Quality Health Care Accountability and Transparency Act This bill requires the Department of Veterans Affairs (VA) to make certain staffing and quality of care data publicly available on a specified VA website. Among other elements, the information published on the website should include statistics related to patient wait times, effectiveness of care, and staffing and vacancy information. The website must be (1) directly accessible from the main VA website and the main websites of each VA medical center, and (2) understandable and usable by the general public. The VA must implement a self-auditing process to assess the accuracy and completeness of the data available on the website and must enter an agreement for the Inspector General of the VA (or other entity) to validate the audits. Additionally, the Government Accountability Office shall review the website to assess the VA's compliance and to provide recommendations on how to improve the website.

Advancing FASD Research, Prevention, and Services Act This bill reestablishes and expands programs for fetal alcohol spectrum disorders (FASD). The Department of Health and Human Services must establish a research agenda on FASD, facilitate and disseminate findings on public health surveillance and research to prevent FASD, and establish multiple grant programs. Depending on the specific grant program, eligible grantees may include states, tribes and tribal organizations, public and private nonprofits, and educational institutions. Among other purposes, the grants support research on the diagnosis, intervention, and prevention of FASD; expand and coordinate surveillance; and foster collaboration to provide integrated services to individuals with FASD. The bill also directs the Department of Education and the Department of Justice to develop and disseminate trainings and best practices related to FASD.

Military Sexual Assault Victims Empowerment Act or the Military SAVE Act This bill addresses care for covered veterans who are seeking counseling, care, or services related to sexual trauma determined by a Department of Veterans Affairs (VA) health care professional to have occurred while the veteran was on active duty or in active or inactive training. A covered veteran is a veteran who is (1) enrolled in the VA health care system; or (2) not enrolled in the VA health care system but is otherwise entitled to hospital care, medical services, or extended care services due to a specified disability. The bill requires the VA to provide hospital care, medical services, and extended care services to a covered veteran at a non-VA provider under the Veterans Community Care Program if such veteran is seeking counseling, care, or services related to such sexual trauma. The decision to receive such care from a non-VA provider shall be at the election of the veteran. The VA must provide information regarding the counseling, care, and services available through the VA to the covered veteran who is seeking counseling, care, or services related to sexual trauma. The bill also authorizes the VA to provide counseling and treatment for any condition determined to have resulted from a sexual trauma that occurred while the covered veteran was on active duty or in active or inactive training (previously only psychological trauma was eligible).

Affordable Insulin for All Act This bill addresses insulin affordability. For example, the bill requires the Department of Health and Human Services (HHS) to enter into agreements with insulin manufacturers to enable individuals with diagnosed diabetes to access Medicaid prices for insulin drugs. Additionally, Medicare and private insurance plans must cap cost-sharing at $10 per month for insulin drugs, and HHS must revise regulations to exclude payments made for insulin drugs from the denominator of the medical loss ratio. The bill also (1) eliminates a safe harbor for certain rebates, discounts, or price concessions for insulin drugs paid by a drug manufacturer to a pharmacy benefit manager for purposes of federal health care fraud and abuse laws; and (2) prohibits certain drug pricing activities related to supplemental rebates and spread pricing in Medicaid. The Government Accountability Office must report on the feasibility and affordability of direct manufacturing by the federal government.

This resolution expresses the sense of the House of Representatives that the Centers for Medicare & Medicaid Services (CMS) should withdraw recent guidance regarding the approval of block grants under Medicaid demonstration waivers. On January 30, 2020, the CMS issued guidance allowing states to apply for capped block grants through Medicaid demonstration waivers, particularly in order to cover services for the Medicaid expansion population (i.e., adults under the age of 65). The guidance also allows states that receive such block grants to make other changes to their programs (e.g., formularies for prescription drugs).

Energy Prices Require Including Climate Externalities Act or the Energy PRICE Act This bill requires the Federal Energy Regulatory Commission (FERC) to direct electric utilities to take greenhouse gas emissions into account when they set their rates for the wholesale sale of electricity. Specifically, if FERC determines that the rates do not incorporate the cost of such emissions to public health, safety, or welfare, then FERC must find that the rates are unjust, unreasonable, unduly discriminatory, or preferential.

Blast Exposure Protection Act of 2020 This bill establishes a Department of Veterans Affairs presumption of service-connection for a veteran's injury or illness associated with a blast exposure during active military, naval, or air service in spite of there being no record of the injury or illness during a period of service. Under a presumption of service-connection, specific diseases or disabilities diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded.

Protecting Americans from Seasonal Influenza Act of 2020 This bill requires the Centers for Disease Control and Prevention to award grants to increase seasonable influenza vaccination rates in states that have sustained influenza vaccination rates below recommended levels. State health agencies receiving such grants must include at least one of the elements set out in the bill in their programs. Among others, these include (1) increasing outreach to vulnerable populations, (2) encouraging employer-based vaccination programs, and (3) coordinating between health care providers and insurers to reduce out-of-pocket costs of vaccinations.

Food Safety Modernization for Innovative Technologies Act This bill provides statutory authority for joint agency jurisdiction over food intended for humans that is produced using animal cell culture technology. The Food and Drug Administration (FDA) shall oversee tissue collection, cell lines, and cell banks. The FDA shall regulate food derived from cell lines of animals other than livestock or poultry, and the Department of Agriculture shall regulate food derived from cell lines of livestock and poultry.

Research Empirical Solutions to End Ambulance Reversals from Closed Hospitals Act of 2020 or the RESEARCH Act of 2020 This bill requires certain reporting and research activities related to ambulance diversions (i.e., temporary closures of a hospital emergency department to incoming ambulances). Specifically, Medicare-participating hospitals that divert ambulances from their emergency departments must report to the Centers for Medicare & Medicaid Services on (1) the length of the diversion, (2) the reason for the diversion, and (3) the number of ambulance calls turned away while the diversion was in effect. Hospitals that comply with the reporting requirements receive increased Medicare payments until 2024. Beginning in 2025, hospitals that fail to report receive reduced Medicare payments. In addition, the National Academy of Medicine must conduct a study and provide recommendations to mitigate the occurrence of ambulance diversions and improve the health and safety of patients affected by ambulance diversions.

Public Health Emergency Fund Act This bill provides $5 billion in supplemental appropriations to the Department of Health and Human Services (HHS) for the Public Health Emergency Fund. The bill designates the funds as an emergency requirement and provides that the funds are only available if the President subsequently designates the funds. (Emergency spending is exempt from discretionary spending limits and other budget enforcement rules.) HHS may use the funds provided by this bill to acquire products such as drugs, vaccines and other biological products, and medical devices for deposit into the Strategic National Stockpile. The bill also exempts the Public Health Emergency Fund from sequestration, which is a process of automatic, usually across-the-board spending reductions under which budgetary resources are permanently cancelled to enforce specific budget policy goals.

Veterans' Acute Crisis Care for Emergent Suicide Symptoms Act of 2020 or the Veterans' ACCESS Act of 2020 This bill requires the Department of Veterans Affairs (VA) to furnish emergent mental health care (i.e., emergency stabilization care) to eligible individuals in certain situations at VA or non-VA facilities. Specifically, the VA must furnish care if an individual seeks it (1) in an emergency situation, or (2) pursuant to a recommendation from the Veterans Crisis Line or licensed health care professional. Eligible individuals under the bill include veterans, persons enrolled in the VA health care system, and individuals who (1) were discharged or released from service under a condition other than honorable, (2) are not enrolled in the VA health care system, and (3) served for a period of more than 90 cumulative days. For individuals receiving care, the VA must ensure the Veterans Crisis Line notifies the Suicide Prevention Coordinator and the Office of Community Care. The VA must also determine the eligibility of the individuals for other VA programs and benefits and make referrals for follow-on care. The VA may not charge an eligible individual for emergent mental health care and shall provide reimbursement to individuals who receive care at a non-VA facility. The bill also expands eligibility for mental and behavioral health care for certain veterans who were discharged or released from service under a condition that is other than honorable and served in the Armed Forces for a period of more than 90 cumulative days.

Veterans Posttraumatic Growth Act This bill requires the Department of Veterans Affairs (VA) to conduct a two-year pilot program to study the effectiveness of nonprofit post-traumatic growth programs to determine (1) the outcomes of such programs in contrast to traditional models of mental health care, (2) the possible integration of such nonprofit programs into VA mental health care programs, and (3) the budgetary impact of such integration. Post-traumatic growth is the positive psychological change that can result from struggling with traumatic events. The bill makes veterans who are not at immediate risk of attempting suicide and not participating in traditional mental health treatment eligible for such program.

Protecting Communities from Hospital Closures Act of 2020 This bill prohibits hospitals from closing unless pursuant to a plan approved by the Department of Health and Human Services (HHS). Specifically, a hospital must (1) notify HHS before closing most or all of its units or departments or specific units or departments where the closure may significantly impact the health and welfare of a community (e.g., emergency departments or labor and delivery units), and (2) provide a closure plan that addresses specified issues related to continuity of patient care and the health and safety needs of the community served by the departments or units. HHS may reject, approve, or require modification of the plan. The bill provides for certain judicial remedies in the event of closures that occur without an approved plan or in violation of an approved plan.

Making Objective Drug Evidence Revisions for New Labeling Act of 2020 or the MODERN Labeling Act of 2020 This bill authorizes the Food and Drug Administration (FDA) to require updates to outdated labels for certain generic drugs if the updates will provide a public health benefit. Fair Credit Reporting for Servicemembers Act This bill revises consumer credit protections for servicemembers. Among other things, the bill (1) extends consumer credit protections to certain active duty uniformed consumers in a combat zone or aboard a U.S. vessel, and (2) prohibits the inclusion on a consumer report of adverse credit information that occurred while a uniformed consumer was engaged in that type of active duty. The bill also adds to those groups covered by specified active duty credit protections individuals in the commissioned corps of the National Oceanic and Atmospheric Administration and the Public Health Service.

Student and Student Athlete Opioid Misuse Prevention Act This bill authorizes the Substance Abuse and Mental Health Services Administration (SAMHSA) to provide grants to support addiction-prevention and prescription-drug-misuse programs related to opioids and other medications used for pain or injury recovery. Specifically, SAMHSA may award grants to eligible public and nonprofit private entities, including states and drug-free community coalitions, to carry out such programs in schools, athletic programs, and communities. Among other activities, grant recipients may use funds to educate teachers, campus-based medical providers, and others on signs of opioid misuse and options for treatment and prevention. In addition, SAMHSA must report annually on federal programs to prevent pain medication misuse and addiction.

Ensuring Access to Direct Support Professionals Act This bill allows state Medicaid programs to cover certain home- and community-based services, self-directed personal assistance services, and home- and community-based attendant services that are provided in acute care hospitals. The bill specifies, among other criteria, that such services may not be duplicative of, or serve as a substitute for, necessary or obligatory hospital services.

This resolution (1) designates January 23, 2020, as Maternal Health Awareness Day; (2) encourages efforts to reduce adverse maternal health outcomes, eliminate disparities in maternal health, and promote respectful and equitable maternity care practices; and (3) honors mothers who have passed away as a result of pregnancy-related causes.
