Retirement Freedom Act This bill allows an individual to opt out of Medicare hospital services benefits without also having to opt out of Old Age, Survivors, and Disability Insurance benefits and without having to repay Medicare hospital services benefits already received. The bill also allows an individual to opt back in with no penalty.

Maternal Care Access and Reducing Emergencies Act or the Maternal CARE Act This bill requires the Department of Health and Human Services to award grants to health professional training programs for training that addresses implicit bias (e.g., racial bias) in the practice of obstetrics and gynecology. The Centers for Medicare & Medicaid Services and the Health Resources and Services Administration must award grants to up to 10 states for pregnancy medical home programs that reduce adverse maternal health outcomes and racial disparities. Among other requirements, such programs must prioritize the care of Medicaid enrollees. The National Academy of Medicine must make recommendations for incorporating bias recognition in clinical skills tests at medical schools.

Stop Harmful Discharges Act This bill makes public health and safety (e.g., preventing discharges with cyanobacteria or related toxins) the primary consideration of the U.S. Army Corps of Engineers when the Corps manages the Caloosahatchee River and Lake Okeechobee drainage areas in central and southern Florida.

This joint resolution nullifies a rule by the Department of Treasury, the Department of Labor, and the Department of Health and Human Services regarding short-term, limited-duration health insurance plans. Short-term, limited-duration health insurance plans are plans that may only offer coverage for a limited amount of time under law and that are exempt from the market requirements of the Patient Protection and Affordable Care Act (e.g., coverage of individuals with preexisting conditions). The rule increases the maximum authorized duration of such plans from less than 3 months (including renewals) to an initial maximum duration of less than 12 months (with a total duration of up to 36 months, including renewals). The rule takes effect October 2, 2018.

Fighting Fraud to Protect Care for Seniors Act of 2018 This bill requires the Centers for Medicare & Medicaid Services (CMS) to establish a pilot program that evaluates the feasibility of using smart card technology to address Medicare fraud. Under the program, smart card technology must be issued free-of-charge to selected Medicare beneficiaries, suppliers, and providers; such technology must support the secure, electronic authentication of beneficiary identity at points of service. In selecting program participants, the CMS must consider the risk of fraud, waste, or abuse among categories of suppliers and providers.

Ensuring Lasting Smiles Act This bill amends the Public Health Service Act, the Employee Retirement Income Security Act of 1974, and the Internal Revenue Code of 1986 to require private health insurance plans to cover diagnosis and treatment services for congenital anomalies and birth defects, including reconstructive services and prosthetics.

Palomares Veterans Act of 2018 This bill includes veterans who participated in the cleanup of radioactive materials at Palomares, Spain, from January 17, 1966 through March 31, 1967, as radiation exposed veterans for purposes of the Department of Veterans Affairs presumption of service-connection for specified cancers and other radiogenic disorders. Under a presumption of service-connection, specific disabilities diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded.

Agent Orange Exposure Fairness Act of 2018 This bill, with respect to veterans exposed to certain herbicide agents during military, naval, or air service in Vietnam between January 9, 1962, and May 7, 1975: (1) removes the manifestation period required for presumption of service connection for chloracne and porphyria cutanea tarda, and (2) includes in such presumption acute and subacute peripheral neuropathy becoming manifest to a disability degree of 10% or more. Under a presumption of service-connection, specific disabilities diagnosed in certain veterans are presumed to have been caused by the circumstances of their military service. Health care benefits and disability compensation may then be awarded without having to go through a separate adjudicative process.

Empowering Seniors' Enrollment Decision Act of 2018 This bill provides statutory authority for the extension of a special enrollment period under Medicare Advantage (MA) to enrollees in certain Medicare Cost plans that are not transitioning into qualifying MA plans. Current regulations allow such enrollees (i.e., non-deemed individuals) to participate in the special enrollment period.

Comprehensive Care for Seniors Act of 2018 This bill requires the Centers for Medicare & Medicaid Services (CMS) to finalize a proposed rule regarding Programs of All-Inclusive Care for the Elderly (PACE) by December 31, 2018. PACE is a program under Medicare and Medicaid that provides in-home and community services for certain individuals as an alternative to nursing home care. The proposed rule updates and revises application, enforcement, and other administrative requirements. The CMS published the proposed rule in August 2016; final action is expected in August 2019.

Stop Excessive Narcotics in our Retirement Communities Protection Act or the SENIOR Communities Protection Act This bill authorizes the suspension of payments to a pharmacy under the Medicare prescription drug benefit and Medicare Advantage prescription drug plans pending the investigation of a credible allegation of fraud by the pharmacy. A fraud hotline tip, without other evidence, may not be considered a credible allegation of fraud.

This bill terminates certain limitations regarding drug rebates under Medicaid. Currently, the maximum rebate that drug manufacturers must pay under Medicaid for single-source and innovator multiple-source drugs is 100% of the average manufacturer price of the drug. The bill specifies that this limitation only applies to rebate periods that begin before January 1, 2019.

Supporting Graduate Medical Education at Community Hospitals Act of 2018 This bill revises payment rules under Medicare for graduate medical education (GME) costs with respect to a hospital that establishes a new medical residency training program. If a hospital has not entered into a GME affiliation agreement, the Centers for Medicare & Medicaid Services (CMS) must establish the hospital's full-time equivalent (FTE) resident amount only after determining that the hospital's medical residency training program trains more than 1.0 FTE resident in a cost reporting period. If a hospital has an approved FTE resident amount that is based on other specified thresholds, the CMS must give the hospital the opportunity to have the amount reestablished when the hospital begins training FTE residents in excess of the applicable threshold. The bill also establishes similar thresholds for new determinations of certain adjustments to hospital payment limitations regarding FTE residents in allopathic and osteopathic medicine; a hospital that has an adjustment has the opportunity to have it redetermined once the applicable threshold is exceeded.

Traumatic Brain Injury Program Reauthorization Act of 2018 This bill amends the Public Health Service Act to reauthorize through FY2024 several programs relating to traumatic brain injuries, including the Centers for Disease Control and Prevention (CDC) grant program for state surveillance systems that monitor traumatic brain injuries. The bill also authorizes the CDC to implement a national concussion surveillance system.

Medicare Secondary Payer and Workers' Compensation Settlement Agreements Act of 2018 This bill alters provisions relating to Medicare secondary payer rules with respect to workers' compensation settlement arrangements. Among other things, the bill provides that a Medicare set-aside fulfills secondary payer obligations if the set-aside is included in the arrangement and meets certain other criteria.

Medicare Prescription Drug Savings and Choice Act of 2018 This bill requires the Centers for Medicare & Medicaid Services (CMS) to offer one or more Medicare-operated prescription drug plan options under the Medicare prescription drug benefit. In doing so, the CMS must: (1) negotiate prices with drug manufacturers; (2) establish an appeals process for denials of plan benefits, including the option for external review and determination by an independent entity; and (3) establish and apply a formulary and formulary incentives. In general, a Medicare-operated drug plan must meet the same requirements as apply to any other prescription drug plan.

Medicare Fair Drug Pricing Act of 2018 This bill requires the Centers for Medicare & Medicaid Services (CMS) to negotiate with drug manufacturers in determining the price that may be charged for prescription drugs under the Medicare prescription drug benefit. Under current law, the CMS may not interfere with negotiations between drug manufacturers and prescription drug plan (PDP) sponsors. The bill creates an exception to this prohibition with respect to specified drugs that: (1) are single-source or biological, (2) are not both manufactured by more than two drug manufacturers and manufactured by at least one manufacturer as a generic drug, and (3) meet other specified requirements. The CMS must promulgate regulations regarding the identification of such drugs. With respect to these drugs, the CMS shall negotiate the price that may be charged to PDP sponsors and Medicare Advantage (MA) organizations for Medicare and MA enrollees. The bill establishes processes for negotiation and price determination in the initial plan year and subsequent plan years. A manufacturer must participate in the negotiation process as a condition of coverage under the Medicare prescription drug benefit.

Price Relief, Innovation, and Competition for Essential Drugs Act or the PRICED Act This bill amends the Public Health Service Act to allow biosimilars to be marketed seven years after the reference brand name biological product is licensed. Currently, brand name biological products are provided a 12-year marketing exclusivity period. This shortened marketing exclusivity period applies only to biological products licensed by the Food and Drug Administration after enactment of this bill.

Drug-Price Transparency in Communications Act This bill amends the Federal Food, Drug, and Cosmetic Act to impose a civil penalty on any person who disseminates a direct-to-consumer drug advertisement that does not include the wholesale acquisition cost (the manufacturer's list price to wholesalers or direct purchasers) for a 30-day supply of the drug. The bill requires any representative of a drug manufacturer who communicates with a health care practitioner about a drug manufactured by the drug manufacturer to disclose the wholesale acquisition cost for a 30-day supply of the drug.
