This bill directs the Department of Veterans Affairs (VA) to ensure that if it creates a presumption of service connection between the occurrence of a disease and exposure to a herbicide agent while serving in the Armed Forces during the Vietnam era at a military base in Thailand, such presumption shall also apply to exposure to a herbicide agent while serving in the Armed Forces during the Vietnam era at any military base in Thailand without regard to where on the base the veteran was located or what military job specialty the veteran performed. The VA may provide to any spina bifida-affected child of a veteran who served on active duty in Thailand beginning on January 9, 1962, and ending on May 7, 1975, and who was exposed to a herbicide agent during such service, the same health care, vocational training and rehabilitation, and monetary allowance required to be paid to a similarly affected child of a Vietnam veteran.

Building Our Largest Dementia Infrastructure for Alzheimer's Act or the BOLD Infrastructure for Alzheimer's Act This bill amends the Public Health Service Act to award cooperative agreements: (1) for the establishment or support of national or regional centers of excellence in public health practice in Alzheimer's disease; (2) to state public health departments, Native American tribes, and other entities to promote cognitive functioning, address cognitive impairment and unique aspects of Alzheimer's disease, and help meet the needs of caregivers; (3) for analysis and public reporting of data on the state and national levels regarding cognitive decline, caregiving, and health disparities, and monitoring of objectives on dementia and caregiving in the Department of Health and Human Services' Healthy People 2020 report.

Rebuilding Resilient Energy Systems Act of 2017 This bill permits amounts awarded under the Robert T. Stafford Disaster Relief and Emergency Assistance Act for essential assistance, hazard mitigation, repair, restoration, and replacement of damaged facilities, federal assistance to individuals and households, and public assistance program alternative procedures to be used to build, repair, restore, reconstruct, or replace an energy system or building as a result of a major disaster or emergency designated by the President during calendar year 2017 in a manner that: is more resilient and more efficient; provides continuous flow of power to facilities critical to public health, safety, and welfare; maximizes the use of clean energy resources and energy storage technologies; and promotes lower energy bills. The Federal Emergency Management Agency (FEMA): (1) shall designate a representative to coordinate with private entities interested in donating energy system technologies and services for such purposes following a major disaster or emergency, (2) is encouraged to coordinate with the Department of Energy (DOE) and the Department of Homeland Security in designating such representative, and (3) is encouraged to consult with the Department of Defense (DOD) regarding DOD's experience in building resilient power systems. Each National Laboratory, in coordination with DOE programs that provide assistance to states and industry, must make technical assistance available to federal, state, and local agencies and private entities interested in: (1) developing plans or providing guidance on the design of a resilient and efficient energy system or building; and (2) building, repairing, restoring, reconstructing, or replacing an energy system or building following a major disaster or emergency.

Disaster Displacement Act of 2017 This bill requires a state, as a condition of participation in the Medicaid program, to provide medical assistance to eligible survivors of Hurricane Maria. For a specified coverage period, the federal matching rate shall be 100% with respect to such assistance. Eligibility shall be determined on the basis of specified income standards but without application of any resources test or state-residency requirements. The Department of Housing and Urban Development shall, upon request from a public housing agency, provide additional funding for specified housing assistance that is necessary as a consequence of a major disaster. The Department of Agriculture shall do the same upon request from either a state or a political subdivision of a state.

Protecting Home Oxygen & Medical Equipment Access Act of 2017 or the Protecting HOME Access Act of 2017 This bill: (1) requires the Centers for Medicare & Medicaid Services (CMS) to delay by one year the full implementation of new Medicare payment rates for durable medical equipment, and (2) revises a Medicare budget-neutrality requirement related to oxygen. Under current law, the CMS may establish separate payment classes under Medicare for items of oxygen and related equipment only if doing so does not result in increased program expenditures. The bill provides an exception to this budget-neutrality requirement with respect to such items that are included in a competitive acquisition program.

Veterans Access to Care Act This bill automatically designates medical facilities of the Department of Veterans Affairs (VA) as health professional shortage areas, therefore allowing primary care providers at VA hopsitals to participate in the National Health Service Corps program and receive scholarships or loan repayment. Individuals may not participate in both the VA's Health Professionals Education Assistance Program and the National Health Service Corps program. The Department of Health and Human Services, in carrying out the National Health Service Corps program, must consult with the VA regarding health professional shortage areas that are VA medical facilities.

Dialysis Patient Access to Integrated-care, Empowerment, Nephrologists, Treatment, and Services Demonstration Act of 2017 or the Dialysis PATIENTS Demonstration Act of 2017 This bill establishes a demonstration program for the provision of integrated care to Medicare beneficiaries with end-stage renal disease (ESRD). Under the voluntary program, eligible participating providers may form organizations to offer ESRD integrated care models and serve as medical homes for program-eligible beneficiaries. Such a model: (1) shall cover medical and hospital services, other than hospice care, under Medicare; (2) must include benefits for transition into transplantation, palliative care, or hospice; and (3) may cover prescription drug benefits. An organization must offer at least one open network model but may also offer one or more preferred network models. An organization shall return savings achieved under the models to program-eligible beneficiaries. A beneficiary shall have the opportunity to: (1) opt out of the program, (2) make an assignment change into an open network model offered by a different organization, or (3) elect a preferred network model. The bill establishes requirements regarding: (1) benefits for program-eligible beneficiaries who are also eligible for Medicaid benefits, (2) program quality and reporting, (2) ESRD integrated care strategy, (3) program operation and scope, (4) beneficiary notification, and (5) payment. The Medicare Payment Advisory Commission must, before 2025, submit to Congress an interim report on the program.

EHR Regulatory Relief Act This bill requires the Centers for Medicare & Medicaid Services (CMS) to establish a 90-day performance period with respect to determining whether an eligible professional or hospital is a meaningful electronic health record (EHR) user. Additionally, the bill: (1) requires the CMS to consider specified findings and recommendations of the Government Accountability Office with respect to assessing whether an eligible professional is a meaningful EHR user, (2) allows the CMS to determine that an eligible hospital is a meaningful EHR user if the hospital meets a specified percentage of the applicable measures established by the CMS, and (3) extends the applicability of the hardship exception with respect to meaningful EHR use.

The bill amends the Internal Revenue Code to suspend for 2017-2021 the individual mandate to maintain minimum health care coverage. The bill suspends the employer health care mandate for 2015-2017, thereby exempting employers from penalties for failing to provide mandated coverage during that time period. The bill increases the monthly contribution limit for health savings accounts through 2022.

This bill requires the Centers for Medicare & Medicaid Services to pay, to a provider that furnishes a hematopoietic stem cell transplant, an adjusted Medicare payment consistent with the Medicare payment methodology for kidney-acquisition costs outlined in regulation. Under the applicable regulation, kidney-acquisition costs are treated apart from the prospective payment rate for inpatient operating costs, and payment is adjusted to compensate the hospital for certain reasonable expenses. "Hematopoietic stem cell transplant" means the infusion of allogeneic hematopoietic cells (including bone marrow, peripheral blood stem cells, and cord-blood units, but excluding embryonic stem cells) that are: (1) not more than minimally manipulated; and (2) intended to reestablish hematopoietic function in an individual whose blood marrow or immune system is damaged, defective, or adversely affective by a congenital disorder.

Youth Opioid Use Treatment Help Act of 2017 or the YOUTH Act This bill amends the Public Health Service Act to expand the grant program for substance abuse treatment services for children and adolescents to cover young adults. The Agency for Healthcare Research and Quality (AHRQ) must award grants for demonstration programs to: (1) expand access to medication-assisted treatment for opioid use disorders among adolescents and young adults, or (2) create and distribute resources on medication-assisted treatment training and implementation for health care providers of children, adolescents, and young adults. AHRQ must report on the demonstration programs and the availability of medication-assisted treatment for adolescents and young adults. The report must include recommendations for ensuring such treatment is accessible.

Veterans Crisis Line Study Act of 2017 This bill directs the Department of Veterans Affairs (VA) to conduct a study on the outcomes and the efficacy of the Veterans Crisis Line during the five-year period beginning January 1, 2014, based on an analysis of national suicide data and data collected from the line. Such study shall address: (1) the efficacy of the line in leading veterans to sustained mental health regimens and suicide prevention; (2) the line's visibility; (3) the role of the line as part of the VA's mental health care services; and (4) whether receiving sustained mental health care affects suicidality, including among veterans who are at high risk for suicide.

Specifically, with respect to such liability, the bill: expands the definition of "responsible third party" to include, among other health insurers, the TRICARE program; eliminates special rules with respect to certain services provided to children; requires the inclusion, in a contract between a state Medicaid program and a health insurer, of certain information regarding whether the state is delegating or transferring to the insurer a right of third-party recovery; provides for the treatment as overpayment of reimbursements made by a responsible third party to a health insurer; disallows a responsible third party from denying a state's claim solely on the basis of a failure to obtain a prior authorization; imposes a timeline for a responsible third party to respond to a state's inquiry regarding a claim for payment; provides for reductions to a state Medicaid program's federal matching rate if the state fails to comply with third-party insurance requirements; and modifies other provisions related to third-party liability under the Medicaid program. Third-party liability requirements applicable under Medicaid shall also apply under the Children's Health Insurance Program (CHIP). The Centers for Medicare & Medicaid Services must: publish on its website, and annually update, best practices for assessing third-party liability; monitor and analyze efforts to assess that liability; in consultation with states, develop and make available a model uniform reporting field for identifying information related to responsible third parties; and provide other specified information and guidance to states.

Reciprocity Ensures Streamlined Use of Lifesaving Treatments Act of 2017 This bill amends the Federal Food, Drug, and Cosmetic Act to establish a reciprocal marketing approval process that allows for the sale of a drug, biological product, or medical device that has not been approved by the Food and Drug Administration (FDA) if the product is approved for sale in another country. For a product to be granted reciprocal marketing approval, the product's sponsor must submit a request to the FDA that demonstrates: (1) the product may be sold in at least one country from a specified list of countries, (2) the FDA and listed countries have not withdrawn approval of the product because of safety or effectiveness concerns, and (3) there is a public health or unmet medical need for the product. The FDA may: (1) require post-market studies of a product granted reciprocal marketing approval, or (2) decline to approve a product that is not safe and effective. The FDA must grant or decline reciprocal marketing approval not later than 30 days after receiving a request. During that period, the FDA and product sponsor must negotiate and finalize product labeling and, for a medical device, classify the device. Congress may pass a joint resolution to grant reciprocal marketing approval to a product that the FDA declines to approve through this process. User fees apply to requests for reciprocal marketing approval. The FDA must encourage the sponsors of potentially eligible products to request reciprocal marketing approval.

Health Care Choice Act of 2017 This bill repeals the health insurance and health coverage expansion requirements of the Patient Protection and Affordable Care Act and related provisions of the Health Care and Education Reconciliation Act of 2010. Provisions of law amended or repealed by those provisions are restored. This bill amends the Public Health Service Act to provide that the laws of a state designated by a health insurer (primary state) apply to individual health insurance coverage offered by that insurer in any state (secondary state) if the coverage, states, and insurer comply with the conditions of this bill. Insurers are exempted from any secondary state's laws that would prohibit or regulate the operation of the insurer in that state. The primary state is given sole jurisdiction to enforce its covered laws in any secondary state. The Government Accountability Office must study the effect of this bill on specified health insurance issues.
