Pharmacist Conscience Protection Act This bill prohibits the federal government and federally funded entities from discriminating or otherwise taking adverse action against a pharmacist, pharmacy owner, or pharmacy technician who declines to store, fill prescriptions for, or make referrals for drugs that cause abortions (or that the individual provider believes in good faith cause abortions). Individuals or the Department of Justice may bring civil actions for violations of this bill.

National Plan to End Parkinson's Act This bill requires the Department of Health and Human Services (HHS) to carry out a project to prevent and cure Parkinson's disease (a progressive brain disorder that causes unintended or uncontrollable movements) and related conditions. Among other components of the project, HHS must (1) implement and periodically update a national plan to coordinate and guide efforts to prevent and cure the disease; (2) improve diagnosis, treatment, and care of those with the disease; and (3) address health and other disparities related to the disease. HHS must also conduct annual assessments on the preparation for and response to the increased burden of Parkinson's disease. In addition, the bill establishes a council, comprised of federal and nonfederal stakeholders, to advise HHS on and make recommendations concerning the prevention and cure of Parkinson's disease. The bill's provisions terminate at the end of calendar year 2035.

Grant Assistance and Technical Education Act This bill supports the capacity of community-based organizations to obtain federal funding for public health and related programs. In particular, the bill establishes a position within the Office of Minority Health to assist such organizations apply for and meet conditions of grants available through the Department of Health and Human Services. It also creates grants for state and local public health entities to provide technical assistance and similar assistance to community-based organizations to carry out and obtain federal funding for public health programs.

Restroom Access Act of 2022 This bill requires retailers to allow a customer to use a nonpublic restroom if the customer has an eligible medical condition (e.g., inflammatory bowel disease) that requires immediate access to a restroom and other conditions are met.

Improving Care and Access to Nurses Act or the I CAN Act This bill allows other health care providers besides physicians (e.g., nurses) to provide certain services under Medicare and Medicaid. Among other changes, the bill (1) allows a nurse practitioner or physician assistant to fulfill documentation requirements for Medicare coverage of special shoes for diabetic individuals; (2) expedites the ability of physician assistants, nurse practitioners, and clinical nurse specialists to supervise Medicare cardiac, intensive cardiac, and pulmonary rehabilitation programs; and (3) allows nurse practitioners to certify the need for inpatient hospital services under Medicare and Medicaid.

Supporting Medicare Providers Act of 2022 This bill extends a payment increase under Medicare's physician fee schedule through the end of 2023 (currently set to expire at the end of 2022).

Healthcare Cybersecurity Act of 2022 This bill requires the Cybersecurity and Infrastructure Security Agency (CISA) to undertake activities to improve the cybersecurity of the health care and public health sector. Specifically, CISA must collaborate with the Department of Health and Human Services (HHS) to improve cybersecurity in that sector. This includes making resources, including cyber-threat indicators and appropriate defense measures, available to federal and nonfederal entities that receive information through HHS programs. In addition, CISA must provide training on cybersecurity risks and mitigation strategies to owners of assets in the health care and public health sector. CISA must also conduct a study on cybersecurity risks in the health care and public health sector. The study must address, among other topics, the impact of the risks on rural entities and small- and medium-sized entities, cybersecurity workforce shortages in the sector, and challenges related to the COVID-19 emergency.

Ensuring Seniors' Access to Quality Care Act This bill repeals certain restrictions under Medicare and Medicaid that prohibit the approval of nurse-aide training and competency evaluation programs in skilled nursing facilities that have been subject to specified regulatory actions (e.g., civil penalties) for substandard quality of care. The Centers for Medicare & Medicaid Services (CMS) must still disapprove such programs for up to two years; however, the CMS must rescind the disapproval upon completion of corrective action and may require additional oversight of the program for purposes of rescission. The bill also allows Medicaid and Medicare providers (e.g., skilled nursing facilities) to access, through the National Practitioner Data Bank, disciplinary information for affiliated physicians and other health care practitioners, as reported by state licensing authorities.

State Opioid Response Grant Authorization Act of 2022 This bill reauthorizes through FY2027 and otherwise changes the State Opioid Response Grant program. This program, which is managed by the Substance Abuse and Mental Health Services Administration, provides funding for states, territories, and Indian tribes and tribal organizations to address the opioid crisis. Specific changes to the program include (1) expanding its scope to also address stimulant use and misuse, (2) establishing a funding methodology and minimum funding allocations, and (3) allowing the use of grant funds for recovery support services. The bill also requires the Government Accountability Office to report on issues concerning the funding and other aspects of the program.

National Sepsis Data Trust, Outcomes, and Innovation Act or LuLu's Law This bill directs the Department of Health and Human Services (HHS) to address sepsis. (Sepsis is a life-threatening organ dysfunction caused by a dysregulated host response to infection.) In particular, HHS must standardize the definition of sepsis; make sepsis a nationally notifiable condition; develop a national strategy for treating and eliminating the burden of sepsis; and establish a national sepsis data trust to improve the collection and sharing of data concerning sepsis cases, including through grants to support state-based data trusts.

This bill prohibits the District of Columbia (DC) from using federal or local funds to require that students in elementary or secondary schools receive a COVID-19 vaccination. The bill also nullifies the Coronavirus Immunization of School Students and Early Childhood Workers Regulation Amendment Act of 2021 (D.C. Act 24-85), enacted by the DC Council on January 12, 2022.

Regulatory Accountability Act This bill expands and provides statutory authority for notice-and-comment rulemaking procedures to require federal agencies to consider (1) whether a rulemaking is required by statute or is within the discretion of the agency, (2) whether existing laws or rules could be amended or rescinded to address the problem, and (3) reasonable alternatives to a new rule. For proposed major or high-impact rules that have a specified significant economic impact or adverse effect on the public health or safety, an agency must publish notice of such rulemaking to invite interested parties to propose alternatives and ideas to accomplish the agency's objectives; allow persons interested in high-impact or certain major rules to petition for a public hearing with oral presentation, cross-examination, and the burden of proof on the proponent of the rule; adopt the rule that maximizes net benefits within the scope of the statutory provision authorizing the rule, unless the agency explains the costs and benefits that justify adopting an alternative rule and such rule is approved by the Office of Information and Regulatory Affairs (OIRA); and publish a framework and metrics for measuring the ongoing effectiveness of the rule. Agencies must notify OIRA with certain information about a proposed rulemaking, including specified discussion and preliminary explanations concerning a major or high-impact rule. Further, OIRA must establish certain rulemaking guidelines. Additionally, the bill (1) revises the scope of judicial review of agency actions, and (2) establishes requirements for agencies issuing guidance.

Building a Health Care Workforce for the Future Act This bill establishes, within the Department of Health and Human Services (HHS), grant programs for health professional education and training. It also requires the National Academy of Medicine (formerly known as the Institute of Medicine) to study the documentation requirements for cognitive services under Medicare, Medicaid, and private health insurers, including administrative and labor costs of such documentation. For the first grant program, HHS must award matching grants to states for scholarships to ensure an adequate supply of health professionals. As a condition of receiving scholarships, recipients must agree to work in areas with shortages of health care providers for one year for each year they receive the scholarship. For the second grant program, HHS must award grants to medical and other health professions schools to improve curricula for, and education and training on, certain priority competencies, such as patient-centered medical homes and chronic disease management. The Advisory Committee on Training in Primary Care Medicine and Dentistry shall select these competencies annually. For the last grant program, HHS may award grants to medical schools for primary care mentorship programs to support faculty who serve as mentors and encourage interest in primary care among students.

Medicare Enrollment Protection Act of 2022 This bill provides for a special enrollment period for Medicare medical benefits for individuals who are enrolled in COBRA continuation coverage at the time they qualify for Medicare. The special enrollment period applies during each month of COBRA coverage and the three-month period after coverage ends; individuals may enroll during the special enrollment period once during their lifetime.

Coast Guard Authorization Act of 2022 This bill authorizes appropriations through FY2023 for the U.S. Coast Guard. It also revises a variety of requirements concerning the Coast Guard's personnel, operations, infrastructure, and environmental compliance. For example, the bill revises requirements concerning maritime cybersecurity and artificial intelligence, workforce readiness, oil spills, healthcare, vessel safety, sexual assault, and sexual harassment.

Boosting Long-term U.S. Engagement in the Pacific Act or the BLUE Pacific Act This bill requires and authorizes activities related to U.S. foreign policy in the Pacific Islands, including the Cook Islands, Fiji, the Marshall Islands, Papua New Guinea, and Vanuatu. The bill requires specified departments and agencies to develop and implement strategies in the region to expand the coverage of the International Law Enforcement Academies program; help build the capacity of local civilian and national security institutions; expand trade capacity and promote regional development; assist in preparing for natural disasters and other emergencies; assist in building public health capacity and improving outcomes, including in response to COVID-19; address climate change, with a focus on improving critical infrastructure and supporting ecosystem conservation efforts; provide expanded media content to the Pacific Islands and partner with journalists; support efforts to reduce gender-based violence and promote gender equality; promote educational and professional development of young adult leaders and professionals; and promote the development of civil society. The bill also requires the Department of State to prioritize efforts to help the Pacific Islands ratify and implement international legal conventions related to transnational crime. The State Department must also coordinate with regional allies and partners in providing assistance to the Pacific Islands. The President may provide assistance to the Pacific Islands to promote quality basic education and to promote the dissemination of free and accurate information.

Reserving Energy For Independence and Empowerment Act or the REFINE Act This bill sets forth provisions to limit the sale and export of petroleum products from the Strategic Petroleum Reserve (SPR), increase energy production from energy producers in the United States, and make related requirements. Specifically, the bill requires the Department of Energy (DOE) to issue regulations prohibiting the export of petroleum products (e.g., crude oil) sold from the SPR to (1) any country that is subject to a U.S. arms embargo as specified by the bill, (2) any country that is a state sponsor of terrorism, and (3) any entity that is owned by China. Before DOE may sell, exchange, or loan crude oil from the SPR, DOE must first develop a plan to increase the percentage of federal land (including submerged land of the Outer Continental Shelf) leased for oil and gas production by the same percentage as the percentage of petroleum in the SPR that is to be drawn down. In addition, the President must rescind the Executive Order titled Protecting Public Health and the Environment and Restoring Science To Tackle the Climate Crisis . The President must also direct federal agencies to (1) identify and repeal any of their regulations that have the intent or effect of substantially reducing the energy independence of the United States, and (2) issue regulations and guidance to reduce the regulatory burden for energy producers in the United States and to increase the energy output by those producers.

Fighting Cancer in Children Act This bill makes funding available for research and related activities concerning pediatric cancer that are conducted or supported by the National Institutes of Health (NIH) from funds previously made available to the NIH Office of the Director. Specifically, the bill transfers unobligated funding from the NIH Office of the Director and merges it with other NIH funding for biorepositories of pediatric cancer specimens and research on pediatric cancer survivorship. The bill also rescinds additional funding that was provided to the NIH Office of the Director.

National Concussion and Traumatic Brain Injury Clearinghouse Act of 2022 This bill establishes a clearinghouse for information (e.g., best practices and research) about concussions and traumatic brain injuries for medical professionals, patients, and other stakeholders. The Department of Health and Human Services and the Centers for Disease Control and Prevention must maintain the clearinghouse.

High School Sports Injury Reporting This bill requires the Centers for Disease Control and Prevention to report to Congress about sports injury reporting requirements in high schools. The report must address, among other topics, the availability of and tools used to collect data on sports injuries, as well as recommend policies and other means of supporting sports injury reporting to improve student athlete safety.

Access to Inpatient Rehabilitation Therapy Act of 2022 This bill allows, for purposes of Medicare payment, an intensive rehabilitation therapy program to include other skilled therapeutic modalities besides physical therapy, occupational therapy, speech language pathology services, or orthotic and prosthetic services, as recommended by the treating physician after the patient is admitted. The bill applies after December 31, 2022, or the last day of the COVID-19 public health emergency, whichever is earlier.

Protect Children's Innocence Act This bill places restrictions on the provision of gender affirming care. Gender affirming care includes performing surgery, administering medication, or performing other procedures for the purpose of changing the body of an individual to correspond to a sex that differs from the individual's biological sex. Specifically, the bill makes it a felony to perform any gender affirming care on a minor and it permits a minor on whom such care is performed to bring a civil action against each individual who provided the care. Additionally, the bill prohibits the use of federal funds for gender affirming care or for health insurance that covers such care. Such care may not be provided in a federal health care facility or by a federal employee. The bill also prohibits qualified health plans from including coverage for gender affirming care. Further, plans that include coverage for such care are not eligible for federal subsidies. Finally, the bill prohibits institutions of higher education from offering instruction in gender affirming care. It also makes any non-U.S. national ( alien under federal law) who performs gender affirming care on a minor deportable and inadmissible to the United States. The restrictions under this bill do not apply to the provision of care under certain circumstances such as when an individual does not have normal sex chromosome structure, sex steroid hormone production, or sex steroid hormone action.

Veteran Treatment Teams on Campus Act or the VETTs on Campus Act This bill expands the Veterans Community Care Program to include health care providers at clinics and hospitals of institutions of higher learning approved for educational assistance furnished by the Department of Veterans Affairs.

Imported Seafood Safety Standards Act This bill prohibits the importation of any seafood from a foreign country unless the country complies with U.S. standards for seafood manufacturing, processing, and holding. Among other requirements, the bill requires an annual inspection of each foreign facility that exports seafood to the United States to ensure compliance with U.S. standards.

Expanding Access to Mental Health Training Act This bill reauthorizes through FY2027 grants for training teachers and other school personnel to recognize the symptoms of childhood and adolescent mental health disorders. These grants are awarded by the Substance Abuse and Mental Health Services Administration to states, localities, Indian tribes, and nonprofits.

Robin Danielson Menstrual Product and Intimate Care Product Safety Act of 2022 This bill requires the National Institutes of Health to conduct or support research on the extent to which components (including contaminants and substances used as fragrances, colorants, dyes, and preservatives) in menstrual products and intimate care products pose health risks to people who use the products or to the children of people who use the products during or before pregnancy.

Chiropractic Act of 2022 This bill expands Medicare coverage of chiropractic services to include evaluation and management services, including examination and imaging services, and other functions provided by chiropractors, rather than only subluxation corrections through manual manipulation of the spine. The bill also allows chiropractors to enter into private contracts with Medicare beneficiaries.

Taxpayers Support Life Act This bill prohibits the Department of Health and Human Services (HHS) from finalizing, implementing, administering, or enforcing a proposed rule (published on August 4, 2022) that implements the statutory ban on discrimination in federally funded health programs and activities. Further, HHS may not use federal funds to contravene the administration or enforcement of the existing nondiscrimination rule, which became effective on June 19, 2020.

No Cost for Monkeypox Testing Act of 2022 This bill requires specified public health care programs and private health insurance to cover, through December 31, 2023, testing for monkeypox without imposing cost-sharing, including deductibles, coinsurance, and copayments. (Monkeypox is a viral disease that is endemic to parts of Africa and causes symptoms similar to, but less severe than, smallpox.) The bill also establishes procedures for uninsured individuals to access such testing at no cost.

Physicians for Underserved Areas Act This bill modifies how a hospital's residency positions are redistributed after it closes for purposes of graduate medical education payments under Medicare. Under current law, if a hospital with an approved medical residency program closes, the Centers for Medicare & Medicaid Services (CMS) must redistribute the hospital's residency positions to other hospitals in the following order: (1) hospitals in the same core-based statistical area as the closed hospital, (2) hospitals in the same state as the closed hospital, (3) hospitals in the same region of the country as the closed hospital, and (4) other remaining hospitals. In order to receive the additional positions, hospitals must demonstrate a likelihood of filling the positions within three years. The bill removes the requirement that the CMS prioritize hospitals in the same region of the country as the closed hospital. It also requires hospitals to demonstrate a likelihood of (1) starting to use the positions within two years, and (2) filling the positions within five years.
