State-Based Universal Health Care Act of 20 23 This bill establishes the option for states, or groups of states, to apply to waive certain federal health insurance requirements and provide residents with health insurance benefits plans through a state-administered program. Such programs must cover 95% of the residents in the state within five years and plan benefits must be at least as comprehensive and affordable as the coverage under the equivalent federal program. State programs are supported with funds from the federal programs the state programs replace, which may include Medicare, Medicaid, the Children's Health Insurance Program, the Federal Employee Health Benefits program, certain federal tax credits, and premium-assistance funds, among others. The bill requires the Department of Health and Human Services to appoint an Independent Assessment Panel for Comprehensive Care to review and recommend whether to approve state applications. Each approved state program must be independently reviewed every five years to evaluate changes in health benefits access, quality, and coverage, including whether the state has met the 95% coverage requirement. The federal government must pay all health insurance costs for American Indians and Alaska Natives who enroll in a plan through a state insurance program.

Protecting Consumer Access to Generic Drugs Act of 2023 This bill prohibits the manufacturer of a brand-name, generic, or biosimilar drug from entering into certain agreements to resolve or settle a patent infringement claim in connection with the sale of a drug or biological product. Specifically, such an agreement shall, with some exceptions, be a violation of the bill if the filer of a subsequent application to market a drug or biological product receives anything of value and agrees to limit or forego research, development, manufacturing, marketing, or sales of the subsequent drug or biological product. (Typically, a subsequent application seeks to market a generic or biosimilar version of a patented drug or biological product.) Penalties for violations of the bill include civil penalties and loss of the 180-day exclusivity period for a generic drug. The Federal Trade Commission (FTC) shall have exclusive authority to litigate to enforce the bill. When a generic or biosimilar drug manufacturer enters into an agreement with another drug manufacturer related to the manufacturing, marketing or sale of a drug, the manufacturers shall certify that the material they have given the FTC concerning the agreement contains (1) the complete agreement; and (2) any agreements related to the main agreement, including descriptions of any oral agreements or representations.

Voting Overseas Treated Equally for Servicemembers Act of 2023 or the VOTES Act of 2023 This bill expands the definitions of absent uniformed services voter and overseas voter for purposes of the Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA). UOCAVA requires that states and jurisdictions allow certain groups of citizens to register and vote absentee in federal elections. Absent uniformed services voters under UOCAVA are primarily active duty service members who are away from their voting residence. These include members of the U.S. Air Force, Army, Coast Guard, Marine Corps, and Navy. The current definition of absent uniformed services voter also includes (1) members of the merchant marine and commissioned officers of the U.S. Public Health Service and the National Oceanic and Atmospheric Administration, and (2) spouses or dependents who also are absent from their voting residence due to the member's active duty or service. This bill expands the definition of absent uniformed services voter to include (1) members on active service or inactive duty training who are absent from their voting residence, and (2) spouses or dependents who are absent from their voting residence due to the member's active service or inactive duty training. The bill also expands the definition of overseas voter to include an absent uniformed services voter who, by reason of active service or inactive duty training, is absent from the United States on the date of the election involved.

Expanding Medical Education Act This bill authorizes the Department of Health and Human Services (HHS) to award grants to institutions of higher education, or consortia of such institutions, to establish or expand medical schools. In awarding these grants, HHS must prioritize minority-serving institutions or those that propose to establish or expand schools in medically underserved communities or areas with shortages of health professionals where no such schools exist.

Multiple Employer Welfare Arrangement Act or the MEWA Act This bill provides statutory authority for the treatment of association health plans (AHPs) as single, large employer health plans for purposes of the Employee Retirement Income Security Act (ERISA). Under AHPs, groups of individuals or small employers join together to purchase health insurance coverage. AHPs were historically subject to the market requirements for individual and small group health plans. In 2018, the Department of Labor issued regulations that allowed an AHP to be considered a single, large employer under ERISA if certain conditions are met. The regulations have been subject to litigation, which is still ongoing. The bill provides that a group of employers is treated as a single, large employer for the purpose of establishing an AHP if the group, among other listed criteria (1) has been in existence for at least two years and was formed for a purpose other than offering health insurance, (2) meets any criteria set by Labor in a prior advisory opinion, or (3) meets any other criteria set by Labor through regulations. Additionally, the bill establishes rules for AHPs to set premium rates and prohibits AHPs from discriminating in coverage based on health status-related factors or denying coverage based on preexisting conditions.

Providing Realistic Opportunity To Equal and Comparable Treatment for Rare Act or the PROTECT Rare Act This bill provides for coverage under the Medicare prescription drug benefit, Medicaid, and private health insurance of certain drugs that are used to treat rare diseases or conditions (i.e., diseases or conditions that affect 200,000 or fewer individuals). Such drugs must be supported by peer-reviewed research or medical experts and must not have been reviewed unfavorably in specified compendia or used in a way that conflicts with approved labels.

Access to Inpatient Rehabilitation Therapy Act of 2023 This bill allows, for purposes of Medicare payment, an intensive rehabilitation therapy program to include other skilled therapeutic modalities besides physical therapy, occupational therapy, speech language pathology services, or orthotic and prosthetic services, as recommended by the treating physician after the patient is admitted. The bill applies after December 31, 2023, or the last day of the COVID-19 public health emergency, whichever is earlier. (The COVID-19 public health emergency ended May 11, 2023.)

Restoring Accountability in the Indian Health Service Act of 2023 This bill establishes a series of programs and requirements relating to recruitment and retention in the Indian Health Service (IHS), including provisions regarding pay, credentialing, and housing needs of workforce personnel. Among other provisions, the bill requires the establishment of a pay system for health care professionals employed by IHS that is based on the pay system for health care professionals employed by the Veterans Health Administration, authorizes a program to provide tenant-based rental assistance to certain IHS employees, requires IHS to establish a centralized medical credentialing system, and expands eligibility for the IHS Loan Repayment Program. Additionally, the bill outlines additional hiring requirements for IHS, requires employees and health care providers who enter into a contract with IHS to annually complete mandatory training on tribal culture and history, establishes a demonstration program to provide IHS units with additional staffing resources, requires the Department of Health and Human Services to establish best practices for governing boards and area offices, establishes a compliance assistance program for underperforming hospitals or outpatient facilities, establishes the Office of Patient Advocacy, and requires IHS to establish regulations for standards to measure the timeliness of the provision of health care services in IHS facilities. The bill also outlines certain employee protections, including whistle-blower protections. The bill establishes various reporting requirements. For example, the bill requires the Government Accountability Office to report on the housing and staffing needs of IHS.

Expanding Health Care Options for First Responders Act This bill establishes a Medicare buy-in option for certain qualifying first responders. Specifically, the bill allows first responders aged 50 to 64 to enroll in Medicare if they are retired or otherwise separated from service due to a disability. The Centers for Medicare & Medicaid Services (CMS) must determine enrollment periods and set premiums for the buy-in option established under the bill, in accordance with specified requirements. The CMS must also award grants to states and nonprofit organizations for outreach and enrollment activities relating to the buy-in option.
